Young Municipal Activity Center 13th Floor Detroit, Michigan 48226 Subject: Quarterly Report, Detroit Land Bank Authority Dear Council President Jones: On behalf of the Detroit Land Bank Authority (DLBA), I am pleased to submit this report of activities for the most recent three month period. The quarterly report is submitted pursuant to the Land Transfer Agreement between the City of Detroit and the Detroit Land Bank Authority as adopted by the Detroit City Council on April 15, 2014. While much work remains to be done, the DLBA takes pride in its accomplishments over the past three months. Those accomplishments are detailed in the following pages and include:

Hiring a strong professional staff to implement the goal of eliminating blighted residential buildings and strengthening neighborhoods;

Expanding Hardest Hit Fund neighborhoods and strengthening the pipeline demolition of blighted properties within HHF areas;

Launching and branding the www.buildingdetroit.org web site for the successful auction of DLBA-owned houses;

Registering more than 6500 interested bidders on the DLBA auction site;

Selling more than $1 million worth of DLBA owned houses;

Hosting 15 open houses in which more than 2700 persons expressed interest in buying a house in Detroit;

Launching a Nuisance Abatement Program which resulted in more than 200 homeowners agreed to either fix up their properties of forfeit them;

Exercising a Right of First Refusal with the Wayne County Treasurer over tax foreclosed properties so that they could be either auctioned and renovated or demolished;

Modernizing procedures and adopting best practices in the areas of sale, demolition, and use of demolished properties; and

Adopting a realistic yet aggressive budget that calls for the on-time spending of all funds allocated under the Hardest Hit Fund program, the auction of repairable homes, and elimination of blight through the Nuisance Abatement Program.

The Detroit Land Bank Authority is especially grateful to the Detroit City Council for the unprecedented confidence and trust the Council has placed in the DLBA, particularly by its willingness to entrust the DLBA with over 16000 abandoned homes for demolition and disposition. The DLBA is stronger and more able to serve its mission of repurposing abandoned properties in Detroit as a result of this relationship, and looks for that relationship to strengthen and mature through its continued consultation with the Council.

The Disposition program within the Detroit Land Bank Authority (DLBA) was established

in February, 2014 with the hiring of Deputy Director, Dekonti Mends-Cole to lead the

program. The program consists of Home Auctions, Side Lot Sales, and the acquisition

of occupied properties. Previously, the program served solely as disposition of

rehabbed properties under the Neighborhood Stabilization Program.

Staff

Dekonti Mends-Cole serves as Deputy Director of the DLBA and directs the

disposition program. She formerly worked on restructuring efforts under the Strong

Cities Strong Communities program. Her background includes working on

community and economic development projects in the Middle East and Africa for the

United Nations and advising UK local and national governments, including the

London Olympic Legacy projects.

The Disposition team consists of highly-skilled staff members with backgrounds in

running CDCs, management of HUD programs, managing large scale economic

development, GIS and data, marketing, clearing title, and closing. There are ten full-

time staff members and 16 part-time contractors: Darnell Adams; Mary Beth

Baumeister; Dave Brown; Richard Cannon; Darryl Earl; Tatiana Grant; Gina Jackson;

Juanita Jones; Rob Linn; Dana Politi; Kevin Robishaw; and Rob Saxon.

Job Fair

On May 30, the Land Bank held a job fair at the University of Detroit Mercy’s law

school, which was generously hosted the event. Over 40 part-time positions serving

as hosts for the BuildingDetroit.org open houses and 4 full-time jobs were advertised

to Detroit residents. The Job Fair was promoted through several channels including

Detroit Employment Solutions, who conducted pre-qualification surveys. Over 250

applicants attended the job fair where the DLBA received several highly qualified and

abled Detroit applicants. The first group of enthusiastic and high caliber

professionals have been hired. The DLBA has brought on 15 Detroit residents, and

one is a veteran.

Auction Programs

On May 5th, the Disposition team rolled out the BuildingDetroit.org auction with huge

success. The auction sells two vacant homes a day that are in need of rehabilitation.

With the theme “Neighbors Wanted” the DLBA has structured the auction program to

encourage responsible investment that will rapidly change the landscape of our

neighborhoods. All successful bidders are required to bring the property up to code

and occupied within six months (nine months for historic properties). Eligibility to

participate is restricted to individuals who are Michigan residents, Michigan

incorporated businesses and non-residents who intend to occupy the property.

Additionally, individuals with any material blight violations or delinquent property

taxes are not eligible to win the properties.

Within the first two weeks over 5,000 people registered to bid and more than 1,050

attended the first open house in East English Village. The DLBA is extremely grateful

to the Detroit City Council for their support in launching this initiative.

The open houses serve as a community building tool and is co-organized with

residents who sell the neighborhoods through volunteering as hosts and tour guides.

The home tours are festive events in which vendors such as financial institutions,

contractors, Detroit Historic Commission (in Historic Districts) attend to attract

customers and inform potential buyers. Bus tours are also available for individuals

who want to see all the homes.

Sales

Within 50 days of launching, the auction has generated $1,000,000 of purchase

commitments. It has dispelled many myths of the strength within the Detroit housing

market. Our highest sale is $97,000 in Boston Edison, followed by $87,000 in

Woodbridge, and $62,000 in Islandview.

Bidder Statistics

Of 6,785 registered bidders, 2,962 have a Detroit address. Attached is a heat map of the initial set of bidders (first 5,000).

