Chair Arnold called the first meeting of the 2010-2011 Board to order at 8:00 A.M., Thursday,December 2, 2010, at the Board office in Montgomery, Alabama. The following were in attendance:

11-001. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner to adopt the revisedagenda. MOTION CARRIED 6-0.
Minutes of the seventh meeting of the 2009-2010 Board held September 16-17, 2010 were received forapproval.
11-002. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust that the minutes of theseventh meeting of the 2009-2010 Board held on September 16-17, 2010 be approvedas written. MOTION CARRIED 6-0.
Action items from previous meetings were reviewed and updated.

Chair Arnold announced the Board would reconvene into open session at approximately 9:45 A.M.The meeting was closed to the public. The meeting was opened to the public at 10:00 A.M. TheExecutive Session was extended to continue discussing pending applications.
11-004. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner to extend the executivesession for one hour for the purpose of discussing pending applications. MistersArkle, Arnold, Foust, Santora, and Ulrich, and Dr. Turner voted in favor of themotion.
Chair Arnold announced the Board would reconvene into open session at approximately 11:00 A.M.The Executive Session was concluded and the Board reconvened in Open Session at 11:00 A.M.
Applications of those applying for Professional Engineer licensure by comity, as provided by Section34-11-4(1)(b) of the Licensure Law, were considered.
Applications of those applying for Professional Engineer licensure by examination, as provided bySection 34-11-4(1)a. and b. of the Licensure Law having previously passed the FE Examination inAlabama or in another jurisdiction, were considered.
Applications of those applying for Engineer Intern certification, as provided by Section 34-11-4(2) ofthe Licensure Law, were considered.
Applications of those applying for Land Surveyor licensure by Examination, as provided by Section34-11-4(3)a., b., and c. of the Licensure Law, were considered. Applications of those applying forProfessional Land Surveyor licensure by examination having previously passed the Fundamentals ofLand Surveying Examination and the Principles and Practice of Land Surveying Examination inAlabama or in another jurisdiction were considered and were approved for the Alabama LandSurveying Standards, History, and Law Examination.
Applications of those applying for Land Surveyor Intern certification, as provided by Section 34-11-4(4) of the Licensure Law, were considered.

11-006. IT WAS MOVED by Dr. Turner and seconded by Mr. Ulrich that the Board accept forEI/LSI certification those applicants listed on Attachment #2. MOTION CARRIED6-0.
11-007. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Foust that the Board defers forlicensure/certification Joseph P. Fullone, David Anthony O'Connor, and FrederickAllen House. MOTION CARRIED 6-0.

11-010. IT WAS MOVED by Mr. Arkle and seconded by Mr. Ulrich that the Board defers forexamination those applicants listed as deferred on Attachment #3. MOTIONCARRIED 6-0.
11-011. IT WAS MOVED by Dr. Turner and seconded by Mr. Ulrich that the Board denies forexamination those applicants listed as denied on Attachment #3. MOTIONCARRIED 6-0.
11-012. IT WAS MOVED by Mr. Arkle and seconded by Mr. Foust that the Board acceptsRoland Vaughan for licensure by comity. MOTION CARRIED 6-0.
The Board reviewed a request for board evaluation of transcripts from an applicant who wished to beconsidered for licensure on the basis of obtaining a foreign degree engineering degree.
11-013. IT WAS MOVED by Mr. Santora and seconded by Mr. Ulrich to deny that the degreeMs. Purvi Talati has obtained from Maharaja Sayajirao of Baroda is equivalent to anunapproved engineering degree. MOTION CARRIED 6-0.
LAW ENFORCEMENT — Mr. W. Gerald Wilbanks, Advisor
Mr. Harold Pridgen appeared before board in regards to him being in non-compliance with a consentorder he had signed. He identified that he did not have the money to pay the $1,000 fine and asked formercy from the board. (Case 08-41-B)
11-014. IT WAS MOVED by Mr. Arkle and seconded by Mr. Ulrich to revoke Mr. Pridgen'sprofessional engineer license for non-payment of the $1,000 fine. MOTIONCARRIED 6-0.
The Board reviewed the status of the files pending with the Board, the Investigator, and/or theInvestigative Committee. The Board reviewed the list of those completed cases that are beingmonitored. The Board was briefed on the 2010 statistics.
FORMAL HEARINGS
At the request of Mr. Ronald R. Ellis, the Board conducted a formal hearing to render a decision onMr. Ellis' request for reinstatement of his previously revoked professional engineer license. The Boardheard testimony from Mr. Ellis. A court reporter was present and a transcript of the hearing is on filein the office.

