    A G R E E M E N T

    BETWEENTHE GOVERNMENT OF THE SLOVAK REPUBLIC

    AND

    THE GOVERNMENT OF THE REPUBLIC OF BELARUS

    FOR THE AVOIDANCE OF DOUBLE TAXATIONAND THE PREVENTION OF FISCAL EVASION

    WITH RESPECT TO TAXES ON INCOMEAND ON PROPERTY

    THE GOVERNMENT OF THE SLOVAK REPUBLICANDTHE GOVERNMENT OF THE REPUBLIC OF BELARUS

    desiring to conclude an Agreement for the avoidance of double taxation and the prevention offiscal evasion with respect to taxes on income and on property,

    HAVE AGREED as follows:

    Article 1PERSONAL SCOPE

    This Agreement shall apply to persons who are residents of one or both of the ContractingStates.

    Article 2

    TAXES COVERED1. This Agreement shall apply to taxes on income and on property imposed on behalf of aContracting State or of its political subdivisions or local authorities, irrespective of the manner inwhich they are levied.

    2. There shall be regarded as taxes on income and on property all taxes imposed on total income,on total property, or on elements of income or of property, including taxes on gains from thealienation of property, taxes on the total amounts of wages or salaries paid by enterprises, as wellas taxes on property appreciation.

    3. The existing taxes to which the Agreement shall apply are in particular:

    a) in the Slovak Republic:

    (i) the tax on income of individuals;

    (ii) the tax on income of legal persons;

    (iii) the tax on immovable property;

    (hereinafter referred to as "Slovak tax");

    b) in the Republic of Belarus:

    (i) the tax on income and profits of enterprises, associations, organisations;

    (ii) the income tax on individuals; and

    (iii) the tax on immovable property;

    (hereinafter referred to as "Belarusian tax").

    4. The Agreement shall apply also to any identical or substantially similar taxes which areimposed after the date of signature of the Agreement in addition to, or in place of, the existingtaxes. The competent authorities of the Contracting States shall notify each other of significantchanges which have been made in their respective taxation laws.

    GENERAL DEFINITIONS

    1. For the purposes of this Agreement, unless the context otherwise requires:

    a) the term "Slovakia" means the Slovak Republic and, when used in geographical sense,

    means the territory over which the Slovak Republic exercises under the laws of Slovakia and inaccordance with international law sovereign rights and jurisdiction;

    b) the term "Belarus" means the Republic of Belarus and, when used in geographicalsense, means the territory over which the Republic of Belarus exercises under the laws of Belarusand in accordance with international law sovereign rights and jurisdiction;

    c) the terms "a Contracting State" and "the other Contracting State" mean Slovakia orBelarus as the context requires;

    d) the term "person" includes an individual, a company and any other body of persons;

    e) the term "company" means any legal person or any entity which is treated as a legalperson for tax purposes;

    f) the terms "enterprise of a Contracting State" and "enterprise of the other ContractingState" mean respectively an enterprise carried on by a resident of a Contracting State and anenterprise carried on by a resident of the other Contracting State;

    g) the term "international traffic" means any transport by a ship, boat, aircraft, railway orroad vehicle operated by an enterprise which is a resident of a Contracting State, except when theship, boat, aircraft, railway or road vehicle is operated solely between places in the otherContracting State;

    h) the term "competent authority" means:

    (i) in the case of Slovakia, the Minister of Finance or his authorisedrepresentative;

    (ii) in the case of Belarus, the State Tax Committee or its authorisedrepresentative;

    i) the term "national" means:

    (i) any individual possessing the nationality of a Contracting State;

    (ii) any legal person, partnership or association deriving its status as such fromthe laws in force in a Contracting State;

    j) the term "political subdivision" refers only to Slovakia.

    2. As regards the application of the Agreement at any time by a Contracting State any term notdefined therein shall, unless the context otherwise requires, have the meaning which it has at thattime under the law of that State for the purposes of the taxes to which the Agreement applies.

    Article 4RESIDENT

    1. For the purposes of this Agreement, the term "resident of a Contracting State" means anyperson who, under the laws of that State, is liable to tax therein by reason of his domicile,residence, place of registration or any other criterion of a similar nature. A Contracting Stateitself, and any political subdivision or local authority thereof, shall be deemed to be a resident ofthat State. The term does not include any person who is liable to tax in that State in respect onlyof income from sources in that State or property situated therein.

    2. Where by reason of the provisions of paragraph 1 an individual is a resident of bothContracting States, then his status shall be determined as follows:

    a) he shall be deemed to be a resident only of the State in which he has a permanent homeavailable to him; if he has a permanent home available to him in both States, he shall be deemedto be a resident of the State with which his personal and economic relations are closer (centre ofvital interests);

    b) if the State in which he has his centre of vital interests cannot be determined, or if hehas not a permanent home available to him in either State, he shall be deemed to be a residentonly of the State in which he has an habitual abode;

    c) if he has an habitual abode in both States or in neither of them, he shall be deemed to bea resident only of the State of which he is a national;

    d) if any problems arise with determining the residence, the competent authorities of theContracting States shall settle the question by mutual agreement.

    3. Where by reason of the provisions of paragraph 1 a person other than an individual is aresident of both Contracting States, the competent authorities of the Contracting States shall settlethe question by mutual agreement.

    Article 5PERMANENT ESTABLISHMENT

    1. For the purposes of this Agreement, the term "permanent establishment" means a fixed placeof business through which the business of an enterprise is wholly or partly carried on.

