Safex ESEthe model for all eventualities
The Safex ESE is a flexibly malleable stainless steel support with general building authority approval made from 1.4301 steel, tested to DIBT and EN 795, and available as the variants Safex ESE, Safex ESE OF and Safex ESE TR.
Safex ESE
The standard model with universal hole pattern in the base plate for fixing to concrete, steel and wooden sub-surfaces. Available in support heights of 300, 400, 500, 600 and 700 mm.
Safex ESE OF
This model has no base plate so that it can be screwed directly in wooden beams and steel girders or glued into solid concrete. Available with a support height of 500 mm.
Safex ESE TR
The single anchorage point for bolting to trapezoidal sheet metal structural cladding (minimum height 85 mm, minimum thick-ness 0.75 mm). Available in support heights of 300, 400, 500, 600 and 700 mm. The base plate of the Safex ESE TR is made from coated thin metal sheet.
Our plastic weather protection cover is available as an option for all models, as are sealing accessories for bitumen and EPDM.

SAFEX ESE Light flat roof fall protection is a permanent stainless steel safety bracket that is fixed into the wall- facade structure and is used as a single anchorage point for the fall arrest or restraint system for personnel working on the edge of the building.

System with no roof penetrationWith the STONEKIT system with no roof penetration, a fall pro-tection device can be cheaply retrofitted to save space without interfering with the roof seal.
The newly developed STONEKIT protection is ideal for oc-cupational safety of 2 persons (1 person + 1 first aid-er) on flat roofs with a roof pitch to 5° and a parapet ≥ 150 mm.
As safety is our top priority, the STONEKIT is model tested in such a way that it far exceeds the required standard, as is the case for all our safety technology projects.

The GreenLine system has been developed to provide a secure anchorage option for several people at the same time with un-restricted movement over the intermediate and corner supports with the aid of a cable glider on a stainless steel cable.
The GreenLine cable securing system has general approval from the building authorities according to DIBT and EN 795 Class C. It is used as a cable attachment for people with personal protective equipment in areas where there is a risk of falling. GreenLine consists of energy-absorbing end connections, curve elements and traversable 180° swivelling intermediate cable brackets that allow work on both sides of the system, together with a special cable glider. The cable glider can be sus-pended at any point in the system or removed entirely. It is possible to travel over the complete system with-out hooking on to it - which ensures optimal safety for the user. The components of this cable system were designed on the basis of many years of experience and provide maximum safety, optimal user-friendliness and ex-tremely efficient fitting options.
GreenLine can be used on both flat roofs and facades in industry, for example.

End lock set GES-3with integrated shock absorption, fall indicator clamp and con-stant cable pre-tensioning.
End fixing on both sides of the system, cable pre-tensioning to 120 kg is constantly spring-loaded on both sides, built-in impact force damping on both sides, which significantly reduces forces in case of a fall (depending on the system configuration).
Pre-assembled on delivery. This means: Thread the cable through, tension it, tighten the screws, and you’re done.
Fitting is carried out with commercially-available tools, no special tools are required! Simple check during annual testing, as all parts are visible! The system has no jaw clamps and no crimping.

The system consists of a guide rail and specially curved brack-ets, which can be fitted to the side, overhead or on the ground with large intervals between brackets. The individual compo-nents allow the course of the guide rail to be adapted to the local conditions.
The MultiRail is a fixed horizontal rail-based anchorage sys-tem that meets DIN EN 795 Class D. MultiRail can also be used around corners and can even bridge vertical gaps of up to 1 m.
Distribution of the forces to the support structure in the event of a fall is achieved by means of a large number of intermediate brackets, not through the two end fittings, as is the case with cable systems, or a single point, as with anchorage points.
Grün MultiRail has the advantage of greater fixing gaps (up to 6 m) and a larger number of simultaneous users (up to max. 6 people).
Grün MultiRail guide rails do not require annual servicing, as is the case with cable systems. This reduces the running costs and offsets any increase in purchasing costs.

on the sensitive cladding is avoided. The system is designed in such a way that a direct connection with the subsurface is not required. As a result, all liability risks and warranty claims, for instance due to leaks in the roof sealing, are excluded from the outset. The patented AluFix® aluminium flat roof protection system, which is certified by the German Professional Association for the Building Industry, can be used on flat roofs with a pitch to 10°. It is used as a temporary protective structure for work on roofs and is therefore ideal for use on new builds and renovations of buildings in which scaffolding cannot be erected.
It can be used on roofs from which there is a drop of at least 3 m (according to the “Construction Work” accident prevention regulations) to max. 100 m.

