"The Contractor may furnish meals to employees requested to and whodo work in excess of 10 consecutive hours after the start of theirregularly scheduled work hours. Additional meals may be made availableevery four hours thereafter. The Contractor may furnish a breakfast today workers who are requested to and who do work more than two hoursbefore their normal starting time. When overtime work includes a mealperiod, such time will be counted as time worked in computing overtimepay. Meals will not be furnished to exempt employees when beingcompensated for time worked in excess of 8 consecutive hours."

(1) Effective December 5, 1961, for Section E, Part V, and Section A,Part V, as Section A applies to Section E (except that the require-rnent contained in the preamble to Section E for prior approval oftransfers by the General Manager shall not apply prior to July 1,1965, and Paragraph 3. of Section A shall not apply to Paragraph 8.of Section E prior to July 1, 1965);

(2) Effective July 1, 1965, for the balance of Part V, including Section A,as It applies to all Sections other than Section E.

PART V

TRAVEL AND SUBSISTENCE EXPENSES; RELOCATION EXPENSESA. General Provisions Applicable to Each Section of This Part V

1. Definitions for purposes of this Part V:

a. "Dependet" shall mean persons who regularly residewith the employee and are considered to be members ofhis immediate household.

b. "Travel expensest' shall mean expenses incurred for:transportation by common carrier; when approved bythe Contractor, rental of cars including payments madefor collision damage waivers; taxis; public transporta-tion; tolls; parking fees; and gratuities. Except as otherwise provided, "subsistence expenses"shall mean lodging, meals, gratuities, laundry, dry clean-ing and pressing, and charges for official telephone calls,telegrams and postage.

Costs allowable for expenses of transportation by airshall not exceed the costs of less-than-first-class airaccommodations except when less-than-first-classaccommodations are riot reasonably available to meetnecessary mission requirements, such as, where less-than...firsta-class accommodations would

(1) Require circuitous routing,

(2) Require travel during unreasonable hours,

(3) Greatly increase the duration of the flight,

(4) Result in additional costs which would offset thetransportation savings.

b. Costs allowable for expenses of transportation by railmay include first-class fare and expenses of Pullmanaccommodations.

c. The Contractor may furnish travel insurance to employ-ees traveling on official business at a cost not to exceed$1.00 per trip.

3. All allowable expenses of the types covered by this Part Vshall be supported by itemized accounts bf the expenses sub-mitted by the individuals who incurred them, documented byappropriate receipts such as stubs for transportation tickets,lodging and car rental receipts, etc. Full explanations willbe furnished relative to receipts which are lost or are notavailable.

4. All travel outside the limits of the continental United Statesin connection with the performance of work under the con-•tract shall have the prior approval of the AEC on a case-by-case basis.

S. Official Travel in Performance of the Contract Work

Reimbursement of reasonable travel and subsistence expensesincurred by employees regularly on the payroll of the Rocky FlatsDivision who are required to travel in connection with the perfor-mance of work under this contract shall be allowable costs.

C. Travel Performed in Connection with Employment Interviews

Reimbursement of reasonable travel and subsistence expensesincurred by individuals traveling at the request of the Contractorfor the purpose of pre-employment interviews shall be allowablecosts. The General Manager may authorize an individual per-forming such travel to be accompanied by his wife, in which casereimbursement of reasonable travel and subsistence expensesincurred by the individual for his wife also shall be allowablecosts; provided that authorization for the wife to accompany shallbe given only to those individuals being considered for exemptsalaried position vacancies. It is expected that except in unusualcircumstances the authorization for the wife to accompany theindividual will be given on a selective basis to those to be inter-viewed for important managerial or Important technical positionsat the Rocky Flats Plant,

Reasonable costs incurred by the Contractor in furnishing mealsto interviewees will be allowable.

