2.0 THE PROJECT
2.1 Project Background
The National Highway Authority of India (NHAI) has decided to take up the
development of various National Highways Stretches / Corridors under the National
Highways Development Programme (NHDP). NHAI had accordingly invited proposals by
its Notice Request for Qualification No. NHAI/NHDP-III/MAHA/BOT/PI dated 29-01-
2010 (the "Request for Qualification" or "RFQ") for short listing of bidders for
construction, operation and maintenance of the of NH-17 (Presently, NH-66) on DBFOT
basis and had shortlisted certain bidders including, the consortium comprising M/s
Supreme Infrastructure India Ltd., M/s China State Construction Engineering (Hong
Kong) Ltd. and M/s Mahavir Roads and Infrastructures Private Ltd. with M/s Supreme
Infrastructure India Ltd. as its Lead Member. Further, NHAI had accepted the bid of
the Consortium and issued its Letter of Award No. NHAI/BOT-I/11012/62/2005/14902
dated 28-10-2010 to the Consortium. On 21-01-2011, NHAI entered into agreement
with Consortium “Supreme Panvel Indapur Tollways Private Limited (SPITPL)” as
Concessionaire, a company incorporated under the provisions of the Companies Act,
1956 and having its registered office at Supreme City, Hiranandani Complex, Powai,
Mumbai - 400076, Maharashtra, India, for execution of the Project on DBFOT basis.
Thus, National Highways Authority of India (NHAI) has entrusted the work of design,
construction, development, finance, operation and maintenance of Four-Laning of the
Panvel - Indapur section of NH-17 (Presently, NH-66) in the state of Maharashtra under
NHDP phase - III on DBFOT basis (Package No : NHDP-III/DL4/05) to the
Concessionaire M/s Supreme Panvel-Indapur Tollways Pvt. Ltd. (SPITPL).
Concessionaire has deployed two EPC Contractors for the construction of the Project.
M/s Yongma Engineering Co., Ltd. in association with M/s Feedback Infra Private
Limited has been appointed as the Independent Engineer [IE] for the Project.
The Project is having 84.6 Km length, located in the state of Maharashtra passing along
and adjacent to the Arabian Sea coast. The Project basically constitute upgradation
involving construction of 4-lanes highway including bridges, widening and rehabilitation
of existing bridges and culverts, elevated structures, ROB’s, wayside amenities,
realignment, bypasses etc. The Project forms part of the National Highway
Development Project (NHDP Phase-III) Program.
2.2 Project Location
The Panvel - Indapur section of NH-17 (Presently, NH-66) is located in the district of
Raigarh, which in turn is located in the State of Maharashtra. The State lies in the
Panvel-Indapur MPR No - 57 Oct. ’16 Page 23
western part of the Indian peninsula and is surrounded by the States of Gujarat,
Madhya Pradesh, Chhattisgarh, Andhra Pradesh and Karnataka.
Maharashtra has an area of 307,690 sq. km with a population of 96,752,247 and
Mumbai is the state capital. The population density per sq. km is 314.44. It has a
literacy rate of 77.3 %, the second highest in the country, against the average Indian
scenario of 65.4 %. More than 900 educational institutions provide 1,69,000 technical
manpower each year and 30% share of new patents, setting the pace for innovation in
India. There are in all 35 districts in Maharashtra. Raigarh district is situated in the
western part of Maharashtra. Raigarh district is surrounded by Thane district in the
north; Pune district in the east; Ratnagiri district in the south; and the Arabian Sea in
the west. According to 2001 census, the population of Raigarh was 2,205,972 with
population density of 309 persons per Sq Km. The district, being a part of Konkan
region receives heavy rainfall during the monsoon.
The National Highway No-17 (Presently, NH-66) is on the west coast linking Panvel
(Maharashtra) and Cochin (Kerala). This section of the National Highway is heavily
trafficked by both passenger vehicles and freight transport vehicles. To meet the need
for road safety and development of the area, Government of India through the
National Highways Authority of India (NHAI) is implementing the Project of
strengthening and widening of the existing two-lane roadway to a four-lane dual
carriageway. Apart from the four laning, flyovers, vehicular underpasses, pedestrian
underpasses, service roads, highway traffic management systems and other road
safety measures will be provided in these sections. The concession period is 21 years
including construction period of 910 days (approximately 2.5 years). The
implementation of the Project will reduce the time and cost of travel for traffic plying
between Panvel and Indapur in the Raigarh district of Maharashtra State. It will also
add to the development of tourism in the State.
NH-17 (Presently, NH-66) mainly traverses through the west coast of India, sometimes
touching shores of Arabian Sea. This highway touches the Arabian Sea at Maravanthe
in Karnataka and Thalassery in Kerala. It passes through the States of Maharashtra,
Goa, Karnataka and Kerala.
NH-17 (Presently, NH-66) start from the junction with NH-4B near Panvel connecting
Indapur, Mahad, Rajapur, Kudal in Maharashtra, Panaji and Margoa in Goa, Karwar,
Honavar, Udupi, Mangalore in Karnataka, Kasaragod, Kannur, Ponnani, Edappalli etc.
NH-17 (Presently, NH-66) allows for movement of goods by trucks from hinterland to
major sea ports of India. The trade and commerce in the region has increased due to
expansion of markets for agricultural and sea food produced in the region connected
by this highway.
The Project stretch runs in plain and short stretch of hilly terrain. The Project includes
6 nos. Major Bridges, 23 nos. Minor Bridges, 2 nos. Flyovers, 3 nos. ROB’s, 11 nos
Vehicular Underpasses, 15 nos. Pedestrian / Cattle Underpasses, 136 nos. Box/Slab
Culverts, 228 Pipe Culverts and 2 nos. Toll Plaza’s. The length of service road on LHS is
19.79 Km at on RHS is 17.76 Km totalling to 37.55 Km. and mostly located at urban