    2. The term "permanent establishment" includes especially:

    a) a place of management;

    b) a branch;

    c) an office;

    d) a factory;

    e) a workshop, and

    f) a mine, an oil or gas well, a quarry or any other place of extraction of naturalresources.

    3. A building site or construction or installation project constitues a permanent establishmentonly if it lasts more than 12 months.

    4. Notwithstanding the preceding provisions of this Article, the term "permanent establishment"shall be deemed not to include:

    a) the use of facilities solely for the purpose of storage, display or delivery of goods ormerchandise belonging to the enterprise;

    b) the maintenance of a stock of goods or merchandise belonging to the enterprise solelyfor the purpose of storage, display or delivery;

    c) the maintenance of a stock of goods or merchandise belonging to the enterprise solelyfor the purpose of processing by another enterprise;

    d) the maintenance of a fixed place of business solely for the purpose of purchasing goodsor merchandise or of collecting information, for the enterprise;

    e) the maintenance of a fixed place of business solely for the purpose of carrying on, forthe enterprise, any other activity of a preparatory or auxiliary character;

    f) the maintenance of a fixed place of business solely for any combination of activitiesmentioned in subparagraphs a) to e), provided that the overall activity of the fixed place ofbusiness resulting from this combination is of a preparatory or auxiliary character.

    5. Notwithstanding the provisions of paragraphs 1 and 2, where a person - other than an agent ofan independent status to whom paragraph 6 applies - is acting on behalf of an enterprise and has,and habitually exercises, in a Contracting State an authority to conclude contracts in the name ofthe enterprise, that enterprise shall be deemed to have a permanent establishment in that State in

    respect of any activities which that person undertakes for the enterprise, unless the activities ofsuch person are limited to those mentioned in paragraph 4 which, if exercised through a fixedplace of business, would not make this fixed place of business a permanent establishment underthe provisions of that paragraph.

    6. An enterprise shall not be deemed to have a permanent establishment in a Contracting Statemerely because it carries on business in that State through a broker, general commission agent orany other agent of an independent status, provided that such persons are acting in the ordinarycourse of their business.

    7. The fact that a company which is a resident of a Contracting State controls or is controlled by acompany which is a resident of the other Contracting State, or which carries on business in thatother State (whether through a permanent establishment or otherwise), shall not of itselfconstitute either company a permanent establishment of the other.

    Article 6INCOME FROM IMMOVABLE PROPERTY

    1. Income derived by a resident of a Contracting State from immovable property (includingincome from agriculture or forestry) situated in the other Contracting State may be taxed in thatother State.

    2. The term "immovable property" shall have the meaning which it has under the law of theContracting State in which the property in question is situated. The term shall in any case includeproperty accessory to immovable property, livestock and equipment used in agriculture andforestry, rights to which the provisions of general law respecting landed property apply, usufructof immovable propery and rights to variable or fixed payments as consideration for the workingof, or the right to work, mineral deposits, sources and other natural resources; ships, boats,aircraft, railway and road vehicles shall not be regarded as immovable property.

    3. The provisions of paragraph 1 shall apply to income derived from the direct use, letting, or usein any other form of immovable property.

    4. The provisions of paragraphs 1 and 3 shall also apply to the income from immovable propertyof an enterprise and to income from immovable property used for the performance ofindependent personal services.

    Article 7BUSINESS PROFITS

    1. The profits of an enterprise of a Contracting State shall be taxable only in that State unless theenterprise carries on business in the other Contracting State through a permanent establishmentsituated therein. If the enterprise carries on business as aforesaid, the profits of the enterprise may

    be taxed in the other State but only so much of them as is attributable to that permanentestablishment.

    2. Subject to the provisions of paragraph 3 of this Article, where an enterprise of a ContractingState carries on business in the other Contracting State through a permanent establishment

    situated therein, there shall in each Contracting State be attributed to that permanentestablishment the profits which it might be expected to make if it were a distinct and separateenterprise engaged in the same or similar activities under the same or similar conditions anddealing wholly independently with the enterprise of which it is a permanent establishment.

    3. In determining the profits of a permanent establishment, there shall be allowed as deductionsexpenses which are incurred for the purposes of the permanent establishment, including executiveand general administrative expenses so incurred, whether in the State in which the permanentestablishment is situated or elsewhere.

    4. Insofar as it has been customary in a Contracting State to determine the profits to be attributedto a permanent establishment on the basis of an apportionment of the total profits of theenterprise to its various parts, nothing in paragraph 2 shall preclude that Contracting State fromdetermining the profits to be taxed by such an apportionment as may be customary. The methodof apportionment adopted shall, however, be such that the result shall be in accordance with theprinciples contained in this Article.

    5. No profits shall be attributed to a permanent establishment by reason of the mere purchase bythat permanent establishment of goods or merchandise for the enterprise.

    6. For the purposes of the preceding paragraphs, the profits to be attributed to the permanentestablishment shall be determined by the same method year by year unless there is good andsufficient reason to the contrary.

    7. Where profits include items of income which are dealt with separately in other Articles of thisAgreement, then the provisions of those Articles shall not be affected by the provisions of thisArticle.

    Article 8INTERNATIONAL TRAFFIC

    1. Profits of the enterprise of a Contracting State from the operation of ships, boats, aircraft,railway or road vehicles in international traffic shall be taxable only in that State.

    2. For the purposes of this Article, profits from the operation of ships, boats, aircraft, railway orroad vehicles in international traffic also include profits from the rental on a bareboat basis ofships, boats, aircraft, railway or road vehicles when used in international traffic, where profitsfrom such rental are incidental to the profits referred to in paragraph 1.

