Legislative Update

Dare I Say “We Are in the Home Stretch”?Daniel Bennett, Vice President of Government Relations

The last day of the 2016 legislative session, scheduled for Thursday, June

2, rapidly approaches. Bills in the House and Senate have

switched chambers and moved on to their second committee — if the bill has a financial impact — or are waiting final votes by their original committee. All bills must be voted out of committee by May 12.

The second year of an election cycle usually brings a lighter legislative year for Senators and Representatives, but this year, not by much. Over 875 bills were filed and another 81 were filed but withdrawn at the beginning of the session. Last year closer to 1,000 bills were filed.

In the NH Legislature, every bill

gets a public hearing and gets voted on; you can only imagine the workload that brings to legislators and staff. House Speaker Shawn Jasper (R-Hudson) recently proposed a bipartisan, six-member committee to study the bill-filing process to see if anything can be done about what is considered to be “frivolous legislation” that takes away from the important substantive work that needs to be done. We applaud Speaker Jasper for looking at this issue.

By crossover, the halfway point of the session when legislation changes chambers, NHADA had made great progress on many of the bills we prioritized this session. We successfully defended the

distracted driving law from many attempts to repeal, modify or weaken the law.

We worked on various bills that would impact workers’ compensation insurance laws in NH.

We remain vigilant in the labor and commerce committees, trying to ensure that NH has a healthy, affordable, and easy to navigate workers’ compensation system. We have worked on a variety of bills that affect the Off Highway Recreational Vehicle (OHRV)  —  snowmobiles and all-terrain vehicles (ATVs) — industry in NH. We know that responsible outdoor,

motorized, trail recreation can be a great economic engine for NH, in all corners of the state. We’ve worked with legislators, state agencies, and other partners to further that goal.

NHADA once again this year defended the annual vehicle safety and emissions inspection program from modification. A bill filed by Rep. James Spillane (R-Deerfield)  — the same Rep. who filed an every-other-year inspection proposal last session  — would have exempted vehicles from inspections for their first few model years. The bill was unacceptable to NHADA. A vote to kill the bill received overwhelming support in the House Transportation Committee, and ultimately was placed on the consent calendar; the full House voted with no debate to kill it.

At the time of this writing, NHADA is working on an important bil l affecting the collision repair industry, members of which NHADA has over

100. Senate Bill 436, filed by Senator Nancy Stiles (Dist. 24, R-Hampton), offers strengthened consumer protection when it comes to protecting the value of a consumer’s new vehicle and preserving consumer choice in the vehicle repair process. NHADA will work hard on this bill to the very end and keep you posted.

No matter the year, there is always a great deal of work to be done at the State House looking out for your business interests. NHADA remains committed to being vigilant, involved, and vocal. We are your voice of the motor vehicle industry in NH, one of the truly great economic engines in NH.

through “L”. Prior to her employment at NHADA, Rita worked for Blue Cross Blue Shield of New Hampshire for 17 years as a customer service representative. In her spare time, Rita brings Finn, her AKC Champion Irish Setter, who is also a registered therapy dog, to nursing homes to lift the spirits of the residents.

Patti “PJ” Smith, Customer Service RepPJ has been employed at NHADA since June of 2004. She also provides customer service to our member employers from companies with names beginning from “M” through “Z”. Prior to joining NHADA, PJ worked at Northeast Delta Dental for eight years. She does yoga regularly, and also likes to take her poodle Reese’s on hikes with her and her friends throughout the state.

Melissa LeBlanc, Customer Service RepMelissa has worked at NHADA since 2001. Highlights of National Automotive Technology CompetitionGeorge Dykstra, Automotive Education Consultant

This was an exciting year for NH’s au-tomotive competitors in the National

Automotive Technology Competition in New York City. Of special note have been the rising scores on competition qualifying tests, which speaks well, not only for our winners, but for all of our program participants.

This year also brought some less than happy news when we lost the sponsorship of the American Automobile Association (AAA), which meant the end of the long time Ford /AAA contest. This means two of our students, who once would have received full tuition scholarships to the Ford ASSET program, no longer will. Some of you may remember... this contest started in the ’50s as the Chrysler/AAA skills contest.

After 15 years of providing great Automotive Skills USA contests at Nashua Community College, Instructor Karl Wunderlich and his department faculty have returned the contest to Lakes Region Community College, where it was held for many years before. We thank Karl and his team for the many years of service to our high school automotive students. We also thank Jamie Decato, himself a national Silver medal winner, for picking up where Karl leaves off.

This year the new automotive facility at Lakes Region Community College was home for the contest with 12 schools and 26 students participating. Congratulations to Austin Gagne our Gold medal winner from Richard W. Creteau Regional Technology Center in

Rochester. This is the first time I can remember a student from Rochester t a k i n g Go l d . A l s o congratulations Austin O’Dea and Nathan Cushman from Concord Regional Technology Center who won Silver

and Bronze respectively.Special Thanks go to Larry Foss of Foss

Loss Prevention Moves On to the Summer Movie SeasonBrian Duplessis, Loss Prevention Coordinator

After a busy winter that saw the intro-duction of online safety training and,

thankfully, very little injury producing winter weather, Loss Prevention is turning its attention to summer.

As with every summer, the season is starting with phone calls to us from NHADA Workers’ Compensation Trust (WCT) members asking if technicians can wear shorts.

No! Shorts are unsafe and anyway, unattractive.