There are currently 61 houses that we have investor or non-investor homebuyer information for. Out of the 61, 23 are investors (38%) and 38 are non-investor homebuyers (62%).

Of the 61, there are currently 19 non-investor homebuyers outside of Detroit (31%) and 17 investors outside of Detroit (28%).

Rehab Financing

A key component to encouraging investment in auction properties is through making

rehab dollars available to auction winners. The DLBA is working with Chase and

Talmer Banks to provide loan options and low cost rehab financing to owner-

occupant bidders. Talmer Bank has offered to provide $1,000,000 in $25,000

forgivable loans that will “burn-off” at a rate $5,000 dollars a year for 5 years as long

as the owner stays in the property.

Nonprofit, Faith, and Community Organization Policy

The DLBA has finalized, with City Council, the nonprofit, faith- and community based

bulk disposition program. Similarly, the DLBA is working with Community

Development Financial Institutions (CDFI) and financial institutions who are

interested in providing low cost financing to these groups.

Acquired Occupied Policies

One of the first policies passed by the new Board is the acquired occupied properties.

The DLBA is working with Enterprise Community Partners to identify skilled providers

to ensure that once legal owner occupants or tenants stay in the City.

Side Lot Program

The side lot sale will launch in July 2014. Side-lot properties in the Hardest Hit Fund

(HHF) areas will be sold for $100 each. There are currently 254 properties that will

be sold in batches to maintain a smooth flow of property sales during this trial period.

The current buildingdetroit.org website will be edited to add a function for interested

buyers to submit their application and payment. Deeds will be available for pickup in

the seven District Managers offices.

Introduction

The Nuisance Abatement Program (NAP) within the Detroit Land Bank Authority (DLBA) was established in February, 2014. The Detroit City Council delegated non-exclusive authority to commence Nuisance Abatement litigation on February 18, 2014 (Council Action Number 23).

Staff

Kevin Simowski serves as General Counsel to the DLBA and directs the Nuisance Abatement Program. He is a former Wayne County Assistant Prosecutor and Assistant Attorney General, and as Assistant Prosecutor ran the Nuisance Abatement Program for Prosecutor Michael Duggan in 2001-2002. Kimberly Homan serves as Deputy Counsel, She formerly worked on the Nuisance Abatement Program under Prosecutor Duggan and most recently served as Executive Director of the Michigan Land Bank Authority, The NAP legal staff consists of seven (7) attorneys (Simowski, Homan, Marcel, Hurt, Mojisola Clement, Jelani Karamoko, Rebecca Camargo, and Stephen Shollack). It also consists of three (3) paralegals (Tanya Lamar-McDonald, Rodney Wilson, and Melissa Vela), two (2) GIS/data specialists (Michelle Simon and David Mieksztyn), and two (2) administrative assistants (Samantha Russ and Nettie Bender-Wright). Additionally, Don Cox serves as Manager of Investigations and four investigators (Miguel Bruce, Herb Alexander, Steve Mason, and John Henry Davis)) are employed on a contract basis. The investigators post the initial notices on NAP target properties, post official court notices on specific properties, and provide support for the DLBA auction open houses, the demolition program, the property acquisition program and other assignments on an as needed basis.

During the spring and summer of 2014 the NAP program participated in an internship program with local law schools and also engaged undergraduates into the program. The internship program has proven to be an invaluable educational experience for the participants and also proved to be extremely beneficial to the NAP program. Interns participated in a variety of tasks including: charting the major commercial corridors in the City for potential NAP enforcement, preparing for the launch of the Drug House program by gathering data from the Detroit Police Department and research, review of the NSP program and research of title issues, participating in website redesign, preparing complaints and other court pleadings, attending court hearings and undertaking an examination and resign of the entire NAP process flow.

Nuisance/Abandoned Properties

Properties that meet the criteria are: boarded, open to trespass, clearly abandoned or neglected, and all must be unoccupied. The property addresses are initially identified

through governmental data, and then verified by investigators, community groups, or neighbors, in targeted geographic areas. The NAP Target Areas were defined by the City of Detroit Department of Neighborhoods with input from members of the community. Specific boundaries were determined with the use of data sources to specify areas where NAP action would be most effective. The first round of the NAP target areas, with boundaries, Council Districts and number of properties that were “postered” are listed below:

Agreement

Notices are placed on targeted properties with instructions that owners/interested parties are to call the NAP hotline (313-628-1180) within 72 hours. Owners of these properties that call are advised of their options:

Enter into an agreement to rehabilitate the property

Enter into an agreement to demolish the property (if needed)

Enter into an agreement to donate the property, or

A complaint will be filed by NAP with the Court

Initial discussions are had with a NAP staff member. Agreements or situations that are more complex are directed to a NAP attorney. One of the goals of the NAP program is to hold property owners accountable and require them to render the property fit for occupancy. Property owners must provide proof of actual occupancy or, at a minimum, a certificate of occupancy within 180 days. As of June 20, 2014 there were 101 agreements reached with property owners to rehab their properties to make them fit for occupancy.