    3. The provisions of paragraph 1 shall also apply to profits from the participation in a pool, a jointbusiness or an international operating agency.

    Article 9ASSOCIATED ENTERPRISES

    1. Where

    a) an enterprise of a Contracting State participates directly or indirectly in themanagement, control or property of an enterprise of the other Contracting State, or

    b) the same persons participate directly or indirectly in the management, control orproperty of an enterprise of a Contracting State and an enterprise of the other Contracting State,

    and in either case conditions are made or imposed between the two enterprises in theircommercial or financial relations which differ from those which would be made betweenindependent enterprises, then any profits which would, but for those conditions, have accrued toone of the enterprises, but, by reason of those conditions, have not so accrued, may be included inthe profits of that enterprise and taxed accordingly.

    2. Where a Contracting State includes in the profits of an enterprise of that State - and taxesaccordingly - profits on which an enterprise of the other Contracting State has been charged totax in that other State and the profits so included are profits which would have accrued to theenterprise of the first-mentioned State if the conditions made between the two enterprises hadbeen those which would have been made between independent enterprises, then that other Stateshall make an appropriate adjustment to the amount of the tax charged therein on those profits. Indetermining such adjustment, due regard shall be had to the other provisions of this Agreementand the competent authorities of the Contracting States shall if necessary consult each other.

    3. The provisions of paragraph 2 shall not apply in the case of wilful lowering of the tax base.

    Article 10DIVIDENDS

    1. Dividends paid by a company which is a resident of a Contracting State to a resident of theother Contracting State may be taxed in that other State.

    2. However, such dividends may also be taxed in the Contracting State of which the companypaying the dividends is a resident and according to the laws of that State, but if the beneficial

    owner of the dividends is a resident of the other Contracting State, the tax so charged shall notexceed:

    a) 10 per cent of the gross amount of the dividends if the beneficial owner is a company(other than a partnership) which holds directly at least 25 per cent of the capital of the company

    paying the dividends;b) 15 per cent of the gross amount of the dividends in all other cases.

    3. The term "dividends" as used in this Article means income from all kinds of shares, or otherrights, not being debt-claims, participating in profits, as well as income from other rights which issubjected to the same taxation treatment as income from shares by the laws of the State of whichthe company making the distribution is a resident.

    4. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the dividends,being a resident of a Contracting State, carries on business in the other Contracting State of whichthe company paying the dividends is a resident, through a permanent establishment situatedtherein, or performs in that other State independent personal services from a fixed base situatedtherein, and the holding in respect of which the dividends are paid is effectively connected withsuch permanent etablishment or fixed base. In such case the provisions of Article 7 or Article 14,as the case may be, shall apply.

    5. Where a company which is a resident of a Contracting State derives profits or income from theother Contracting State, that other State may not impose any tax on the dividends paid by thecompany, except insofar as such dividends are paid to a resident of that other State or insofar asthe holding in respect of which the dividends are paid is effectively connected with a permanentestablishment or a fixed base situated in that other State, nor subject the company's undistributedprofits to a tax on the company's undistributed profits, even if the dividends paid or theundistributed profits consist wholly or partly of profits or income arising in such other State.

    Article 11INTEREST

    1. Interest arising in a Contracting State and paid to a resident of the other Contracting State maybe taxed in that other State.

    2. However, such interest may also be taxed in the Contracting State in which it arises andaccording to the laws of that State, but if the beneficial owner of the interest is a resident of theother Contracting State, the tax so charged shall not exceed 10 per cent of the gross amount of theinterest. The competent authorities of the Contracting States shall by mutual agreement settle themode of application of this limitation.

    3. Notwithstanding the provisions of paragraph 2 interest arising in a Contracting State, derivedand beneficially owned by the Government of the other Contracting State or the Central(National) Bank of that State shall be exempt from tax in the first mentioned State.

    4. The term "interest" as used in this Article means income from debt-claims of every kind,whether or not secured by mortgage and whether or not carrying a right to participate in thedebtor's profits, and in particular, income from government securities and income from bonds ordebentures, including premiums and prizes attaching to such securities, bonds or debentures.Penalty charges for late payment shall not be regarded as interest for the purpose of this Article.

    5. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the interest,being a resident of a Contracting State, carries on business in the other Contracting State in whichthe interest arises, through a permanent establishment situated therein, or performs in that otherState independent personal services from a fixed base situated therein, and the debt-claim inrespect of which the interest is paid is effectively connected with such permanent establishmentor fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shallapply.

    6. Interest shall be deemed to arise in a Contracting State when the payer is that State itself, itspolitical subdivision, a local authority or a resident of that State. Where, however, the personpaying the interest, whether he is a resident of a Contracting State or not, has in a ContractingState a permanent establishment or a fixed base in connection with which the indebtedness onwhich the interest is paid was incurred, and such interest is borne by such permanentestablishment or fixed base, then such interest shall be deemed to arise in the State in which thepermanent establishment or fixed base is situated.

    7. Where, by reason of a special relationship between the payer and the beneficial owner orbetween both of them and some other person, the amount of the interest, having regard to thedebt-claim for which it is paid, exceeds the amount which would have been agreed upon by thepayer and the beneficial owner in the absence of such relationship, the provisions of this Articleshall apply only to the last-mentioned amount. In such case, the excess part of the payments shallremain taxable according to the laws of each Contracting State, due regard being had to the otherprovisions of this Agreement.

