records to Zila Sainik Welfare Officer but Zila Sainik Welfare
Officer has not signed and forwarded the same duly completed.
OIC Legal Cell submits that the officer of the Soldier Board has
already signed the necessary papers but it appears that the
papers have not yet reached to the Record Office. Let Zila
Sainik Welfare Officer be appear in person before this Tribunal
alongwith all records to explain as to why such delay has been
caused and as to why an exemplary cost may not be imposed for
such an inordinate delay.

The order of dismissal passed against the applicant was set
aside by this Tribunal by order dated 17.10.2011 passed in T.A. No.
60 of 2010.
Ld. Counsel for the applicant submits that all the consequential
benefits have not been provided to the applicant though Ld. Counsel
for the respondents submits the same have been paid but fact
remains that the break up of the payment has not been provided to
the applicant. Hence the applicant has right to know the correct fact.
It is the applicant’s right to receive the break up of entire
consequential benefits including the allowances and in case he finds
that some wrong has been done he may approach for judicial review
of the matter.
Accordingly we direct the respondents to provide break up of all
consequential benefits in writing in terms of order dated 17.10.2011
(supra) to the applicant expeditiously, say, within a period of three
months from today.
In terms of above directions we dispose of the O.A. finally.

Learned counsel for the Applicant prays for interim order
submitting that the drill of the Applicant is complete and he is in
the process of being discharged very soon. He further submits
that in case the Applicant is allowed to be discharged, it would
frustrate the very purpose of filing the present O.A.
Having considered the submission on interim orders, we
are of the view that the interest of justice would be best served, if
some protective order by way of interim measure is passed.
In view of the above, it is directed by way of interim
measure that the Applicant shall not be discharged and shall be
allowed to continue in service till final orders to be passed by this
Tribunal.

An statement has been made by OIC Legal Cell that by an
order dated 09.08.2016 the applicant has been permitted to resume
duty. We have been informed by Ld. Counsel for the applicant that
the applicant approached to resume duty but he was not permitted to
join the same. For convenience sake paras (c), (d), (e) and (f) of
execution application are reproduced as under :-
“(c) That applicant has approached concerning unit with
the aforesaid order of dated 27.07.2016 on 05.09.2016 and
after departure from Kanpur to Sikanderabad on 03.09.2016
by Train No 12591 Kanpur to Hyderabad. The copy of the
Railway ticket dated 03.09.2016 is being annexed herewith.
(d) That on 05.09.2016 at about 8 am. On R.P. Gate 2T
Range on main gate information was given by the
applicant regarding Tribunal order dated 27.07.2016 and
later on matter was referred to JCO Sudhir Kumar who has
not given any response and afterwards applicant approached
concerning higher officer through on duty personal but matter
of surprise proper response has not been given and refusal
was shown by the authorities with the comment applicant
will be not allowed to resume service.
(e) That after two days moving here and there at unit
concerning authorities of unit has not taken any cognizance and
deadly refused regarding compliance of the order dated
27.07.2016 due to that having no option applicant returned
back on 06th September 2016 by train Sikanderabad to Kanpur.
The copy of the Railway ticket dated 06.09.2016 is being
annexed herewith as Annexure No E-3 to this execution
application.
(f) That inspite of no change order which has been observed
by opposite party during argument in Tribunal even though
applicant has been discharged from service since last 3 years
pendency of the aforesaid case Hon’ble Tribunal has given
order in favour of the applicant and direction to the authorities
concerned on dated 27.07.2016 to allow applicant to resume
duties even though order has not been complied with by the
authorities concerned due to that execution application has
been preferred in Hon’ble Court by the applicant for the
compliance of the order dated 27.07.2016.”
Let an inquiry be held in the matter and report be submitted in
terms of pleadings on record that who are the officers accountable in
not permitting the applicant to resume duty inspite of order passed by
the competent authority as well as the order dated 27.07.2016. We
hope and trust that the applicant shall be permitted to resume duty
following the order dated 09.08.2016 passed by Artillery Records.
The inquiry shall be held by an officer not lower than the rank of
Colonel/Commanding Officer.
Copy of this order shall be provided to parties counsel.

