Mayor Mescheropened the publichearing on theWillis/Welter re-zoningof Lots 81 through 85and Lot 96 from R-1 toC-2 at 6:00 p.m.

Providence Valente –673 Lilac Lane - livesdirectly behind theproperty, when theybought their lot, theyknew that the propertyacross the street wasresidential so she wasok with purchasing theproperty. She isn’tagainst growth in thecommunity, she is infavor of it. Out ofrespect for the familiesshe understands whythey want to do whatthey want to do, but asa property owner shehas to look out on herbehalf also. One of hermain concerns is howit will affect Lilac Lane,when you enterDeerwood Street fromPeosta Street this is avery narrow road and ifthere are two cars atthe intersection thereis always an issue; ifthere is a businesslocated on the propertyhow is traffic going toflow? The buildingsare pretty close to theroad, she isn’t surehow this works withthe setbacks; she alsohas concerns aboutfencing and what thatis going to look likeaesthetically. Whatabout chemical use, aspeople that like to beoutdoors what are theygoing to be smelling?Will there be noisecoming from thecommercial property,this is a quiet street,they love living there.The property is largewill it be a catch all forthings a businessmight accumulate?Providence read up onthe code and sheknows that Peosta hasa junk ordinance, sheisn’t sure how it’senforced, as aneighbor she doesn’twant to be calling CityHall to complain aboutthe business on a

regular basis. This willcreate a substantialhardship for herproperty and the valueof it when she goes tosell her home. Whatjustifies changing thezoning from residentialto commercial. To theCouncil if they dorezone please payclose attention to theproperty and how arethey going to improvethe property, it is onthe main road it needsto look nice.Providence thankedthe Council for theirconsideration of hercomments.

Mayor Mescher askedabout the junk carsthat are on theproperty currently,Mark Willis said thateverything that issetting there will begone once they ownthe property. JeffWillis said the littleshed will also beremoved and the shedthat is off of DeerwoodStreet will be re-sided.The Mayor also saidthat the City doesn’tallow trailers to beparked on grass,nothing has beenapproved yet and thereare already five trailersparked on theproperty. Per JeffWillis one trailer andone camper will beleaving for sure; theMayor said personallyhe doesn’t think this isthe right spot for thebusiness. John Kraftaddressed the area tothe south of thebuilding on Lilac Lane,Jeff said that thefenced in area willhave their metaldumpster and if a caris delivered overnightit will be parked behindthe fence. John askedhow often the metaldumpster is disposedof; Jeff said they emptyit themselves sowhenever it gets fullthey get rid of it. Johnalso asked about athird side to theprivacy fence sonothing is visible fromPeosta Street. KathyOrr asked about paintfumes, Jeff said theyhave a $40,000 paintbooth and he doesn’tknow that you would

yever smell any fumes,they haven’t had anycomplaints from theircurrent neighborsliving in the condosGreg Rausch owns.What product will beused for the fencing?Jeff said it will eitherbe a chain link fencewith vinyl slats or onewith fabric that goesthrough it. Kathy alsoasked about noise, Jeffsaid noise is minimal.John asked abouthours of operation, Jeffsaid 8-5 Mondaythrough Friday andsome Saturdaysdepending on howbusy they get. JohnValente asked aboutbanging on cars, Jeffand Mark said youshouldn’t hear muchoutside the building.The Mayor asked whatthe timeline for thehard surfacing is; Jeffsaid once they figureout where their officewill be located, theycan’t pave until theoffice is up. Front setback is 20’; KarenLyons said she doesn’tknow that the existingbuildings meet thesetbacks from thestreet; she said thesmall garage probablywon’t meet the 20’setback. The Mayorsaid he stepped it offtoday from the centerof the road to thegarage isapproximately 29 feet;the big building is only24 feet off the street;from the edge of theasphalt to the building;it doesn’t meetsetback. Karen saidthe property hasn’tbeen used for abusiness for some timeand when the businessclosed it reverted backto residential; if theproperty the housesets on staysresidential they arecreating an island.Karen is concernedabout all of theresidential propertyaround them. Jeffasked how a 60 x 96building is built onresidential property,the Mayor said thiswas done before theZoning Ordinance wasadopted. Karen said ifit would have stayed in

ybusiness all this time itwould not be an issue.John Kraft asked whatthe building is used fornow, Jeff said storagefor cars. Karenexplained that therestricted residencedistrict is no longer ineffect; now there is azoning ordinance.

Heis concerned aboutliving by the businessrunning as an autobody shop; hates tosee this building withthis type of zoning.Providence Valenteasked if this would beconsidered spotzoning? Jeff Willis saidthat the bar iscommercial; Karensaid they have beenopen through thezoning changes. Jeffsaid that the propertythey are on now is keptup and they will bemoving to twice thesize building so most ofthe stuff that has apossibility of beingoutside can be inside.

Gerry Hess askedabout parking surface;Jeff Willis said up frontwill probably beblacktop, this would beat the intersection ofSundown andDeerwood Streets. Jeffsaid this is their way ofgetting the propertycleaned up, they willtake care of theirproperty. Gerry askedabout the condition ofthe existing garage onDeerwood Street, Jeffsaid it is slate siding,but the structure lookspretty good it has anew roof, it is in theirplans to make it lookbetter. There are justtwo people working inthe shop, may add 1 or2 part timers in thefuture. They may putup a different buildingin the future if they areable to get the zoningbut it could be fiveyears down the road.John Kraft asked ifthere is a backlog ofvehicles, where willthey be stored? Jeffsaid the majority couldbe stored in the backstorage (northeastdoor of the building)they aren’t taking thewhole building for theirwork area. John askedother than the cars forsale and their carsthere won’t be anyother cars parked onthe lot? Jeff saidunless a customer waspicking up a car afterhours it would usuallystay in the building.Gerry asked abouttrailer parking, Jeffsaid they will probablykeep them where theyare currently, it’s toughto keep a trailer instorage since they takeup so much room andthey are using them ona regular basis.

John Valente said atthe end of the day,they are going to haveto look at the car lot,fences, blacktop orgravel it will still be abusiness that theyhave to look at everyday.

Motion by Kathy Orr,seconded by GerryHess to approve thetentative time table forthe City Administratorsearch process. AllAyes. Motion Carried.

Motion by Gerry Hess,seconded by John Kraftto contract for sixmonths with Tri-StatePorta Potty for KellyOaks Park at a cost of$540. All Ayes. MotionCarried.

Motion by Gerry Hess,seconded by John Kraftto approve the quotefor disc golf andconcrete in the amountof $6800. All Ayes.Motion Carried.
