1 Introduction
In2010thepresidentoftheSwissconfederationtogetherwithanotherSwissFederalCouncilorandtheBulgarianMinisterforEUFundsManagementsignedaFrameworkagreementbetweenBulgariaandSwitzerland.ThisSwiss-BulgariancooperationprogrammeaimsatreducingsocialandeconomicinequalitieswithintheexpandedEuropeanUnion.
ThebilateralFrameworkagreementdefinestheconcretetopicsandprocesses.SwitzerlandwillgivesupportinareaswhereBulgariahasclaimedneedandinwhichSwitzerlandcanofferknow-howandexpertise.
OneofthetopicsofthecooperationprogrammeistogivemethodologicalsupporttorthedevelopmentofGreenPublicProcurement(GPP)inBulgaria.
Theawardingofgreenpublicprocurement,inlinewiththerelevantEUdirectives,thenationalpublicprocurementlegislationshouldbepromotedthroughtheproject.
AmongstothersitisforeseentoprovideaHandbookonSwissgoodpracticeexamplestothePublicProcurementAgencyBulgaria(PPA).ThishandbookshouldshowontheonehandunderwhatinstitutionalandlegalframeworkGPP/SPPisimplementedinSwitzerland(Federal,CantonalandMunicipallevel)andontheotherhandshowexamplesofimplementedGPP/SPPprojects.
Chaptertwoandthreeaimathighlightingthelegalandinstitutionalprovisionsthatmentionsustainability,publicprocurementrespectively.Theseinclusionsofsustainabilityaspectshelppublicprocurers(strategicandoperationalones)tojustifytheintroductionofsustainabilitycriteriaintheprocurementprocessinthecasetheymightbechallengedinternallyorbyatenderer.
2 LegalFramework
SustainablePublicProcurementinSwitzerlandisvoluntaryexceptforsomeproductgroupslikeICTequipment,passengercarsandtimber.Asthefirsttwoproductgroupsareknowntoberelativelyhighenergyconsumingproductstworeasonsledtothemandatoryecologicalrequirementsfortheseproductgroups:
OntheonehandtheEnergyStrategy2050oftheFederalcouncilthatasksamongstotherthingstobuyenergy-efficientproductsandontheotherhandtheeconomicadvantagethatcanclearlybeshownbybuyingandusingenergy-efficientdevices.EnergysavingsresultinaCO2emissionreduction.
Ingeneral,itcanbesaidthattheSwisslegalframeworkfurtherstheimplementationofSustainablePublicProcurement.

In1999Swisspeoplevotedfortheinsertionofacommitmenttofurthersustainabledevelopmentandthelong-termpreservationofnaturalresourcesinArticle2,AimsoftheFC.ThisasalogicalconsequencetowhatissaidinthepreambleoftheFederalConstitution,thattheSwisspeopleandtheCantonsshalladoptthenewconstitution“mindfuloftheirresponsibilitytowardscreation”andconsciousoftheir“responsibilitytowardsfuturegeneration”.TheFederalConstitutionacknowledgesthereforethepreservationofnaturalresourcesasindispensable.

TechnicalSpecifications,Art.12BoeBandArt.16aVoeBThetechnicalspecifications(TS)allowtosetminimumenvironmentalstandardsthathavetobemetbyeveryoffer.Oftenthecriteriathatliebehindeco-labelsareusedtosettheminimumstandard.Itisimportanttohaveinmindthatthebarwillnotbesettoohigh,otherwiseonemightgetnoofferortherequirementcouldbeofdiscriminatorycharacter.Itisalsopossibleinsteadofdefiningthespecificationspreciselytomentiontheobjectiveofprocurementonthebasisofperformanceorfunctionalcriteria.
AwardCriteria,Art.21BoeBandArt.27VoeBInordertofurtherinnovationortorewardoffersthatperformbetterthanaskedintheTS,itispossibletoawardoffersthatperformbetterthantherequiredenvironmentalminimumstandardwithadditionalpoints.Therecanalsobeformulatedotherenvironmentalaspectsrelevanttothesubjectmatterofthecontractsuchassustainability(hastobeconcretised),innovativecontent.Thelistofcriteriagivenisnotexhaustive.
SelectionCriteria,Art.9BoeBSelectioncriteriarefertothebidderandnottothesubjectmatterofthecontract.Thesecriteriaareusedtoensurethatthebidderisfinancially,commerciallyandtechnicallyinapositiontofulfilthecontract.Thesubjectmatterofthecontractdecidesifaselectioncriteriaregardingenvironmentalaspectsmaybeintroduced.Forparticularservices,itmaybeopportunetoaskthebiddertoshowhisskillsorknow-howinecologicalmatters.Oneexampleisacontractinwastemanagement.Certificationasaspecialiseddisposalcompanymayberequired.