11-015. IT WAS MOVED by Mr. Arkle and seconded by Dr. Turner to grant Mr. Ellis' requestand allow for the reinstatement of Mr. Donald R. Ellis' professional engineeringlicense. MOTION CARRIED 6-0.
LAW ENFORCEMENT — Mr. W. Gerald Wilbanks, Advisor
The Board reviewed enforcement action taken against Alabama licensees by other licensingjurisdictions. The licensees will be notified that copies of the actions will be placed in their Alabamalicensing files.
11-016. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner that the enforcementactions taken by other licensing jurisdictions be made a part of the Alabama licensees'records and that the individuals be sent a letter of caution MOTION CARRIED 6-0.
The Board reviewed a request for extension of time to respond. Mr. Brannan, the attorney for Mr. 0.Guthrie Jeffcoat, Jr., had filed a motion with the Board asking for more time to respond to theAdministrative Law Judge's recommendations in regards to Case 09-305-B. Mr. Brannon also hadprovided correspondence in which his client waived the Board's compliance with any deadline for adecision whether the deadline was established by Statute or Rule of the Board. Mr. Foust and Mr.Arkle recused themselves from the discussion.
11-017. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner to deny Mr. Brannan'srequest for a time extension. MOTION CARRIED 4-0 with Mr. Foust and Mr. Arklerecused.
The Board reviewed pending cases that the investigative committees have completed to accept,modify, or reject the suggested courses of action.
11-018. IT WAS MOVED by Dr. Turner and seconded by Mr. Santora that probable causeexists that Mr. Derek L. Harvel, PLS #18387, had been providing or offering toprovide land surveying services in Alabama without obtaining a Certificate ofAuthorization for land surveying; he had utilized licensed land surveyors' sealswithout their permission; and had provided false information in a contract with anational firm. The proposed terms of the consent order are Mr. Harvel shall pay theBoard a $1,000 fine, his professional land surveyor license is revoked and he shall notseek reissuance of his license for two years, and that the record of this matter will be amatter of public record. The Board accepted the terms of the consent order and issuedthe final order. MOTION CARRIED 5-0 with Mr. Foust recused. (Case 10-15-B)
11-019. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Foust that probable cause existsthat Mr. Walter Kulash, a non-licensee, had provided a traffic engineering report for aproject in Alabama without obtaining a license to practice engineering. The proposedterms of the consent order are Mr. Kulash shall pay $169.91 to the Board for theexpenses of the investigation; he will become an Alabama licensed professionalengineer within six months of the final order; that failure to become an Alabamalicensed professional engineer within the six months shall cause Mr. Kulash to pay a$500 civil penalty to the State General Fund; he will complete a three hour continuingeducation course on engineering ethics sponsored by the Murdough Center for

