Mr.Feingoldwasresponsibleforconductinganin‐depthanalysisofthecurrentgasratesandservicesforaMidwesterngasutility.Hedevelopedanappropriatepricingstructurefortheutility’sunbundledgastransportationandstorageservicesandassistedinestablishingalonger‐rangepricingstrategyforallutilityserviceswithsupportprovidedthroughthepresentationofexperttestimony.ThisassignmentistypicalofMr.Feingold’sworkintheutilityratedesignandanalysisarea.

Interstate Natural Gas Pipeline Ratemaking and Regulation 

Mr.FeingoldhasworkedonnumerousratemakingandregulatoryprojectsonbehalfofmajornaturalgasshippersinvolvinginterstatenaturalgaspipelinecompaniesregulatedbytheFederalEnergyRegulatoryCommissionintheU.S.andtheNationalEnergyBoardinCanada.Theseprojectshaveaddressedawidevarietyofissues,including:

Revenuerequirements; Costallocationmethods Ratedesignandcompetitivepricing; Serviceandrateunbundling; Salesforecastinganalyses; Revenuesharingmethods; Fuelcostrecoveryandfueltrackermechanisms;and Experttestimonyandenergylitigationsupport.

Competitive Market Assessment 

Inconjunctionwiththederegulationofthegasandelectricutilityindustries,Mr.Feingoldhasassistedutilitieswiththeevaluationanddevelopmentofnewenergy‐relatedproductsandservices.Theseassignmentstypicallyincludeanassessmentofcompetitorsandthestrategicopportunitiesandthreatsposedbyfuturemarketconditions,anassessmentofcustomerneeds,developmentofhigh‐levelproductandservicestrategies,developmentofprototypeproductsandservices,anevaluationoftheirexpectedfinancialperformance,preparationofmarketrolloutstrategiesandaspecificationofthecorporateinfrastructurerequirementsassociatedwiththeirmarketrollout.

Mr.FeingoldhasassistednumerousgasandelectricutilitiesinNorthAmericatodesignandimplementretailcustomerchoiceprograms.Hisworkhasfocusedonthefollowingtopicalareas:reviewsofindustrytrendsandsuccessfulchoiceprograms,costofservicestudyandrevenuerequirements,rateandserviceconceptdevelopment,analysisofdemandforecastingmethodologies,analysisoffinancialimpactsofcustomerchoice,customerrelationshipstrategydevelopment.organizationdesignsupport,andexperttestimonyandwitnesspreparation.

Onbehalfofanunregulatedenergymarketingaffiliate,Mr.FeingolddirectedaprojecttoassesstheclaimsmadebytheU.S.DepartmentofJusticethatthemarketingaffiliateviolatedantitrustlaws.Specifically,theclaimsfocusedontheimpactthatthecompany’sformationhadoncompetitionrelatedtosecondarycapacityrightsoninterstatenaturalgaspipelinesandwhethertherewasanyattempttomonopolizethatcapacity.

WithinthebroadercontextoftheNorthAmericangascommodityandpipelinetransportationmarkets,adetailedmarketpowerassessmentwasconductedthatevaluatedthepipelinecapacityheldbythemarketerrelativetothecapacityheldbyothercompetingshippersonthepipeline.Basedonhisanalysis,itwasconcludedthattheenergymarketerwasnotinapositiontoexerciseanylevelofmarketpowerunderanyeconomicorlegalstandard.

OnbehalfofamajorNewEnglandcombinationutility,Mr.Feingolddirectedaprojecttoconductacompetitiveassessmentofvariousunbundledservices,includingcustomerbilling,callcenteroperations,meterservices,meterreading,streetlighting,anddistributionservice(bothgasandelectricfunctions).Theworkconsistedofthefollowingactivities:

Identifytheservicesprovidedbygasandelectricdistributioncompanies;

Identifytheactualcostsofprovidingtheseservices;

Benchmarktheutility’sperformanceagainstothercompanies;

Identifycurrentandfuturecompetitorsforeachservice;and

Formulateabusinessplanforeachservice.

Mr.Feingoldhasdirectedorparticipatedinvariousprojectsrelatedtomarketanalysisanddemandforecasting,aswellasthefunctionalareaofmarketing.Aspartofbroaderpricing‐relatedprojects,hehasreviewedandassistedinthedevelopmentofthemarketingstrategies,plansandprogramsofmanylocaldistributioncompanies.Theseprojectshaveincludedmarketresearchandsegmentationanalysis,marketforecasting,loadresearchandcustomerfocusgroupevaluations.Mr.Feingold’sclientsinthisareahaveincludednumerousMidwesternandNortheasterngasandelectricutilities.

