Discussions with State Lands 2280 Sunnyside Lane Tahoe City 2 December 2013 Prepared by Greg Price (415) Our Impact Area November 2009 The Pier April 2011 Our Impact Area Impact Area Staff calculated our Pier Area: 1,150 sq ft Staff calculated our Impact Area additional 2,887 sq ft => or the assumed docking of 10 boats Impact Area expands leased area by 250% Dec 2011, staff reduced Impact Area lease rate by 50% for seasonal usage Actual Usage Staff does not include Impact Area near a boat lift or walls of boat houseas that would be impractical, could not off-load there. For our pier, room for one (1) boat, only at catwalk for loading and unloading and not docking of vessels. Pier too high or too dangerous (swells). Local Conditions Seasonal usage (3-4 months) in Tahoe vs. longer season in the Delta or tidal. Weather and swells prevents tie ups in Impact Area for open pile pier vs. side tie up common in Delta Lake reservoir level prevents usage of pier for years at a time, see Nov 2009 photos. Slows boats closer to shore Navigational aide Charging Rent, but not Exclusive use The public regularly uses the Impact Area Recreational vs. Commercial Seems to apply Commercial-use or extreme Potential-use rather then reasonable or Actual-use. Is rent charged for the shadow a building casts or visual impact? Reasonable. Easy-to-understand Most owners can understand rent for state land under a pier, but not an arbitrary bubble around the pier.
