Statewide Historically Underutilized Business (HUB)
Program
A “HUB” is a minority or woman
owned business that is certified
with the State of Texas as a
Historically Underutilized Business.
Currently, there are approximately 12,000 certified HUBs.
What is a “HUB”?
HUB Eligibility Requirements
• Asian Pacific Americans
• Black Americans
• Hispanic Americans
• Native Americans
• American women
• U.S. Citizen born or naturalized
• Resident of the State of Texas
Criteria I - Ethnicity, U.S. Citizenship, and Texas Residency
• For Profit Business • 51% or more ownership
Criteria II - Ownership
Criteria III - Active Participation
Must have a proportionate interest & activeparticipation in the control, operation, &management of the business.
Criteria IV - Principal Place of Business
The principal place of business must be within the State of Texas

Incentives To Become HUB Certified
• FREE of charge and valid for four (4) years
• Listed on the state’s HUB Directory
• Agencies and universities are required to make a “Good Faith Effort” to increase contract awards to HUBs and report the utilization of HUBs
• Increased exposure to prime contractors ($743M+ spent w/HUBs in subcontracting opportunities)
• Increased opportunities for non-competitive purchases ($40M+ was spent w/HUBs through procurement card)
Statewide HUB Program’s Mission
The mission of the Statewide HUB Program is to facilitate the use of HUBs in
state procurement, and to effectively provide information on the state's
procurement process to minority and woman-owned businesses.
The Statewide HUB Program is administered in accordance with:
• Texas Government Code, Chapter 2161, and
• Texas Administrative Code, Title 34, Part 1, Chapter 20, Subchapter B
Enabling Legislation
Memorandums of Agreement (MOA)
The Statewide HUB Program hasEstablished Memorandums of Agreement(MOA) with ten certification entities.Minority and women owned business whoare certified with one of these entities mayreceived HUB certification if:
1. The certifying entity determined that the business meets HUB eligibility; and
2. The certifying entity submits the business’ information to the Statewide HUB program for HUB certification approval and inclusion into the state’s HUB Directory.

Statewide HUB Program Certification Process
• The application is two pages and requires general business information and inclusion of documentation substantiating HUB eligibility
• Applications are typically assigned to HUB staff within 1 week to began review process
• On-site compliance reviews may be performed prior to granting HUB certification and/or during the term of a business’ HUB certification
• Upon certification approval, the vendor is sent a HUB Certification Package
• Vendors who are denied HUB certification have the opportunity to appeal the decision
• HUBs are sent a renewal notice approx. 90-days prior to their HUB certification expiration date

Centralized Master Bidders List (CMBL)
Why Register?
– The CMBL is an automated registration system used by state agencies. Once a state entity has determine the need to solicit vendors for commodities or services they will develop a mailing list from the CMBL to distribute notifications of bid opportunities.
– Used by other purchasing entities (public & private) as well as prime contractors.
Note: The CMBL is not an approved vendors list.

• Texas Government Code, Chapter 2155.263-270, and
• Texas Administrative Code, Title 34, Part 1, Chapter 113, Subchapter CRule 20.34

How to Register!
– Annual registration/renewal fee is $70.00 and may be paid on-line by credit/debit card or check debit (US addresses only).
– The profile may be printed after entered online and mailed with a check or money order (US dollars). Mailed applications incur a longer processing time.
Doing Business With The State of Texas
In fiscal 2008 the State of Texas Spent over $13.7 Billion. Over $1.8 was
spent with HUBs.
Statewide Procurement
Procures commodities and services except information technology for client agencies, universities and cooperative purchasing entities.
• Term Contracts have start/end date- Over 200 contracts exist for
various commodities and services (i.e. drug testing to e-voting machines)
• Open Market Solicitations- Vary from food, tennis shoes,
trucks to tractors and heavy equipment
• State agencies purchase information technology commodities and services through the Department of Information Resources (DIR), with few exceptions.
• Commodities include commercial software, hardware technology services, including seat management.
• Bid opportunities over $25,000 visit the Electronic State Business Daily http://esbd.cpa.state.tx.us/
• Vendors seeking bid opportunities under $25,000 should visit DIR at www.dir.state.tx.us

Information Technology
Procurement Thresholds• Non Competitive - up to $5,000
– Solicitations are not required
• Informal Solicitations - $5,000.01 to $25,000– Solicitations may be requested by
phone, fax or email to:1) Minimum of three vendors (two must
be HUBs) and 2) Registered on the Centralized Master
Bidders List (CMBL).
• Formal Solicitations - Over $25,000– Have terms/conditions, – Indicate opening time and place, – Notifications are sent to CMBL vendors,
and– Posted on the Electronic States
Business Daily (ESBD).
Electronic State Business Daily(ESBD)
• State agencies are required to advertise solicitations over $25,000 on the ESBD
• Posting Requirements- 14 days - When all solicitation
documents are available on the ESBD
- 21 days – When all solicitation documents are not available on
the ESBD (i.e. Blue Prints, Project Manuals, etc.)
• Search for bid opportunities or awards by – agency, requisition number,
city/county, NIGP code or by keywordhttp://esbd.cpa.state.tx.us/
HUB Subcontracting Plan (HSP)
• State agencies and universities must determine if subcontracting opportunities are probable on solicitations of $100,000 or more
• If subcontracting opportunities are probable, agency will list the probable subcontracting opportunities and require an HSP
• HSPs are required to be submitted at the same time as the response
Completing the HSP
• All respondents (HUBs and Non-HUBs) to the solicitation must complete an HSP if required
• For each subcontracting opportunity not self-performed by the respondent, they are required to provide written notification of the subcontracting opportunity to at least three (3) HUBs and allow the HUBs no less than five (5) working days to respond
• Respondent must provide written notification of their subcontracting opportunities to a minority or women trade organization or development center, at least five (5) working days prior to submitting their bid offer

Mentor/Protégé Program
• Each state agency with a biennial appropriation that exceeds $10 million shall implement a Mentor Protégé Program
• Designed to build relationships between prime contractors and emerging HUBs
• Intent is to grow the HUB Protégé
• Incentive for Mentor to offer Protégé subcontracting (HSP) opportunities

Centralized Master Bidders List
• CMBL new registration or renewal updates are processed and are activated within 30 minutes of time of payment.
• Renewal notices are emailed or mailed 30-45 days prior to the expiration date.
• Vendors are responsible for maintaining the profile with the most current information pertaining to their business to include appropriate selection of class and item codes based on the products or services that can actually be provided.

• Exception to vendor profile maintenance:
changes in tax identification numbers or business names must be changed by CMBL staff or the Statewide HUB program if the vendor is a HUB
• Certified HUB vendors have existing profiles in the CPA database so a new registration is not required. Approved HUB vendors should contact the CMBL Help Desk at 512-463-3459 for assistance.
