HB 1361■ 2018 Legislature passed HB 1361 (chapter 2018-71, Laws of Florida)

effective July 1, 2019■ Excerpt

– Section 7. Paragraph (f) of subsection (6) of section 318.1451, Florida Statutes, is amended to read:

– 318.1451 Driver improvement schools■ (6) The department shall adopt rules establishing and maintaining

policies and procedures to implement the requirements of this section. These policies and procedures may include, but shall not be limited to, the following:

■ (f) Submission of records – The department shall require that all course providers submit course completion information to the department through the department’s Driver Improvement Certificate Issuance System within 5 days. Course providers must also submit course completion information together with the citation number through the Florida Courts E-Filing Portal governed by the Florida Courts E-Filing Authority to the clerk of the circuit court of the county where the citation is issued within 3 days after receipt of the unique course completion certificate number from the Driver Improvement Certificate issuance System. (Effective July 1, 2019)

■ July 1 – 5 Pull in 20 counties

■ July 8 – 12 Pull in 20 counties

■ July 15 – 19 Pull in remaining counties– All counties are receiving completion certificates

electronically through the Portal to comply with HB 1361

Pilot Counties

Proposed Solution■ Driver school providers send completion certificate data to

DHSMV as they currently do

■ The Portal will pull the data nightly from DHSMV after it has successfully passed the edit checks

■ Data is used to generate a ‘certificate’ that is sent to the Clerk for review in the County where the violation occurred

■ Clerk will process the certificate

■ Driver school provider will receive confirming email when certificate is filed

■ A driver school may single session file their certificates. Their filer role would be State Agent and they would be part of the DHSMV school certificate organization

Portal Process■ The Portal will take the data provided by DHSMV and if a

citation number is provided we will run that citation number through CCIS to obtain a corresponding UCN. If a corresponding match is made we will send that certificate submission to the county with the UCN provided;

■ If multiple citations are returned, we will again rely on CCIS to determine a driver's license and attempt to make a match based on the driver's license. If a match can be made we will send to the county with a UCN provided;

■ If the provided citation number is not found in CCIS, we will run a check against our TCATS data to search for a citation number. If a citation is found, we will send the submission the county with the case number field of CASE NOT FOUND. The county will have to research to find the UCN;

Portal Process Continued■ If no citation number is provided in the certificate data from

DHSMV or the citation number provided does not exist in our data after completing the previous screen steps, we will automatically reject the submission back to the driver school through a submission rejection email. The driver school with have to resubmit to DHSMV the certificate data to include a citation number;

■ The Portal will validate the citation number submitted for a length of seven characters the first six of which are alphanumeric and the last character alpha. If the submitted citation does not meet this criteria, it will be automatically rejected back to the driver school through a rejection email. The driver school will have to resubmit to DHSMV the corrected certificate information.

Correction Queue. The following email will be provided to the driver school. The submission will be automatically moved to the Abandoned Filing Queue.