This Section applies to all individuals first becoming employeesof the Contractor as recruits for work under this contract and toall individuals who Were employees of the Contractor prior totheir transfer to the Rocky Flats Plant other than those coveredby Section E. Except wherespecial circumstances exist dictating that the move of theemployee and his dependents should be made by means ofcommon carler and the Manager of Industrial Relationsapproves travel by such means, the move of the employeeand his family shall be by way of his personal car. Themileage to be used in computing the amount to be paid theemployee for use of his car in making the move shall notexceed the number of miles as shown by the latest edition ofHousehold Goods Carriers Bureau Atlas, of the most direct,practical route of travel at the time of the move from theemployee' s previous location to his new location.

Reasonable expenses, Including packing and unpacking, ofshipping household goods and personal effects by commonor contract carrier to a location within commuting distanceof the Rocky Flats Plant; provided that no reimbursement ofexpenses incurred for handling and shipping boats, livestock,firewood or other items not normally considered "householdgoods and personal effects" shall be allowable. Should it benecessary for the employee to store his household goods andpersonal effects because the housing he will occupy as his"permanent" residence at a location within commuting distanceof the Rocky Flats Plant is not ready to receive the goods,reasonable expenses incurred by the employee for storagefor a period not in excess of thirty days may be reimbursed.

Premiums paid by the Contractor for blanket coverageinsuring household goods and personal effects of employ-ees against loss or damage in shipment or storage shallbe allowable; provided the insurance applied to the house-hold goods and personal effects of the individual employeeis reasonably commensurate with the value of that property.

Reasonable expenses incurred by the employee for himselfand his dependents for subsistence expenses for a maximumof thirty days while securing the housing he will occupy as his"permanent" residence within commuting distance of the RockyFlats Plant; provided that the General Manager authorizes

the reimbursement; and provided further that, should theemployee, through no fault of his own, be unable to securesuch housing within the thirty-day period, such reasonablesubsistence expenses may be reimbursed for such additionaltime as shall be authorized by the General Manager with theapproval of the Contracting Officer.

E. Relocation Costs- -Transferred Exempt Salaried Employees

This Section applies only to exempt salaried employees of theContractor selected with the prior approval of the GeneralManager for transfer to the Rocky Flats Plant to fill mana-gerial or technical positions.. Reimbutsement to such em-ployees of the following expenses incurred by the employeesshall be allowable costs:

1. Reasonable travel and subsistence expenses (except thosecovered by Paragraphs 8 e. and 8 j. of Section E) incurredby the employee for himself and his wife for one trip, notexceeding seven days in duration, to seek the housing hewill occupy as his "permanents' residence within commutingdistance of the Rocky Flats Plant; provided that such a tripis made prior to the move which is the subject of Para-graph 2 below.

2. Reasonable travel and subsistence expenses (except thosecovered by Paragraphs 8 e. and 8 j. of Section E) incurredby the employee in moving himself and his dependents towithin commuting distance of the Rocky Flats Plant. Ex-cept where special circumstances exist dictating that themove of the employee and his dependents should be madeby means of common carrier and the Manager of IndustrialRelations approves travel by such means, the move of theemployee and his family shall be by way of his personalcar. The mileage to be used in computing the amount tobe paid the employee for use of his car in making the moveshall not exceed the number of miles as shown by the latestedition of Household Goods Carriers Bureau Atlas, of themost direct, practical route of travel at the time of themove from the employee' s previous location to his newlocation.

In lieu of reimbursement of a fee to a real estate broker,

Expense incurred by the employee for cancellation of a lease for thehousing he occupied as a residence at the location from which trans-ferred; provided that the cost allowable shall not exceed that portionof the cancellation charge which Is attributable to the period beginningwith the date the employee occupies the housing (whether rented orpurchased) which will be his 'permanent" residence within commutingdistance of the Rocky Flats Plant.