areas of the Project highway. The Panvel - Indapur section passes through the towns
of Pen, Vadkhal, Nagothane, Kolad and ends at Km 84 before Indapur town.
2.3 Terrain and Alignment
The Project passes primarily through plain & rolling terrain except for the two small
Ghat sections (Km 8 to 9 & Km 64 to 66) where the terrain can be classified as hilly.
The alignment is single carriageway comprising two lanes with width ranging from 7 m
to 10 m and earthen shoulder on either side. The alignment is generally straight with
reasonably large radii curves that are generally appropriate for high speeds except for
some sharp curves in the Karnala Bird Sanctuary portion and Sukheli Khind ghat
section. In these hilly stretches the alignment follows a winding path and several sharp
curves with limited sight distance are present. These curves need to be redesigned to
the extent possible within the available ROW and the overall visibility improved. In the
plain / rolling stretch the highway is not having any major cutting and filling whereas in
the Ghat areas some sections involve large to deep cuts. About 80 % of the Project
Highway runs on an embankment of 1.0 to 2.0 m height. However, significant
variations in heights of embankment are observed at low-lying fields and also at bridge
approaches.
The highway passes through rural agricultural areas and villages, such as Pen (Km
26+600 to 30+000), Wadkhal (Km 32+000 to 34+600), Nagothane (Km 53+000 to
56+200) and Kolad (Km 71+500 to 74+000). The adjoining land use is predominantly
barren with patches of agricultural land, forest and built-up locations. The highway
passes through several towns and many villages some of which have settlements in
close proximity of the highway.
The existing highway has a single two-lane carriageway with pavement width varying
from 10 m to 11.0 m and 1.0 m wide soft shoulder on either side till Km 33. Beyond
this, the width is 7.0 m with soft shoulders of 1.5 to 2.0 m, till the end of the Project.
The highway is on an embankment for most of the length except in Ghat areas from
Km 8 to 9 and Km 64 to 66 where it lies in cutting. The embankment height in general
varies between 1.0 to 5.0 m but there are several locations where it is less than 1m.
However, there is no history of submergence or overtopping of the pavement at these
locations. The depth of cutting in Ghat Sections varies between 1.0 to 10.0 m. The
pavement condition is found to be fair to good for the almost the entire length except
for the stretch from Km 20 to 25 and Km 40 to 42 where substantial raveling and
rutting is observed. The riding quality as such also varies from fair to quite good. Most
of these stretches have been overlaid recently by the Department.
No organised drainage system exists along the Project Highway. However, the highway
level is sufficiently raised and earthen drains have been constructed to drain the
surface water to the nearby culverts. At some locations, lined drains have also been
constructed adjacent to the shoulders. Local enquiries reveal that there is no history of
overtopping of the road at any location.