ForaSoutherngasutility,Mr.Feingoldperformedastrategicandoperationalassessmentofitsmarketing,pricingandgassupplyoperations,aswellasemergingopportunitiesinthenaturalgasandelectricpowermarketingindustries.

Mr.FeingoldparticipatedinaprojectforaMidwesterngasutilitytodevelopcomprehensiveintegratedleast‐costplansforfilingbeforeitsstateregulatorycommission.Thisprojectdealtwithallaspectsofintegratedresourceplanning,includinggassupply‐sideplanningandstrategies,DSMprogramscreening,developmentandimplementation,evaluationofcostrecoverymechanisms,supply‐anddemand‐sideintegrationactivities,andregulatorypresentationandacceptance.OthergasutilitiesforwhichsimilarserviceswereprovidedincludeaMidwesterngasutility,aSoutherngasutilityandanEasterngasutility.

Mergers, Acquisition, and Corporate Restructuring 

Mr.FeingoldservedastheoverallProjectOfficerforalong‐termassignmentwithDetroitEdisonCompany,MichiganConsolidatedGasCompany(MCN)andtheFederalTradeCommission(FTC)inconjunctionwithDetroitEdison’sacquisitionofMCN.Specifically,heservedastheAuditorofa20‐yearEasementAgreement(forgasdistributionassets)betweenMCNandExelonEnergytoimplementacompetitiveremedyrequiredbytheFTC,asapre‐conditionofthemerger,pertainingtothesupplyofnaturalgastoanyelectricdisplacementloadsinthemergedutilityserviceterritories.

Mr.FeingoldservedasProjectManagerinprovidingassistancetoanEasternutilityholdingcorporationduringitsproposedacquisitionofanEasterngasandwaterutility.Hisresponsibilitiesincludedtheidentificationofthepotentialsavingsthatwouldresultfromtheacquisition,thedevelopmentofaninter‐jurisdictionalgascostallocationmethodologyandrelatedassistancedealingwithobtainingthenecessaryregulatoryapprovaloftheacquisition.

OnbehalfofIndianaGasCompany(VectrenEnergy)andCitizensGas&CokeUtility,heprovidedstrategicandlitigationsupportinconjunctionwiththeirformationofanunregulatedgasmerchant/marketingcompany(ProLianceEnergy,LLC).Hisresponsibilitiesincluded:

AssessmentofthestrategicandeconomicbenefitsofthenewcompanyfromtheperspectiveoftheLDCs’ratepayers;

OnbehalfofaUnionGasLimited(WestcoastEnergy/DukeEnergy),Mr.Feingolddirectedaprojecttoorganizationallyseparatetheutility’sEnergySolutionsBusinessfromitsGasDeliveryBusiness.Specifically,theprojectteamconductedthefollowingtasks:

Researchedandestablishedtheclient’sbusinessandcostseparationprinciples;

Developedcomputermodelingcapabilitiestoconducttheunderlyingcostseparationanalysis;

Conductedthecostseparationstudy;

Assistedintherestructuringoftheclient’ssharedcorporateservices;

Assistedintheestablishmentoftransferpricingprinciplesforuseinsettingpricesofsharedservicesbetweenthetwobusinesses;

Advisedtheclient’sexecutivegrouponbusinessseparationstrategiesandissues;and

Preparedandsupportedexpertevidencebeforetheclient’sregulatorybody.

Mr.FeingoldwasresponsibleforanassignmentwithamajorMidwesterngasutilitytoevaluateapotentialacquisitionofspecifictransmissionassets,gasproductioncontractsandrelatedgatheringfacilitiesfromanothercompany.Hisresponsibilitiesincludedconductinganeconomicandnon‐economicevaluationofthepotentialacquisition,assessingtheimpactoftheacquisitionfromanoperating,financialandregulatoryperspectiveandidentifyingthekeyrisksrelatedtotheacquisition.

