General remarks/information:

According to EU legislation different procedures may apply to a waste pending on the destination of the shipment and whether the waste is destined for recovery or for final disposal. The shipments of wastes within, from and into the area of the European Union are regulated by three different regulations. The general procedure is laid down in the shipment regulation (Council regulation 93/259/EEC) as amended. Following the rules of 93/259/EEC the following procedures apply: 1) Shipments of all kinds of wastes for final disposal (defined in accordance with Annex IV A of the Basel Convention) are subject to a prior written consent procedure. No exports outside the European Economic Area (EEA) are allowed. 2) Shipments of wastes listed in Annex II of the regulation 93/259/EEC for recovery (defined in accordance with Annex IV B of the Basel Convention) within the OECD area are not subject to any PIC procedure. Each shipment has to be accompanied with documents giving the following information:

a) name and address of the waste owner b) common name of the waste c) amount of the waste d) name and address of the consignee e) recovery option as listed in Annex II B of council regulation 75/442/EEC (it’s the same R-code as in Annex IV B of the Basel Convention) f) date of the shipment

However, based on an European Court Decision (Case C-192/96 from 25 June 1998) mixtures of various categories of wastes are subject to a PIC Procedure. 3) Shipments of non listed wastes and of wastes listed in Annex III and IV of 93/259/EEC for recycling are subject to a PIC-procedure (for wastes listed in Annex III a “tacit consent” may apply within the OECD Area). 4) Exports of wastes listed in Annex V outside the OECD Area are prohibited. Annex V contains the wastes listed in Annex VIII of the Basel Convention, the hazardous wastes in accordance with the European Hazardous Waste List and the hazardous wastes listed in OECD Council Decision (2001)107 Appendix 4, Part II (the Council Decision (C(2001)107 is an amendment of C(92)39). By this provision the “total ban” (the amendment III/1) is implemented in European legislation.

5) The shipments of wastes listed in Annex II of 93/259/EEC to non OECD Countries are regulated by two regulations:

a) Council regulation 1420/1999/EC and b) Commission regulation 1547/1999/EEC

In 1998 the European Commission contacted the non OECD Countries with a note verbal seeking information on requested control procedures for shipments of non hazardous wastes listed in Annex II of the OECD Council Decision C(92)39. On basis of the replies (and non replies) by countries the two regulation stipulate specific control procedures (from total ban to no control procedure applied). By request of countries the two regulations are amended (typically within 3 to 5 months). As a result of this complex situation the import of wastes listed in Annex IX of the Basel Convention to Austria is always subject to a PIC-procedure in the case of final disposal (D-operation).

In the case of import for recovery the procedure depends whether the waste listed in Annex IX of the Basel Convention can be referred to a waste listed in Annex II of the shipment regulation or not. It has to be mentioned that in order to harmonise the regulation 93/259/EEC with Annex VIII and IX of the Basel Convention and the OECD Council Decision C(2001)107 an amendment is under preparation.