3.0 THE ESTABLISHMENT
3.1 Project Organisation
NHAI
NHAI have established a Project Implementation Unit at Panvel. The Project
Director is Mr. Prashant J. Fegade. He is supported by the Manager (Tech.) Mr.
Abhishek J. Agrawal and other Administrative Staff.
Concessionaire
The Organization of Concessionaire’s is represented by its SPV Manager, Mr.
Pradeep Garole. He is responsible for day to day activities of the Concessionaire
and he also provides information to IE/NHAI as and when necessary.
Concessionaire has established their office near Km 27+800 at Pen.
Concessionaire’s Organisation chart is given in Figure 2.1.

Independent Engineer
The Independent Engineer, Yongma Engineering Co., Ltd in association with
Feedback Infra Private Limited mobilised on 28-12-’11 and the Consultancy
Agreement was signed on 11-01-‘12. The team at site is headed by the Team
Leader cum Sr. Highway Engineer. All Key-Professionals were mobilised. Part
Time / Intermittent staff is visiting site on as and when required basis apart from
reviewing Design, Drawings and Submittals from main / satellite offices. In
addition to above, Project Manager and Project Director at Head Office work as
link between site office and main office for co-ordinating issues beyond day to day
works. The Table 2.1 below shows the deployment of Independent Engineer.

The present set of machinery is highly insufficient to complete the project with proper
quality in time.

4.0 PROGRESS OF WORKS
4.1 Land Handing Over
Concession Agreement Vol-I, Clause 10.3 specify that on or prior to the Appointed
Date (that is 19-12-2011), NHAI shall have granted vacant access and Right of Way
such that the Appendix shall not include more than 20% of the total area of the Site
required and necessary for the Four-Laning of Project Highway. Also, NHAI shall make
best efforts to procure and grant, no later than 90 days from Appointed Date (that is
18-03-2012), the Right of Way to the Concessionaire in respect of all land included in
the Appendix. Total land to be acquired is 504 Ha. Now, major part of the Project
highway is encumbrance-free and available for construction.
Diversion of 1.65Ha Forest Land in the core area of Karnala Bird Sanctuary
(1500m length) : The proposal has been approved by RO MoEF, Nagpur vide letter
dt 23-06-2016 subject to fulfillment of conditions for grant of stage-II approval by
State Govt. Further, Conservator of Forest (WL), Thane vide letter dt. 14-07-2016 has
requested to deposit NPV & CA charges (Rs 88,18,668 /-) through e-challan in Ad-hoc
CAMPA of Maharashtra State and also 2% of the Project cost against diverted 1.65 Ha
forest area to the office of CF (WL), Thane. NHAI has deposited these charges on 23-
09-2016. Working permission awaited.