Civil Litigation

Service of Process is made on all parties of interest. A search of tax and title records, to determine all interest holders of record for each property; including owners, mortgage companies and any other liens is conducted. All interest holders of record are named in the civil lawsuit, which requests that the ‘nuisance’ created by the condition be abated. All named parties are served with the pleadings (Complaint and ex parte orders), as required by the Michigan Court Rules and a special Docket Directive created by the Chief Judge of Wayne County Circuit Court. The goal of the program is for the owners to sign an agreement to rehabilitate the property according to specific requirements and deadlines. Those owners that refuse to sign such an agreement, or those that fail to comply with the agreement, are required to appear in Circuit Court and to explain to the Judge their reasons for failing to comply.

Owners or interest holders in property who fail to respond to the lawsuit may lose their ownership rights to the property at a hearing for default judgment. Upon reviewing completed proofs of service, the Court is asked to transfer title of the nuisance property to the County for failure by the owner to appear and resolve the nuisance condition or activity.

As of June 20, 2014 the NAP program has received 19 (out of 19) default Judgments.

Consequences for Failure to Comply With Executed Agreement

If the owner fails to meet specified deadlines for rehabilitation the owners must appear before the Court at a hearing to show cause why they failed to comply with their agreement. The Judge has the authority to transfer title to the property in situations of blatant violation of the agreement. The transfer of title enables the program to cover the costs of abating the nuisance, and to convey the properties to good faith owners who sign agreements to completely rehabilitate and occupy the premises within six months. The progress of the buyers is closely monitored, similarly to the agreements signed by property owners who were named in the lawsuits.

NAP Database

A critical aspect of the program is a unique parcel database that keeps specific data on property addresses, owners and their mailing addresses, the dates and types of service of process on each party, and the entire legal process including scheduled court hearings. The database also tracks the owners’ compliance with the agreements to rehabilitate the properties.

Drug Houses

On July 1, 2014 the NAP program expanded to include properties that are a nuisance due to illegal drug activity. When a search warrant is executed and drugs are found in the premises that information is forwarded to the NAP program. A warning letter is sent to the owner of the property after the first search warrant (to negate the ‘innocent owner’ defense); if a second warrant finds drugs, a case is filed using the same procedures as used for abandoned properties.

Wayne County Treasurer Right of First Refusal Properties

The Detroit Land Bank had discovered a problem during the nuisance abatement litigation process in the targeted neighborhoods: approximately 17% of the nuisance properties are currently owned by the Wayne County Treasurer. The Treasurer had taken title and intended to sell them in the tax auctions in late 2014. In other words, 1 out of every 6 vacant houses would be sitting in a legal limbo with no action being taken against these nuisance properties. The DLBA has worked out a solution with the Treasurer. The Treasurer is willing to turn over the properties in our litigation-targeted areas. We’ve agreed to demolish the houses that can’t be saved, auction the ones we can sell, and turn the net proceeds over to the Treasurer as tax payments. This will allow the Land Bank to

move immediately to remove the nuisance and will allow the Treasurer to collect everything practical in back taxes. The DLBA has sought and received the support of Detroit City Council. The Council had approved a resolution on June 24, 2014 (Item number 30) supporting the use by the Detroit Land Bank of the City’s right to purchase tax foreclosed property from the Wayne County Treasurer prior to the auction and have the properties transferred directly to the Detroit Land Bank. The Detroit Land Bank will assume financial responsibility for the property’s acquisition cost as well as any liability for the property’s demolition, maintenance, or resale. That resolution related to 143 properties foreclosed by the Wayne County Treasurer in areas of the City where the Detroit Land Bank is filing nuisance abatement lawsuits. The Detroit Land Bank has sent a list to the Wayne County Treasurer on June 27, 2014 that includes 91 unoccupied and non-commercial properties from the original list listed below:

Introduction

Carrie Lewand-Monroe directs the effort to implement the Hardest Hit Fund (HHF)

demolition program. An attorney, Lewand-Monroe is the former Executive Director of

the Michigan Land Bank (2007-2010) and most recently served as Director of Policy of

Detroit Future City.

Her efforts are augmented by the following staff:

Currently, almost all funds allocated to the DLBA for demolition purposes are provided

through the Hardest Hit Fund program.

Background

In February 2010, the U.S. Department of Treasury (“Treasury”) created the Hardest

Hit Fund (“HHF”) to provide assistance to homeowners in 18 states that were most

affected by the mortgage foreclosure crisis. In 2014, the State of Michigan petitioned

the U.S. Department of Treasury to use $100 million of the funds to reduce blight

through demolition activities in the State’s most distressed cities. The petition was

successful and in July 2013 the State of Michigan, through the Michigan State Housing

Development Authority (MSHDA) awarded the Detroit Land Bank Authority $52.3

million in demolition funds.

Because the funds were repurposed from Treasury’s mortgage foreclosure assistance

program, a number of restrictions apply to the funding. First, the money can only be

used to demolish residential structures of less than four units, and not commercial or

industrial structures.

Second, demolition activities have to be targeted in the City’s strongest housing

markets – the areas in which demolition can have the greatest positive impact on

surrounding home values.

Third, ownership is required before demolition can occur. The properties cannot simply

be publicly owned, they must be owned by the entity conducting the demolition activity

– the in this case by the DLBA.

In the early stages of the HHF Demolition Program, the DLBA found that it held title to

less than 700 blighted properties within the HHF Target Areas. The program was in

crisis and the City was in jeopardy of returning the funds to the Department of Treasury.

Then in April, 2014 two events occurred.

First, the Detroit City Council allowed for the transfer of an estimated 16,000 residential

structures to the Detroit Land Bank Authority.