Themostimportantfactorregardingeconomyistocreatewiththecallfortenderacompetitivesituationthatallowstoawardthecontractundercompetitiveconditions.
AwardCriteria,Art.21BoeBandArt.27VoeBAwardcriteria(AC)givetheopportunitytoseekforthebest“valueformoney”optionortheeconomicallymostadvantageousofferbyformulatingmonetaryaswellasnon-monetarycriteria.Regardingmonetarycriteria,itisimportanttoasknotonlyforthepricebutalsoforthetotalcostsofownership(TCO)oftheofferedsolution.

Biggerprocurementvolumesmeanlowervolumeprices,discountsandbetterpaymentanddeliveryconditions.Centralisedprocurementhelpstoimplementtheformulaofbundlingandallowstohaveprocurementspecialists,professionalswithhighpurchasingexpertiseandcurrentmarketknowledge.Standardizedprocessesandmoderninstrumentsensureefficientprocesses,allattributesthatbuildpartofamodernprocurementstrategy
FurthermoreCentralprocurementallowsthedevelopmentandimplementationofnationwideuniformprocurementstrategiesandprocedures,andisalwaysuptodatewiththecurrentcaselawandinternationalagreements.Thisalsoensuresthattheproductscomplywiththespecificrequirementsofthefederaladministration,forexamplewithregardtosustainabilityaspects.

3 Institutionalframework
3.1 SustainableDevelopment(SD)StrategyoftheFederalCouncil
Since1997,theFederalCouncilhassetoutitspoliticalintentionsfortheimplementationofsustainabledevelopmentinSwitzerlandinadedicatedstrategy.TheSDstrategyisrenewedeveryfouryears.ThisprovidesareferenceframeworkforthedirectioninwhichSwitzerlandshouldcontinuetodevelopincertainkeyareas.TheStrategy'saimistoensurethecoherentsustainabledevelopmentofthecountry.ThisincludescoordinatingConfederationactivitiesandensuringthattheyareinlinewithactionsbythecantons,municipalities,businessandcivilsociety.
ThemostimportantbodyatfederallevelistheInterdepartmentalSustainableDevelopmentCommittee(ISDC),headedbyARE.ThiscommitteefurtherstheConfederation'ssustainabledevelopmentpolicy,andservesasaplatformforsharinginformationontheConfederation'snumeroussustainabilityactivities.12
Inthesecond“SDStrategy2002”thatfollowedaftertheRio+10anniversaryandwasbasedontheSDpolicyformulatedin1997amorewide-rangingapproachwasadopted:Theintegrationoftheprinciplesofsustainabledevelopmentacrosstheboard,ineverysectorofpolicy.Inordertobuttressthisintegratedapproach,thenewFederalConstitutioncallsforsustainabledevelopmenttobedulyconsideredinalllaws,programs,conceptsandprojects.ItisinthissecondSDstrategythatSustainablePublicProcurementismentionedundertheactionarea“Financialpolicy”.Atthattime,theconceptof“IntegratedProductPolicy”IPPwaslaunchedwithintheEU13andhasbeenreflectedintheSDstrategy2002:

ThefifthSustainableDevelopmentStrategy,fortheperiod2016-2019,wasadoptedaspartofSwitzerland'sbroaderfour-yearlegislativeplanningprocess14.Itstargetframework,structuredbytopic,comprisestheConfederation'slong-termvisionandspecifictargetsupto2030.

Initspublicprocurementofgoods(products,services,construction),theConfederationendeavorstoensurethattheysatisfyhigheconomic,environmentalandsocialrequirementsthroughouttheirlifecycles.Itsetsanexamplewithitsownprocurementactivities,bypurchasingproductsandconstructingbuildingsthatareeconomical,environmentallycompatibleandhealthy,andareproducedorbuiltbymeansthatareassociallyresponsibleaspossible.

