Preamble Recognizing that
the public service labour-managementregime must operate in a context where protec-tion of the public interest is paramount;
effective labour-management relations repre-sent a cornerstone of good human resourcemanagement and that collaborative efforts be-tween the parties, through communication andsustained dialogue, improve the ability of the
public service to serve and protect the publicinterest;
collective bargaining ensures the expressionof diverse views for the purpose of establishingterms and conditions of employment;
the Government of Canada is committed to
fair, credible and efficient resolution of mattersarising in respect of terms and conditions ofemployment;
the Government of Canada recognizes thatpublic service bargaining agents represent theinterests of employees in collective bargainingand participate in the resolution of workplaceissues and rights disputes;
commitment from the employer and bargain-ing agents to mutual respect and harmoniouslabour-management relations is essential to a
productive and effective public service;

(a) a person appointed by the Governor in
Council under an Act of Parliament to astatutory position described in that Act;
(b) a person locally engaged outsideCanada;
(c) a person not ordinarily required to workmore than one third of the normal period for
persons doing similar work;
(d) a person who is a member or specialconstable of the Royal Canadian MountedPolice or who is employed by that force un-der terms and conditions substantially thesame as those of one of its members;
(e) a person employed in the Canadian Se-curity Intelligence Service who does not per-form duties of a clerical or secretarial nature;
(f) a person employed on a casual basis;
(g) a person employed on a term basis, un-less the term of employment is for a periodof three months or more or the person has
been so employed for a period of threemonths or more;
(h) a person employed by the Board;
(i)
a person who occupies a managerial orconfidential position; or
(j) a person who is employed under a pro-gram designated by the employer as a stu-dent employment program.

Powers of Board 40. (1) The Board has, in relation to anymatter before it, the power to
(a) summon and enforce the attendance ofwitnesses and compel them to give oral orwritten evidence on oath in the same manneras a superior court of record;
(b) order pre-hearing procedures, includingpre-hearing conferences that are held in pri-vate, and direct the date, time and place ofthe hearings for those procedures;
(c)
order that a hearing or a pre-hearing con-ference be conducted using any means oftelecommunication that permits all persons
participating in the conference to communi-cate adequately with each other;
(d) administer oaths and solemn affirma-tions;
(e) accept any evidence, whether admissiblein a court of law or not;
(f) examine any evidence that is submittedto it respecting membership of employees in
an employee organization seeking certifica-tion and, in the case of a council of employeeorganizations seeking certification, in anyemployee organization forming part of thecouncil;
(g) examine documents forming or relatingto the constitution or articles of associationof any employee organization seeking certifi-

(j) subject to any limitations that the Gover-nor in Council may establish in the interestsof defence or security, enter any premises ofthe employer where work is being or has
been done by employees, inspect and viewany work, material, machinery, appliance or
article in the premises and require any personin the premises to answer all questions relat-ing to the matter before it;
(k) subject to any limitations that the Gover-nor in Council may establish in the interestsof defence or security, enter any premises ofthe employer for the purpose of conductingrepresentation votes during working hours;and
(l) authorize any person to do anything thatthe Board may do under paragraphs (d) to (k)and require the person to report to it on whatthe person has done.