Second, with the approval of the Michigan State Housing Development Authority, the

DLBA expanded the HHF Target Areas to include additional demolition locations within

all 7 Council Districts. These two actions paved the way to allow the DLBA to take

dramatic steps towards reducing blight in some of the City’s strongest neighborhoods.

The average cost of demolition including asbestos abatement is $11,563

Based on the average cost of demolition, the DLBA expects to be able to

demolish 3800 blighted structures

The DLBA currently has 3090 properties under contract for demolition or

asbestos survey

800 demolitions are predicted for July

1200 demolitions are expected in August

MSHDA requires that 70% of the HHF Funds must be spent by the DLBA by October

1, 2014. The number of contractors available to provide demolition related services in

the City was not adequate to maintain the pace required to complete demolition on the

schedule required. Therefore, the Detroit Land Bank Authority entered into a Unit Price

Contract with 3 demolition companies to each knock down 400 properties a month. In

total, the DLBA has contracted for a total of $15,990,334 of which, $9,449,426 is being

spent with Detroit companies.

General Considerations

From its inception, finances for the Detroit Land Bank Authority (DLBA) has been managed by an external accounting and financing firm, Corporate FACTS, which also handled Human Resource functions. The 500% increase in funding as a result of the Hardest Hit Fund program, grants, and proceeds from a highly successful auction has prompted the DLBA to build internal capacity, primarily in the most recent quarter, in the areas of finance, operations, and human resources.

In February, the DLBA hired Michelle Story-Stewart, Ph.D., to serve as its Chief Financial Officer, and to consolidate Finance and Human Resource functions within the DLBA. Ms. Story-Stewart is the former Director of Operations and Finance of the Detroit office of the Local Initiatives Support Corporation (LISC). Her efforts are currently supported by the following personnel:

Accounting/Finance: Alicia Moore (Controller)

Operations: David Bernard (Operations Manager)

Human Resources: Cynthia Thomas (Human Resources Manager)

The internal consolidation will result in increased efficiencies and overall savings for the DLBA, including savings based on prompt payment to contractors

Revenues

The Detroit Land Bank Authority currently has projected revenues of $44.1 million for the 2014-15 fiscal year (July 1 – June 30th). Government grants total approximately $41.3 million, which includes $39.8 million in the form of a reimbursement-based grant. The reimbursement grant is paid through Michigan State Housing Development Authority for demolition costs funded by the U.S. Treasury’s Hardest Hit Fund Blight Elimination (HHF) Program.

As the Hardest Hit Fund Program is a reimbursement-based program, the DLBA has obtained a line of credit from the Detroit Development Fund in the amount of $3.5MM. The line of credit will ensure that contractors, and particularly small contractors, will receive payment from the DLBA within 30 days, thereby eliminating cash flow problems on their part and reducing costs based on carrying charges to the DLBA.

Approximately $1.5MM and $2.3MM of the HHF funds will be used to pay administrative and property maintenance expenses, respectively, with the remaining funds used for demolition costs. The remaining $1.5MM of government grants is from the City of Detroit for operating expenses.

Private grant revenues total just over $350,000 and represents revenues from the Kresge ($187,500) and Ford ($166,667) Foundations.

Sales revenues, primarily from the auction of DLBA-owned properties, and other revenue, including donations, are projected to be $50,000.

Expenses

The DLBA 2014-15 operating budget is projected at just over $56 million, more than ¾ of which will be paid for demolition services.

Additionally, Salaries and Benefits for thirty-five employees total $2.7 million. Rent, utilities, and maintenance are expected to be just under $2 million, while Administrative expenses are estimated at $1.8 million.

Some key administrative expenses include: $400,000 for advertising and marketing (primarily for the DLBA auction), $115,000 for Motor City Mapping and other software costs, and $800,000 for court costs, filing, seizure, and process serving fees for the Nuisance Abatement Program.

Professional services are projected to be just under $1.5 million. This includes $180,000 in legal expenses, nearly $170,000 for the Policy/Engagement Director and the Communications Manager, just under $200,000 for Demolitions Managers/Inspectors, and $100,000 for maintenance of the Motor City Mapping database.

Finally, the DLBA’s Program Expenses are projected to be approximately $50 million. Property acquisitions and other expenses related to the auction total $4.2 million. Demolition costs are estimated to be $45.8 million.

The Detroit Land Bank Community Development Corporation

The DLBA has a 501c3 tax-exempt subsidiary entity called the Detroit Land Bank Community Development Corporation (CDC). It was set up to accept donations, grants, and other similar funds from foundations and other entities looking to contribute funds to a tax exempt non-for-profit for either tax or their own internal purposes. The DLBA needs a major capacity enhancement to help build its long-term

sustainability in order to carry out its near-term functions responsibly and reliably. The

Detroit Land Bank CDC received $1.2MM of a $5MM commitment from the JPMorgan

Chase Foundation in May 2014 in support of financial infrastructure and organizational

capacity building for the DLBA. The remaining funds will be deposited annually over

the next four years to the Detroit Land Bank CDC for the DLBA’s use. The DLBA will

use the funds to build the capacity to coordinate with government and quickly and

efficiently transfer viable properties into responsible private hands, while also

maintaining blighted and dangerous properties in the City’s more distressed areas.

