February1,2017PresidentDonaldJ.TrumpTheWhiteHouse1600PennsylvaniaAvenueWashington,DC20500DearMr.President,Overtwoyearsago,faithleadersacrossthenationwrotetoPresidentObama,urginghimnottoincludeareligionexemptioninanExecutiveOrderendingdiscriminationagainstLGBTpeopleinhiringbyfederalcontractors.Asfaithandcivicleaderswhoaffirmthesacreddignityandequalworthofeveryperson,wearenowwritingtoyou.WeurgeyounottounderminetheseimportantprotectionsagainstdiscriminationbyaddingareligiousexemptiontotheExecutiveOrder.Formorethantwoyears,ithasbeenthelawoftheland.Itwouldbeharmfulandwrongforyoutochangefederalpolicytosanctiondiscriminationwithtax-payerdollars.Furthermore,weurgeyounottoincludereligiousexemptionsthatdiscriminateagainstLGBTpeople,women,andothersinanyfederalpolicies.Inourdemocraticnation,publicservice—particularlywhenitisdirectlyfundedbythefederalgovernment—mustbealignedwiththeconstitutionalprinciplethatallpeoplereceiveequaltreatmentunderthelaw.Requiringthosewhoreceivepublicfundingtoadheretonon-discriminatoryhiringpracticesnotonlyabidesbythisprinciple,butalsoitistherightthingtodo.Beyondthat,itprotectsourlawsfromconfusionandabuse.Ifcontractorsandotherswereallowedtooptoutofcertainlaws,dependingontheirreligiousbeliefs,wewouldsoonseeamorassoflegalconfusionanddispute.Inaddition,ifareligiousexemptionwereaddedtoPresidentObama’sExecutiveOrder,thepeoplewhowouldsuffermostarethosewhoalwayssuffermostwhendiscriminationisallowed:individualsandcommunitiesthatarealreadymarginalized.Addingtotheirburdenistheoppositeofwhatpublicservicecanandshoulddo—andbetraysthevalueswestandforaspeopleoffaithandconscience.FederalpoliciesthatallowfordiscriminationagainstLGBTpeopleviolatebasichumanrightsanddignity,aswellasthebeliefsharedbymillionsofAmericans—thatLGBTpeopleshouldnotbetreatedassecond-classcitizens.InanationasdiverseastheUnitedStates,thefederalgovernmentmustfollow—andindeed,mustmodel—equitableandfairemploymentpractices.Ourmutualcommitmenttothecommongoodisbestservedbypoliciesthatprohibitdiscriminationbasedonfactorsthathavenorelationtojobperformance.Wearebetterandstrongerasanationwhenhiringdecisionsarebasedonprofessionalmerit.Ourpluralisticnationisamongthemostreligiouslydiverseanddevoutintheworld.Eachdaywemakeprogressonourjourneytoward“amoreperfectunion,”whereallGod’schildrenaretreatedwithdignityandrespect.Manyforceshelpspurthisprogress.Theyincludethecourageofpeoplewholiveopenlyaswhotheytrulyare;thewitnessoffaithleaderswhoprovideacompassforreligiousgrowth;thecommitmentofpoliticalleaderswhohelpguideournationtowardamorejustpath;andthepassageoflawsandpoliciesthatensurefairtreatmentforall.
