Attached is a copy of Memorandum Circular No. 04 signed by ExecutiveSecretary SALVADOR C. MEDIALDEA dated 22 August 2016 entitled, 'COURTESYRESIGNA TIONS OF PRESIDENTIAL APPOINTEES. '
Heads of Bureaus, Commissions and Offices attached to the DOJ are herebyenjoined to please take note of paragraphs 1, 2, 5 and 7 thereof, which reads asfollows:
'7. In view of the President's desire to rid the bureaucracy of corruption, andto give him a free hand in achieving this objective, aii presidentiaiappointees are hereby directed to tender their unquaiiffed courtesyresignations within seven (7) calendar days from date hereof,except the following:

Newiy appointed Cabinet Secretaries, Undersecretaries andAssistant Secretaries in their respective Departments, includingpresidential advisers or assistants with the equivalent rank asaforementioned;Other officials in the Executive Department, inciuding stateuniversities and colleges, and government-owned-and-controUedcorporations(GOCCs), appointed by the incumbentPresident;Career officiais as defined by the Civil Service Laws, rules andregulations;Judiciary;Officials whose offices are created by virtue of the PhilippineConstitution (e,g.. Constitutional Commissions, Ombudsman,etc); and
f) Those whose appointments are currently being processed orwho may be appointed by the President shortly after theeffectivity of this Memorandum Circular.

2. Courtesy resignations shall besubmitted to the Heads ofDepartments orOffices exercising supervision or control over the appointee, or to whichthe iatter's office is attached, copy furnished the Office of the Presidentthru the Executive Secretary.
5. Until any action on their courtesy resignations is taken by the President,appointive officials shall continue to report for work and perform theirnormal duties and responsibilities.
7. Any Presidential appointee covered bythis Memorandum Circular who failsorrefuses without a valid reason to tender his orher courtesy resignationwithin the period stated above may be heid administratively liable andmetedthe appropriate penalty. "(Emphasis ours)
All concerned ofRcials and employees are hereby directed to submit theircourtesy resignation to the Secretary of Justice or to the Heads of ofRces exercisingsupervision or control over them, or to which their ofhce is attached, copy furnishedthe Office of the President thru the Executive Secretary.
The respective Personnel Divisions of the DOJ, its attached agencies andoffices are hereby directed to submit a list of positions covered or affected byMemorandum Circular No. 4 together with the courtesy resignation(s) on or beforethe date prescribed therein.
Let the original copy thereof be kept in the DOJ Library Section.

COURTESY RESIGNATIONS OF PRESIDENTIAL APPOINTEES
In view of the President's desire to rid the bureaucracy of corruption, and togive him a free hand in achieving this objective, all;'presidentiaf appointees arehereby directed to tender their unqualified courtesy resibnations within seven(7) calendar days from date hereof, except the follo\fvjng: '
a) newly appointed Cabinet Secretaries, Undefsecreiaries and AssistantSecretaries in their respective Departments, including presidential advisersorassistants with the equivalent rank as aforementioned;
b) other officiais in the Executive Department, including state universities andcolleges, and government-owned or - controfldd corporations (GOCCs)appointed by the incumbent President; I t
c) career officials as defined by the Civil Service Lajjvs, rules and regulations-d) Judiciary; ' ; ^ •e) officials v^hose offices are created by virtue of (the F^hilippine Constitution