Personal protective equipment to prevent falling is equipment that is required to secure a person to an anchor point in such a way that a fall is either prevented completely or safely arrested.
It consists as a minimum of a harness and a belaying device (such as cables, fall arresters) or arresters that connect the har-ness to the anchorage device.
PPE must always be used when there are no collective technical safety measures in place, organisational measures to avoid risks have been exhausted and residual risks still exist (see Principles for Accident Prevention).
Falls are one of the main causes of injury in industry and the second most frequent cause of fatal accidents. In the majority of industrial accidents, the associated reports frequently point to inadequate working conditions; if the work is carried out in an elevated position, the consequences of this can be extremely serious. About one in seven 7 with fatal consequences result from a fall.

Standards:Under regulation BGV 22, fall protection measures must be put in place by the employer or plant operator for persons working at a specified height (above about 3 m). General Terms & Conditions§ 1 Scope of application
The following terms and conditions shall apply to all sales, deliv-eries and services, including future ones, and shall be deemed an integral part of the contract. Any conflicting terms and conditions of the customer shall not become part of the contract even without express objection and even in the case of services. Any deviation from these conditions as well as other supplementary agreements requires our express written consent to be effective. This require-ment of consent shall be applicable under all circumstances, in particular, if we carry out a delivery or service to the customer unconditionally in full knowledge of the customer’s general terms and conditions. Only the managing directors and authorised repre-sentatives of our company registered in our commercial register are entitled to conclude delivery and service terms of any kind deviating from these General Terms and Conditions. These General Terms and Conditions apply until the publication of new General Terms and Conditions.
§ 2 Offer
The services offered by our company are always non-binding and subject to change without notice and are subject to availability of our own supplies. This also applies if we have provided the customer with catalogues, product descriptions or technical doc-umentation (e.g. user manuals, calculations, calculations) prior to the conclusion of the contract, to which we reserve ownership rights and copyrights. Design or product-related deviations from descriptions or illustrations are possible. The customer does not hold any rights from such deviations against us. Verbal assurances given by employees and representatives shall only be binding if expressly confirmed by us in writing. If an order is to be regarded as an offer in accordance with § 145 BGB, we may accept it within four weeks of receipt. Acceptance can be made in writing or by delivery of the products or other services to the customer. Despite confirmation of the order, we are entitled to refuse a customer or not to execute an order if there are justified doubts as to the cor-rectness of the information provided by the customer or if other reasons, e.g. impending insolvency or inadequate creditworthiness that goes against the execution of the order.
§ 3 Delivery, dispatch, transfer of risk
Delivery periods shall only be deemed to have been agreed as binding if they have been expressly assured by us in writing as binding. To the extent that delivery periods have been bindingly agreed, we shall not be in default without a written reminder from the customer. All delivery periods are subject to the timely delivery of our own supplies. Partial deliveries are allowed. Compliance with deadlines for deliveries and services requires that all documents to be supplied by the customer, necessary approvals and releases, in particular of plans, are made available in good time, that the customer performs the cooperative duties required of him and that the agreed terms of payment are complied with. If this condition is not met, the delivery period shall be extended accordingly. This shall not apply if we ourselves are responsible for the delay.
