Préambule.
La présente convention est conclue en application des
textes suivants :
- Code du travail, notamment son article L. 6211-5 et les
articles R. 6223-17 et suivants ;
- Code rural, livre septième ;
- Directive européenne n° 94/33 du 22 juin 1994 relative
à la protection des jeunes au travail (notamment article
premier sur l'âge d'admission, article 7.3 sur les
interdictions de travail et articles 8, 9 et 10 sur les
temps de travail et de repos) ;
- Règlement (CEE) n° 1408/71 relatif à l'application des
régimes de sécurité sociale aux travailleurs salariés, aux
travailleurs non salariés et aux membres de leur famille
qui se déplacent à l'intérieur de la Communauté.
Remarques :
Le terme " établissement de formation " désigne l'école,
le centre ou l'établissement de formation du pays
d'origine, dans lequel l'apprenti suit sa formation
théorique.
Le terme " employeur " désigne l'organisme signataire
du contrat d'apprentissage en France, dans lequel
l'apprenti suit sa formation.
Le terme " entreprise d'accueil " est entendu au sens
d'unité économique ou d'organisme, quelle que soit sa
forme juridique, établi dans un autre Etat membre de
l'Union européenne et accueillant l'apprenti en situation
de travail. Dans le cadre de l'utilisation de cette
convention sur le site http://www.european-mobility.eu
et en accord avec l'ensemble des partenaires concerné,
nous utiliserons le terme générique de "
entreprise/organisme d'accueil "
Protection sociale :
Les apprentis qui effectuent une partie de leur formation
dans un autre Etat membre bénéficient du maintien du
régime de protection sociale de leur pays d'origine en
vertu des dispositions du règlement n° 1408/71. Le
formulaire E101 atteste de l'affiliation de l'employeur à
un régime de sécurité sociale.
La présente convention ne permet pas de déroger aux
règles nationales d'entrée, de séjour et d'accès au
marché du travail de ressortissants d'Etats tiers.
Partage des responsabilités entre l'employeur et
l'entreprise d'accueil :
- L'employeur reste soumis, pendant la durée de la mise
à disposition, aux obligations résultant de la signature
du contrat d'apprentissage, dont, notamment, le respect
des termes du contrat de travail, le maintien de la
rémunération, le paiement des charges sociales, la
responsabilité du pouvoir disciplinaire, de la médecine
du travail et de la gestion des congés payés.
En cas de difficulté, ou de faute de la part de l'apprenti,
l'entreprise/l'organisme d'accueil en informe
immédiatement l'employeur qui prend les mesures
appropriées.
- L'entreprise/l'organisme d'accueil est responsable des
conditions d'exécution du travail. Cela couvre
notamment les dispositions relatives à la durée du
travail, au travail de nuit, au repos hebdomadaire et aux
jours fériés, aux règles d'hygiène et de sécurité, aux
conditions d'emploi des femmes et des jeunes
travailleurs.

Article 1 : Objet.
La présente convention règle les rapports entre les
signataires en vue de l'organisation et du déroulement
de la période de formation européenne de l'apprenti(e)
dans une entreprise/un organisme d'accueil.
Dans le cadre de la formation prévue par le contrat
d'apprentissage, la responsabilité d'une formation
complémentaire est confiée à une entreprise/un
organisme d'accueil établi dans un autre pays de l'Union
européenne.
Les objectifs généraux de cette formation et les tâches à
réaliser dans l'entreprise/l'organisme d'accueil sont
précisés dans l'annexe pédagogique accompagnant la
présente convention.
Article 1: Purpose
The purpose of this agreement is to set up for the benefit
of the designated pupil/student an in-house training
period either possible or made obligatory by the official
programme of his/her education or study.
This training course shall correspond to an application or
an introduction or a training period in the work
environment related to the teaching dispensed in the
vocational training school.
It shall be monitored and supervised by a company tutor
appointed for this purpose by the head of the host
company if he is not himself the company tutor. The
pupil/student shall participate in the tasks specified in
the pedagogical appendix, which is part of this
agreement. In no case may his/her participation to these
activities be detrimental to the employment situation in
the host company. The trainee shall be bound to respect
professional secrecy.
Article 1: Purpose
This agreement shall govern the relations between the
signatories as regards the organisation and
implementation of the European training period of the
apprentice in a host company/organisation.
Within the framework of the training programme
outlined within the apprenticeship contract, the
responsibility for a complementary training period shall
be given to a host company/organisation established in
another EU Member State.
The objectives of this training course and the tasks to be
carried out in the host company/organisation are
specified in the pedagogical appendix enclosed to this
agreement.