    Article 12ROYALTIES

    1. Royalties arising in a Contracting State and paid to a resident of the other Contracting Statemay be taxed in that other State.

    2. However, such royalties may also be taxed in the Contracting State in which they arise, andaccording to the laws of that State, but if the beneficial owner of the royalties is a resident of theother Contracting State, the tax so charged shall not exceed:

    a) 5 per cent of the gross amount of the royalties, in the case of payments of the kindreferred to in sub-paragraph a) of paragraph 3;

    b) 10 per cent of the gross amount of the royalties, in the case of payments of the kindreferred to in sub-paragraph b) of paragraph 3;

    c) 10 per cent of the gross amount of the royalties, in the case of payments of the kindreferred to in sub-paragraph c) of paragraph 3.

    3. The term "royalties" as used in this Article means payments of any kind received as a

    consideration for the use of, or the right to use :a) any copyright of literary, artistic or scientific work including cinematograph films or

    films or tapes and other means of image or sound reproduction;

    b) any patent, trade mark, design, drawing or model, plan, secret formula or process, orfor information concerning industrial, commercial or scientific experience or for the use of, or theright to use, industrial, commercial or scientific equipment;

    c) any transport vehicles.

    4. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the royalties,being a resident of a Contracting State, carries on business in the other Contracting State in whichthe royalties arise, through a permanent establishment situated therein, or performs in that otherState independent personal services from a fixed base situated therein, and the right or property inrespect of which the royalties are paid is effectively connected with such permanentestablishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case maybe, shall apply.

    5. Royalties shall be deemed to arise in a Contracting State when the payer is that State itself, itspolitical subdivision, a local authority or a resident of that State. Where, however, the personpaying the royalties, whether he is a resident of a Contracting State or not, has in a ContractingState a permanent establishment or a fixed base in connection with which the liability to pay theroyalties was incurred, and such royalties are borne by such permanent establishment or fixedbase, then such royalties shall be deemend to arise in the State in which the permanentestablishment or fixed base is situated.

    6. Where, by reason of a special relationship between the payer and the beneficial owner orbetween both of them and some other person, the amount of the royalties, having regard to theuse, right or information for which they are paid, exceeds the amount which would have beenagreed upon by the payer and the beneficial owner in the absence of such relationship, theprovisions of this Article shall apply only to the last-mentioned amount. In such case, the excesspart of the payments shall remain taxable according to the laws of each Contracting State, dueregard being had to the other provisions of this Agreement.

    Article 13GAINS FROM THE ALIENATION OF PROPERTY

    1. Gains derived by a resident of a Contracting State from the alienation of immovable propertyreferred to in Article 6 and situated in the other Contracting State may be taxed in that otherState.

    2. Gains from the alienation of property other than immovable property forming part of the

    business property of a permanent establishment which an enterprise of a Contracting State has inthe other Contracting State or of property other than immovable property pertaining to a fixedbase available to a resident of a Contracting State in the other Contracting State for the purpose ofperforming independent personal services, including such gains from the alienation of such apermanent establishment (alone or with the whole enterprise) or of such fixed base, may be taxedin that other State.

    3. Gains derived by a resident of a Contracting State from the alienation of ships, boats, aircraft,railway or road vehicles operated in international traffic or property other than immovableproperty pertaining to the operation of such ships, boats, aircraft, railway or road vehicles shall betaxable only in that State.

    4. Gains from the alienation of any property other than that referred to in paragraphs 1, 2 and 3,shall be taxable only in the Contracting State of which the alienator is a resident.

    Article 14INDEPENDENT PERSONAL SERVICES

    1. Income derived by a resident of a Contracting State in respect of professional services or otheractivities of an independent character shall be taxable only in that State unless he has a fixed baseregularly available to him in the other Contracting State for the purpose of performing hisactivities. If he has such a fixed base, the income may be taxed in the other State but only somuch of it as is attributable to that fixed base.

    2. The term "professional services" includes especially independent scientific, literary, artistic,educational or teaching activities as well as the independent activities of physicians, lawyers,engineers, architects, dentists and accountants.

    3. For the purposes of this Agreement, the term "fixed base" means a fixed place such as anoffice or room, through which the activity of an individual performing independent personalservices is wholly or partly carried on.

    Article 15DEPENDENT PERSONAL SERVICES

    1. Subject to the provisions of Articles 16, 18 and 19, salaries, wages and other similarremuneration derived by a resident of a Contracting State in respect of an employment shall betaxable only in that State unless the employment is exercised in the other Contracting State. If the

    employment is so exercised, such remuneration as is derived therefrom may be taxed in that otherState.

    2. Notwithstanding the provisions of paragraph 1, remuneration derived by a resident of aContracting State in respect of an employment exercised in the other Contracting State shall be

    taxable only in the first-mentioned State if :a) the recipient is present in the other State for a period or periods not exceeding in the

    aggregate 183 days within any twelve-month period commencing or ending in the calendar yearconcerned, and

    b) the remuneration is paid by, or on behalf of, an employer who is not a resident of theother State, and

    c) the remuneration is not borne by a permanent establishment or a fixed base which theemployer has in the other State.

    3. Notwithstanding the preceding provisions of this Article, remuneration derived in respect of anemployment exercised aboard a ship, boat, aircraft, railway or road vehicle operated ininternational traffic by an enterpise of a Contracting State may be taxed in that State.

    Article 16DIRECTORS' FEES

    Directors' fees and other similar payments derived by a resident of a Contracting State inhis capacity as a member of the board of directors of a company which is a resident of the otherContracting State may be taxed in that other State.

