First, the California Electricity Generation Facilities Standards Committee (Committee) adopts and revises the standards. Then, the California Public Utilities Commission (Commission) implements and enforces the standards adopted by the Committee. Various generating facilities including many nuclear, publicly owned, and qualifying facilities are exempt from maintenance and operations standards. Summary: On October 16, 2004, Eric Eisenman, Chief, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Cmmr. Brown in San Francisco. Also present was David Gamson, advisor to Cmmr. Brown, David Rubin, Director of Service Analysis of PG&E, Mike Hoover, Director of Southern California Edison Company, and Billy Blattner of San Diego Gas & Electric Company. Written materials (copies attached to the notice) were used. Eisenman advocated that no municipal departing load (MDL) be exempted from the customer responsibility surcharge (CRS). Rubin noted that PG&E has an obligation to serve all customers, while municipal utilities and irrigation districts can selectively choose which customers to serve. Rubin discussed the sales forecast for the 2001-2003 timeframe provided by PG&E to the California Department of Water Resources in February 2001. Carroll stated that cost shifting is either a myth or inconsequential. As to transferred load, Carroll stated that PG&E for two years claimed it did not provide any information about its August 2000 bypass report to the Department of Water Resources until June 2001, but PG&E had to change its story because DWR found a smoking gun e-mail that proved PG&E’s story was false. Summary: On October 14, 2004, Mark Pocta, Program Manager with the Office of Ratepayer Advocates (ORA), met with Brian Prusnek, advisor to Cmmr. Kennedy, in San Francisco. Pocta described the positive aspects of the settlement agreements filed in the proceeding addressing the cost of service applications of Southern California Gas Company and San Diego Gas & Electric Company. Pocta explained that the revenue requirements adopted in both the proposed decision and alternate proposed decision were in excess of the revenue requirements recommended in the settlements. Summary: On October 14, 2004, Christopher J. Mayer, Assistant General Manager Planning and Marketing, Modesto Irrigation District (Modesto/ID), met with Cmmr. Brown in San Francisco. Also present were David Gamson, advisor to Cmmr. Brown, and other attendees listed on the attachment to the notice. Mayer explained that some of Modesto’s electric customers are located in a joint electric service area with PG&E. Mayer described load served by Modesto in the joint electric distribution service area, emphasizing that only a small amount of this load is attributable to customers that initially received Modesto electric service after February 1, 2001, most of which are new load customers. Mayer stated that without a CRS exemption, some of Modesto’s customers would have to pay twice for the same measure of reliable electric service. Mayer stated that the record now clearly establishes that PG&E did reduce its load forecast for projected customer departure to Modesto and Merced IDs, and that the California Department of Water Resources did not purchase power for this load. Summary: On October 13, 2004, Jennifer Dowdell, Manager, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. Also present were Walt Campbell, Senior Director, Business and Financial Planning, and Chris Warner, Attorney, for PG&E. Written material (attached to the notice) was used. Dowdell advocated changes to the unnecessarily restrictive conditions to the issuance of debt and preferred stock proposed by the draft decision. Campbell explained how restrictions in allowed short-term debt capacity and use of accounts receivable financing will limit the utilities access cash and potentially increase ratepayer costs. Campbell stated that accounts receivable financing is currently PG&E’s most cost effective form of short-term financing.