Engineering Ethics of Texas Tech University within six months of the final order; hewill cease and desist using the title "PE" or any derivative thereof relative to projectsin Alabama until such time as he obtains a professional engineer license from theBoard; and that the record of this matter will be a matter of public record. The Boardaccepted the terms of the consent order and issued the final order. MOTIONCARRIED 5-0 with Mr. Arkle recused. (Case 10-22-C)
11-020. IT WAS MOVED by Mr. Arkle and seconded by Mr. Foust that probable cause existsthat Mr. Lawrence Fischer, PE #19088, had voluntarily surrendered his PE license inArkansas for placing his PE seal and signature to electrical, mechanical, and plumbingdesign drawings that were not prepared by him or under his direct supervision. Theproposed terms of the consent order are Mr. Fischer will surrender his Alabama PElicense, he shall not seek reissuance of the license for three years from the date of thefinal order, he shall submit design drawings regarding three projects selected by theBoard prior to the Board considering a request for re-issuance of his Alabama PElicense, and that the record of this matter will be a matter of public record. The Boardaccepted the terms of the consent order and issued the final order. MOTIONCARRIED 5-0 with Mr. Santora recused. (Case 10-35-B)
The Board was briefed on a complaint that had been filed by Mr. Fischer in regards to the length oftime it was taking to refund his 2011 renewal fee.
11-021. IT WAS MOVED by Mr. Arkle and seconded by Dr. Turner that the staff shouldcontinue the process of refunding Mr. Fischer's 2011 renewal fee and to dismiss anyfurther action on his complaint. MOTION CARRIED 5-0 with Mr. Santora recused.
11-022. IT WAS MOVED by Dr. Turner and seconded by Mr. Foust that probable cause existsthat Mr. Benjamin L. Shealy, PE #28111, had failed to obtain the necessary continuingprofessional competency credits required to renew his Alabama PE license. Theproposed terms of the consent order are Mr. Shealy shall pay the Board a $300 fine, hewill be required to obtain three professional development hours within sixty days ofthe final order which are in addition to the fifteen hours required to renew for 2011, hewill serve a six month probation, and that the record of this matter will be a matter ofpublic record. The Board accepted the terms of the consent order and issued the finalorder. MOTION CARRIED 5-0 with Mr. Arkle recused. (Case 10-38-B)
11-023. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust that probable causeexists that Mr. Alvin R. Conner, Jr., a non-licensee, and his firm Conner LandServices, LLC had been providing or offering to provide land surveying services andengineering in Alabama without obtaining a Certificate of Authorization for landsurveying and engineering or without obtaining a license for land surveying andengineering. The proposed terms of the consent order are Mr. Conner shall pay a$1,000 civil penalty to the State General Fund, he will pay the Board $170.17 for theexpenses of the investigation, he will cease and desist offering engineering and landsurveying until such time as the firm employs a licensed Alabama professional landsurveyor and engineer and the firm obtains a certificate of authorization forengineering and land surveying, and that the record of this matter will be a matter of

public record. The Board accepted the terms of the consent order and issued the finalorder. MOTION CARRIED 5-0 with Mr. Ulrich recused. (Case 10-42-C)
11-024. IT WAS MOVED by Mr. Foust and seconded by Mr. Arkle that probable cause existsthat Mr. Paul Latino, a non-licensee, and his firm P. Latino Construction Engineeringhad been providing or offering to provide engineering in Alabama without obtaining aCertificate of Authorization for engineering or without obtaining a license forengineering. The proposed terms of the consent order are Mr. Latino shall pay a$1,000 civil penalty to the State General Fund, he will pay the Board $141.58 for theexpenses of the investigation, he will cease and desist offering engineering until suchtime as the firm employs a licensed Alabama professional engineer and the firmobtains a certificate of authorization for engineering, and that the record of this matterwill be a matter of public record. The Board accepted the terms of the consent orderand issued the final order. MOTION CARRIED 5-0 with Dr. Turner recused. (Case10-43-C)
11-025. IT WAS MOVED by Mr. Santora and seconded by Mr. Arkle to close Case 10-49-Bwith no further action. MOTION CARRIED 5-0 with Dr. Turner recused.
11-026. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Foust that probable cause existsthat Mr. Frank A. Dagley, PE #9246, had placed his engineering seal on drawings thatcontained violations of the acceptable standards of the practice of engineering andincluded drawings that were within the practice of architecture. The proposed termsof the consent order are Mr. Dagley will pay the Board a $1,000 fine, he will serve atwo-year probation, and the record of this matter will be a matter of public record.The Board accepted the terms of the consent order and issued the final order.MOTION CARRIED 5-0 with Mr. Arnold recused. (Case 09-12-B)
11-027. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust to close Case 10-12-Bwith a letter of caution. MOTION CARRIED 5-0 with Dr. Turner recused.
The Board was briefed on Mr. Kenneth E. Holt, PLS #24969, being non compliant with a consentorder that he had agreed to in 2009.
11-028. IT WAS MOVED by Dr. Turner and seconded by Mr. Foust to revoke Mr. Holt'sprofessional land surveyor license. MOTION CARRIED 5-0 with Mr. Arnoldrecused.
CERTIFICATES OF AUTHORIZATION — Mr. Don T. Arkle, Advisor
11-029. IT WAS MOVED by Mr. Foust and seconded by Dr. Turner that the Board ratify theapproval of Engineering Certificates of Authorization CA-4081-E through CA-4130-Eand Land Surveying Certificates of Authorization CA-934-LS through CA-943-LSissued since the September 16-17, 2010 Board Meeting and further that the list ofthose issued be included in the minutes on Attachment #4. MOTION CARRIED 6-0.
The Board reviewed the certificate of authorization applications that had anomalies.

