337.408 Regulation of bus stops, benches; transit 2493 shelters,street light poles; waste disposal receptacles, and 2494 modularnews racks within rights-of-way.- 2495(1) Benches or transit shelters, including advertising 2496displayed on benches or transit shelters, may be installed 2497within the right-of-way limits of any municipal, county, or 2498state road, except a limited access highway, provided that such2499 benches or transit shelters are for the comfort or convenience2500 of the general public or are at designated stops on officialbus 2501 routes and provid~d that written authorization has beengiven to 2502 a qualified private supplier of such service by themunicipal 2503 government within whose incorporated limits suchbenches or 2504 transit shelters are installed or by the countygovernment 2505 within whose unincorporated limits such benches ortransit 2506 shelters are installed. A municipality or county mayauthorize 2507 the installation, without public bid, of benches andtransit 2508 shelters together with advertising displayed thereonwithin the 2509 right~of-way limits of such roads. Onand 2523 after July 1, 2012, a municipality or county thatauthorizes a 2524 bench or transit shelter to be installed withinthe right~of~way 2525 limits of any road on the State HighwaySystem must require the 2526 qualified private supplier, or anyother person under.contract 2527 to install the bench or transitshelter, to indemnify, defend, 2528 and hold harmless thedepartment from any suits, actions, 2529 proceedings, claims,losses, costs, charges, expenses, damages, 2530 liabilities,attorney fees, and court costs relating to the 2531 installation;removal; or relocation of such installations, and 25"32 shallannually certify to the department i0 a notarized signed 2533statement that this requirement h?s been met. Pursuant to our telephone conversation yesterday, please note that Objective 2 1 5. of the TransportationElement of Volusia County1s Comprehensive Plan calls upon Volusia County and VOTRA~~ to provide.among other things"! passenger, amenities and accommodation of the special needs of the transportationdisadvantaged. Policy 2.1.5.9. requires Vo!usia County to coordinate with VOTRAN to ensure that thetransportation disadvantage population is adequately served. Policy 2.1.5.4. further calls upon Vo!usiaCounty to coordinate with VOTRAN to provide passenger amenities along major public transportationcorridors. Other similar policies may be found under Objective 2.1.5.
Insofar as we've contracted with Tindale Oliver to conduct field work and analysis to implement theCounty's planning program (i.e., the Comprehensive Plan) and develop policies and desiqn Quidelinesconsistent therewith (see Scope of Services for Contract No. 11-SQ-162SR), I do believe-we should beable to provide Tindale Oliver with a task assignment under our present contract to provide the design'guidelines for the RFP for ADA-compliant bus benches.

We noted Stafftr'lOUght it might be difficult to deal with rewriting theapplicable ordinances as well as controlling the adv~singcontent on the signs due to recentfreedom of speech enaciments. Both ofthose conceins are easily complied with.

It has also come to my attention that staff tried to peiSuade you that I was iess than totaiiy honest withyou coiiceiiling the request to remove those ongina; 4 benches in question, made by then VOTRAN GM,Ken Fischer. In layman's language, that is an as! Ken called me directly and stated very specificaily therequest had come direct from Orange City staff. rv1oreover, if FDOT had initiated the request, it wouldhave come direct to me as we have a strong working relationship \r..,.ith Rick Snow at FOOT. He has caHedme directly each and every time there is a question or issue with any of the 600 benches we ownCountywide. Especially those on State Roads like 17-92. To suggest that he, or anyone at FDOT. tooksuch a circuitous routeto contact us is fanciful, at best. _.

Pursuant to Ru!e Chapter 14~20J FAC. focal government entities have permitting authority for the instaUation of bussheiters end benches within their respective jurisdictions; the Department generaiiy retains compliance oversight.
There are two benches located on SR 15;600 (US i7-92; Voiusia Avenue): one near 1995 N. Volusia Avenue and oneiiear 2400 North Voiusia Avenue. it has been oi:?served that the location of these benches do not comply with clear zonerequirements as per FOOT Design Standard Index 700. If the City has permitted these benches, tt,ey need to bereiocated out of the clear zone. If the City has not permitted these benches; they should be removed.

The project appears 10 be entirely within the city limits of Deland. Valran is the transit agency, but we donot have any ownership of the bus stop improvements within the city. Bus stop improvement in the rightotway must be authorized by the City of Deland. The benches with advertising belong to Waverly Media,under contract to the City of Deiand (see Florida Administrative Code 14-20.0032 Placement of Benches).

Hi Steven,Clyde Morris and Red John Drive are the only County Roads on your list. Clyde Morris has 100 feet of
deed right of way from Big Tree to Bevil!e with an additional 10 feet on the east side fiOm Big Tree northapprox. 400 feet. Red John Drive is prescriptive. HO\'v'8ver; the County owns the property on the eastside and there appears to be plenty of room on the west side. To determine exactly •....here the iight ofway iine is, you would need to have it surveyed.