    Article 17ENTERTAINERS AND SPORTSMEN

    1. Notwithstanding the provisions of Articles 14 and 15, income derived by a resident of aContracting State as an entertainer, such as a theatre, motion picture, radio or television artiste, ora musician, or as a sportsman, from his personal activities as such exercised in the otherContracting State, may be taxed in that other State.

    2. Where income in respect of personal activities exercised by an entertainer or a sportsman in hiscapacity as such accrues not to the entertainer or sportsman himself but to another person, thatincome may, notwithstanding the provisions of Articles 7, 14 and 15, be taxed in the ContractingState in which the activities of the entertainer or sportsman are exercised.

    3. Notwithstanding the provisions of paragraphs 1 and 2 income derived by a resident of aContracting State from his personal activities as an entertainer or a sportsman shall be taxable

    only in that State if the activity is exercised in the other Contracting State within the frameworkof the program of Cultural and Sports exchange approved by both Contracting States and suchactivities are wholly or mainly supported from the public funds of either State.

    Article 18PENSIONS

    1. Subject to the provisions of paragraph 2 of Article 19, pensions and other similar remunerationpaid to a resident of a Contracting State in consideration of past employment shall be taxableonly in that State.

    2. Notwithstanding the provisions of paragraph 1, pensions and other payments made under thesocial security legislation of a Contracting State shall be taxable in that State.

    Article 19GOVERNMENT SERVICE

    1. a) Salaries, wages and other similar remuneration, other than a pension, paid by aContracting State or a political subdivision or a local authority thereof to an individual in respectof services rendered to that State or subdivision or authority shall be taxable only in that State.

    b) However, such salaries, wages and other similar remuneration shall be taxable only inthe other Contracting State if the services are rendered in that State and the individual is aresident of that State who:

    (i) is a national of that State; or

    (ii) did not become a resident of that State solely for the purpose of renderingthe services.

    2. a) Any pension paid by, or out of funds created by, a Contracting State or a politicalsubdivision or a local authority thereof to an individual in respect of services rendered to thatState or subdivision or authority shall be taxable only in that State.

    b) However, such pension shall be taxable only in the other Contracting State if theindividual is a resident of, and a national of, that State.

    3. The provisions of Articles 15, 16, 17 and 18 shall apply to salaries, wages and other similarremuneration and to pensions in respect of services rendered in connection with a businesscarried on by a Contracting State or a political subdivision or a local authority thereof.

    Article 20STUDENTS

    Payments which a student or business apprentice who is or was immediately beforevisiting a Contracting State a resident of the other Contracting State and who is present in thefirst-mentioned State solely for the purpose of his education or training receives for the purposeof his maintenance, education or training shall not be taxed in that State, provided that suchpayments arise from sources outside that State.

    Article 21OTHER INCOME

    1. Items of income of a resident of a Contracting State, wherever arising, not dealt with in theforegoing Articles of this Agreement shall be taxable only in that State.

    2. The provisions of paragraph 1 shall not apply to income, other than income from immovableproperty as defined in paragraph 2 of Article 6, if the recipient of such income, being a residentof a Contracting State, carries on business in the other Contracting State through a permanentestablishment situated therein, or performs in that other State independent personal services froma fixed base situated therein, and the right or property in respect of which the income is paid iseffectively connected with such permanent establishment or fixed base. In such case theprovisions of Article 7 or Article 14, as the case may be, shall apply.

    Article 22PROPERTY

    1. Property represented by immovable property referred to in Article 6, owned by a resident of aContracting State and situated in the other Contracting State, may be taxed in that other State.

    2. Property represented by property other than immovable property forming part of the businessproperty of a permanent establishment which an enterprise of a Contracting State has in the otherContracting State or by property other than immovable property pertaining to a fixed baseavailable to a resident of a Contracting State in the other Contracting State for the purpose ofperforming independent personal services, may be taxed in that other State.

    3. Property represented by ships, boats, aircraft, railway or road vehicles owned by a resident of aContracting State and operated in international traffic or by property other than immovableproperty pertaining to the operation of such ships, boats, aircraft, railway or road vehicles shall betaxable only in that Contracting State.

    4. All other elements of property of a resident of a Contracting State shall be taxable only in thatState.

    Article 23ELIMINATION OF DOUBLE TAXATION

    1. In the case of Slovakia, double taxation shall be eliminated as follows:

    Slovakia, when imposing taxes on its residents, may include in the tax base upon whichsuch taxes are imposed the items of income or property which according to the provisions of thisAgreement may also be taxed in Belarus, but shall allow as a deduction from the amount of taxcomputed on such a base an amount equal to the tax paid in Belarus. Such deduction shall not,however, exceed that part of the Slovak tax, as computed before the deduction is given, which isappropriate to the income or property which, in accordance with the provisions of thisAgreement, may be taxed in Belarus.

    2. In the case of Belarus, double taxation shall be eliminated as follows:

    Where a resident of Belarus derives income or owns property which, in accordance withthe provisions of this Agreement, may be taxed in Slovakia, Belarus shall allow:

    a) as a deduction from the tax on the income of that resident, an amount equal to theincome tax paid in Slovakia;

    b) as a deduction from the tax on the property of that resident, an amount equal to theproperty tax paid in Slovakia.

    Such deduction in either case shall not, however, exceed that part of the income orproperty tax, as computed before the deduction is given, which is attributable, as the case may be,to the income or the property which may be taxed in Slovakia.

