DOCTRINE OF STATE IMMUNITY -the state cannot be sued without its consent TWO PRINCIPLES Classical or Absolute Theory –sovereign cannot, without its consent, be made a respondent in courts of another sovereign Newer or Restrictive theory - Jure imperii –public acts (state immunity recognized) o Exemption: exercise of power of eminent domain when done w/o payment of just compensation - Jure gestionis –private acts (state immunity not recognized) Not any agency of a foreign state may invoke the latter’s state immunity to ward offs suits against it