Funding Outlook

Over time, the DLBA plans to refine and improve its disposition policies so that it can attain a reasonable return to fund its operations. The DLBA anticipates a continued inflow of new properties, both from the tax foreclosure and nuisance abatement programs, and since these properties will no longer be allowed to sit abandoned for a long period of time, they will produce a greater return.

Another planned revenue source is tax recapture from properties sold by the land bank to individual or other non-governmental entities. Under this provision, the DLBA will be able to collect fifty percent of real estate taxes for five years on each property sold. The DLBA will then recalibrate its demolition and other activities to live within its budget, which will likely be made up of its own revenues, city, state and federal funding and charitable support. The DLBA will be able to better project these revenues after its business planning process is complete.

The DLBA is also optimistic about additional revenue sources, particularly in the area of demolition activities, once the original Hardest Hit Fund Area funding is spent – and spent on time.

Statement of Financial Position (Balance Sheet) as of May 31, 2014

The DLBA’s cash balance was $1.1 million at the end of May 2014, a decrease of $419,000 from

the previous month. NSP3 bank deposits were $173,000 and auction deposits were $36,000.

Disbursements were $101,000 for NSP3; $91,000 for auction program; and $440,000 for

operating expenses. Accounts receivable totals $1.1 million comprised mainly of $200,000 owed

from the City of Detroit for NSP1; $333,000 from the City of Detroit for NSP3; $80,000 for a land

contract mortgage; and $465,000 from MSHDA for the Hardest Hit Blight Elimination program.

The DLBA properties are valued at $8.3 million. The DLBA received a transfer of approximately

3,300 properties from the City. Book value is about $1.4 million. Other assets include $87,000

(net of depreciation) for furniture and equipment. Additional computers and software were

purchased in May.

Accounts payable totaled $142,000, which represents payments due for property related costs

and other administrative expenses. The $1.9 million in deferred revenue represents the balance

of the city of Detroit operating grant as shown below, along with the grant from Kresge. Unearned

revenues, which reflects expenses for NSP1 related properties expected to be reimbursed from

NSP1 program income generated from home sales subject to approval by the City of Detroit, is

at $200,000. As a reminder, if the City of Detroit does not approve use of program income, the

$200,000 represents unfunded expenses.

Statement of Financial Activities (Profit & Loss) for the period ended May 31, 2014

Revenue for May is $196,000 for Hardest Hit; and $488,000 from deferred revenue to cover operating expenses. The DLBA has used $1,356,216 of the $1.5 million City of Detroit operating support grant.

Staff

In February, Michael Brady joined the staff of the DLBA. As Director of Policy and

Community Engagement, Brady is charged with reviewing and developing “best

practices” in policy areas, and implementing a community engagement strategy.

Brady joined the DLBA after serving in a senior advisory position with the Center for

Community Progress as their national Vice President of Policy. In June, Charity Dean

joined the division as Deputy.

Policy

The DLBA has been very active in policy development this quarter, enacting

important policies such as: (1) a property auction policy, (2) a side lot sales policy, (3)

an occupied properties policy, (4) a nonprofit faith based organization policy, and (5)

a clean and green policy. PDFs of all of these policies are attached for your review.

Additionally, here is a brief summary and breakdown of each of these policies:

1. Property Auction Policy. This policy provides the guidelines and parameters for the Building Detroit auction website.

2. Side Lot Sales Policy. The Side Lot Sales policy lays out the preferred process for selling side lots to adjoining property owners. In brief, an interested party needs to show ID and prove that they own the property next door, are current on their taxes, and pay $100.

3. Occupied Property Policy. The Occupied Property policy provides a preference for selling property to current occupants of the property so long as they are not there illegally. Common eligible examples include renters whose landlord has been foreclosed upon or former owners who have lost their property to foreclosure.

4. Nonprofit Faith Based Organization Policy. The Nonprofit Faith Based Organization policy creates a clear path for a nonprofit, faith-based or community development organization to become a ‘Community Partner’ of the DLBA. Additionally, this policy provides a preference for the sale of property to a Community Partner in the goal of stabilizing neighborhoods through increasing owner occupancy, removing blight, and undertaking redevelopment. The current version is attached, as is the version adopted on July 1, 2014 by the Detroit City Council for subsequent adoption by the DLBA.

5. Clean and Green Policy. The Clean and Green policy allows for the lease of DLBA property in exchange for its maintenance.

Community Engagement

Improving and expanding DLBA community engagement has been a high priority for

the new DLBA Board from its first meeting in January 2014. One of the board’s very

first acts was to create a Community Engagement Board Committee to elevate the

importance of this to all DLBA activities and policy. Additionally, a DLBA staff person

was immediately assigned to develop a community engagement strategy and begin

its implementation. The DLBA is undertaking ongoing community engagement

through a very close partnership and coordination with the Department of

Neighborhoods and the fourteen (14) District Managers located throughout the city. It

has also participated in community forums as requested by members of the Detroit

City Council. To this end, DLBA has presented at various public meetings and

forums, for neighborhoods, districts, and also city wide organizations. Brady was

recently a facilitator at the statewide Land Bank Summit.

Policy Regarding Disposition of Occupied Properties Acquired by DLBA

I. Objective:

The objective of the DLBA in the disposition of occupied residential properties is to give

existing residents the opportunity to purchase their own safe and affordable housing.