This is an application for condonation of delay. Applicant
is aggrieved by orders dated 05.02.2004 and 27.01.2007 passed
by the Commanding Officer on the ground that the procedure
prescribed has not been followed. Submission is that the
procedure provided for red ink entries in pursuance of Army
Order 28.12.1988 has not been followed and punishment has
been awarded with severe reprimand. It is also submitted that
the applicant has been deprived of his 28 day’s salary in an
illegal manner. In consequence thereto the applicant is losing
promotional avenues also.
Ld. Counsel for the applicant has cited number of
judgments of Hon’ble Apex Court while preferring the application
for condonation of delay, some of them have been referred in
para 7, 8, 9 and 10 of the application. For convenience sake
paras 7, 8, 9 and 10 are reproduced as under:-
“7. That Hon’ble Supreme Court in Laxmi Devi (Smt.) Vs.
U.P. State (AIR 1988-133) held – There is no denying the
fact that the court is required to take a broad view in the
matter of condonation of limitation, so as to advance the
cause of justice.
8. That Hon’ble Supreme Court in plethora of its judicial
decisions held that – in the matter of condoning the delay,
the object should be to advance the cause of justice. In
Bhag Singh vs. Major Daljit Singh (1987) (supp)-SCC-685,
the Hon’ble Supreme Court observed that –while
considering an application for condonation of delay, the
court will consider the facts and circumstances not for
taking too strict and pedantic stand which will cause of
injustice, but to consider it from the point of taking a view
which will advance the cause of justice. Same view taken
in Sandhya Rani Sarkar vs. Sudha Rani (AIR 1978 SC-
537) (para 8). In Sital Prasad Saxena Vs. UOI (1985) 1
SCC-163.
9. That Hon’ble Supreme Court in the case of M.R. Gupta
vs. UOI and Ors (1995) 5-SCC-628 decided on 21.08.1995
held that –point of limitation will not arise when it is
established that there is a continuing wrong going rise to a
recurring cause of action.
10. That a Division Bench of Hon’ble Apex Court in UOI
and Ors Vs. Tarsem Singh decided on 13.08.2008 (2009)
(1) AISLJ-371 gave following verdict in the matter of
limitations:-
(i) In case of pension cause arises every month.
(ii) A claim based on continuous wrong can be
allowed irrespective of delay.
(iii) Continuing wrong applies in service law also.
(iv) Continuing wrong is a single act causing
continuous injury”.
Though while submitting reply the respondents asserted
that applicant has failed to explain the delay and it is not the
case of recurring cause of action. Further submission of Ld.
Counsel for the respondents is that the applicant has not
disclosed the day-to-day delay and in the absence of day-to-day
disclosure of delay, the application for condonation of delay
should be rejected.
We have considered the rival contentions of Ld. Counsel
for the parties and perused the records. As referred to by Ld.
Counsel for the applicant, in the judgments referred hereinabove
the purpose of judicial review is to advance the cause of justice.
The Court should not take too strict and pedantic stand which
may cause prejudice, but to consider it from the point of view
which may advance the cause of justice. In the present case
since the question involved is with regard to red ink entries and a
decision in same matter has already been settled by this Tribunal
in OA. No. 168 of 2013, decided on 23.09.2015 (Abhilash
Singh Kushwah vs. Union of India & ors) and more over the
procedure prescribed for red ink entries matters has not been
followed, which is creating obstacle in applicant’s promotional
avenues, there shall be great prejudice in case delay is not
condoned in the instance case.
Keeping in mind that no strict and pedantic stand should
be adopted while disposing of application for condonation of
delay and cause of justice should be advanced in such a way

This is an Application under section 30 (1) of the
Armed Forces Tribunal Act moved by learned counsel for
the Applicant seeking leave to appeal vis-à-vis the order
of the Tribunal dated 27.01.2016. Learned counsel for
the respondents has vehemently opposed the
Application for condonation of delay attended with
submission that since there is huge delay, the Tribunal
lacks jurisdiction to condone the delay. In our
considered view, the argument is loaded with substance.
There is no appearance for the Applicant. We are
informed that learned counsel for the Applicant has
made an Application for adjournment of the case today.
According to the office report, the Application for
leave to Appeal has been moved after expiry of
statutory period, it being barred by seven months and
fourteen days. On this ground alone, the Application
deserves to be heard and disposed of today.
It is well settled that the Tribunal lacks jurisdiction
to condone the delay for want of any enabling provisions
in the Armed Forces Tribunal Act, 2007. Hence the
Application for condonation of delay is not maintainable
and is rejected.