5.0 UALITY CONTROL & QUALITY ASSURANCE
5.1 Quality Control & Quality Assurance
Quality Assurance of a Project is defined as a process which exercises various checks
at different stages of a work right from its inception till its acceptance, to put it in
services to ensure that the work has been properly designed and constructed as per
approved designs, drawings and specifications.
Quality Control is defined as the procedure adopted and control exercised to ensure
that the materials proposed to be used in production, processes adopted for
production and workmanship of production conform to the prescribed standards and
laid down acceptance criteria.
The Quality Control is exercised by construction agency that ensures that the defined
objective is achieved through appropriate tests, checks and inspections by suitable
qualified personnel. Furthermore, the objective evidences of all tests, checks and
inspections carried out from time to time are documented in prescribed formats for
reference and record.
Independent Engineer’s professional staff is frequently checking various works at site
and wherever found necessary, corrective measures are suggested to the
Concessionaire.
5.2 Compliance/Non-Compliance
Non-Compliance cases are being reported through Non-Conformance Reports.
Concessionaire is constantly advised to take necessary rectifications for such non-
compliances in time. List of NCR’s issued and their statuses are given in Table 4.1. &
4.2. Concessionaire has been constantly advised to make necessary rectifications and
submit for closure of NCR within stipulated time. Many NCR’s are not yet closed out in
spite of several reminders.
The status of calibration of equipments in the laboratory and plant is given in Appendix
- P.
5.3 Routine Inspection by Independent Engineer
Independent Engineer is conducting routine inspection of the works at site and
notifying the Concessionaire about any non-compliance observed. List of Site
Inspection Note issued so far is given in Table 4.3. Details of Audit Reports issued to
the Concessionaire are given in Table 4.4. Details of tests carried out are given in Table

6.0 TRAFFIC & SAFETY
6.1 Safety Issues
(i) There is an urgent need to provide all the required traffic control & safety devices
viz., signs, delineators, blinkers, barriers, etc. at the work sites as per relevant
standards viz, NHAI-Technical Specifications, IRC-SP-55 & IRC-SP-84 wherever
lapses are observed.
(ii) All ‘Working Zone’ must be provided with adequate lateral & longitudinal buffer
clearances as per IRC-SP-55.
(iii) Workers at site must be provided with necessary PPE viz., Safety Shoe, Gloves,
Jackets, etc.
(iv) Traffic Diversions are potential accident spots since vehicles approach the
diversions at high speeds. Appropriate temporary signs, delineators, blinkers, New
Jersey barriers & barricades must be provided at the diversions and at proper
locations to guide the vehicles to safety before passing by the work zones.
(v) The Concessionaire has been advised to comply the deficiencies observed in the
traffic safety measures taken.
(vi) Traffic diversions are potential accident spots during construction period.
Necessary signs to be provided at such locations. Many of the diversions provided
at site are sharp and not with proper geometry which leads to accidents. Many
letters are issued to Concessionaire to rectify the safety issues at site.
(vii) All safety issues at site are reported to the Concessionaire for necessary
compliance.
Show cause notice was issued to the Concessionaire to improve the safety and
maintenance issues on the Project highway. At most of the diversions, necessary
cautionary boards are not provided, the transitions are not smooth, the road surface is
not pothole free and smooth. In spite of several reminders Concessionaire has not
provided required safety measures at site.
6.2 Accident data
The accident data is given in Appendix-I.
6.3 Maintenance of Existing Highway
Concessionaire is being advised to continue maintenance of the existing highway to
traffic-worthy condition. Site Inspection notes / letters are issued to Concessionaire in
this regard. Further, advices were given to the Concessionaire to maintain the hand rail
of structures, vents of structures etc.
Concession Agreement, Vol-I, Clause-12.2 specifies that “During the construction
period the Concessionaire shall maintain, at its cost, the existing lane(s) of the Project

Highways so that the traffic worthiness and safety thereof are at no time materially
inferior as compared to their condition 7 (Seven) days prior to the date of this
Agreement, and shall undertake the necessary repair and maintenance works for this
purpose; provided that the Concessionaire may, at its cost, interrupt and divert the
flow of traffic if such interruption and diversion is necessary for the efficient progress of
Construction Works and conforms to Good Industry Practice; provided further that
such interruption and diversion shall be undertaken by the Concessionaire only with the
prior written approval of the Independent Engineer which approval shall not be
unreasonably withheld. For the avoidance of doubt, it is agreed that the Concessionaire
shall at all times be responsible for ensuring safe operation of the Project Highway.”
Since Concessionaire was not doing much maintenance work, NHAI has mobilised
outside agencies to complete the maintenance works at the risk and cost of
Concessionaire.
6.4 Incident Management System
Concessionaire has made arrangement for Incident Management System. During the
recent monsoon, landslides concurred at Sukheli Khind and Concessionaire mobilesd
necessary machinery to clear the Project Highway and make smooth traffic movement.
Similarly at the culvert (Ch. 5+300 LHS) the approach retaining wall partially collapsed
recently and Concessionaire made arrangements to divert the one side traffic on the
other carriageway.