If non-compliance with delivery periods is due to force majeure, e.g., war, riot or similar events, strike, lockout, untimely delivery of our own supplies by a supplier or similar events, the delivery periods shall be extended accordingly. If we are in default with the delivery, the customer may, provided he proves that he has suffered damages as a result thereof, demand compensation of 0.5 % for each full week of default, but no more than a total of 5 % of the price for that part of the delivery which could not be put to the intended use due to the default.
Claims for damages by the customer due to delayed delivery and
in lieu of services which exceed the aforementioned limits shall be excluded in all cases of delayed delivery, even after expiry of a deadline for delivery set by us. This shall not apply if we are liable for wilful misconduct, gross negligence or injury to life, body or health; this does not imply a change in the burden of proof to the detriment of the customer. The customer may only withdraw from the contract within the framework of the statutory provisions if we are responsible for the delay in delivery.
Upon request, the customer shall be obliged to declare within a reasonable period of time whether it will withdraw from the con-tract due to the delay in delivery or insist on delivery.
If the delivery is impossible, the customer is entitled to claim damages, unless we are not responsible for such circumstances. However, the customer’s claim for damages shall be limited to a maximum of 25 % of the net order value of that part of the delivery which cannot be used on time or in accordance with the contract due to the inability to deliver. The right of the customer to with-draw from the contract remains unaffected. The limitation of our liability in the event of gross negligence of an essential contractual obligation shall be limited to the foreseeable damage typical for this type of contract.
Products are delivered directly to the customer. The risk shall pass to the customer when the delivery item has left our factory, even if partial deliveries are made or other services are provided by us. At the customer’s request, the products can be shipped to another destination. Unless collection by the customer or third parties has been agreed and the customer has not given any special instruc-tions, we shall be entitled to determine the type of shipment (in par-ticular transport company, shipping route, packaging) ourselves.
The risk of accidental loss and accidental damage shall pass to the customer upon delivery. It shall be equivalent to the handover if the customer is in default of acceptance. If goods are shipped, the risk of accidental loss and/or accidental damage shall pass to the customer upon delivery to the forwarding agent, carrier or other person or institution appointed to carry out the shipment.
§ 4 Remuneration, terms of payment
Unless fixed prices have been expressly agreed, the amount of the price for the respective delivery or service shall be based on the Company’s price list valid at the time of order confirmation. Prices are understood to be net ex stock without deductions and plus the applicable statutory value added tax. Costs for delivery, packaging and any rush surcharges will be charged separately.
The price for the installation of accessories shall be charged sep-arately unless otherwise agreed. In this case, the list prices and rates of charges generally applicable to us at the intended time of assembly shall apply.
Cost estimates for repairs are made to the best of our knowl-edge. They do not constitute a fixed price agreement. The object examined in the context of a cost estimate does not need to be returned to its original condition if it is technically and economi-cally unjustifiable.
If a repair order is placed without a clear indication of defects and cost limitation, we can carry out all repairs that we deem neces-sary, taking into account the market value and the operational safety or functionality of the object to be repaired. If the customer indicates a defect and further defects are discovered during the repair, we may repair these without a special order if this is nec-essary to maintain operational safety and if the expenditure is insignificant in relation to the costs of the main order.