• Theenvironmentalimpactperfull-timeequivalentwillbereducedby30percentbytheendof2019comparedto2006.Greenhousegascompensationisnotcounted.

TheRUMBAmodule"IT-Standard"(G,F)20servestoimplementtherequirementsofthisstandardatallofficeworkplacesoftheFederalagencies.Inparticular,itgivesadvicefortheoptimalsettingoftheenergy-savingfunctionsofthedevicesaswellasfortheuseofswitchablepowerstrips,inordertoavoidunnecessarystand-bylossesoutsideworkinghours.Furthermeasuresshouldbetakenforthecoolingofserverrooms.
3.2.2 Paper
TheFederalOfficeforBuildingsandLogistics(BBL)asoneofthecentralprocurementagencies,offersarangeofenvironmentalfriendlypapersforvarioususes.
TheRUMBAModuleontheecologicallycorrectuseofpaperforcopying,printingandarchiving,showsalsotheenvironmentalimpactsofthedifferentpapers.(G,F)21Theresponsibilityforthecost-effectiveandenvironmentallyefficientuseofpaperlieswithintheindividualFederalagenciesandwitheachemployee.TheFederalCouncilhassetthegoalofcontinuouslyreducingtheenvironmentalimpactineachdepartment.Therefore,theconsumptionofcopypaper-currentlyaround9,350sheetsperemployeeperyear-shouldbereducedandtheshareofrecycledpaperincreased.
3.2.3 ProcurementofemissionreductioncertificatesCER
Greenhousegasemissionsthatcannotbeavoidedcanbecompensatedvoluntarilythroughtheprocurementofemissionreductioncertificates.TheprocurementofthesecertificatesiscarriedoutcentrallybyFOEN.
In2017,around21`600tonsofCO2equivalentswereoffsetbytheRUMBAunits.
RequirementsforCER
OnlyCertifiedEmissionReductions(CER)alreadyissuedbyCleanDevelopmentMechanism(CDM)22projectswithaprovencontributiontosustainabledevelopmentwillbeaccepted.TheCERsmustbeGoldStandard23ordemonstratecompliancewithcomparablerequirements.Thisbundledapproach(centralprocurementofCER

3.3 EnergyStrategy2050
FollowingthereactordisasterofFukushimain2011,theFederalCouncilandParliamentdecidedonSwitzerland'sprogressivewithdrawalfromnuclearenergyproduction.Thisdecision,togetherwithfurtherfar-reachingchangesintheinternationalenergyenvironment,requiresanupgradingoftheSwissenergysystem.Forthispurpose,theFederalCouncilhasdevelopedtheEnergyStrategy2050.(E,G,F,I,)24
On4September2013,theFederalCouncilsubmittedtotheParliamentadraftofatotallyrevisedEnergyAct.Therevisedactaimsatsignificantlydeveloptheexistingpotentialforenergyefficiencyandexploitthepotentialofwaterpowerandthenewrenewableenergies(sun,wind,geothermal,biomass).ThenewEnergyActalsoentailsamendmentstovariousotherfederallaws.Swissvotersapprovedthelawon21May2017.Thenewlegislationhasbeeninforcesince1January2018.
AspartoftheEnergyStrategy2050,thefederalgovernmentmustserveasarolemodelfortheSwisspopulationandmotivateitsemployeestosaveenergy.Thisgoalispursuedwiththeprogram"ResourceandEnvironmentalManagementoftheFederalAdministration(RUMBA)"(seeabove).

SinceDecember2011,theCantonofObwaldenisthefirstcantoninwhichallmunicipalitiesareawardedwiththelabel"EnergyCity"86.Thecantonwantedtoincludethephilosophyofitscommunitiesinenergyissuesinitsroads,andespeciallyinthetunnels.ThiswasoneofthereasonswhythecantonwaslookingforanenergyefficientsolutionforthelightingoftheLungerntunnel.Thecantonhadthreevariantsexaminedandcomparedinmoredetail:acontinuouslightstripwithtubelights(basicversion),linearluminairesingroupsofthreeandLEDlightsaspointlightingevery8m.Theevaluationincludedlightingtechnology,energyefficiency,costsandinstallations.TheLEDtunnelpointlightingconvincedinallcriteria.Energyefficiencyisundisputedandtheenergysavingpotentialcomparedtothebasicversionisover50%accordingtoinitialcalculations.Decisiveisalsothebetterefficiencyofthelampsinthedimmedstate.Tunnelsarecriticalstretchesofthemotorwayandnationalroadsnetwork.Abruptchangesinlightingcangiverisetoaccidents.Tunnellightingisabalancingactbetweenenergyconsumptionandroadsafety.