The guidellne-s included in this document are intended to provide general parameters for per
sonnel and organizations when designing and placing bus stops and amenities in the pub!lc
right-ot-way. This document is not intended to be an engineering design manual, and it does
not provide site-specific detailed public transit, engineering, aichitecturai, construction, or legal
information. Users of thisdoeument will need to adjust the information contained in the guide~
lines to site-specific needs, constraints, and applicable laws, regulations, and ordinances. if a
user desires expert advice concerning any of the information in these guidelines, the user is
encouraged to retain the services of an appropriate expert.
Some bus stops, pubiic seating benches, and other amenities at bus stops currently in piaee in
the public domain at existing Votran transit facilities are inconsistent with the goais and guide
lines presented in this document. !n some instances, bus stop conditions and placement are
defined by the underdeveloped corridors or roads they serve. In these cases, application of the
design guideiines in this document may be limited by a lack of right-of-way development, con
straints due to the natural terrain, unimproved roadways with no infrastiuc1ure (e.g., curb, gut
ter, drainage; sidewalks, etc.), or because of the policies and standards of the jUrisdiction in
"Ihlen the bus stop is located. Because of these conditions, Votran may not be able to improve
the pubiic right-of-way sufficient to support an accessible bus stop placement until such time
as major improvements are planned and funded. The facilities can best be improved through a
coordinated planning and design effort between Votran and the local agencies responsible for
maintaining and upgrading the roadway and pedestrian rights-ot-way.
Votran has a responsibility to ensure that bus stops and amenities are piaced in a manner that
provides access and use by individuals with disabiiities and must, therefore, use non
discriminatory judgment when planning for the placement of bus stops for pubiic use. This
judgment may result in refusal by Votran to either place or allow piacement of a bus stop at a
desired location because site conditions prevent an accessible environment reSUlting in a nonaccessibie transit stop. Establishment of a new bus stop at a site where full access is afforded
is mandated by the ADA.

all bus stops to have sufficient space for a boarding and alighting area that has a firm, stable,
and slip-resistant surface to accommodate boarding and alighting at the stop.
The following section contains design prototypes for ADA-compiiant bus stops, includina the- .
coordination of bus stop elements such as bus stop signs, benches, and shelters. Any con-

3.1 ELEMENTS OF AN ACCESSIBLE ENViRONMENT
Bus stops shouid be designed to make transit more convenient, accessible, and aestheticallyappealing to transit users. These me?sures are necessary if public tra.nsportation is to competeeffectively with other transportation modes. The proper design of bus stop zones and adjacentcurbs can increa.se transit access and convenience by eliminating barriers, especially for thoseindividuals with mobiiity limitations. The ADA mandates equal access to mass transit for everyU.S. citizen, thereby requiring every ne"A, bus and bus stop to be wheelchair accessibie to themaximum extent practic.ab!e. All eiements, including benches, piaced at or near bus stops foruse by the pubiic in conjunction with use of the transit system must also be fully compliant withthe ADA provisions as adopted by the U.S. Department of Transportation.
Regulatory Requirements for Accessible Transportation Facilities are provided by theFedeial and state governments. The ADAAG includes the Federal regulations governing ac

The Florida State regUlatory requirements are provided under the Fiorida BUilding Code, Chapter 11 FAC fer Building Construction. The FAC generally mirrors the requirements of theADAAG, but is somewhat more stringent in some areas such as accessible parking spaces
and accessible restroom configurations.
The foiiowing information provides a general overview of the accessibility regulations requirements for bus stops and facilities that may affect the accessibiiity to or use of a bus stop andamenities placed at the bus stop. Not aii of the ADAAG requirements are given here. Onlythose pertinent for the understanding of personnel responsible for bus stop siting and p!ace
ment of amenities in an accessible manner are listed.
.. Accessible Pedestiian Routes
o Must be 36" minimum width, continuous, and unobstructed path (note thatthe 2012 FAC requires a 48" deai accessibie pathway which can be reduced to no less than 36" when approved by the Engineer).
o Must have a 32" minimum width at door...,ays.
o Must have 60" X 60" passing spaces at 200' intervals (if <60" Wide).
o Running slope (direction of tiavel) must be equai to or less than 5 percent
(1 :20) (>5% =ramp i ramp slope cannot exceed 8.33%.)

o The maximum ramp running slope permitted is 1:12 (8.33%).
o The maximum ramp cross slope permitted is 1:48 (2Cio).
o Side flare (transition) slopes must be no greater than 1:12,
o Curb ramps must be 48" wide (FOOT ,Design Standards, Index 304 - widthmay be reduced to 36" as required by ADAAG in restricted conditions and
as approved by the Engineer).
o Curb ramps must have detectabie warning materiai the fuii widih of ramp
and 24" from back edge of curb,
o Curb ramps must have a 48" long landing at top of slope (FOOT Design
Standards, Index 304).
o Curb ramps must have detectable warning in truncated dcmes \"/ith pattern
and characteristics defined by regulations, including contrastjng coior.
o Detectable y-varning also required at -landings and flush transitions at street

