OBJECTIVE
•To give the Institute of Waste Management “IWM” progress on permitting in terms of s.20 of the ECA as amended since the transfer of the function from DWAF to DEAT on the 3rd of January 2006• To outline the current permitting process.•To discuss the best way forward

BACKGROUND• ECA amendment and the transfer of landfill
permitting function under s.20 of ECA from DWAF to DEAT on 3 Jan 2006
• Outline of Draft MoA between DWAF to DEAT (See slide 6)
• DEAT’s capacity for the landfill permitting function under s.20 of ECA - DEAT established a new sub-directorate for landfill
permitting in 2005- Additional capacity created in 2006 with establishment
of new directorate dedicated to waste authorisations and disposal management

PERMITTING PROCEDUREThe Applicant:1. Fills in Application Form
S.20 App. Form 2. Sends 3 sets of App. form and
supporting docs (EIS, EMP, Maps, studies pertaining to activity, etc ) to Director: Authorisation & Waste Disposal
3. Uses checklist to ensure completeness of documentation

PERMITTING PROCEDUREThe DEAT:1. Checks for completeness of application
documentation within 14 days 2. Acknowledges receipt for all
applications within 14 days3. If Application is incomplete the
acknowledgement letter notifies the applicant about missing information
4. If Complete, 2 sets are sent to DWAFoutline of the Draft MoA B/t DEAT & DWAF

PERMITTING PROCEDURETHE DWAF:• Sends App to relevant province• 2-6 months later Draft ROD from
Province received• Final RoD compiled by DWAF Pretoria• DWAF ROD sent to DEAT - DWAF
informs DEAT if Draft Permit must come back for review
THE DEAT:• DEAT compiles Draft Permit - 8 Review
& 1 Approval steps - whole process takes 6 weeks

Towards a more Speedy Permitting Process:
• Provinces already assigned functions relating to waste disposal management under s.24 of ECA
• Waste disposal permitting function will be assigned to Provinces (this is consistent with the EIA process already being undertaken by Provinces)
• DEAT will retain permitting of hazardous waste sites in line with EIA Regulations
• DEAT will provide support to Provinces for the development of provincial capacity for landfill permitting function