Thereforethetunnelisdividedintofoursectionswithdifferentcolorsforfloorandceilingcoverings.Thewallcolorremainsunchanged.Fortheroadsurface,anormaldarkdeckcoveringwithgrit-masticSMA11andalight-coloreddeckcoveringwithmasticasphaltMA11H"brightlysprinkled"areinstalled.Fortheceiling,apartisleftuntreatedintheconcretecolor;onepartisfinishedwithaRAL9010«purewhite»topcoat.Theextensivefive-yearmeasuringcampaignisincludedintheadditionalconstructioncostsof750’000CHF.Withregardtoanoptimizationofenergyconsumption,comfortandsecurityoftheroadusers,theresultsofthemeasurementsareexpectedtoprovideinformationonthefuturecolorschemeofthetunneldrivingspace.

Themeasurementswerecarriedouteachspringandautumnbeforeandafterthetunnelwascleaned.Adistinctionwasalsomadebetweenday-timeandnight-timelighting.
Results
AdvantagesofLEDlighting
Halfofthe440LEDtunnellightsareconnectedtotheUPSsystem(uninterruptiblepowersupply),theperformanceofthesystemcanbereducedbyabout30%.Anotheradvantageisthelifetimeofthelamps:Dependingontheuseofthedimming,thesuppliersspeakof50’000and80’000hours-thatis,upto10years-andthesuppliersgiveaguaranteefor5years.
Forsafetyaspects,theuniformilluminationofthetunnelisespeciallyimportant.Thankstothelongitudinaldistributionoflight,theLEDluminairesachievegoodvalues.Theestimatedannualelectricityconsumptionfortheoperationofthetunnelwascalculatedatapproximately4millionkWh,whichcauseselectricitycostsofaround600’000CHF.
Thecostclarificationrevealedastonishingresults:theindividuallightsareatleastthreetimesasexpensiveasconventionaltubelights;However,thankstosavingsinthenumberofluminairesandsimplercablingandcontrol,thetotalinvestmentisaround10%cheaper.
Influenceofdifferentcolors
Firstfindingsafterthreeyearsoftesting(2016)showthatthelight-coloreddeckcoveringhasaninfluenceonbrightnessandledto60%energysavingsbecauseduringdaytime,thepassagelightingcanbedimmedto20percent,eventotenpercentatnight.
ThedistanceofeightmetersbetweentheLEDlightscanbesignificantlyenlargedwithalight-coloredsurface.

4.3.3 MunicipalityofTrubschachen
4.3.3.1 InstallationofintelligentLEDstreetlighting
Trubschachenhasupgradedtheentire,outdatedstreetlightingtointelligentLEDlamps.Thestreetlampsareonlyreallybrightwhenthelightisneeded,otherwise,thestreetlampsshinewithonlytenpercentoftheiractualcapacity.TheMunicipalityofTrubschachenisthefirstSwissmunicipalitywith100%LEDlighting(80luminaries)
Theoldlightswouldhavehadtobereplacedanyway(endoflife).Therefore,thissolutionwiththenewintelligentLEDtechnologyisperfect.Inordertoachieveideallightingconditions,forboth,streetandpavement,apilottestshowedthatthenewpoleshavetobe6mhigh.
Smartlighting
Smartlightingmeansthatthelightsareinterconnected:LampAregistersthatsomeoneismovingtowardsthelamp.Immediately,lampAsendsasignaltolampsBandC,whicharefurtheraway.Thesetooaregettingbrighter.Thisensuresthatalightcarpetformsinfrontoftheroaduserandthatitisalreadybrightalsointhedistance.
Costs
ThetotalcostsfortheinstallationofLEDlampsareabout110'000CHF.25lamppostshadtobecompletelynewbuilt,12hadtobeextendedand9ofthemshortened.ThisworkhadbeenundertakenbyemployeesofthemunicipalityofTrubschachen.