II. Qualified Occupants:

The DLBA shall require an occupant of acquired property to demonstrate the following:

1. Occupant currently resides in the property, has resided there for at least one

year, and has maintained the property to the best of his or her

ability.

2. Occupant was formerly the owner of the property and lost title through tax

or mortgage foreclosure; OR Occupant leased the property from a landlord that

lost title through tax or mortgage foreclosure; OR Occupant had permission of

the former owner to reside in the property prior to foreclosure. If Occupant

cannot meet any of the three tests listed above, the Occupant may offer any

other explanation of how he or she came to reside in the property, and the DLBA

may in its sole discretion decide whether or not this section has been

satisfied.

3. Neither Occupant, other residents, nor individuals frequenting the property are

under arraignment or have been convicted of any violent or drug-related

crimes.

4. Additionally, the Occupant shall apply to the Wayne County Tax Exempt

Program or enter into a Stipulated Tax Payment Agreement for future property

tax payments.

The DLBA will work with neighbors, community groups and block clubs to verify

documentation and evidence provided by Occupant and reserves the right to refuse sale

to an Occupant on the basis of evidence collected from these or other sources.

III. Property Inspection of Occupied Properties

The DLBA shall inspect each occupied property prior to agreeing to a sale under this

policy to ascertain whether the property is in compliance with the Detroit Building Code,

whether it meets minimum habitability standards, and if environmental remediation is

necessary.

If the property does not meet the Building Code, or there is an environmental problem

requiring remediation that does not cause an immediate health hazard to the residents

the Occupant will be required to remediate the property to resolve these issues within a

reasonable timeframe to be agreed with the DLBA and required to transfer documents.

If the property does not meet minimum habitability standards or if there is an

environmental problem that may cause an immediate health hazard to residents and that

cannot be remediated within a reasonable time frame, the property will not qualify for sale

under this policy. DLBA staff will work with other agencies to assist residents in locating

to other suitable housing.

IV. Sale of Properties to Occupants

If an Occupant qualifies under Section II and the property qualifies under Section III of

this policy, then the DLBA shall offer the property for sale. The price for each property

(“Established Sales Price”) will be established by staff in a consistent and transparent

process, based on an analysis of the Fair Market Value and comparable properties,

unless otherwise required by other (e.g. federal or state) program requirements and

except in Hardship Cases as set forth below.

The transfer documents will require that for a period of five years, the Occupant: (1)

complete any remediation required within the time agreed with the DLBA, (2) continue

to occupy the property (the occupant or members of the occupant’s immediate family),

(3) maintain the property in reasonable condition, (4) keep the property free of charges

that it was the site of violent or drug-related crimes, and (5) pay property taxes on time.

If the Occupant fails to meet any of these requirements, the DLBA shall have the right to

initiate court proceedings to regain title to the property.

V. Purchase by Land Contract

If Occupant is unable to obtain financing after approaching at least two lenders, and

provide(s) copies of their denial letters, Occupant may qualify to purchase the property

under a Land Contract with the DLBA. The maximum term of a Land Contract shall be 5

years so as to give an opportunity for Occupant to: complete homebuyer, budget and

credit counseling and homeownership training; reduce overall debt; establish regular

payment history; and apply for a private mortgage loan to re-finance the Land Contract

debt before the end of the 5 year term. The amortization term shall be adjusted so as to

keep the monthly PITI payments less than 30% of total monthly income.

VI. Hardship Cases

In certain hardship cases in which the Occupant and the property would otherwise meet

the standards of this policy, the DLBA may consider selling property at below the

Established Sales Price to an Occupant who does not have sufficient income to purchase

the property at the full price. Priority consideration shall be given to the following

household types:

1. Households with incomes at or below Federal Poverty Level Income

Guidelines adjusted for household size.

2. Elderly persons on fixed income.

3. Head of household with permanent medical disability

4. Veterans

5. Single parent households

6. Other circumstances that the DLBA Board deems to be a Hardship Case

A sale to hardship applicants shall be approved by the DLBA Board of Directors on a

case by case basis.

VII. Release of Tax Recapture in Neighborhood Enterprise Zone

The Neighborhood Enterprise Zone initiative is a tax abatement program to retain

owners and incentivize new purchasers in designated areas of the City. In order to

ensure that purchasers retain the full benefit of this tax abatement program, the

Detroit Land Bank Authority will not seek the 5 year, 50% tax recapture for properties

sold in Neighborhood Enterprise Zones.

Clean & Green Program

I. Objective

The DLBA seeks to partner with residents, businesses and community organizations

to adopt a DLBA owned vacant lot and utilize it for the benefit of the community. The

Clean and Green Program will engage community members to identify productive

short-term uses for vacant lots, keep lots free of debris, ensure grass is mowed

regularly, and snow is removed from sidewalks.

II. Who Can Participate?

Any resident, business, neighbor, block club, church or other organization interested

in using and maintaining a vacant lot within their Council District is eligible to adopt a

lot from the DLBA.

III. Requirements for Program Participation

All program participants must execute a Clean and Green program agreement to

maintain the identified lot(s) for at least one year. Program participants must agree to

sign a waiver of liability releasing the DLBA from any liability associated with the

Program Participant’s use of the property, and perform the following tasks

throughout the term of the program agreement:

A. Conduct at least two annual clean-ups and keep lot(s) free of debris.

B. Mow lawn regularly to ensure that grass does not grow more than 4” high.

C. Remove snow from sidewalks adjacent to the street frontage

D. Projects must be consistent with all approved land use policies including

zoning ordinance and Urban Agriculture rules as may be applicable for the project.