Present is an Application for condonation of delay in
filing the O.A. Nil of 2015.
The Application for condonation of delay has been
vehemently opposed submitting that the Applicant had
wilfully absented himself from duty and as a result he was
pronounced deserter.
On the other hand, learned counsel for the Applicant
submits that it was not a case of deserting the unit but in fact
he had proceeded on leave on the ground of serious illness
of his wife which was duly granted. While on leave, it
transpired that his wife was suffering from cancer for which
she was being treated. Later-on, after prolonged ailment,
she died. He further submits that when the Applicant
reported for duty at the Unit, he was informed that he had
been declared deserter on 14.04.2009 and he was not
permitted to join duty.
Coming to merit of the case, learned counsel for the
Applicant submits that in view of the provisions contained in
section 39 (b), he ought to have been permitted to resume
duty and reason for overstaying the lave ought to have been
considered in view of the statutory provisions.
Learned counsel for the respondents on the other hand
repudiated the submission submitting that after being
declared deserter there was no occasion for the Applicant
being permitted to resume duty.
In the instant case, the Applicant has already put in
more than 15 years of service. According to the Applicant he
had overstayed the leave and reported for duty at his unit
after 15 days but he was not permitted to resume duty.
In the facts and circumstances of the case, we are of
the view that a case is made out for condonation of delay.
Accordingly, delay in filing the O.A is condoned.
O.A. No nil of 2015.
Keeping in view the factual matrix and pleadings on
record and subject to above discussion, the O.A is admitted.
Learned counsel for the respondents may file counter
affidavit within four weeks. Rejoinder affidavit, if any may be
filed within two weeks next thereafter.
In the facts and circumstances of the case and regard
being had that the Applicant had overstayed the leave and it
is not a case of wilfully deserting the Unit, it is provided as
an interim measure that the respondents shall permit the
Applicant to resume duty forthwith in his unit/Regimental
Centre in case he has not already been dismissed from
service. It is made clear that the Applicant shall report for
duty on 2nd Nov 2016.
It is also made clear that in case the order of dismissal
has already been passed, in that event, copy of order so
passed dismissing the Applicant from service shall be
provided to the Applicant.
It is further made clear that it would be open to the
respondents to proceed against the Applicant in accordance
with law after he is permitted to resume duty in his unit.
It is provided that in case dismissal order has already
been passed, it shall be open for the Applicant to submit
statutory complaint in accordance with law.
List this case on 2nd November 2016 for orders on
which date learned counsel for the respondents shall
produce the original record for perusal of the Bench.

Shri Kushal Yadav, Applicant is present in court. The
precise case is that the Applicant had not made any application
for premature discharge from service and the Application and
signatures made thereon which has been acted upon leading to
his premature discharge are all fake and forged.
The statement made across the Bar by the Applicant is to
the effect that one JCO of One Training Battalion of B.E.G
Centre had made a demand of illegal gratification to the tune of
Rs 50,000/- after almost 20 days of his enrolment in the Army
and on his refusal to grease his palm, the order of voluntary
discharge was prepared behind his back acting upon the
Application which he had never made nor signed and
consequently he was discharged from Army service.
We have tallied the signatures made on the Application
with the signatures made by him on the O.A. The two signatures
are quite distinct and do not tally.
Let the entire original record be produced before us for
perusal on the next date of listing.
Looking to the nature of the case, we are of the view that
the matter be referred to the Chief of the Army Staff to look into
the matter and institute inquiry vis a vis the allegations of the
Applicant treating the present order as statutory complaint on
behalf of the Applicant. It is desirable that the inquiry may be
ordered to be taken to finality by the next date of listing of the
present case.
In the facts and circumstances of the case, it is directed
that the Applicant shall also file an affidavit by the next date of
listing making averments vis a vis the statement made before us
today in Court.
Besides the original record that shall be produced before
us for perusal, it is also directed that some responsible officer
from Recruitment Centre shall be sent alongwith the original
record of the Applicant for being produced before us for perusal.

This is an application for condonation of delay in filing
application for grant of leave to appeal in O.A.(A) 239 of 2014.
Admittedly, the application is time barred and has been moved
beyond statutory period. The Tribunal lacks jurisdiction to condone
the delay under the Armed Forces Tribunal Act, 2007. It is well
settled proposition of law that the Tribunal is not empowered to
condone delay in moving application for leave to appeal. Accordingly
application for condonation of delay in moving application for grant of
leave to appeal is not maintainable and is rejected.

This is an application for grant of leave to appeal which has been
filed beyond the statutory period of limitation. Application for

of MoD (Army), AG’s Branch/MP-3. Copy of the order has been
placed on record. It has been submitted that the petitioner shall
be called in the unit within a week and thereafter process of
change of trade shall start.
Keeping in view the statement given by OIC Legal Cell
(supra), we dispose of the execution application finally with the
hope and expectation that the entire process shall be completed
within a period of six weeks from today.
In terms of above, execution application is disposed of