7.2 Project Milestones
Project Milestone - I
The Concessionaire has to achieve Project Milestone-I by 19-12-2012 as per Schedule -
G of the Concession Agreement. They have requested/applied for shifting the date of
Project Milestone-I for a period of 135 days. The Independent Engineer advised the
Concessionaire to submit the details of actual progress (both Physical & Financial) with
substantiating supporting details to enable Independent Engineer to critically analyse
the case.
Independent Engineer has critically assessed the allowable Extension of Time (EOT) for
achieving Milestone-1. Accordingly, it was observed that the allowable Extension of
Time (EOT) due to various issues such as delayed handing over of land, delay in
approval of GAD for ROB’s, delay in shifting of various utilities etc. is assessed to be
152 days (That is upto 20-05-2013). However, Concessionaire requested for Extension
of Time, for 135 days from stipulated Milestone -1 date (That is upto 03-05-2013).
While recommending Extension of Time for Milestone No-1, Independent Engineer has
critically assessed and concluded that Concessionaire is eligible for 152 days extension
(That is upto 20-05-2013). However, Concessionaire has requested for Extension of
Time for 135 days only which fall on 03-05-2013. The Milestone no-1 was achieved on
01-05-2013 that is, 133rd
day from Schedule milestone no-1 date, which was within the
recommended period of Extension of Time. Executive committee of NHAI has approved
EOT upto 01-05-2013.
Project Milestone - II
The Concessionaire has to achieve Project Milestone-II by 19-12-2013 as per Schedule-
G of the Concession Agreement. Concessionaire vide their letter no. SPITPL/P-
NHAI/2013-14/2471 dt 28-01-’14 has claimed and informed NHAI that they have
achieved Milestone-II by 19-12-’13 considering the land made available for
construction. Independent Engineer has reviewed and commented vide letter no.
PIP/IE/NHAI/2014/2164 dt. 03-04-2014. NHAI has advised Concessionaire to submit
undertaking specifying unconditional waiver.
In the modified revised construction programme for Project completion submitted by
Concessionaire, they have indicated that they will achieve Milestone-II by August 2015.

The executive committee of NHAI has approved Extension of Time to achieve Milestone
- II upto 31-10-2015.
However, Concessionaire has not achieved the scheduled Milestone-II. Independent
Engineer has advised them to submit details regarding how they are going to achieve
the desired progress.
Four Laning (Project Completion)
Concessionaire did not achieve the Four Laning (Project Completion) as stipulated in
Concession Agreement. Concessionaire has cited various issues such as delay in handing
over of encumbrance-free land, utility shifting, non-removal of encroachments etc.
Concessionaire has requested Extension of Time (EOT) for 898 days (That means upto 30
Nov 2016). It is to be re-iterated that Concessionaire should also continue to initiate pro-
active role in land acquisition and removal of encumbrances. Further, in the review
meeting by Member (PPP) at NHAI dt. on 31-10-‘14, it was advised to re-visit the EOT
issue and submit revised recommendations along with draft supplementary agreement.
Concessionaire has submitted detailed construction program showing completion of
stretch from 0+000 to 20+100 by June ’16 and stretch from 20+100 to 84+600 by
March ’16. Independent Engineer has recommended the same to NHAI for approval
along with EOT.
Approval by NHAI Executive Committee held on 19-02-2015 (Agenda No
230.05)
The Executive Committee of NHAI deliberated the agenda no 230.05 and approved
adjustments of milestone for scheduled 4-laning upto 30-03-2016 (upto 653 days)
excluding Eco-sensitive zone with mutual forfeiture of any Claim/Compensation for the
delays occurring of any kind. For Eco-sensitive zone stretch milestones for completion
shall be decided at the time of handing over of ROW subject to signing of
Supplementary Agreement Project by mutual resolution to remove the hindrances with
forfeiture of any claim or compensation of any kind in respect of the delays occurring
of any kind