IV. Allowable uses for Program Participants

Program participants may use lot(s) for the following purposes, if the proposed use is

permissible by local zoning ordinance and Urban Agriculture rules:

A. Installing a sign that identifies Adopt-A-Lot participants

B. Gardening

C. Planting flowers or trees

D. Passive uses such as picnic tables, benches, etc.

E. Installing a fence

F. Other proposed uses as may be approved by the DLBA

V. Maintenance Stipends

The DLBA may provide maintenance stipends to Program Participants that adopt

10 or more lots, as funding is available to the DLBA. Stipend amounts shall be

established annually by the DLBA and shall cover lot maintenance activities for a full

year. It is expected that the stipend will not cover the full maintenance cost, and that

Program Participants will obtain other financial and human resources, as needed, to

maintain the lots as agreed.

Program Participants must have demonstrated capacity to apply for a Maintenance

Stipend.

VI. Renewal of Lease

The Clean and Green leases will be reviewed annually and renewed based on the

upkeep and maintenance of the lot(s).

Policies Governing Property Disposition by Auction

I. Objective:

The purpose of the auction is to sell identified properties for rehabilitation to bidders

that can demonstrate a clear intent and ability to undertake the appropriate

renovation.

II. Eligible Properties

The DLBA will select properties that it owns to include in the auction based on (1)

their current condition and potential for rehabilitation and renovation, and (2) their

intended use and purpose that takes into consideration broader City strategies,

including the City’s Master Plan of Policies and the Detroit Future City Strategic

Framework Plan.

III. Bidder Qualifications

An eligible bidder shall be an individual, a limited liability company, partnership, or a

legally incorporated entity.

A. Neither the bidder, member, shareholder, nor any other person or entity acting

as an agent for, or acting in concert with the bidder, who currently owns or has

previously owned property in the City of Detroit that during their ownership has

been cited for violations of state and local codes and ordinances with respect

to building safety or engineering or building code enforcement or environmental

requirements shall be eligible to bid, unless all such citations have been

resolved to the satisfaction of the enforcing jurisdiction, whether by

remediation or by payment of citations, liens, fines, or other penalties.

B. Neither the bidder, member, shareholder, nor any other person or entity acting

as agent for, or acting in concert with that bidder, who currently owns or has

previously owned property, other than property that was their primary

residence, that has been foreclosed due to delinquent property taxes shall be

eligible to bid.

C. Neither the bidder, member, shareholder nor any other person or entity acting

as agent for or acting in concert with that bidder who has previously been the

winning bidder in a DLBA auction and failed to close, except as such failure to

close was excused by the DLBA in its sole discretion, shall be eligible to bid.

The DLBA is entitled to interpret the restrictions on a bidder set forth in Sections III.

B, C and D and, in its sole discretion, prevent a bidder from using any type of entity,

including those commonly referred to as “a shell company” to avoid the

intent of those requirements.

IV. Pre-Bid Process

A Bidder shall complete a short eligibility questionnaire online to register for the

auction, and shall certify that it meets the requirements set forth in this policy and will

be able to meet the requirements for a deposit and for closing if successful.

V. Auction Procedure and Minimum Bid Prices

A. The DLBA shall post or publicize through various channels including the

auction website a public notice once a property has been selected to be

included in the auction.

B. The Auction Website shall be open for bids on the stated date, and the dollar

amount of each bid received (but not the identity of the bidder) will be visible to

anyone who visits the website. Bids will be accepted until a stated time of

expiration, provided that if a new and winning bid is made within the last five

minutes that the bidding is open, then bidding shall automatically be extended

until five minutes after that bid was placed, and this process shall be repeated

until five minutes have elapsed after the final bid was placed.

C. A minimum bid price shall be established for each property by the DLBA and

posted on the website, based on factors including the condition and location of

the property and the impact of federal or state requirements if their funding was

used in the acquisition of the property.

VI. Procedure for Successful Bidder

A. The successful bidder for each property is responsible for confirming the

winning bid.

B. For properties where the winning bid is greater than $350, the

successful bidder shall pay a down payment of $350 or 10% of the

purchase price, whichever is greater, within three business days following

the date of the auction.

C. Within ten business days of notification, the winning bidder shall submit to

the DLBA the documents listed in Section VIII below. If the winning bidder

fails to do so, the bidder’s option to purchase the property is terminated, and

the down payment will be forfeited to the DLBA.

VII. Right to Reject Bid

The DLBA reserves the right to reject the winning bid without cause and either

remove a property from auction, or offer it in another auction or other sale at a later

date. In the event of a rejected bid, the bidder will receive a full refund of the deposit.

VIII. Documents required to be submitted to the DLBA within 10

business days of Auction

A. The successful bidder shall submit the following documents to the DLBA within

10 business days of notification.

a. All properties owned by the winning bidder, or where applicant has any

ownership interest, do not have any un-remediated citations of violation of

the state and local building codes and ordinances;

b. There is no outstanding tax delinquency;

c. The winning bidder has not lost title to any property due to

nonpayment of taxes within the last 3 years; and

d. All of the other Bidder Qualifications set forth in Section III are satisfied.