OnbehalfofaSoutherngasutility,Mr.Feingoldparticipatedintherestructuringofanexistingcorporateorganizationintogasdistribution(intrastate)andgaspipeline(interstate)operatingdivisions.Heassistedintheoperational,regulatory,legal,financial,andaccountinganalysesthatdevelopedfinancial,gassupplyandmarketforecastsnecessarytodeterminetheeffectsofthereorganization.

Mr.Feingoldhasactivelyparticipatedinnumerousregulatoryduediligenceprojectstoevaluatetheregulatorypolicies,processes,andproceduresapplicabletothegasandelectricutilityoperationsofthetargetutilitycompany.

Gas Supply Planning and Procurement 

Mr.Feingoldhasconductednumerousstudiesrelatedtogassupplyprocurementandplanningforlocaldistributioncompaniesandcombinationutilities.Thesestudieshaveanalyzedawiderangeofissues,includingtheavailabilityandcostoffuturesupplies;evaluationofalternategassupplyanddeliverabilityresources;gassupplyplanning,procurementandmanagementprocessesofautility;supplyreliabilityandpeakday/winterseasoncapacitylevels;andtheappropriatenessofacapacityreservemargin.

Additionally,hehasbeeninvolvedingassupplymodelingactivitiesrelatedtoleast‐costplanningandtheevaluationoftransportationprojectalternatives.Mr.Feingoldhasprovidedtheseservicestovariouslocaldistributioncompanies,includingthreeMidwesterngasutilities,aWesterngasandelectricutility,aSoutherngasutility,aMidwesterngasandelectricutility,anEasterngasandelectricutilityandaMidwesterngasutility.

Mr.Feingoldworkedwithnumerousgasdistributionutilitiestoanalyzeandsupportthroughexperttestimonytheirdesigndaydemandandcapacityrequirementsbeforeutilityregulators.TheseincludedSouthJerseyGasCompany,EquitableGasCompany,DominionPeoplesandDominionEastOhioandPGEnergy.

OnbehalfoftheGasResearchInstitute(GRI),Mr.Feingolddirectedacomprehensivestudytoevaluatethefutureroleofpeak‐shavingingasutilityoperations.Theobjectiveofthestudywasto:

Evaluatetheroleofpeak‐shavingsuppliesinrelationtostorageanddeliverabilitywithinthelargercontextoftheevolvingdemandprofileinthenaturalgasindustry;

Determinepeak‐shavingcosts;

Summarizetrendsinutilitydecisionpracticesthatinfluencethevalueofpeak‐shavingsupplies;

Assesstheopportunitytorealizesynergieswithutilitypeak‐shavingandnew‐enduses,suchaspowergenerationandtransportation;

Projectfuturedemandforpeak‐shavingsupplies;and

Isolateanyissuesorbarrierstoincreasingthebenefitofutilizationofpeak‐shavingsuppliesandidentifyanyR&Dopportunities.

Mr.Feingoldhasalsoadvisedelectricutilityclientsontheprocurementofgassupplyandinterstatecapacityresourcesforuseinelectricgeneration,includingNevadaPowerCompanyandanEasterncombinationutility.

Operational and Transactional Reviews 

OnbehalfofaCanadiangasutility,Mr.Feingoldwasresponsibleforestablishingtheoriginalorganizationalframeworkandstructurefortheutility’srateand

regulatoryactivities.Heidentifiedandspecifieddatabaserequirements;manpowerandworkexperiencerequirements,establishedjobdescriptions,anddelineatedtheappropriatemannerinwhichthedepartment’sactivitiesshouldinterfacewithothercorporateactivitieswithinthecompany.

Onbehalfofoneofthelargestintegratedgascompanies,Mr.Feingolddirectedacomprehensivereviewofinter‐companytransactionsandrelationshipsamongitsaffiliateorganizations.HisresponsibilitiesincludedexaminingtheappropriatenessofitsaffiliatetransactionprocessandevaluatinghowreasonablethelevelofaffiliatechargesincurredwerebyeachoftheLDCaffiliatesandconductingacomparativeassessmentofitsaffiliatetransactionsthroughbenchmarkingagainstthetransactionsofsimilarly‐situatedgasutilities.

Mr.Feingoldledaprojectteamonanassignmentforamajormid‐Atlanticgasutilitytoreviewandanalyzethelostandunaccountedfor(LUF)gaslevelsexperiencedhistoricallyonitsgassystem.Theeffortrequiredtheteamtoreview,analyzeandvalidatethedataandproceduresusedbytheutilitytoreconcileandaccountforthegasreceivedintoitsgassystemandthegasdeliveredtoitscustomers.Bothaccountingandoperationalissueswereconsideredintheproject,andacomprehensivestructuralprocesswasdevelopedformonitoringandevaluatingLUFinternallyonanongoingbasis.

