TheDisciplineCommitteeOrdersasfollows:
1. TheDisciplineCommitteeacceptsinitsentiretytheSettlementagreedtobythePartiesandas setoutintheJointSubmissiononPenaltyanditsattachedSchedules;
2. Accordingly,theComplaintsmadeagainstMs.LucionassetoutinICCRCFilesNo.CD.2013.936 andCD.2014.216havebeenresolvedandthefollowingpenaltyisimposed:
(a)NolaterthanSeptember1st,2016Ms.Lucionshalltakeaminimumof5hoursofContinuingProfessionalDevelopment("CPD")onthetopicofclientcommunication;
(b)TheCPDnotedatparagraph(a)aboveshallbeinadditiontothe16hoursofannualrequiredCPD.ItistheresponsibilityofMs.Luciontofind,registerfor,andcompleteCPDinfulfillmentofparagraph(a)above.Ms.LucionmaynotcounthoursspenttakingamandatoryPracticeManagementEducationcoursetowardthefulfillmentoftherequirementatparagraph(a)above;
(c)Ms.LucionwillprovidetheICCRCRegistrarwithasworn/affirmeddeclarationthatshehascompletedtheProfessionalDevelopmentrequirementnotedatparagraph(a)abovenolaterthanSeptember6,2016;
(d)AreprimandintheformsetoutintheattachedSchedule"C"shallbeplacedintheMember'sICCRCFileforaperiodof2yearsfromthedateoftheDisciplineCommittee'sOrder;
3. ThisOrdershallbepublishedontheICCRCWebsite;
(a)TheOrdershallbetransferredfromtheRecentorCurrentDecisionssectionoftheICCRCWebsitetotheArchivedDecisionssectionoftheICCRCWebsiteonreceiptofthesworn/affirmeddeclarationnotedatparagraph2(c)above.
(b)OntransfertotheArchivedDecisionssectionoftheWebsite,theMember'snameandregistrationnumbershallberedacted.
