Note: It is ultimately your responsibility to ensure that you are registered for the correct modules for your programme. You must study 120 Credits at both Stage 2 and Stage 3 giving a total of 240 Credits over the two Stages (or 360 credits over three stages for a four year programme). At least 90 Credits must be taken at Level 6 during Stage 3 to be eligible for an Honours degree. Qualification as a Solicitor or Barrister in England and Wales All of KLS’s undergraduate degree programmes contain modules known as the ‘foundations of legal knowledge’ (hereafter referred to as ‘foundation modules’). The foundation modules are required in order to achieve a Qualifying Law Degree. The Law School will assume that all students want to complete the foundations of legal knowledge. Therefore, students will be automatically registered for the following: LW315/LW325 Introduction to Obligations (15 Credits) (Autumn) Must be taken with LW316/LW5316/LW324 LW316/LW324 OR LW5316 Foundations of Property (15 Credits) (Spring) Must be taken with LW315/LW325 LW327 The English Legal Systems and Skills LW508/LW613 Criminal Law (30 Credits) (Autumn & Spring) OR LW601 Advanced Level Criminal Law (30 Credits) (Autumn & Spring) LW588/LW614 Public Law 1 (30 Credits) (Autumn & Spring) LW592 Public Law 2 (15 Credits) (Spring) LW593 European Union Law (15 Credits) (Autumn) LW598 Equity and Trusts (15 Credits) (Spring) LW599 Land Law (15 Credits) (Autumn) LW650 The Law of Contract (15 Credits) (Autumn) LW651 The Law of Tort (15 Credits) (Spring) In order to obtain a Qualifying Law Degree (QLD), students must take and pass (i.e. attain a mark of at least 40%) the modules listed above over the course of their degree. Students must also successfully complete a further 60 credits of Law to obtain the 240 credits needed for a QLD1 Students who successfully meet these requirements are exempt from the need to undertake the Common Professional Examination and can proceed directly to the Legal Practice Course (for solicitors) or the Bar Professional Training Course (BPTC) (for barristers). Please note, however, that students who wish to proceed to the BPTC must obtain an overall degree classification of 2:2 or higher.

It is vital that students PASS ALL the foundations of legal knowledge modules listed above; there may be serious consequences for failing to do so.

Prospective Solicitors
Where a student fails one or more foundation modules, the University’s rules governing compensation2 and condonement3
might nevertheless permit the student to progress to the next stage of their degree, or even pass their degree as a whole.
Importantly, however, the foundation module(s) will still have been failed and, as a result, the student will not achieve
a QLD.
However, the Solicitors Regulation Authority (SRA) grants the Board of Examiners the discretion to award a student a QLD (following a decision to compensate or condone a single failure of a foundation module) but only in exceptional circumstances and only if specific criteria are met. Students should contact the Student Support Office [email protected] for guidance on the process of submitting evidence of extenuating circumstances to the Board of Examiners. Prospective Barristers
The Bar Standards Board (BSB) rules are more complex than those of the SRA, therefore students should contact the Student Support Office for further guidance.
Number of attempts The Solicitors Regulation Authority and Bar Standards Board both allow a maximum of three attempts at each foundation module (one initial attempt followed by two further attempts). Attempts treated ‘as for the first time’ do not count for this purpose. If a student is compensated or condoned before being given three attempts to allow them to progress or graduate, the student can either:
sit the module again alongside their programme of study OR
If they have graduated, as an external candidate at the first opportunity after graduating. For example, for a student
who graduates with a compensated mark in a foundation module in July 2018, the first available opportunity to sit as an external candidate will be in August 2018.
Time limits for Qualifying Law Degrees

Note: Discretion is afforded to the Board of Examiners by the SRA to grant a QLD to a student exceeding the prescribed time limits above, but only in exceptional circumstances and if specific criteria are met. BSB rules are more complex than those of the SRA and therefore, students seeking qualification as a barrister are advised to contact the Student Support Office for further guidance. Non-Qualifying Law Degree students Students who have not taken all of the foundation modules or have otherwise failed to obtain a QLD may be able to complete their academic training by undertaking the Common Professional Examination (CPE) also known as the Graduate Diploma in Law (GDL) at another institution. From 2019-20 onwards, all of Kent Law School’s joint-honours programmes have been amended so that students can be
awarded a Bachelor of Laws (LLB (Hons)) instead of a Bachelor of Arts (BA (Hons)). Joint-honours students interested in this