• Reasonable expenses for utilities and fuel, nominal yard care, propertyinsurance, property taxes, mortgage interest and miscellaneous minormaintenance Incurred by the employee in maintaining the house heowned and occupied as a residence at the location from which trans-ferred, beginning with expenses Incurred on and after the 61st dayfrom the date he occupies (either as owner or renter) the housing whichwill be his "permanenttt residence within commuting distance of theRocky Flats Plant; provided that:

a. During the period commencing with the aforesaid 61st day andending with the 300th day from the date he occupies said housingwithin4 commuting distance of the Rocky Flats Plant, the employeeoffers his house at the location from which transferred for sale ata price not in excess of the average of two independent appraisals;

b. During the period commencing with the 3Olst day from the datehe occupies said housing within commuting distance of the RockyFlats Plant, and ending with the 425th day from the date he occupiessaid housing or the date sold, whichever is sooner, the employeeoffers his house at the location from which transferred for saleat a price not in excess of 95 per cent of the average of two inde-pendent appraisals;

c. In local situations where it has been demonstrated that appraisalvalues are consistently and substantially higher than marketsaleability, the Contractor appropriately reduces the time

periods, and the prices at which the employee must offer hishouse for sale, specified in a. and b.;

The employee does not refuse during the respective periodsany offer equal to or greater than the price referred to in a.and b. as modified pursuant to C.; and

e. Any expenses reimbursed the employee pursuant to thisParagraph? shall have been incurred by the employeeduring the period commencing with the aforesaid 6lst dayand ending the 425th day from the date he occupies saidhousings

8. Reasonable and necessary miscellaneous legitimate expenses incurredby the employee as a direct result of the transfer, which either arenot specifically covered elsewhere in this Section E, or which ifof a type specifically covered, are incurred in amounts in excessof a limitation imposed by the paragraph dealing with the expenseincluding, but not limited to such items as:

a. Closing costs on sale of home (expense of abstract ortitle insurance, deed, prepayment penalties, documentarystamps, recording fees, notary costs, legal fees, discountpoints).

b. Preparation for shipment and installation of appliances.

c. Driver and auto licenses.

d. Shipping a car if move of employee and dependents ismade by common carrier; shipping a second car.

e. Telephone and telegraph charges (applies to all phasesof move).

f. Removal and installation of phones.

g. Removal and installation of carpeting and draperies.

1. Expenses of the type covered by Paragraph 7 aboveincurred during the period commencing with the dateemployee occupies (either as owner or renter) thehousing which will be his Ipermannlt residence

within commuting distance of the Rocky Flats Plantand ending with the 60th day thereafter.

For an employee who owned the premises he occupied asa residence at the location from which transferred at thetime selected for transfer, the costs allowable for expensesreimbursed under this Paragraph 8 shall not exceed onemonthts salary, or $1,500, whichever is less. For allothers, the costs' allowable for reimbursement of suchexpenses shall not exceed one-third of a month's salaryor $500, whichever is less.

F. Temporary Assignment

If it becomes necessary in connection with the performance ofwork under the contract to make temporary assignments, theContractor shall obtain the prior approval of the ContractingOfficer for each assignment and for the arrangements proposedfor reimbursing the employee for expenses incurred incident tothe assignment. The Contractor will submit a written justifica-tionto the Contracting Officer in advance fo the assignment andthe proposed reimbursement arrangements.

The term "temporary assignment" means assignment of an em-ployee for a period of not less than one month nor in excess oftwelve months to perform work under the contract at a locationother than the Rocky Flats Plant and not within reasonable com-muting distance of the employee's usual residence. The term

"employee" as used in this Section F means a person regularlyon the payroll of the Rocky Flats Division.

Relocation Costs - - Terminated mployees1. The following expenses, If incurred within ninety days (orsuch longer period as may be approved in writing by theContracting Officer) subsequent to the date of terminationby The Dow Chemical Company of the employment at theRocky Flats Plant of an individual because of lack of work,may be reimbursed by the Contractor; provided that suchitems of cost shall not be allowable if (I) the individual wasnot employed at the Rocky Flats Plant prior to October 15,1965; (ii) an express oral or written understanding that theemployee would be reimbursed for such expenses was notmade a condition of employment; or (iii) the Contractortransfers the employee to another facility, subsidiary oraffiliate of the Contractor.