Yet, certainly summer’s heat is a concern as temperature in shops start to soar.

WCT members should take steps to combat heat-related stress: It is important to recognize the signs of heat stress and heat stroke. Look for more summer safety information coming soon to Dateline: NH.

New TrainingAlso this season, Loss Prevention sets out upon several new training development projects. A forklift safety video, specific to NHADA member operations, is currently being filmed.

A Lockout/Tagout video also will be completed this summer. We hope to add tire safety/certification and tire changer offerings as well.

Loss Prevention recently met with Kevin Rohlwing, senior vice president of training at the Tire Industry Association and with representatives of NHADA Bronze-level partner Sullivan Tire, Inc.®/Liftworks on offering their technician trainings on NHADA’s Traincaster site, http://bit.ly/23Lq3yd.

As employers gear up for the summer hiring season, we thought this

would be an opportune time to review the laws governing the employment of individuals under the age of 18 in NH, as we have done in previous years.

Which laws govern youth employment? The federal Fair Labor Standards Act (“FLSA”) and state youth employment law govern youth employment in NH. Youth work-rules are routinely enforced by both the NH and U.S. departments of labor. Employers should ensure that any individuals responsible for summer hiring are aware of the state and federal rules pertaining to youth employment and that all supervisors are properly

trained with respect to the scope of appropriate work for minors, as well as with respect to scheduling issues.

Who is a “youth”? Any individual under the age of 18. When does the law prohibit the employment of a youth? In general, any youth under the age of 14 may not work in NH (there are exceptions for casual work and newspaper delivery). Additionally, most youths may not perform “hazardous” work, such as, but not limited to, commercial driving, excavation, manufacturing explosives, and operating many types of power-driven equipment.

Permissible work/hours14- and 15-year-olds: • Youths who are 14 and 15 years of age may work in various non-manufacturing, non-mining, and non-hazardous jobs, such as found in retail stores, restaurants, movie theaters, amusement parks, and gasoline service stations. Youths under 16 cannot work in warehouse, communications or public utilities jobs, construction or repair jobs, or jobs in which they drive a motor vehicle, or operate power-driven machinery or hoisting apparatus (other than typical office machines). They cannot bake, cook (except with gas or electric grills that do not involve cooking over an open flame), work with freezers or meat coolers, or work in meat processing areas, or operate, set-up, adjust, clean, oil or repair power-drive food slicers, grinders, choppers, cutters, or bakery mixers. •  They are permitted to work three hours on a school day during non-school hours and a total of 18 hours during the school week. •  On non-school days, they may work eight hours per day. During the summer vacation, they may work six days per

week, but not exceed 40 hours per week in work. •  Lastly, they may only work between 7:00 a.m. and 7:00 p.m., except from June 1 through Labor Day, when they are permitted to work until 9:00 p.m. 16- and 17-year-olds: • They are permitted to work no more than six consecutive days during the school calendar week, which is Sunday through Saturday. • They may work no more than 30 hours per week during the school calendar week. •  They may work no more than ten hours a day in manufacturing or more than ten-and-a-quarter hours a day at manual or mechanical labor in any other employment that is not exempt by statute. • From June 1 through Labor Day, these minors may work no more than six consecutive days or 48 hours in any one week.• They may perform no more night work than 8 hours in 24 hours.

Exception: In general, the minimum age requirements do not apply to minors employed by their parent or by a person acting as their guardian. There are slight variations to the above guidelines for 16- or 17-year-olds who are not enrolled in school.

notice stating the hours of work, the time allowed for dinner or other meals, and the maximum number of hours any youth is permitted to work in any one day.

Certificates: NH requires most youths under the age of 16 to acquire a NH Youth Employment Certificate from the school district within three business days of the first day of employment. For 16- and 17-year-olds, the employer must obtain a signed written document from the youth’s parent or legal guardian permitting the youth’s employment and this permission form must be on file at the worksite prior to the first day of employment. Samples of both of these forms are available on the NH Department of Labor’s website at http://1.usa.gov/1cab7QJ.

Penalties: Employers violating youth employment laws risk criminal and civil penalties, including fines and imprisonment. Under federal law, employers are subject to a civil money penalty of up to $10,000 per worker for each violation of the child labor laws. In addition, employers are subject to a civil money penalty of $50,000 for each violation that causes the death or serious injury of any minor employee, and that penalty may be doubled, up to $100,000, when the violations are determined to be wilful or repeated. Federal law also provides for a criminal fine of up to $10,000 upon conviction for a wilful violation of child labor laws. For a second conviction for a wilful violation, the act provides for a fine of not more than $10,000 and imprisonment for up to six months, or both. State law also imposes civil and criminal penalties for violations of youth employment laws.

Other Considerations: Teenagers and young adults often have limited work experience and may not understand what

is appropriate or “normal” behavior in the workplace. As such, young workers may be more susceptible or vulnerable to sexual harassment and discrimination in the workplace and may not understand how to report such conduct. Employers should consider taking special care to train young employees on company policies and reporting procedures for discrimination and harassment upon hire. By encouraging young employees to come forward and report any problems as they arise, employers will have the

opportunity to take appropriate action before the situation grows worse.

Unpaid Interns: Finally, many teenagers and young adults express interest in working for free as a summer “intern” in order to gain practical work experience. Most unpaid interns and employers consider the relationship a win-win — the intern gets a foot in the door for regular employment, and the employer gets the benefit of some unpaid work from