11-032. IT WAS MOVED by Mr. Arkle and seconded by Mr. Ulrich to approve the certificateof authorization application for Electrical Engineering Consultants Inc. MOTIONCARRIED 6-0.
11-033. IT WAS MOVED by Mr. Arkle and seconded by Mr. Santora to approve thecertificate of authorization applications for Hyde Engineering and Land Surveying.MOTION CARRIED 6-0.
11-034. IT WAS MOVED by Dr. Turner and seconded by Mr. Foust to disapprove the 2011certificate of authorization renewal application for Carter & Slope due to the fact thatthey are offering in two locations and need a full time professional engineer inresponsible charge at both locations. MOTION CARRIED 6-0.
The Board considered a request from Dr. John Kim who was asking on behalf of his firm, GaNCorporation, if a certificate of authorization was required.
1 1 -035. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Santora that GaN Corporationrequired a certificate of authorization and if a CA was not obtained within 30 days ofnotification that they would be required to cease and desist the offering or performingof engineering. MOTION CARRIED 6-0.
At the request of Victory Solutions, Inc. the agenda item regarding Victory Solutions, Inc. waspostponed till the March 2011 board meeting.
The board considered a second request from Mr. James Trapane who was asking that his firmEngineered Maintenance Services be allowed to continue to use that name even though they do nothave a CA.
11-036. IT WAS MOVED by Dr. Turner and seconded by Mr. Ulrich to deny EngineeredMaintenance Services request to be allowed to continue the use of their name withoutobtaining a Certificate of Authorization. MOTION CARRIED 6-0.
LEGISTATIVE — Mr. W. Gerald Wilbanks, Advisor
The Board was briefed on the 2011 Legislative General Session calendar. The Board finalized theirreview of possible changes to the Licensure Law. The changes will be circulated and efforts willbegin to get sponsors for the legislation.

The reports on the receipts as well as expenditures were reviewed. A request was made to break outlast year's figures between PE and PLS receipts and expenditures.
The Board approved the FY 2011-2012 proposed budget.
11-037. IT WAS MOVED by Mr. Foust and seconded by Dr. Turner to approve the FY 2011-2012 budget. MOTION CARRIED 6-0.
CHAIR'S REPORT
The proposed changes to the Administrative Code having been duly advertised were considered foradoption. No oral or written comments were received and there had not been a request for publichearing.
11-038. IT WAS MOVED by Mr. Arkle and seconded by Mr. Ulrich to adopt the changes toAppendix A, Section 330-X-4 as proposed. MOTION CARRIED 6-0.
The Board adjourned at 5:00 P.M. The Board reconvened on Friday, December 3, 2010 at 8:00 A.M.All Board members were present.