B. Proof of Legal Status of applicable Applicant Entity

a. Individuals - Federal or State issued photo identification and proof of

legal residency.

b. Corporations - Certificate of Good Standing & List of Board Officers with

home addresses, phone and email contact information. Entity must be

incorporated in the State of Michigan.

c. Limited Liability Company & Partnerships - Certificate of Good

Standing & List of Members or Partners with home addresses, phone and

email contact information. Entity shall be organized as a limited liability

company in the State of Michigan.

d. Joint Ventures consisting of a Corporation, Partnership or

Limited Liability Company - Certificate of Good Standing & List of

Members with home addresses, phone and email contact information for

each entity that is part of the joint venture. An entity must be organized

pursuant to the laws of the State of Michigan.

IX. Purchaser Agreement Obligations to Rehabilitate Property

The property transfer agreement at closing will require that the Successful Bidder

shall comply with specific requirements concerning the obligation to rehabilitate the

property. These will include submission to the DLBA of the following:

A. Within 14 days after Closing, photographs of the exterior of the Property, or

other evidence indicating that the property has been secured; that all debris,

trash or other materials have been removed from the outside yard area, and

that the grass, yard, shrubs, planting, etc. have been trimmed or mowed;

B. A copy of a City of Detroit Rehabilitation Permit, within 60 days after Closing;

C. Submission of one of the following:

a. Proof of a fully-executed contract with a State of Michigan licensed

contractor to renovate the subject Property, within 60 days after Closing.

Said contract shall contain a specified date by which work on the subject

Property is to begin OR

b. Proof that the Bidder or others identified by name and qualifications who

will be working with him or her have the skills, time and financing to

complete the required rehabilitation within the required time periods;

D. A Certificate of Occupancy for the subject Property within 180 days of Closing.

Investors shall also submit evidence of property being registered under City of

Detroit’s Rental Registration Ordinance within 180 days of Closing.

E. If the Bidder cannot complete the rehabilitation within one-hundred and eighty

(180) days from the date of the Closing, the Bidder may apply to DLBA, in

writing, for an extension.

F. If the Bidder fails to rehabilitate the Property, as defined above, the Bidder is in

breach of the Purchase Agreement. Upon Bidder’s breach of any requirements

of the Purchase Agreement, the DLBA may immediately exercise its right to

revert ownership of the property to the DLBA.

X. Closing

A. Closing shall occur at the DLBA offices within 30 days of notice by the DLBA to

the Successful Bidder, but may be extended at the discretion of the DLBA.

a. The Successful Bidder shall provide at closing all documentation as

required by the Purchase Agreement.

b. The Successful Bidder shall pay the balance of the bid price at closing in

the form of a certified check.

B. Deed:

a. Quit Claim Deed. The DLBA shall convey its interest in the Property to

the Successful Bidder through a Quit Claim Deed. Successful Bidder shall

waive all warranties pertaining to the Property’s condition and shall take

the Property “AS IS"

b. Reconveyance Deed: The Successful Bidder shall execute a

Reconveyance Deed that Reconveys the Property to the DLBA. If the

Successful Bidder is in breach of any of its obligations set forth in the

Purchase Agreement, the DLBA may record the Reconveyance Deed at

the Register of Deeds, and thereby reconvey the property to the DLBA.

XI. Release of Tax Recapture in Neighborhood Enterprise Zone

Policies Governing Side Lot Disposition

I. Objective:

To sell DLBA-owned vacant lots to adjoining property owners to be used for

residential side lot purposes only.

II. Qualified Residential Properties

Parcels of property eligible for inclusion in the Side Lot Disposition Program shall

meet the following minimum criteria:

The property shall be vacant unimproved real property.

First priority shall be given to an owner of a property that is physically contiguous to

the applicant’s adjacent occupied residential property, with not less than 75%

common boundary line on one side (left or right side or rear). Secondary priority shall

be given to any owner-occupant located on the same block.

The application shall state the intended use for the side lot and shall be required to

pay the property taxes on the side lot.

Property owner who is adjacent to a vacant side lot, but across an alley (either to the

side or the rear), may apply for the program.

III. Purchaser

A Purchaser under the Side Lot Program shall hold title and the contiguous property

shall be an occupied residential dwelling.

IV. Pricing

A property that is 5,000 square feet or less and shall be priced at a fee of $100 per

lot.

A side lot that is in excess of 5,000 square feet shall be sold at a price determined at

the discretion of the DLBA.

V. Additional Requirements

A. If more than one application is received for a side lot, the winning bidder will be

chosen as follows:

a. If there is only one bid from an owner of a property that is physically

contiguous (left or right side or rear), that owner shall be the winning

bidder.

b. If two or more of the bids are from owners of a property that is physically

contiguous (left or right side only), then the DLBA shall meet with these

bidders and endeavor to achieve an acceptable resolution including,

exploring the possibility of a lot split.

c. If there are not bids from an owner of a property that is physically

contiguous (left or right side or rear) then any owner-occupant located on

the same block shall be the winning bidder.

B. A side lot created by the use of federal or state funds shall comply with all state

or federal requirements related to the use of those funds.

V. Release of DLBA Tax Recapture

To facilitate Transferee’s ability to combine the acquired side lot with the contiguous

residential property for property tax assessment purposes, the DLBA shall provide a

release of its 5 year, 50% tax recapture for the side lot property.

VI. Transfer of Title

The DLBA shall provide the Transferee with a Quit Claim deed upon closing.