L'apprenti est soumis aux règles générales en vigueur
au sein de l'entreprise/l'organisme d'accueil pour cette
catégorie de salarié, notamment en matière de sécurité,
d'horaires et de discipline, sous réserve des dispositions
particulières relatives à la protection des jeunes au
travail, en application de la directive européenne
n°94/33/CE du 22 juin 1994, et de dispositions plus
favorables dans le pays d'accueil.
La durée du travail (formation comprise) et les horaires
applicables sont ceux en vigueur dans
l'entreprise/l'organisme d'accueil pour cette catégorie de
salarié, dans la limite de 35 heures par semaine, sans
qu'il soit permis d'effectuer d'heures supplémentaires,
sauf dispositions plus favorables dans le pays d'origine.
Hormis le cas des heures supplémentaires, les apprentis
âgés de plus de 18 ans se voient appliquer les règles de
droit commun, rappelées dans l'annexe administrative,
en matière de durée du travail (amplitude horaire, temps
de repos, etc). Les dispositions protectrices des
apprentis mineurs relatives à la durée du travail sont
précisées dans la même annexe.
Pour les apprentis mineurs, si une dérogation est
nécessaire pour l'utilisation des machines et produits
dangereux, la copie du formulaire de dérogation signé
par les autorités compétentes est jointe à la présente
convention.
L'entreprise/l'organisme d'accueil s'engage à former
l'apprenti à la sécurité, à l'informer des risques
spécifiques qu'il rencontrera dans l'entreprise au cours
de sa période de mobilité, et devra lui fournir les
équipements de protection individuelle nécessaires.
Les parties s'accordent sur les congés de l'apprenti.
L'employeur doit s'assurer que les droits à congé de
l'apprenti sont respectés sur l'ensemble de l'année.
Article 3: Working conditions: site, hours, leave
entitlement, health and safety

The apprentice shall be subject to the general rules in
force in the host company/organisation for this category
of employee, in particular as regards safety, working
hours and discipline, subject to the particular provisions
relating to the protection of young people at work,
pursuant to Directive n° 94/33/CE of 22 June 1994, and
more favourable provisions in the host country.
The working time (including training) and the hours
applicable shall be those in force in the host
company/organisation for this category of employee, up
to a limit of 35 hours per week, with no overtime
permitted, except in the case of more favourable
provisions in the country of origin.
Apart for the case of overtime, apprentices aged over 18
shall be subject to the rules of ordinary law set out in the
administrative annex on working time (working time
range, rest periods, etc.). The provisions for protecting
minors relating to working time are specified in the same
annex.
If exemption is required for apprentices under 18 to use
dangerous machinery or products, a copy of the
exemption form signed by the competent authorities
shall be appended to this agreement.
The host company/organisation shall train the apprentice
in safety, inform him or her of the specific risks that s/he
will encounter in the company during his or her mobility
period, and provide such personal protective equipment
as necessary.
The parties shall agree on the apprentice\\'s holidays.

Article 7 : Couverture sociale et risque accident du
travail.
L'apprenti(e) bénéficie d'une couverture sociale maladie
et accident du travail/maladie professionnelle au titre de
son contrat d'apprentissage et pour la durée
d'application de la présente convention.
Durant la période de mobilité effectuée dans un autre
Etat membre de l'Union européenne, l'apprenti conserve
sa qualité d'assujetti au régime de sécurité sociale dont
il relève, dans les conditions fixées par la législation
européenne (notamment le règlement CEE n°1408/71)
et française (notamment art L. 761-1 du code de la
sécurité sociale pour les apprentis relevant du régime
général et art. L. 764-1 du code rural pour les apprentis
relevant du régime des salariés agricoles).
En cas d'accident survenu à l'apprenti, soit au cours du
travail, soit au cours du trajet depuis/vers l'entreprise ou
l'organisme d'accueil, le responsable de
l'entreprise/l'organisme d'accueil s'engage à informer
l'employeur dans la journée où s'est produit l'accident ou
au plus tard dans les 24 heures.
La déclaration d'accident du travail doit être faite par
l'employeur, par lettre recommandée avec demande
d'avis de réception, à la caisse accident dont relève
l'apprenti, dans les 48 heures, non compris les
dimanches et jours fériés, à compter de l'information
faite par l'entreprise/l'organisme d'accueil.