    3. Where in accordance with any provision of the Agreement income derived by a resident of aContracting State is exempt from tax in that State, such State may nevertheless, in calculating theamount of tax on the remaining income of such resident, take into account the exempted income.

    NON-DISCRIMINATION

    1. Nationals of a Contracting State shall not be subjected in the other Contracting State to anytaxation or any requirement connected therewith, which is other or more burdensome than thetaxation and connected requirements to which nationals of that other State in the same

    circumstances, in particular with respect to residence, are or may be subjected. This provisionshall, notwithstanding the provisions of Article 1, also apply to persons who are not residents ofone or both of the Contracting States.

    2. The taxation on a permanent establishment which an enterprise of a Contracting State has inthe other Contracting State shall not be less favourably levied in that other State than the taxationlevied on enterprises of that other State carrying on the same activities. This provision shall notbe construed as obliging a Contracting State to grant to residents of the other Contracting Stateany personal allowances, reliefs and reductions for taxation purposes on account of civil status orfamily responsibilities which it grants to its own residents.

    3. Except where the provisions of paragraph 1 of Article 9, paragraph 7 of Article 11, orparagraph 6 of Article 12, apply, interest, royalties and other disbursements paid by an enterpriseof a Contracting State to a resident of the other Contracting State shall, for the purpose ofdetermining the taxable profits of such enterprise, be deductible under the same conditions as ifthey had been paid to a resident of the first mentioned State. Similarly, any debts of an enterpriseof a Contracting State to a resident of the other Contracting State shall, for the purpose ofdetermining the taxable property of such enterprise, be deductible under the same conditions as ifthey had been contracted to a resident of the first-mentioned State.

    4. Enterprises of a Contracting State, the property of which is wholly or partly owned orcontrolled, directly or indirectly, by one or more residents of the other Contracting State, shall notbe subjected in the first-mentioned State to any taxation or any requirement connected therewithwhich is other or more burdensome than the taxation and connected requirements to which othersimilar enterprises of the first-mentioned State are or may be subjected.

    5. The provisions of this Article shall, notwithstanding the provisions of Article 2, apply to taxesof every kind and description.

    Article 25MUTUAL AGREEMENT PROCEDURE

    1. Where a person considers that the actions of one or both of the Contracting States result or willresult for him in taxation not in accordance with the provisions of this Agreement, he may,irrespective of the remedies provided by the domestic law of those States, present his case to thecompetent authority of the Contracting State of which he is a resident or, if his case comes underparagraph 1 of Article 24, to that of the Contracting State of which he is a national. The case mustbe presented within three years from the first notification of the action resulting in taxation not inaccordance with the provisions of the Agreement.

    2. The competent authority shall endeavour, if the objection appears to it to be justified and if it isnot itself able to arrive at a satisfactory solution, to resolve the case by mutual agreement with thecompetent authority of the other Contracting State, with a view to the avoidance of taxationwhich is not in accordance with the Agreement. Any agreement reached shall be implementedwithin the time limits in the domestic law of the Contracting States.

    3. The competent authorities of the Contracting States shall endeavour to resolve by mutualagreement any difficulties or doubts arising as to the interpretation or application of theAgreement. They may also consult together for the elimination of double taxation in cases notprovided for in the Agreement.

    4. The competent authorities of the Contracting States may communicate with each other directlyfor the purpose of reaching an agreement in the sense of the preceding paragraphs. When it seemsadvisable in order to reach an agreement to have an oral exchange of opinions, such exchangemay take place through a Commission consisting of representatives of the competent authoritiesof the Contracting States.

    Article 26EXCHANGE OF INFORMATION

    1. The competent authorities of the Contracting States shall exchange such information as isnecessary for carrying out the provisions of this Agreement or of the domestic laws of theContracting States concerning taxes covered by the Agreement insofar as the taxation thereunderis not contrary to the Agreement. The exchange of information is not restricted by Article 1. Anyinformation received by a Contracting State shall be treated as secret in the same manner asinformation obtained under the domestic laws of that State and shall be disclosed only to personsor authorities (including courts and administrative bodies) concerned with the assessment orcollection of, the enforcement or prosecution in respect of, or the determination of appeals inrelation to, the taxes covered by the Agreement. Such persons or authorities shall use theinformation only for such purposes. They may disclose the information in public courtproceedings or in judicial decisions.

    2. In no case shall the provisions of paragraph 1 be construed so as to impose on a ContractingState the obligation:

    a) to carry out administrative measures at variance with the laws and administrativepractice of that or of the other Contracting State;

    b) to supply information which is not obtainable under the laws or in the normal course ofthe administration of that or of the other Contracting State;

    c) to supply information which would disclose any trade, business, industrial, commercialor professional secret or trade process, or information, the disclosure of which would be contrary

    to public policy.

    Article 27MEMBERS OF DIPLOMATIC MISSIONS AND CONSULAR POSTS

    Nothing in this Agreement shall affect the fiscal privileges of members of diplomaticmissions or consular posts under the general rules of international law or under the provisions ofspecial agreements.

    Article 28ENTRY INTO FORCE

    1. The Contracting States shall notify to each other that the domestic requirements for the entryinto force of this Agreement have been complied with.

    2. The Agreement shall enter into force thirty days after the date of the later of the notificationsreferred to in paragraph 1 and its provisions shall have effect in both Contracting States:

    a) in respect of taxes withheld at source, to amounts of income derived on or after the firstday of January in the calendar year next following the year in which the Agreement enters intoforce;

    b) in respect of other taxes, on income and on property, for taxes chargeable for any taxyear beginning on or after the first day of January in the calendar year next following the year inwhich the Agreement enters into force.

