Document, Document, Document! What to do when you are faced with discrimination and/or harassment in the workplace.Ambuter Law, LLC

Step 1: Look at Your Employee HandbookUpon being hired, make sure to read your employee handbook if one was provided to you. If the handbook contains an anti-discrimination and/or anti-harassment policy, make sure to notate the policy number(s).

Step 2: Document OccurrencesIf faced with harassment or discrimination in the workplace, make sure to document all occurrences. However, make sure when documenting these occurrences that you are not doing so on company time or on company computer programs. For instance, document any occurrences in a personal journal or log, or on any type of program that you may have installed on your personal phone.Make sure when documenting occurrences that you accurately record the date, time, the name of the aggressor, and the situation and/or comments that took place.

Step 3: Report All Occurrences to the Appropriate Person or DepartmentIf your employee handbook provides instructions on how to handle discrimination and/or harassment in the workplace, make sure to follow those procedures, i.e. call the employee hotline, report the incident to HR or your manager, etc.Make sure to follow all instructions and the chain of command to avoid any type of reporting problems.

What Do I Do Next?If the issue was resolved internally, make sure to continue on with work as normal. If an issue arises again, follow the steps as you did before. If the discrimination and/or harassment does not stop after following the proper procedures, you may need to see if there are any other internal options available to you. If not, you may need to contact an employment attorney to discuss the next steps to take.

RememberRead your employee handbook and notate anti-discrimination and anti-harassment policies.Document all occurrences in a personal log or journal.Follow the proper procedures in reporting all occurrences. If the discrimination and/or harassment persists, see what other internal options are available. If no internal options are available, contact a labor attorney.
