TheBoardandstaffareproudtosharetheenclosedhighlightsfromaverybusy year. We are engaged in legal system’s change around the country, tack-lingthechallengesofcomplexcoordinationeffortsthatenablecommunitiestosucceedinprotectingvictimsofintimatepartnerviolenceanddeterringfurtherviolencebyoffenders.

As we work with jurisdictions around the country, we draw energy and in-spirationfromthemanyoverburdenedpractitionersonthefrontlineswhonever-theless take time to step back and ask how the system could better serve victims andtheirfamilies.Engagingwiththesecommittedprofessionalsmakesourdayschallenging, but so rewarding.

Lastly,thisyearBWJPreceivedfinancialsupportfromanincreasingnum-berofindividualdonorsacrossthecountry.Theprogressthatwe’vebeenableto achieve this year would not have been possible without them—their trust in oureffortsisdeeplyappreciated.

Program Highlights

Improving Criminal JusticeResponses in Palm Beach County

In 2019, BWJP continued its partnership with the Criminal Justice Com-mission and Palm Beach County (FL) Victim Services to improve criminal jus-ticeresponsestoIntimatePartnerViolence(IPV).Thisworkfocusesonthreemajorcomponents:identifyingandfillinggapsintrainingonIPV,especiallyforlawenforcement;strengtheningPalmBeachCounty’sCoordinatedCommunityResponse;pilotingcontinuousassessmentofagencyandsystemresponsestoIPV.

BWJPstaffmade4visits toPalmBeachCounty in2019,meetingwithover 40 practitioners involved in responding to IPV to gain a comprehensive understandingofcountyservices.BWJPstaffrodealongwithpatrolofficers,ob-served 9-1-1 call takers and dispatchers, and attended criminal court hearings. BWJPstaffalsoheld 4 listening sessionswith 23 victims-survivors to gatherfirst-personexperiencesandinsightsintothesystem.InSeptember,BWJPpub-lishedaninterimreport.InOctober,BWJPfacilitatedaday-longtrainingforlawenforcementonreportwritingandpresentedaprogressreporttotheCriminalJusticeCouncil,whichincludedanassessmentoftwolawenforcementagen-cies’ response to intimate partner violence as measured against their own poli-cies as well as national best practices.

In 2020, a comprehensive report will integrate the experiences of vic-tim-survivorsandin-depthassessmentofpoliciesandpracticesinlawenforce-ment departments which have partnered with the project. This report will be pub-lishedandpresentedinthefirsthalfoftheyear,withworkongoingtorelaunchastrengthened Coordinated Community Response in Palm Beach County.

A Focus on Enforcement of Tribal Protection Orders

Thelackofenforcementoftribalprotectionorderscontinuestoremainanissue across the United States. To address this priority, the National Center on Protection Orders and Full Faith and Credit (NCPOFFC) continues to work on a widevarietyofassignmentsincooperationwithIndiantribesandNativeAlaskaVillages. An Alaska Native Village Protection Order Module was developed, cov-eringdiscipline-specifictopicsaswellastheexpansionoftheTribalProtectionOrderChecklistscreatedwiththeTribalLawandPolicyInstitute.StaffhadtheopportunitytotrainoverthecourseofaweekattheNationalTribalTrialCollegehosted by the Southwest Center on Law and Policy, which was held at the Uni-versityofWisconsinLawSchool.Staffcontinue toplan informationgatheringcallswith tribal leaders and innovators to informNCPOFFC’swork in IndianCountry.

NCPOFFCprovidedsignificantsite-specific technicalassistanceon thisissueinOregonthisyear.AttherequestofJeffersonCounty,OR,staffworkedtorevisetheprotectionordersystemtoallowforseamlessenforcementoftrib-alprotectionordersbyaffordingthemfull faithandcreditandensureentryoftribalprotectionordersintothestateandnationalregistries.Afterconductinganinitialwebinaronenforcement issues,NCPOFFCstafftraveledtothestateinAugust2019tobeginworkwiththeOregonDepartmentofJusticeandtheAttor-

neyGeneral’sOfficeonre-vising the state statutes to address tribal protection orders and on drafting anAttorney General Opinion on tribal protection orders. Site specific work contin-ueswithJeffersonCountyto ensure that the issues raised are corrected to al-lowfortribalprotectionor-derenforcement.

This year brought considerable development in our partnership with the NationalNetworkforSafeCommunities(NNSC)toimplementtheIntimatePart-ner Violence Intervention (IPVI) in three communities across the country. A grant fromtheOfficeonViolenceAgainstWomenfundstheseeffortsinMadisonCoun-ty,Illinois,DutchessCounty,NewYork,andthe8thPrecinctofDetroit,Michigan

InitiallydevelopedbytheNationalNetworkforSafeCommunities(NNSC)andthecommunityofHighPoint,NorthCarolina,IPVIisanoffender-focused,victim-centered approach that addresses the most serious violence against in-timatepartners.Thestrategyaimstoreduceharmtovictims;interveneearlyincyclesofvictimization;andshifttheburdenofpreventingfurtherviolencefromvictimstoapartnershipofcriminaljusticeactors,advocates,serviceproviders,

andcommunityfigures.ResearchonIPVandandintimatepartnerhomicideshasdemonstrated twoclearfindings:1) themostdangerous IPV tends tobedrivenby“chronic”offenderswhoalsocommitawidevarietyofcrimes;and,2)IPVoffenderswhodonotfitthisprofilecanbedeterredbyrelativelylow-levelsanctionsandcommunitysupportforchangeifreachedearlyintheirpatternofoffending.