The ,/1,D,fJ.v/1,G contains specific requirements fer benches in Section 903. However, the seopingprovisions of the ADAAG indicate that Section 903 is only applicable to benches located in in
terior spaces such as dressing, fitting, and locker rooms (803.4), and in hoiding and housing
cells (807.2.2).
Additionaiiy, to reinforce agreement of the above comment, it is necessary to note that accord
ing to direct communication with U.S. Access Board technica! staff, ADAAG Section 903 is not
applicable to benches placed in the pubiic right-af-way. However, the Public Rights-of-Way Ac
cessibiiity Guideiines published by the Access Board (PROWAG are not enforceable regula
tions at the time of this writing) do specify accessibility gUidelines for benches in the pUblic right
-of-way. PROWAG particularly emphasizes the need to consider the dimensions and use of
pedestrian circulation routes Ylhen coordinating the piacement of improvements, appurte=nances, utilities, Oi street furniture (inciudingbenches). Comments from disability organizations
and indIviduals have identified blocked or compromised pedestrian routes as a major barrier to
independent trave!.
FDOT has taken an aggressive posture concerning the placement of benches and other
amenities within the public right~of-way, particulariy at transit stops. Rule 14-20.0032, Place
ment of Transit Bus Benches, specificaily addresses requirements for benches placed in the
pubiic right-af-way. This rule utilizes many of the requirements of ADAAG Section 903 and
PROWAG R212.6 covering the plac.ement and dimensional characteristics for benches. This
Votran Bus Stop Design standards document has been developed to inc-Orporate the FDOT
(PROWAG) and ADAAG requirements for benches and the applicable requirements are in
cluded on the following pages.

This section describes important considerations for bench and shelter placement at bus stops.
ADA standards require all bus stops to have sufficient space for a boarding and aiighting area
that has a firm, stable, and slip-resistant surface to accommodate boarding and alighting at the
stop. When a bench or sheiter is jiiOvided at a bus stop, a boarding and alighting area con
crete pad is required and must be located within the speclfJed clear zone for the roadway envi
ronment being used according to FOOT Design Standards, index Number 700. if bus stop
amenities in addition to a bus stop sign are provided, the bus stop boarding and alighting area
shail be connected to the amenities, streets, sidewalks, and/or existing pedestrian infrastruc-
ture by an accessibie route.
1. Bus access characteristics (critical) - This category involves characteristics related
to the use of a paiticuiar ioeation by a transit entity for a bus stop. For a location to be
viabie for application of a bus stop, requirements must be met for vertical and side
clearanc.e of the bus, turning radius of the intersection, curb lane width, parking clear
zone, and presence of driveways, among other criteria. Placement of a bench at a site
that does not provide an accessible environment is not recommended and may present
liability issues for the transit agency.
2. Patron accessibiiity characteristics (critical) - Once it is deteiITlined that a bus is
capable of safely accessing a potentia! bus stop loc:ation, it next must be determined
whether patrons can access the location conveniently and safely. To do this; patron
access toifrom and use of the site must be assessed. For a location to be viable from
the point of view of the transit patron, requirements must be met for the presence,
width, and relative connectivity of sidewalks where appiicable, the presence of an ADA
boarding and alighting area (minimum 5-foot by 8-foot) enabiing clearance for wheel
chair iifUramp deployment, and the presence of accessible connecting pedestrian path
ways and curb ramps, among other potentia! considerations.
3. Site infrastructuie characteristics (non-critical) - If buses and patrons are both ableto successfuiiy access a potential bus stop loc-ation, then the location should be suit

5.2 GUIDELINES FOR BENCH PLACEMENT
The foiio'Ning aie minimum gUidelines for the piacement of benches at bus stops. These guide
lines are written in concert with established accessibility requirements found in AD,l:J.AG and the
FAC,
Wheelchair ClearanceMinimum clear width for a single wheelchair passage shall be 36 inches continuousiy.
Note: Clearance for new locations or locations to be adjusted should provide for 48-inch clear
ance to be in conformance \"Iith FDOT design standards and the 2012 FAC.
Minimum clear length of 96 inches (measured perpendicular from the curb or vehicle roadway

layout options, and the ones shown are typicai for urban, suburban, or rural environments.
Clearance between Bench and Other Bus Stop Components (Trash Cans, Shelters! and
Kiosks)Avoid placement of bench next to waiis or fences. ·If possible, maintain 36-inch clearance in
front of and behind bench. If not possible, place bench within 4 inches of waii or other struc
ture. However, this placement must maintain 36 inches in fiCnt of bench for accessible path
clearance.
Benches placed adjacent to shelters should allow an accessible route not less than 36 inches
minimum! 48 inches preferred.
Benches may be placed within a bus shelter. A spac.e no less than 30-inches by 48~inches at
one end of the bench must be provided fully within the shelter fer wheelchair parking. Most bus
stop shelters are designed to include benches placed to provide for a Wheelchair turning space
of at least 60 inches. The space required for a wheelchair to make a 180-degree turn is a ciear
space of 60 inches in diameter.
