On Wednesday 25 May 2016, Council resolved to sell vacant land known as 3 Mylora Street, Hill Top. MN 245/16 1. THAT a formal valuation report from a registered valuer be obtained to assess
current market value of 3 Mylora Street, Hill Top.
2. THAT the General Manager be delegated authority to negotiate with the adjoining owner at Lot 14-22 and 41-53 Sec 1 DP 1263, Raglan Street, Hill Top for the sale of the property within ten per cent (10%) of the formal valuation obtained from a registered valuer assessing the current market value of 3 Mylora Street, Hill Top.
3. THAT in respect of the proposed sale of 3 Mylora Street, Hill Top, authority be
delegated to the General Manager and Mayor to execute the Contract for Sale of Land, Transfer or other associated real property dealing under the Common Seal of the Council.
Contracts for the sale of the above mentioned property were exchanged on 12 September 2016. Settlement is due to take place 24 October 2016.

A Development Application 16/0822 was lodged with Council for a development at Lot 2 DP 1219070, No. 2 Ranelagh Rd. Burradoo for the construction of Dwelling additions and an attached Garage. The proposed works are associated with the second Dwelling on the property. The works are comprised of replacement of the existing windows, conversion of the existing Verandah to a Sunroom, construction of a new Deck and attached Garage. For probity and transparency reasons, the application has been included in Council’s Weekly Circular as the Owner of the dwelling is a current Council staff member. If the application is not called up by Councillors to be determined by full Council, the application will be determined by staff under delegated authority. Plans of the proposal are included with this Circular (Attachment 1)

SUBJECT: MODIFICATION TO WOOLWORTHS SERVICE STATION, MITTAGONG

The purpose of this weekly circular is to inform Councillors of a modification application that has been lodged towards the Woolworths Service Station at 96 Bowral Road, Mittagong which was approved by the Land and Environment Court (LEC) on 26 May 2016. A location Plan can be found at Attachment 1. Background DA15/0434 was lodged with Council on 13 May 2015 which sought consent for a Woolworths Service Station. It was lodged in conjunction with DA15/0284 which also sought consent for a proposed KFC restaurant at 98 Bowral Road, Mittagong. These two developments proposed to share an access road and therefore lent themselves to being assessed concurrently. On 22 December 2015, proceedings were filed against Wingecarribee Shire Council’s deemed refusal of DA15/0434. Subsequently, DA15/0434 was approved on 25 May 2016 by the LEC for the construction and use of 96 Bowral Road, Mittagong as a Woolworths Service Station. DA15/0284 for the proposed KFC restaurant also formed part of the proceedings and was approved at the same time. Proposed Modification On 6 September 2016, Council received a 96(AA) application towards DA15/0434 which is a modification that can be considered by Council of a consent granted by the Court. This application seeks approval for
The increase in floor area of the building (from 80sqm to 120sqm)
Increase in car parking (from 6 spaces to 8 spaces)
Change to the size of the site to incorporate land to the south (See Attachment 2)
Amend the stormwater management system resulting in modifications to landscaped areas and car parking.
Assessment Timeline The application is currently being neighbour notified to two objectors of the original development application between 7 September 2016 and 23 September 2016. One submission has been received to date. The application has been internally referred to Council’s Development Engineer and Contributions Planner for consideration. No response from internal referrals have been received to date. The application has also been externally referred to NSW Roads and Maritime Service and Water NSW for their consideration, with no response to this date.