occupational sickness/accident coverage at work by
virtue of his or her apprenticeship contract and for the
term of this agreement.
During the mobility period in another EU Member State,
the apprentice shall retain his or her affiliation with his or
her social security system, under the conditions fixed by
European legislation (in particular Regulation (EEC)
n°1408/71) and French legislation (in particular article L.
761-1 of the Social Security Code for apprentices under
the general system and article L. 764-1 of the Rural Code
for apprentices under the agricultural worker system).
In the event the apprentice is involved in an accident,
either in the course of work or whilst on the way to or
from the host company/organisation, the person
responsible in the host company/organisation shall
inform the employer on the day the accident occurred,
or at the latest within 24 hours.
The occupational accident declaration must be made by
the employer by registered letter with acknowledgement
of receipt, to the social mutual aid fund of the
apprentice, within 48 hours, excluding Sundays and
public holidays, as of being informed by the host
company/organisation.

virtue of his or her apprenticeship contract and for the
term of this agreement.
During the mobility period in another EU Member State,

The agreement shall apply as of receipt, by the
employer, of the consent of the rector of the academy,
the regional director of agriculture and forestry or the
regional director of youth affairs, sports and clubs and
societies. The absence of reply to the employer within
one month after receipt of the agreement by the
competent authority shall be tantamount to consent.
Article 12 : Résiliation de la convention.
La résiliation de la convention peut intervenir sur accord
exprès des co-signataires. Elle doit être constatée par
écrit et notifiée à l'établissement de formation, au
service chargé de l'enregistrement du contrat, au
service du travail, de l'emploi et/ou de la formation
professionnelle de référence ainsi qu'à l'autorité
pédagogique de référence.
La présente convention peut être résiliée par l'une ou
l'autre partie, en cas de faute grave, de mise en danger
de l'apprenti ou de non respect des engagements de la
présente convention, dûment constatés.
Cette résiliation ne peut donner lieu à indemnité, et n'a
pas de conséquence, par elle-même, sur la poursuite du
contrat d'apprentissage.

The head of the institution of origin must inform the chairman of the examination committee concerned and obtain his or her agreement, if the
training programme and the report are taken into account when administering the examination.
The obligations of the apprentice are in particular to :
- carry out the tasks assigned by the tutor in accordance to the provisions of the present agreement.
- present the log book or any monitoring document regularly and spontaneously to his/her tutor.
- respect the rules of confidentiality and professional secrecy.
The obligations of the host company/organisation are in particular to :
- provide personal protective equipment;
- present and discuss with the apprentice the results of the assessment of the hazards specific to his or her company
- direct and supervise the apprentice in his or her activities by appointing a "tutor," with the necessary educational and professional skills as
well as ethical guarantees, to perform the supervision;
- have the trainee accomplish work corresponding both to his/her abilities and to the course objectives (complete this heading for each period

- if this work includes the use of equipment, indicate the type of equipment, given that the head of the host company has the obligation only
to have equipment used which complies with the regulations and the conditions of use (supervision, wearing of personal protective equipment,
training,….);
- allow the apprentice to prepare his/her report by granting him the necessary time.
If this work includes the use of chemical agents referred to in Council Directive 98/24/EC of 7 April 1998 on the protection of the health and

safety of workers from the risks related to chemical agents at work, the apprentice shall be provided with full information, in writing, on the
hazardous chemical agents in the workplace pursuant to article 8 of said directive, so that he can pass it on to the industrial physician of his or
her employer;
In the event of performance of dangerous tasks or the use of dangerous machinery and products by young persons under 18, the host
company certifies that it complies with the regulations under which it falls on exemption from the prohibition of certain works (Directive
94/33/EC on the protection of young people at work; article 7.3 on prohibitions of work and articles 8, 9, 10 on working time and rest period).
If the apprentice has to be accommodated, provide housing in accordance with the health and safety standard of the host country.