    3. From the date when this Agreement becomes effective, in the mutual relations between theSlovak Republic and the Republic of Belarus the application of the Multilateral Convention forthe avoidance of double taxation with respect to income and capital of individuals signed inMiskolc on 27 May 1977 and the Multilateral Convention for the avoidance of double taxationwith respect to income and capital of legal entities signed in Ulan-Bator on 19 May 1978 shall

    cease to have effect.

    Article 29TERMINATION

    This Agreement shall remain in force until terminated by one of the Contracting States.Either Contracting State may terminate the Agreement, through diplomatic channels, by givingnotice of termination at least six months before the end of any calendar year following after theperiod of five years from the date on which the Agreement enters into force. In such event, theAgreement shall cease to have effect:

    a) in respect of taxes withheld at source, to amounts of income derived on or after the firstday of January in the calendar year next following the year in which the notice of termination isgiven;

    b) in respect of other taxes on income and taxes on property, for taxes chargeable for anytax year beginning on or after the first day of January in the calendar year next following that inwhich the notice of termination is given.

    At the moment of signing the Agreement between the Government of the Slovak Republicand the Government of the Republic of Belarus for the avoidance of double taxation and theprevention of fiscal evasion with respect to taxes on income and on property, the undersignedhave agreed that the following provisions shall form an integral part of the Agreement:

    Ad paragraph 2 of Article 6:

    It is understood that until appropriate changes are introduced in the legislative acts ofBelarus the term "immovable property" as defined in paragraph 2 of Article 6 of this Agreementshall be applied by Belarus only in the part in which it is present in its laws.

    Ad paragraph 2 c) of Article 12:

    It is understood that the gross amount of the royalties represents the difference betweenthe whole amount of the payment and the price of transport vehicles or the income. For thispurpose the tax base is calculated in conformity with the domestic laws of the Contracting States.

    lnok 4REZIDENT

    1. Na ely tejto dohody vraz "rezident zmluvnho ttu" oznauje kad osobu, ktor poda prvnych predpisovtohto ttu m daov povinnos v tomto tte z dvodu svojho bydliska, trval ho pobytu, miesta registrciealebo inho podobnho kritria. Predpoklad sa, e samotn zmluvn tt a kad jeho ni sprvny tvar alebomiestny orgn je rezidentom tohto ttu. Tento vraz vak nezaha osobu, ktor m daov povinnos v tomtotte iba z dvodu prjmov zo zdrojov v tomto tte alebo z majetku umiestnenho v tomto tte.

    2. Ak je fyzick osoba poda ustanoven odseku 1 rezidentom oboch zmluvnch ttov, ur sa jej postavenie takto:a) tto osoba sa povauje za rezidenta len toho ttu, v ktorom m stly byt; ak m stly byt v oboch ttoch,

    povauje sa za rezidenta len toho ttu, ku ktormu m uie osobn a hospodrske vzahy (stredisko ivotnedleitch zujmov);

    b) ak nemono uri, v ktorom tte m tto osoba stredisko svojich ivotne dleitch zujmov, alebo ak nemstly byt v iadnom tte, povauje sa za rezidenta len toho ttu, v ktorom sa obvykle zdriava;

    c) ak sa tto osoba obvykle zdriava v oboch ttoch alebo sa nezdriava v iadnom z nich, povauje sa zarezidenta len toho ttu, ktorho je ttnym prslunkom;

    d) ak sa pri uren rezidencie vyskytn akkovek problmy, prslun rady zmluvnch ttov upravia ttootzku vzjomnou dohodou.

    3. Ak osoba in ako fyzick osoba je poda ustanoven odseku 1 rezidentom oboch zmluvnch ttov, prslunrady zmluvnch ttov upravia tto otzku vzjomnou dohodou.

    lnok 5

    STLA PREVDZKARE

    1. Na ely tejto dohody vraz "stla prevdzkare" oznauje trval zariadenie na podnikanie, prostrednctvomktorho podnik plne alebo iastone vykonva svoju innos.

    2. Vraz "stla prevdzkare" zaha najm:a) miesto vedenia;b) poboku;c) kancelriu;d) tovre;e) dielu, af) bau, nlezisko ropy alebo plynu, lom alebo akkovek in miesto aby prrodnch zdrojov.

    3. Stavenisko, stavba alebo intalan projekt tvoria stlu prevdzkare len vtedy, ak trv dlhie ako dvansmesiacov.

    4. Bez ohadu na predchdzajce ustanovenia tohto lnku vraz "stla prevdzkare" nezaha:a) zariadenie, ktor podnik vyuva iba na ely uskladnenia, vystavenia alebo dodania tovaru patriaceho

    podniku;b) zsobu tovaru patriaceho podniku, ktor sa udriava iba na ely uskladnenia, vystavenia alebo dodania; c) zsobu tovaru patriaceho podniku, ktor sa udriava iba na ely spracovania inm podnikom;

    5. Bez ohadu na ustanovenia odsekov 1 a 2, ak osoba - in ako nezvisl zstupca v zmysle odseku 6 - kon vzmluvnom tte v mene podniku a m a obvykle uplatuje prvomoc uzatvra zmluvy v mene podniku, tak tentopodnik m stlu prevdzkare v tomto tte vo vzahu ku vetkm innostiam, ktor tto osoba vykonva pre podnik, pokia innosti tejto osoby nie s obmedzen na innosti uveden v odseku 4, ktor by nezakladaliexistenciu stlej prevdzkarne poda ustanoven tohto odseku, keby sa vykonvali prostrednctvom trvalhozariadenia na podnikanie.