Mr.FeingoldservedasProjectManageronanassignmentforaSoutherngasutilitytoevaluateitsaccountingproceduresandbusinesssystemsfortransportationservice.Inaddition,Mr.FeingoldwasresponsibleforconductingadetailedreviewtoidentifyimprovementsintheCompany’spracticesandmethodsformanaginglostandunaccounted‐forgaslevels.

ForaNortheasterngasutility,Mr.Feingoldperformedacompletefinancialreview,withanalysisandrecommendations,dealingwithfinancialandsalesforecastingmethods,revenueinstabilityproblemsandreturnoninvestment.

Mr.Feingoldhasparticipatedinvariousgasutility‐relatedprojectsinvolvingthespecificationofuserrequirements,conceptualsystemdesign,andthetestingandevaluationofsoftwaresystems,whichwerebothmainframeandPC‐based.Specifically,thesesystemsrelatedtocostingandratedesign,gastransportationmeasurement,billingandaccounting,revenueforecasting,gassupplyplanninganddispatching,marketinginformationsystemsandregulatoryfilingrequirements.

HisclientshaveincludedanEasternutilityholdingcompany,twoSoutherngasutilities,numerousEasterngasutilities,aSoutherngasutilityandamajorMidwesterngasutility.

Mr.Feingoldhasalsoperformedanalysesofutilityenergycosts,energyconsumptionanddemandlevels,utilitypowercontractsandplantoperationsto

International Energy Assignments 

BesideshisextensiveworkexperienceinCanada,Mr.Feingoldhasparticipatedinnumerousinternationalenergy‐relatedassignments.OnbehalfofthelargestgasutilityinAustralia,Mr.Feingoldaddressedawiderangeofcosting,pricing,regulatory,competitive,organizationalandtransactionalissuespertainingtogasderegulationandopen‐accesstransportservicesforthegasindustryinAustralia.

OnbehalfofamajorAsianelectricutility,Mr.Feingoldconductedacomprehensivestudyofthetariffreformstrategiesandplansrequiredtoprepareanelectricutilityforfullenergyderegulation.Workincludedreviewoftariffreformissuesresultingfromrestructuringoftheelectricutilitiesinsixselectedcountriesanddevelopmentofimplicationsandrecommendationsforguidingchangestotheutility’soperating,financial,andmarketsituation.

Onbehalfofaninternationalgascorporation,Mr.Feingoldreviewedandevaluatedpossiblechangesintheregulationofliquefiedpetroleum(LP)gascompaniesthatwereproposedbyanInternationalEnergyAgency.

Foraninternationalelectricutility,Mr.Feingoldperformedenergyauditsofselectedcommercialandindustrialelectricusersandevaluatedthecountry’spotentialenergyconservationlevelsoverforecastedfive‐and10‐yearperiods.

Mr.FeingoldassistedaninternationalgasutilityinunderstandingU.S.gasregulatorypolicies,proceduresandprogramsaspartoftheongoingeffortstoprivatizethegasindustryinthatcountry.

Onbehalfofagovernment‐ownedgasmanufacturingplantandassociatedgasdistributionsystemlocatedinMontevideo,Uruguay,Mr.Feingoldconductedaratestructureanalysisonacostofservicebasistoevaluatetheratelevelsnecessarytorecoverthefacility’scapitalinvestment;operationandmaintenanceexpensesandafairreturnoninvestmentoverthe15‐yearleaseterm;andonamarketorvalueofservicebasis,toevaluatethelevelofgaspricessupportablerelativetoothercompetitivefuelsources.

Expert Testimony and Litigation Support 

Asanintegralpartoftheservicesprovidedtoclientsintheabove‐discussedareas,Mr.Feingoldhasfrequentlypreparedandpresentedexperttestimonyinsupportofhisconsultingactivities.ThistestimonyhasbeenpresentedbeforetheFERCandnumerousstateandprovincialregulatorycommissions.

Specifically,Mr.Feingold’sexperttestimonyhasdealtwiththecostingandpricingofenergy‐relatedproductsandservicesforgasandelectricdistributionandgaspipelinecompanies.