Misters Arkle, Arnold,Foust, Santora, Ulrich and Wilbanks, and Dr. Turner voted in favor of the motion.
Chair Arnold announced the Board would reconvene into open session at approximately 8:30 A.M.The meeting was closed to the public. Mr. Foust and Mr. Arkle were recused from the deliberationand did not participate in the executive session. The meeting was opened to the public at 8:30 A.M.
11-040. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner to find Mr. 0. GuthrieJeffcoat, Jr. Professional Engineer #9587, guilty on the one count and to accept theAdministrative Law Judge's recommendations with modifications. Mr. Jeffcoat willreimburse the Board $2,500 plus the cost of hearing, his professional engineer'slicense is suspended for two years, he will serve one year probation after thesuspension, and he will be required to take two three-hour courses of ethics from theMurdough Center for Engineering Ethics of Texas Tech University in addition to the15 continuing professional competency hours required for renewal of licensure.MOTION CARRIED 5-0 with Mr. Foust and Mr. Arkle recused. (Case 09-305-B)
EXECUTIVE DIRECTOR'S REPORT
The Board was briefed on the efforts being made to resolve the issues between the societies who aremembers of the nominating committee. The upcoming board vacancy has been announced. Anothermeeting of the nominating committee working group is scheduled for December. The Board

developed a statement to be provided to the members of the working group. The Board also revieweda draft of a generic board member position description that outlines the responsibilities of a boardmember and outlined the time commitments.
APPLICATIONS — Mr. Phillip E. Santora, Advisor
At the request of Mr. Stephen Nowak, the Board met with Mr. Nowak, Mr. Jim Hampton (Mr.Nowak's attorney), and Mr. Mark Baker to discuss the status of Mr. Nowak's pending land surveyorapplication. Upon the conclusion of the meeting the board went into executive session.

IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner that the Board ofLicensure for Professional Engineers and Land Surveyors go into Executive Sessionfor fifteen minutes for the purpose of discussing Mr. Nowak's application. MistersArkle, Arnold, Foust, Santora, Ulrich and Wilbanks, and Dr. Turner voted in favor ofthe motion.

11-042. IT WAS MOVED by Mr. Santora and seconded by Mr. Arnold to approve Mr. StephenNowak for the land surveyor professional examinations. MOTION CARRIEDUNANIMOUSLY
CORRESPONDENCE
The Board reviewed a request from Mr. John Wade, P.E., who was requesting an opinion if based onhis education and background could he submit life safety and passive fire protection designs withoutthe involvement of an architect. The Board at the previous meeting had deferred the decision to theBoard of Architects since it was believed that the project dealt with incidental practice of architectureby an engineer. Mr. Wade provided additional information in that he believed what he was performingwas actually engineering and should not be considered incidental architecture. The Board agreed thatcertain aspects of life safety plans could be done by properly trained engineers. It appears that there isa difference of opinion between the two boards that will have to be discussed between the boards.
11-043. IT WAS MOVED by Dr. Turner and seconded by Mr. Santora that it is the opinion ofthe Board that a professional engineer properly qualified in fire protection engineeringcan design life safety plans and further that the Board will be investigate the issue withthe Board of Registration for Architects. MOTION CARRIED UNANIMOUSLY
The Board reviewed various newsletters that required no response.
NEW BUSINESS
The Board reviewed correspondence from Mr. Kendell Phillips who was contending that based oninformation on the services performed by his firm, Willbrook Solutions Inc.; the firm did not require acertificate of authorization.

11-044. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Foust that Willbrook SolutionsInc. is offering engineering for a fee to the government which is considered to beoffering to the public and as such requires the individuals offering/performingengineering to be licensed as professional engineers and the firm has to have anengineering certificate of authorization. MOTION CARRIED UNANIMOUSLY.
The Board approved the proposed security assessment proposal between the board office and theCenter for Advanced Technologies.
11-045. IT WAS MOVED by Dr. Turner and seconded by Mr. Arnold that the Board approvesthe entering into the agreement with the Center for Advanced Technologies asproposed. MOTION CARRIED UNANIMOUSLY.
The Board received, reviewed, and discussed the objections filed in the Case 09-305-B. It was notedthat the Board had ruled on this case earlier in the board meeting.
11-046. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner that the Board hasdiscussed the objections filed and overrules the respondent's objections in Case 09-305-B. MOTION CARRIED 5-0 with Mr. Foust and Mr. Arkle recused.

No comments were received during the open forum portion of the meeting.
