FDA Organization (2) Two level organization structure
– Level 1: Type of product: drug, biologic, device, etc
– Level 2: Disease pursued: cancer, cardio‐renal, allergy, etc
– Each level supported by common offices: Quality, Statistics, pharmacology, advertisement, legal, audit (investigations)
Overall more than 100 Divisions or departmentsEach application has to work with a specific Division
www.FDAMAP.com©2014 CopyrightFDAMAP.com
– Each application has to work with a specific Division
– Very hierarchical; companies need to follow the process
6

US Drug Market About >50% of global revenues
– Prescription drugs: Innovator and generic
– Dietary supplements, medical foods: rising sectors
Acceptability of products manufactured anywhere in the world– About 20% of Innovator and >80% of generic drugs are imported into the US
www.FDAMAP.com©2014 CopyrightFDAMAP.com
imported into the US
Strict control by FDA on imports– Extensive paperwork: registrations
– Audits: Pre‐ and post‐market approval
7
US Regulations Versus ROW Increased harmonization of rules
– ICH guidance
– PIC/S signatory
– Information sharing with other regulators
Global standards with US customization– Application‐specific “self” review
Frequently come to different conclusions than ROW

8
So you have a Product that you Want to Sell in the US
Multi‐dimensional strategy– Product classification
– Review of available information, e.g., marketing history, label, claims, etc
– FDA consultation and review of regulatory options
– Standardization of manufacturing processes
www.FDAMAP.com©2014 CopyrightFDAMAP.com
– Testing – clinical/non‐clinical, if required
4
Manufacturer’s Responsibilities Comply with applicable regulations
Provide FDA with documentation to support claims
Let FDA know about all accidents
Be available to be audited by FDA
Respond to all audit findings and FDA’s actions

Introduction to FDA Audits
www.FDAMAP.com©2014 CopyrightFDAMAP.com
16
Audit is an Important FDA Function Before making the final decision for all applications, FDA must certify accuracy of the content of the application
When there is an accident (injury, quality or fraud), FDA must investigate before action
FDA makes the rules so it is best party to verify them

Don’t Panic! Prepare.
• How to prepare?
19
Common Criteria to be Selected by FDA to Audit (1)
Prior to final decision on a marketing approval application such as NDA/PMA
– Clinical sites and vendors (random or high priority)
– Manufacturer (always)
Prior to grant of import license for DS or Food (!)
www.FDAMAP.com©2014 CopyrightFDAMAP.com
Prior to grant of import license for DS or Food (!)
20
Common Criteria to be Selected by FDA to Audit (2)
If the application involves a high risk product
– Used in vulnerable population (very sick, children, pregnant)
– Used in large populations
– New technology, unknown mechanism, etc.
21
8
Common Criteria to be Selected by FDA to Audit (3)
If the application a high risk process
– Complaints, safety concerns, recalls
– Special testing processes, e.g., genetic diagnostic
– Inadequate documentation (SOPs, reports, records, etc)
22
Can you Refuse an FDA Audit? No, you cannot refuse an FDA audit; refusal of an FDA request for audit is illegal in the US
– Indicates non‐compliance with US regulations
– Could lead to suspension of import license
– Repeated refusal may put the company on import black‐list
– Punitive actions against the company’s US operations
23
Can you Avoid an FDA Audit? Yes, by eliminating red‐flag issues
– FDA cannot audit every single facility so they look for issues• Evidence of inadequate documentation
• Evidence of sloppiness, carelessness, training deficiency
• Complaints, recalls, adverse publicity

24
9
FDA Does Not Audit Several Facilities Many facilities, particularly those in non‐US locations are not audited by FDA if they
– Maintain high level of compliance
– Keep up to date with documentation
– Are proactive to provide FDA all requested information
– Maintain good communication with FDA
25
How Frequent are FDA Audits?
•GMP audits are most frequent: At least once every two years for all manufacturing facilities
•GCP inspections when needed, but not more than once every 3 years
•GLP and IRB inspections, less than 5% of total audits
L dit í á f t l i GMP (

Audits are Always Application Specific Audits are always because of an application or product
– FDA oversight is over products it approves, process oversight is in‐direct
– Processes leading to no viable application might never get audited., e.g., R&D is not directly audited
All audits focus on documents and facility tours