ADMINISTRATIVE ANNEX
OCCUPATIONAL SICKNESS/ACCIDENT COVERAGE
Formalities (consultable on the websites www.ameli.fr and www.msa.fr):
- The French employer must, prior to the departure of his apprentice, ask the social security office under which he falls to issue the E101 form
(completed in duplicate) attesting that the apprentice continues to be affiliated to the social protection system.
- One of the copies issued by the social security office is handed to the apprentice.
- For occupational sickness/accidents, Regulation (EEC) no. 1408/71 provides for benefits in kind (access to healthcare or reimbursement of
healthcare costs) according to the provisions of the legislation in force in the host country. The presentation of a European Health Insurance
CARD (EHIC) issued by the social security office with which the apprentice is registered attests to the entitlement of such rights. Benefits in
cash fall under French legislation only.
Simplified formalities are provided for postings for a period of up to 3 months at most.
The obligations of the employer remain in force for the entire term of the apprenticeship contract.
In the event the apprentice is involved in an occupational accident, either in the course of work or whilst on the way to and from work, the
person responsible in the host company shall draw up an accident report and send it to the signatory employer of the contract, who shall have
48 hours to send it, by registered letter with acknowledgement of receipt, to the social security office with which the apprentice is registered
(the SIRET number indicated on the declaration is that of the employer). The accident report form (CERFA 60-3682) can be downloaded online
from www.ameli.fr.
ORDINARY LAW APPLICABLE TO APPRENTICES AGED 18 AND OVER ON WORK TIME
Apprentices are wage earners who have concluded a particular type of contract under the terms of which the employer undertakes, in addition
to paying a salary, to provide the apprentice with full vocational training, given in part in the company and in part in the apprentice training
centre or apprentice section (article L. 6221-1 of the Labour Code).
By convention, and unless stipulated otherwise, all the articles cited in the administrative annex refer to the Labour Code.
As such, ordinary law rules shall apply to apprentices aged over 18, in particular those concerning their work time (articles L. 3121-1 to L.
3134-15).
Reminder of the national rules applicable during the mobility period, unless the provisions of the host country are more favourable for the
apprentice :
- The legal work time is 35 hours per week, which constitutes the threshold for overtime (article L. 3121-10), for a maximum work period per
week of 48 hours (article L. 3121-35). Nevertheless, the possibility of working overtime beyond the hours provided by the
apprenticeship contract is not available under an agreement for making an apprentice available in a host company established
in another EU Member State;
- The maximum work time per day is 10 hours (L. 3121-34);
- Any and all work performed between 9:00 PM and 6:00 AM, or in another interval stipulated contractually (article L. 3122-29) shall be
considered night work. Night work is exceptional and must have been established by a collective bargaining agreement (article L. 3122-33);
- The minimum daily rest period is 11 consecutive hours (article L. 3131-1);
- Weekly rest (articles L. 3132-1 ff.): It is prohibited to have a wage earner work more than 6 days per week. The wage earner must moreover
have a minimum rest period of 24 consecutive hours, to which is added the daily rest period mentioned above (i.e. a total of 35 hours); this
weekly rest is given on Sunday, barring exemption;
- Paid holidays: Articles L. 3141-1 ff. (see also article 4.3 of the agreement for making available).
SPECIFIC PROVISIONS FOR APPRENTICES UNDER 18 ON WORK TIME
Reminder of the national provisions applicable during the mobility period for apprentices under 18, except where the provisions of the host
country are more favourable for the underage apprentice :
Particular provisions for young workers: Part three of the Labour Code, book one, title VI;
Provisions relating to apprenticeship: Part six of the Labour code, book two, title II.
Daily and weekly work time:
Young workers may not work more than eight hours a day or more than thirty-five hours per week (articles L. 3162-1 to L. 3162-3).
Exemption from the prohibition of night work (articles L. 3163-1 to L. 3163-3 and R. 3163-1 to R. 3163-6) :
The law prohibits night work for people under 18, while allowing that an exemption can be made in certain sectors for minors aged 16 to 18,
when warranted by the activity of the company.
Sectors that can qualify for an exemption from the prohibition to employ minors during the night are bakeries, cake-making, hotel and catering,
the performing arts and horse racing (article R. 3163-1). In addition, strict time slots are defined for night work by minors in each of the
specified sectors.
Any and all exemptions from this prohibition are issued by the labour inspector under the conditions fixed by article R. 3163-5.
Daily rest (article L. 3164-1) :
The minimum daily rest period for young workers may not be less than 12 consecutive hours, and is extended to 14 consecutive hours when
they are under 16.
Work on Sundays and public holidays (articles L. 3132-3 ff., L. 3164-2 to L. 3164-8 and R. 3164-1 to R. 3164-2) :
Young workers are entitled to two consecutive days of rest per week (weekly rest).
This weekly rest is given on Sunday, barring exceptions provided expressly by the Labour Code (article L. 3132-3 ff. and article L. 3164-3).
The prohibition of work on Sunday is not, however, applicable to underage apprentices employed in certain sectors where the particular