General Terms & Conditionsif a required spare part can no longer be procured or if the order was withdrawn during the performance, the costs incurred shall be charged to the customer. The same shall also apply if the customer was not present at the agreed date for repair work.
We expressly reserve the right to reject cheques or bills of ex-change. Acceptance thereof shall always be as conditional pay-ment. Discount and bill charges shall be borne by the customer and are due immediately.
Invoices are due and payable without deduction within 14 days of issue of the invoice by our company, unless otherwise agreed in the order confirmation and/or invoice. Upon expiry of this period, the customer shall be in default without the need for a separate reminder. If the customer is in default of payment, the default interest for consumers shall be 5 percentage points per annum above the respective base interest rate, for non-consumers 8 per-centage points per annum above the respective base interest rate, § 247 BGB. We reserve the right to provide evidence of a higher interest loss.
Price changes of the prices stated in the contract are permissible if there are at least 4 months between the conclusion of the contract and the agreed delivery date, and if after the conclusion of the contract, the basic wages of the collective agreement applicable to us or the list prices with regard to the services to be rendered have changed. In this case, we can adjust the price according to the change. This also applies mutatis mutandis to changes in the statu-tory value-added tax and in the event that delivery and services are delayed because the customer fails to meet his obligation to accept them or have them installed in good time. Cost reductions or cost increases shall be substantiated to the customer upon request.
The customer shall only be entitled to a right of offset if his count-er-claims have been legally established or acknowledged by us in writing. In addition, the customer can only exercise a right of retention if his claim on the basis of which he withholds payment is based on the same contractual relationship and is either legally established or recognised by us.
If the customer is in arrears with payments to a not insignificant extent, we shall be entitled to suspend or withhold further services from the same legal relationship to which we have committed ourselves and to demand immediate payment of all outstanding amounts from this contractual relationship.
In this case, any agreed dates or deadlines for the execution of outstanding deliveries and services shall lapse for us without the need for any special reference to them.
§ 5 Reservation of ownership and rights
We reserve the right of ownership of the delivered items as well as the right to use the software contained in them until complete payment of all claims incurred or to be incurred as a result of the business relationship. This shall also apply if an individual or all claims have been included by us in an open account and the ac-count is balanced and acknowledged. The customer shall store the goods subject to reservation of ownership with professional due diligence and adequately insure them at his own expense against fire, water, theft and other risks of damage. The customer shall assign his corresponding claims from the insurance contracts to us with the conclusion of this agreement. We shall accept this assignment.
The customer is entitled to resell the goods subject to reserva-tion of ownership in the ordinary course of business. However, he hereby assigns to us all claims arising from the resale of the goods or the further licensing of the software. We shall accept this
assignment. The customer is entitled to collect this claim subject to revocation. At our request, he shall disclose the assigned claims and their debtors. We are entitled to disclose the assignment to the customer’s debtor.
However, we undertake not to collect the claim as long as the customer meets his payment obligations, is not in default of pay-ment and in particular as long as no insolvency proceedings have been instituted against the customer's assets or the customer has discontinued payments. If the customer acts contrary to the terms of the contract or if payments are expected to cease, we shall be entitled to take back the goods subject to reservation of ownership at the customer’s expense or to demand the assignment of any claims for surrender by the customer against third parties. These rights shall also apply if the secured claims have expired accord-ing to the statute of limitations. We are entitled to sell the goods subject to reservation of ownership if necessary and to settle them from the proceeds of sale by offsetting them against open claims.
If the goods are taken back exclusively in accordance with the above provision, we shall be entitled to collect the goods subject to reservation of ownership still in the customer’s possession at the customer’s expense. The customer shall permit the employees of our company who are authorised to collect the goods subject to reservation of ownership to enter the business premises during office hours even without prior notice.
The exercise of the rights arising from the reservation of ownership or a request for surrender shall not be deemed a withdrawal from the contract. Any processing or treatment of the goods subject to reservation of ownership shall be carried out by the customer on our behalf without any obligations arising for us as a result. If the goods subject to reservation of ownership are treated, combined, mixed or blended with other goods not belonging to us, we shall be entitled to the resulting co-ownership of the new item in the ratio of the value of the goods subject to reservation of ownership to the other processed goods at the time of treatment, combina-tion, mixing or blending. If the customer acquires sole ownership of the new item, the customer and we agree that the customer shall grant us co-ownership of the new item in proportion to the value of the treated, combined, mixed or blended goods subject to reservation of ownership and shall hold them in safekeeping for us free of charge.
If a bill of exchange liability is established for us in connection with the payment of the sales sum by the customer, the reservation of ownership, as well as the claim on which it is based, shall not expire before the payment of the bill of exchange by the customer as drawee.
We undertake to release the existing securities at the customer’s request insofar as the recoverable value of the securities exceeds the claim to be secured by more than 20 percent; the choice of the securities to be released shall be at our discretion.
§ 6 Liability for material defects and breach of title
The customer is obliged to inspect deliveries and services imme-diately for completeness and obvious defects, in particular, also for obvious shortages or damages, and to notify us in writing of these immediately, at the latest within one week after receipt of the delivery or service. In the case of non-obvious (hidden) de-fects, the customer is obliged to notify us in writing immediately after their discovery, at the latest within the limitation period. The timely notification of the respective complaint shall comply with the deadline. If the customer fails to make the aforementioned complaints, liability for the non-reported defect shall be excluded. The customer shall bear the burden of proof for compliance with