Usinglawenforcementdataandcommunityknowledge,IPVoffendersareidentifiedandarrangedintoahierarchybasedontheirhistoriesofIPVoffend-ing.Eachlevelofoffendingbringsaspecific,differentiatedresponse—tovictimsandoffenders—byapartnershipoflawenforcement,advocatesandcommunityrepresentatives.

Identifyingboth“chronic”and“serious”offenders,theIPVIstructureisde-signedtoaddressallIPVoffendersknowntothecriminaljusticesystem,withafocusonthemostvulnerablevictimsharmedbythemostdangerousoffend-ers;makeitcleartolow-leveloffendersthatIPVwillnotbetolerated;andtakespecial,escalatingaction todeterandutilize fullenforcementactionsagainstoffenderswhoarenotdeterredbylowerlevelsanctions.Aparallelresponsetovictims also escalates the outreach and support to enable victims to take action safelyagainstthelevelofcoercivecontrolandviolencedirectedatthem.

Aswemoveinto2020,allthreesiteswillbegintheimplementationofre-sponsestoidentified“A”and“B”leveloffenders,maintaincontactwithvictimsandadvocatestoensurethatvictimsafetyisnotcompromisedbytheseefforts,anddeveloprelationshipswithfederalpartnerstoassistinenforcementeffortsas needed.

Effective Implementation of Firearms Prohibitions

BWJP’s National Resource Center on Domestic Violence and Firearms (NRCDVF) provided inten-sive technical assistance to several jurisdictions in 2019, guiding the de-velopmentofprotocolsinthosejuris-dictions to better enforce domesticviolence-relatedfirearmprohibitions.Staffworkedcloselywithcourts,lawenforcementandother legalsystempractitioners in places such as Albu-querque,NM;Albany,NY;Nashville,TN; as well as both Hennepin andRamsey counties in Minnesota.

Forexample,RamseyCountyembarkedonanefforttodevelopfirearmsurrenderprotocolsincivilprotectionordercasesusingitsexistingBlueprintforSafetycommittee.ThroughitspriorBlueprintwork,thecommitteehasexperi-enceconveningfocusgroups,mappingsystemprocessesandidentifyingsafety“gaps”fromamulti-disciplinaryperspective.DaveKeck,NRCDVFDirector,andAlicia Nichols, NRCDVF Deputy Director, assisted the Blueprint committee in applyingthosesameskillsto identifyingbetterprotocolsfor:1) identifyingtheuseandpresenceoffirearmsindomesticviolence-relatedcases;2)determiningwhethertherespondentisaprohibitedpersonunderstateand/orfederallaw;3)effectivelyandlawfullyorderingthesurrenderofanyfirearmspossessedbytherespondent;and4)monitoringcompliancewiththesurrenderorderandimpos-ingconsequencesfornoncompliance.

Inaddition to these longer-termconsultations,NRCDVFstaffhavepre-sentedatanumberofnationalconferencesthispastyear,aswellaslocalandregional trainings, reachingwell over a thousand individuals.Staff have alsopublishedseveralarticlesinavarietyofpublications.

Mary Byron Project Honors SAFeR with Celebrating Solutions Award

We are very proud that BWJP’s SAFeR Project received a Celebrating SolutionsAwardfromtheMaryByronProjectforourworkonimprovingcustodydecisions in cases involving intimate partner violence.

SAFeRconsistsofafour-partconceptualframework—andanumberofpracticeaids—tohelppartiesandpractitionersgather,synthesizeandanalyzecriticalin-formationaboutthecontextandimplicationsofintimatepartnerviolenceinordertoimproveinformeddecision-makingacrossdisciplinesandcourtsettings.TheSAFeRconceptualframeworkservesasroadmapforinformeddecision-makingforanyoneandeveryoneinvolvedinthesecases.Itworksforparties,advocatesandpractitionersofeveryvariety.

SAFeRisdesignedtoachievebetteroutcomesforparentsandchildrenwhilere-spectingandprotectingthedueprocessrightsofpeopleaccusedofIPV.SAFeR encouragesinstitutionalpractitionerstosystematically:(1)screenforIPVinev-erycase;(2)assessthefullnatureandcontextofanyabusedetected;(3)focusonthereal-lifeeffectsofIPV,especiallyonchildren;and(4)respondinwaysthataccountforthoserealities.

As JudgeMaureenMcKnight—aprincipal judge from theMultnomahCountyFamily Court—put it:

“With the SAFeR approach and its related materials and trainings, BWJP has given the field exactly what it needs to respond effectively to child custody and visitation cases.”

SAFeR guides the family court system to produce safer,moreworkable out-comesforbatteredparentsandchildren.Itisnowfullydeveloped,widelyen-dorsed,andreadytorolloutmoregloballytothefield.