a. Reasonable travel, food and lodging expenses incurredby the employee in moving himself and his dependentsback to the location from which he was recruited ortransferred for work in the performance of this contractor to a location of lesser distance. If the move wasmade by way of car, the mileage to be used incomputingthe amounts to be paid the individual for use of his carshall not exceed the number of miles, as shown by thelatest edition of Household Goods Carriers Bureau Atlas,of the most direct, practical route at the time of themove between the individual's place of residence withincommuting distance of the Rocky Flats Plant and thelocation from which he was recruited or transferred.If the individual moves to some location which is a greaterdistance from his place of residence within commutingdistance of the Rocky Flats Plant than is the place fromwhich recruited or transferred, the aforesaid expensesmay be reimbursed up to an amount which is in the sameratio as the distance of the most direct route, •as shown bythe latest edition of the Household Goods Carriers BureauAtlas, between his place of residence within commuting

Reasonable expenses, including packing and unpacking,of shipping the household goods and personal effects ofthe individual by common or contract carrier to a loca'-tion from which he was recruited or transferred forwork in the performance of this contract or to a locationof lesser distance; provided that no reimbursement ofexpenses incurred in handling and shipping boats, live-stock, firewood, automobile or other items not normallyconsidered "household goods and personal effects" shallbe allowable; and provided further that should the movebe made to some location which is a greater distancefrom his place of residence within commuting distanceof the Rocky Flats Plant than is the place from whichrecruited or transferred, the aforesaid expenses maybe reimbursed up to an amount which is in the same ratioas the distance of the most direct route, as shown by thelatest edition of the Household Goods Carriers BureauAtlas, between his place of residence within commutingdistance of the Rocky Flats Plant and the location fromwhich recruited or transferred bears to the distance thehousehold goods and personal effects were actually moved.

2. Before making reimbursement of expenses covered by thisSection, the Contractor shall:

a. Obtain from the individual evidence establishing withreasonable certainty that the individual has completedthe move; and

b. 1. Regular Vacation

a. After one year of continuous employment, salaried employees willbecome eligible for a paid vacation of fourteen working days. Thisfirst vacation must be completed during the remaining part of thecalendar year after the employee first becomes eligible, exceptas outlined in subparagraphs c and d below, or where the eligibilitydate of an employee falls during the month of December, in whichcase vacation for which such employee would otherwise becomeeligible on that date, may be taken at such time during that monthas his supervisor may approve.

b. After the first anniversary of his hire, each salaried employeebecomes entitled to fourteen days of vacation on or after eachsucceeding January let that the employee is on the payroll. Thisvacation must be taken during the calendar year in which theemployee becomes entitled to the vacation or lost without paymenttherefor, except as outlined in subparagraphsc and d below.

c. An employee may carry over up to five days of vacation from onecalendar year to the next succeeding calendar year. (Note: forcalendar year 1965 any employee may carry over up to six daysof regular vacation into calendar year 1966.)

J. Length of Service Awards

The contractor has a length of service award program pursuant to which(i) pins are given to male employees after 10 years of service and foreach additional 5 years of service thereafter, (ii) a pin, brooch orbracelet, at the option of the employee, is given to female employeesafter 10 years of service and for each additional 5 years of servicethereafter, and (iii) watches are given to employees after 35 years ofservice. Costs incurred by the contractor for such awards shall beallowable subject to the following limitations:

1. Costs to be allowed for pins, brooches and bracelets, including anyengraving, shall not exceed the costs for these items shown in the

p contractor's description of its program dated May 4, 1965.

2. Costs to be allowed for . watch, including any engraving, shall notexceed that portion of the cost of the watch, as set forth in thecontractor's description of the program referred to above, whichis in the same ratio as the employee's years of service under thecontract bear to 35.

E. Temporary Assignment

If it becomes necessary in connection with the performance of workunder the contract to make temporary assignments, the contractorshall obtain the prior approval of the Contracting Officer for eachassignment and for the arrangements proposed for reimbursing theemployee for costs incurred incident to the assignment. Thecontractor will submit a written justification for the assignment andthe proposed reimbursement arrangements.

The term "temporary assignment" means assignment of anemployee for a period of not less than one month nor in excess oftwelve months to perform work under the contract at a locationother than the Rocky Flats Plant and not within reasonable com-muting distance of the ernployeets usual residence.