The revisions in milestone are subject to the following:
(i) No extension of Concession Period will be granted on account of adjustment of
Milestone for Four-Laning. (i.e. extension for only construction period shall be
granted without extending Concession Period)
(ii) The progress of the Concessionaire will be monitored as per the revised schedule
for first six months from the grant of EOT and if the Concessionaire failed to
achieve the desired progress the action as deemed fit as per the provisions in
Concession Agreement may be initiated.
(iii) Concessionaire will submit an undertaking regarding completion of the four-
laning within the EOT granted.
(iv) The Concessionaire will not claim any damages for delay in handing over of land
approval of estimates for utility shifting /force majeure etc. or any reasons of
delay upto the Extension of Time (EOT) granted and Authority will not impose
penalty on account of delay in completion by the concessionaire till extension
granted on mutual basis.
7.3 Requests by Concessionaire for Extension of Concession Period
Concessionaire has submitted request for Extension of Concession Period vide their
letter no. SPITPL/P-IE/2015-16/3569 dt. 05-11-’15. Independent Engineer advised
concessionaire to submit the details in specific terms (delays in month) if any
attributing to both Concessionaire and NHAI instead of simply narrating history of the
Project. Concessionaire has submitted the request for Extension of Concession Period
on 07-03-2016. Independent Engineer has reviewed and submitted their comments
vide letter no. PIP/IE/NHAI/2015/636 dt. 29-03-2016. The Recommended Extension of
Concession Period is of 1318 days.
7.4 Request by Concessionaire for Extension of Construction Period
The Concessionaire has submitted application vide their letter reference SPITPL/P-
IE/2015-16/3774 dt. 04-04-’16 for Extension of Construction period. During the
analysis and recommended of Extension of Concession Period it was considered that
80.88% length of land was available by 31-06-2016. Considering 12 months
construction period for the work for which land was not available and 3 months time
as monsoon season, the construction period can be extended upto 28th September
2017 in line with the calculations given during Extension of Concession period. That
means, the total Extension of Time (EOT) for construction period is 1200 days (upto
28-09-2017). Accordingly, Independent Engineer has recommended Extension of
construction period (EOT) upto 28-09-2017 and the approval is in process.

8.0 CRITICAL ISSUES AND RECOMMENDATIONS
(1) Slow Progress of RE Wall Works: Though Concessionaire has initiated some RE
wall works, it is completely stopped. This will be critical activity on the Project.
Concessionaire should immediately pursue this matter. Out of the total 26 underpasses
not even single underpass structure and its approaches is completed.
(2) Slow Progress of shifting of Electrical Posts and Lines, MJP Water Pipe Lines
by Concessionaire : The shifting of electrical poles and lines is very slow. Hardly any
crossing is done so far. The shifting of MJP water pipeline is slow. Concessionaire
should speed up these activities.
(3) Slow Progress of Structure Works: The progress of structures (especially, major
bridges, flyovers and ROB’s) is slow. Concessionaire should improve the progress of
structures. The overall progress so far is 40 % only.
(4) Slow Progress of Highway Works :
In spite of prevailing good working season, absolutely no work is in progress in both
sections. It appears that the works are held up for want of fund cement, bitumen, diesel,
manpower, machinery and other resources. The length of highway works completed (m)

(5) Safety Issues:
Many safety issues were identified and notified to the Concessionaire. The safety
issues observed are mainly improper diversions, shoulder drop, road side deep cutting,
non-demarcation of construction zone, lack of sign boards, damaged crash barriers
etc. Many letters have already been issued to the Concessionaire to improve the safety
situation. In spite of such several reminders Concessionaire has not provided
necessary signs at diversions.
(6) Pending Designs and Drawings:
Some design and drawings for highway and structures are still pending with
Concessionaire. In spite of several reminders no action is taken by Concessionaire.
(7) Insufficient Resources:
Concessionaire has not mobilised sufficient resources such as fund, manpower,
machinery, plant etc. Resources mobilised are less. Construction works were held up
many times for want of fund, cement, bitumen, diesel, manpower, machinery, and
other resources etc.