characteristics of the activity so warrant. These sectors, itemised in article R. 3164-1, are hotel and catering, cafes, tobacconists, bakeries,
cake-making, butchers, pork butchers, dairies, fishmongers, florists, and other sectors whose core activity is the production of retail food
products intended for immediate consumption (sale to take away), or were the exclusive activity is the retail of foodstuffs (markets).
Furthermore, rest on public holidays is mandatory for young workers except in industrial establishments that operate continuously (articles L.
3164-6 and 7).
The employment of minors - workers or apprentices - is nonetheless possible on public holidays in certain sectors and under the conditions of
article L. 3164-8. These sectors, itemised in article R. 3164-2, are those for which work on Sunday is authorised (listed below), and the
performing arts (Decree n°2008-889 of 2 September 2008).
SPECIFIC PROVISIONS FOR UNDERAGE APPRENTICES ON DANGEROUS WORK
Reminder of national rules (articles L. 4153-8, D. 4153-15 to D. 4153-40) :
Minors being a vulnerable group, it is necessary to protect them by restricting the possibility of assigning them to perform work considered
dangerous. Article L. 4153-8 prohibits the employ of workers under 18 for certain categories of work that expose them to risks for their health,
safety and morality, or that may be overtaxing for them. Some of these prohibitions, specified in articles D. 4153-15 to D. 4153-40, are subject
to exemptions.
These are:
- work that undermines good conduct and morals (articles D. 4153-15 and 16) ;
- work outdoors (articles D. 4153-17 to 19) ;
- the use of certain work equipment (articles D. 4153-20 to 24) ;
- work that entails exposure to dangerous chemicals (articles D. 4153-25 to 28) ;
- work that entails exposure to the electricity risk (article D. 4153-29) ;
- work with devices under pressure and work in a compressed environment (articles D. 4153-30 to 32) ;
- work entailing exposure to ionising rays (articles D. 4153-33 and 34) ;
- work entailing contact with animals (slaughterhouses and wild or venomous animals; article D. 4153-35) ;
- construction and public works (article D. 4153-36) ;
- glassworks (article D. 4153-37) ;
- work entailing contact with molten metal (article D. 4153-38) ;
- handling loads (article D. 4153-39 and 40).
Exemptions to these prohibitions may be granted for apprentices by the labour inspector, after a favourable opinion from the industrial
physician. The authorisation of the teacher or shop supervisor is required for every task (articles D 4153-41 to 49).
These exemptions are valid, under certain conditions, for the entire term of the contract, but are limited to the beneficiary employer on French
territory, and may be revoked at all times if the conditions that justified them cease to be met.
Rule applicable to making apprentices available in another EU Member State :
A young apprentice in mobility may be assigned, in the host company, to perform works deemed dangerous, within the meaning of the
provisions of Directive 94/33/EC on the protection of young people at work, only if the company has complied with the exemption procedure in
force on its territory.
