Labor law & HRMEvery HR manager must know the labor laws of that country where he is working, because most of the core HR functions are linked and according to
the labor laws of concerned country. Managing human resources without following labor laws may
be illegal and in some cases it may be serious offence which may lead to close down of factory or
establishment.SO,

Recruitment law of HRM
HR manager can recruit workers according to sec:3 and workers shall
be classified in any of the following classes
according to sec 4 of labor act:
(a)Apprentice (d) temporary
(b) casual (e) permanent
(c) probationer (f) badli
Sec 4 (types of requisition)
• Can not employ without letter of appointment
• Shall provide ID card with recent photo

HR managers should make an arrangement for Cleanliness,
ventilation & temperature, dust and fume, disposal of waste,
lighting, drinking water,Latrines and urinals, dust bean and spittoon facilities for the

HR responsibility for Working hour & leave
• Daily hours (sec 100) : not more than eight hours
• Casual leave (sec 115): full wage for 10 days
• Sick leave (sec 116): Full wage for 14 days• Festival holidays (sec 118): paid 11 days• Annual leave (sec 117): Adult worker get one day holiday for 18 days >>>> shop or commercial 22 days >>>> tea plantation 11 days >>>> Newspaper worker
Responsibility of Extra-allowance for overtime according to Sec. 108
(1)Where a worker works in an establishment on any day or week for more than the hours fixed under this Act, he will get allowance at the rate of twice his ordinary rate of basic wage and dearness allowance by HR manager.
(2)Where any worker in an establishment are paid on a piece rate basis HR manager will fix time rates as nearly as possible equivalent to the average rates of earnings of those workers, and the rates so fixed shall be deemed to be the ordinary rates of wages of those workers.
OVER TIME
HRM responsibilities for pregnant worker
In maternity period every female worker shall get following benefits
• Sec 45: will get leave during the eight weeks immediately following the day of her delivery.
• Sec 46: shall be liable for, the payment of maternity benefit. if she has two or more surviving children, she will not have it.
• Sec 49: if women die on delivery, manager will pay benefits due.
Washing facilitiesWashing facilities (Sec 42) Every HR manager should check
following facilities:1. Adequate & suitable facilities for
washing be provided.2. Separate facilities for male and
women3. Such facilities must be conveniently
accessible & kept clean.
Sec 89:First aid appliances
• First aid boxes or cupboard shall be maintained & shall not be less than one for every 150 workers at one time.
• If more than 500 worker working in the organization there should be room with nursing stuff.

According to the labor law 2006 sec (94) HR manager needs to provide Rooms for children
1.Where in forty or more workers are ordinarily employed, there shall be provided and maintained a suitable room or rooms for the use of children under the age of six years of such women.
2.Such rooms shall provide adequate accommodation, adequately lighted and ventilated and maintained in a clean and sanitary condition and shall be under the charge of woman trained or experienced in the care of children and infants.In 2006 Grameen phone opens “Happy Hearts” for employees’s child in GP HOUSE with the presence of Emad Ul Ameen, director (human resources)
ROOM FOR CHILD
GROUP INSURANCEHRM department should follow Section 99 of Labor Act and ensures group insurance for those establishments where at least 200 workers work.
REALITY OF HR PRACTICE• Worker works for 9-11 hours and its not
counted as overtime or gets BDT. 35-50 for per hour.(violation of sec 108)
• Violation of safety (sec. 61) : 1132 killed in the 24th April 2013 RANA PLAZA collapse.
• Violation of (ILO Convention 98, article 2): “yellow union” practice.
• 67% worker works 8 hours a day. 78% of workers were put on the night shift, at times remaining at the factory until 3am.