The Law and Economics Programme
2 ‘Compensation’ is where credit is awarded for a module that has been narrowly failed (i.e. a module mark of 30-39% has been achieved). 3 ‘Condonement’ is where credit is awarded for a failed module because of documented illness, or other mitigating circumstances (irrespective of the mark achieved).
Students on this programme must take 30 Credits of extra-curricular Law in order to obtain a QLD. The University’s regulations allow a student to take 30 extra-curricular Credits in each Stage. These modules will not count towards the final degree classification (though they will appear on the transcript). Students must discuss this with their Academic Advisor and decide which modules will be extra-curricular before they are studied. Modules cannot be switched subject to results. ‘Wild Modules’
Students are encouraged to consider taking Wild modules from other schools in Social Sciences and Humanities during Stages 2 & 3. Wild modules offer an opportunity to broaden your educational experience, to demonstrate intellectual curiosity and to study subjects that may contribute to your career development. In many programmes up to 60 Credits may be obtained from Wild modules (a maximum of 30 Credits in each Stage) while still providing a professionally qualifying degree. You are encouraged to discuss any interest in or questions about Wild modules with the Director of Studies. Students in stage 2 must choose level 5 Wild modules and students in stage 3 must select level 6 Wild modules. Language study is exempt from these rules and may be studied at any level provided that prerequisites are met and that you comply with credit framework rules. However, you should note that Law students are NOT permitted to take Level 4 language modules in Stage 3. Although you are free to apply for any module from these Wild Modules lists you should note that some modules require certain prerequisite qualifications. If you need further details about a particular module you should contact the module convenor or owning school. QUALIFICATION AS A LAWYER IN OTHER JURISDICTIONS

LAW (SENIOR STATUS) LAW(SS):LLB Single Honours To be eligible for the award of an LLB honours degree students must obtain 360 Credits, at least 210 of which must be Level 5 or above. The University’s Education Board has granted this programme a waiver from the requirements of Annex 4 of the Credit Framework (i.e. a requirement for a minimum of 90 Credits at level 6 in Stage 3). Students must, however, study 75 Credits at level 6 in Stage 3. Students who meet the entry requirements for the programme will have been awarded 120 Credits at Level 4 for Stage 1 in accordance with the University’s procedures for Accrediting Prior Learning. ENGLISH AND FRENCH LAW ENGFRELAW-A:LLB Single Honours The degree in English and French Law is a four-year programme offered in co-operation with the Universities of Aix-Marseille Université (AMU), Bordeaux, Grenoble and Paris 1 (Panthéon-Sorbonne). Students from the University of Kent registering for this degree will spend the first two years and the final year (Stages 1, 2 and 3) of the degree programme at Kent, and the third year (Stage A) at a French University. You must study 120 Credits at both Stage 2 and Stage 3. At least 90 Credits must be taken at Level 6 during Stage 3 to be eligible for an Honours degree. You must ensure that you choose an even weighting of Credits in each term: 60 Credits in the Autumn and 60 Credits in the Spring. No Level 4 wild modules can be taken at Stage 2 or 3. Notes
1. An average of 60% in stage 1 is a pre-requisite to entry to the year abroad (if the programme was started in 17/18 only, not beforehand). Students who are not eligible for the year abroad will be transferred to another programme, usually the LLB Law. The Director of the programme will consider applications for entry to the year abroad from students who do not achieve the required average if:
a) There is documented evidence of exceptional circumstances which have interfered with the student’s academic performance in stage 1, and
b) the Director of the programme is satisfied that, where appropriate to the circumstances, appropriate support is available whilst abroad to mitigate the effect of those circumstances, or
c) In order to contribute to widening participation in Higher Education, the student meets one of more of the contextual indicators required for entry to the Certificate route of the LLB Law programme.
2. A pass in LW539 Droit Français is a prerequisite for entry to Stage A of the degree. 3. Students should note that some of the above-named modules may not be available in any given year and that there
may be timetable clashes. 4. Students who enrol in a Certificate/Diploma programme should note that they may have a limited choice of options. 5. Students who reach the required standard during the year abroad may be awarded a Certificate/Diploma in French
Law by the host institution (Aix-Marseille Université, Bordeaux and Grenoble only).