General Terms & Conditionsand timeliness of the obligation to give notice of defects as well as for the presentation and time of detection of a defect.
All claims of the customer – for whatever legal reasons – shall expire after 12 months from the start of the statutory warranty period. This shall not apply if the law prescribes longer periods pursuant to § 438 para. 1 no. 2 (buildings and items for buildings), § 479 para. 1 (right of recourse) and § 634 a para. 1 no. 2 (con-struction defects) of the German Civil Code (BGB).
We are entitled, at our discretion, to remedy defects by eliminating them or by delivering goods free of defects. We are also entitled, without additional costs to the customer, to make such changes to the product as may become necessary due to defects, provid-ed that such changes do not significantly alter the contractual performance. The customer reserves the right to reduce the pur-chase price or to withdraw from the contract if the subsequent performance fails.
The customer shall support us in remedying the defect and shall, in particular, provide all information and documents necessary for the remedying of the defect. If a defect for which we are re-sponsible is rightfully notified, we shall be entitled to choose be-tween replacement delivery or rectification of the defect within a reasonable period of time, which is normally three weeks. If the replacement delivery or subsequent rectification fails, the cus-tomer may, at his discretion, demand a reduction in payment or cancellation of the contract.
In all cases of justified notices of defects, we shall have the right to rectify the defect several times before the customer can demand a reduction in payment or cancellation of the contract. Warranty claims are excluded, in particular, if the defect is caused by inap-propriate or unintended use of the goods; faulty installation or commissioning by the customer; natural wear and tear; faulty or negligent handling, care, maintenance or operation; use of unsuit-able operating materials or unsuitable accessories; modifications or repair work carried out by the customer or by a third party; damage due to overloading, defective construction work or un-suitable building site; damage due to force majeure (e.g. lightning strike), chemical, electrochemical or electrical influences – insofar as these are not the responsibility of the supplier.
Warranty claims do not apply in the event of insignificant devi-ations from the agreed quality; in the event of only insignificant impairment of usability; in the event of natural wear and tear or damage arising after the transfer of risk as a result of faulty or negligent handling, overloading, unsuitable equipment; or as a re-sult of special external influences not provided for in the contract.
If it turns out that services requested by the customer and provided by us were not necessary as a result of a breach of duty by our company, the customer shall pay for these services and bear the costs incurred by us. We will base the calculation on our hourly and travel cost rates applicable at the time.
Claims by the customer for expenses incurred for the purpose of subsequent performance, in particular, transport, travel, labour and material costs, shall be excluded to the extent that such ex-penses increase because the object of delivery has subsequently been taken to a place other than the place of delivery agreed at the time of conclusion of the contract.
In addition, we refer to the usual maintenance intervals which are required for the delivered goods. Defects and/or damage resulting from the failure to carry out the necessary maintenance work shall not constitute material defects or breach of title. Claims for warranty and/or damages are excluded.
§ 7 Liability
We shall be liable without limitation for intent and gross negligence including our legal representatives or vicarious agents as well as for damages resulting from injury to life, body or health which are based on a breach of duty for which we, our legal representatives or vicarious agents are responsible.
The same shall apply in the event of intervention by the provi-sions of the Product Liability Act. However, our liability is limited to the compensation of foreseeable, typically occurring damages. Even in cases of gross negligence, our liability shall be limited to foreseeable damages typical of this type of contract if none of the above exceptions applies. A change of the burden of proof to the detriment of the customer is not connected with these rules. In the event of a breach of duty that is not based on a defect, the customer may only withdraw from the contract if we are re-sponsible for the breach of duty, provided that the other le-gal requirements are met. The withdrawal is excluded if the breach of duty is insignificant. In the event of other breaches of substantial contractual obligations, our liability shall be limited to the sum insured under our business liability insurance.
We shall not be liable for damages to the extent that the custom-er could have prevented their occurrence by taking reasonable measures.
The above liability provisions shall also apply to the benefit of our employees and other vicarious agents.
§ 8 Damages in case of refusal of acceptance
If the customer is in default with the acceptance of the service ordered by him and if we set him a reasonable deadline in writing for the acceptance of our service, we shall be entitled after the expiry of this deadline to claim damages for non-performance instead of performance of the contract. In this case, we may claim a lump sum of 20 % of the agreed price as compensation without proof, unless it can be proven that the damage was significantly less. The right to assert an actually higher damage is reserved.
These provisions on the lump-sum calculation of damages shall also apply if, in the event of the insolvency of the customer, the insolvency administrator exercises his right not to perform the contract.
§ 9 Infringement of copyrights and commercial property rights of third parties
If the delivery item infringes the property rights of third parties, in particular copyrights, or if third parties are entitled to prohibit the customer from further use of the delivery item, we undertake to take it back and remedy it appropriately. Any further claims for damages by the customer due to non-fulfilment are excluded.
If software is included in the scope of delivery, the customer shall receive the non-exclusive right to transfer the delivered software for the agreed purpose and the agreed scope of services to the delivery item intended for this purpose. All other rights to the software remain with us. In particular, the customer does not have the right to reproduce, modify or make the software accessible to an unauthorised third party unless we have given our express consent. The customer undertakes to inform us immediately of any infringement of property rights by third parties with regard to the software supplied by us and to provide us with legal defence at his own expense. We are entitled to make necessary software changes at our own expense, even for delivered and paid goods, based on the claims of third parties to property rights.

§ 10 Ownership and copyright of documents
We reserve ownership and copyright to technical documents, illus-trations and drawings which we make available to the customer. The customer is not authorised to make these documents acces-sible to unauthorised third parties. Should the customer violate this obligation or misuse the documents in any other way, we shall be entitled to demand their return.
§ 11 Non-disclosure, confidentiality
The customer agrees that the data received by us within the scope of the business relationship may be stored and processed by an EDP system.
The data will be treated strictly confidential, and the legal regula-tions will be observed. Insofar as the contracting parties exchange confidential information of a commercial or technical nature or become known to a party from the area of the other party which is usually regarded as a trade secret, such as customer data, they undertake to treat this information as strictly confidential and not to make it accessible to third parties without the consent of the other contracting party nor to use it in any way outside the performance of this contract.
Excluded from the mutual obligation to maintain secrecy are such information which is demonstrably general in nature or becomes public without the involvement of a contracting party; information which becomes known to a contracting party from another source which is not obliged to maintain secrecy with respect to the other contracting party; information which must be disclosed by a con-tracting party (in particular to courts, law enforcement agencies and authorities) due to mandatory legal provisions.
Each party undertakes to return all confidential information phys-ically transmitted by the other party to the other party at any time upon request or to destroy such information at the other par-ty’s discretion without retaining copies or records. Own records, compilations and evaluations containing confidential information shall be destroyed immediately at the request of the other party; electronically transmitted and/or stored confidential information shall be deleted. The destruction/deletion carried out shall be confirmed in writing to the other contracting party upon request.
However, the above provisions shall not apply to copies which must be retained by a contracting party in a confidential file for the purposes of proof.
The duration of this obligation to maintain secrecy exceeds the duration of purchase contracts, contracts for goods and services by five years.
§ 12 Miscellaneous
We are entitled to use the assistance of third parties to fulfil our contractual obligations. Our obligation under this agreement re-mains unaffected.
In the case of contracts for standby delivery, binding quantities must be notified by a request notice at least one month before the delivery date, unless otherwise agreed. Additional costs caused by a delayed request notice or subsequent changes to the request notice with regard to time or quantity by the customer shall be borne by the customer.
Collateral agreements have not been made.
If individual provisions of this agreement are or become invalid,
the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the effective provision which comes closest to the economic purpose of the invalid provision. Otherwise, the statutory provisions shall apply.
Insofar as the customer is a merchant as defined by the German Commercial Code (HGB), a legal entity under public law or a spe-cial fund under public law, Siegen shall be the agreed place of jurisdiction. The same also applies in the event that the customer does not have a general place of jurisdiction in Germany. However, we are also entitled to pursue legal action at the customer’s place of business.
The law of the Federal Republic of Germany shall apply excluding the provisions of conflicting international private law and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Any change or amendment to these General Terms and Conditions must be made in writing.
Electronic documents, such as Emails without a qualified electron-ic signature within the meaning of the Digital Signature Act, shall not be considered to be in writing. We will not accept invoices sent to us electronically without such a qualified electronic signature.