STAGE A – 120 Credits Stage A will be spent in the Faculty of Law at one of the institutions given below. In principle, students will register for a Certificate/Diploma in French Law (this decision is subject to the authorisation of the Directors of Studies at Kent and at the French University). A small number of places are available at the Sorbonne and in Bordeaux. Selection for these two destinations will be made on the basis of academic performance. It is strongly recommended that students achieve an overall mark of at least 65% in stage 1. Aix-Marseille Université Students may register for the standard Erasmus programme or the Diploma programme in French Law.
Bordeaux Students may register for the Certificate programme in French Law. Grenoble Students may register for either the Diploma in French Law programme or the Diploma in Administration and International Politics programme Paris I (Panthéon-Sorbonne) Students may register for the standard Erasmus programme only. EUROPEAN LEGAL STUDIES EURLEGST-A:LLB Single Honours The degree in European Legal Studies (ELS) is a four-year programme offered in co-operation with the Universities of, Bergen (Norway), Copenhagen (Denmark), Grenoble (France), Maastricht (The Netherlands), Charles University Prague (Czech Republic), Turku (Finland), Uppsala (Sweden) and Vienna (Austria). Students from the University of Kent registering for this degree will spend the first two and the final year (Stages 1, 2 and 3) at Kent, and the third year (Stage A) studying in either Austria, the Czech Republic, Denmark, Finland, France, The Netherlands, Norway or Sweden. Notes
An average of 60% (or a Merit on preponderance) in stage 1 is a pre-requisite to entry to the year abroad .Students who are not eligible for the year abroad will be transferred to another programme, usually the LLB. The Director of the programme will consider applications for entry to the year abroad from students who do not achieve the required average if:
a. There is documented evidence of exceptional circumstances which have interfered with the student’s academic performance in stage 1, and
b. the Director of the programme is satisfied that, where appropriate to the circumstances, appropriate support is available whilst abroad to mitigate the effect of those circumstances, or”
c. In order to contribute to widening participation in Higher Education, the student meets one of more of the contextual indicators required for entry to the Certificate in Law programme.
STAGE A – 120 Credits This Stage will be spent at one of the law departments or faculties of the following Universities: Bergen, Copenhagen, Grenoble, Maastricht, Charles University Prague, Turku, Uppsala or Vienna. Students accumulate 60 ECTS (European Credit Transfer System) Credits, equivalent to 120 Kent Credits, from modules the majority of which should be law modules. Modules are to be chosen in consultation with the Director of Studies for European Legal Studies, Dr Martin Hedemann-Robinson. There are usually a limited number of places available to study at one of the designated host continental European partner-universities during the year abroad. Places are allocated normally on the following basis: (1) students submit their preferred short list of host partner universities to the Erasmus Placements Team, International Development Office, The Registry, University of Kent during the early part of the Autumn term of Stage 2; (2) places for each host partner university are then normally allocated by the Director of ELS according to individual student preference in so far as possible. However, where demand for a partner university exceeds the number of places available, the allocation will in principle be determined usually on the basis of academic performance of individual students during Stage 1 of the degree programme. Exceptionally though, a place may be allocated to a student by the Director of ELS if there are particularly strong academic-related or personal reasons for this to be done (eg. a student wishes to study the language of the country of a particular host partner university during Stage 1 and/or 2). The year abroad is assessed on a pass/fail basis. Students who fail the year abroad will revert to the LLB Law.

European Credit Transfer System In accordance with the European Credit Transfer System, students on these exchanges will be expected to have completed a learning agreement by the end of the Spring term of Stage 2. The learning agreement will contain an indicative list of the subject choices of students, and will be forwarded to the host university via the International Development Office. Information on the range of subjects offered will be available from the Director of the ELS programme.

Single Honours The degree International Legal Studies is a four-year programme offered in co-operation with partners in China, Hong Kong, Japan and Canada. Students from the University of Kent registering for this degree will spend the first two years and the final year (Stages 1,2 and 3) of the degree programme at Kent and the third year (Stage A) at their partner institution. Students choosing to go to the partner institution in China will be offered the opportunity to study Mandarin Chinese classes. For students opting to take this extra-curricular course, attendance is mandatory. In order to progress to the year abroad students must achieve an average of 60% in Stage 1 and 60% in Stage 2 (for students who started the programme in 17/18). The Director of Studies for the programme will consider applications for entry to the year abroad from students who do not achieve the required average if:
a) there is documented evidence of exceptional circumstances which have interfered with the student’s academic performance in Stage 1, and
b) The Director of the programme is satisfied that, where appropriate to the circumstances, appropriate support is available whilst abroad to mitigate the effect of those circumstances, or
c) in order to contribute to widening participation in Higher Education, the student meets one or more of the contextual indicators required for entry to the Certificate route of the LLB Law programme (for more information about contextual indicators, refer to https://www.kent.ac.uk/courses/undergraduate/2018/229/certificate-in-law
Students should be aware that due to the entry requirements prescribed by some of our partner institutions, for example Osgoode Hall and Hong Kong University, a year abroad at these institutions will not be possible without an average of 60% in Stage 1 and 2. Students who are not eligible for the year abroad will be able to transfer to another programme; normally the single honours LLB Law.

LAW WITH FRENCH LANGUAGE AND A YEAR ABROAD LAWFRELANG-A:LLB Single Honours The degree in Law with French Language and a Year Abroad is a four-year programme offered in co-operation with the University of Montreal and the University of Ottawa.