    6. Nepredpoklad sa, e podnik m stlu prevdzkare v zmluvnom tte len preto, e v tomto tte vykonva svojuinnos prostrednctvom maklra, generlneho komisionra alebo inho nezvislho zstupcu, pokia tieto osobykonaj v rmci svojej riadnej innosti.

    7. Samotn skutonos, e spolonos, ktor je rezidentom jednho zmluvnho ttu, ovlda spolonos alebo jeovldan spolonosou, ktor je rezidentom druhho zmluvnho ttu, alebo ktor vykonva svoju innos vtomto druhom tte (i u prostrednctvom stlej prevdzkarne alebo inak), neznamen, e tto spolonos jestlou prevdzkarou druhej spolonosti.

    1. Prjmy, ktor pober rezident jednho zmluvnho ttu z nehnutenho majetku (vrtane prjmov zponohospodrstva alebo lesnctva) umiestnenho v druhom zmluvnom tte, mu by zdanen v tomto druhomtte.

    2. Vraz "nehnuten majetok" m tak vznam, ak m poda prvnych predpisov zmluvnho ttu, v ktorom jetento majetok umiestnen. V kadom prpade tento vraz zaha prsluenstvo nehnutenho majetku, iv amtvy inventr pouvan v ponohospodrstve a lesnctve, prva vzahujce sa na pozemky poda noriemobianskeho prva, prvo uvania nehnutenho majetku a prva na premenliv alebo pevn platby za abualebo za povolenie na abu nerastnch losk, prameov a inch prrodnch zdrojov; lode, lny, lietadl,eleznina cestn vozidl sa nepovauj za nehnuten majetok.

    3. Ustanovenia odseku 1 sa pouij na prjmy z priameho uvania, z njmu alebo z kadho inho spsobu uvanianehnutenho majetku.

    4. Ustanovenia odsekov 1 a 3 sa vzahuj aj na prjmy z nehnutenho majetku podniku a na prjmy z nehnutenho

    lnok 7ZISKY PODNIKU

    1. Zisky podniku jednho zmluvnho ttu podliehaj zdaneniu len v tomto tte, ak podnik nevykonva svojuinnos v druhom zmluvnom tte prostrednctvom stlej prevdzkarne, ktor sa tam nachdza. Ak podnik

    vykonva svoju innos takmto spsobom, mu by zisky podniku zdanen v tomto druhom tte, ale iba vtakom rozsahu, v akom ich mono pripota tejto stlej prevdzkarni.

    2. Ak podnik jednho zmluvnho ttu vykonva svoju innos v druhom zmluvnom tte prostrednctvom stlejprevdzkarne, ktor sa tam nachdza, s vhradou ustanoven odseku 3 tohto lnku, tejto stlej prevdzkarni sa vkadom zmluvnom tte prirauj zisky, ktor by dosiahla, keby ako samostatn podnik vykonvala rovnak

    alebo obdobn innosti v rovnakch alebo obdobnch podmienkach, a keby bola plne nezvisl od podniku,ktorho je stlou prevdzkarou.

    3. Pri urovan ziskov stlej prevdzkarne sa povouje odpota nklady podniku vynaloen na ely tejto stlejprevdzkarne vrtane nkladov na vedenie a veobecnch sprvnych vdavkov takto vynaloench, i u vznikliv tom tte, v ktorom sa tto stla prevdzkare nachdza, alebo inde.

    4. Ak je v niektorom zmluvnom tte obvykl stanovova zisky, ktor maj by pripotan stlej prevdzkarni nazklade rozdelenia celkovch ziskov podniku jeho rznym astiam, ustanovenie odseku 2 nevyluuje, aby tentozmluvn tt stanovoval zisky, ktor maj by zdanen takmto obvyklm rozdelenm. Pouit spsob rozdeleniazisku mus by vak tak, aby bol vsledok v slade so zsadami stanovenmi v tomto lnku.

    5. Stlej prevdzkarni sa nepripotavaj iadne zisky na zklade skutonosti, e iba nakupovala tovar pre podnik.

    6. Zisky, ktor sa maj pripota stlej prevdzkarni sa na ely predchdzajcich odsekov uria kad rokrovnakm spsobom, ak neexistuj dostaton dvody na in postup.

    7. Ak zisky zahaj asti prjmov osobitne uvedench v inch lnkoch tejto dohody, ustanovenia tchto lnkovnie s dotknut ustanoveniami tohto lnku.

    lnok 8MEDZINRODN DOPRAVA

    1. Zisky podniku jednho zmluvnho ttu z prevdzkovania lod, lnov, lietadiel, elezninch alebo cestnchvozidiel v medzinrodnej doprave podliehaj zdaneniu len v tomto tte.

    2. Na ely tohto lnku, zisky z prevdzkovania lod, lnov, lietadiel, elezninch alebo cestnch vozidiel vmedzinrodnej doprave zahruj aj zisky z prenjmu przdnych lod, lnov, lietadiel, elezninch alebocestnch vozidiel pouvanch v medzinrodnej doprave, priom zisky z takhoto prenjmu s nhodn vovzahu k ziskom uvedenm v odseku 1.

    3. Ustanovenia odseku 1 platia aj na zisky z asti na poole, spolonej prevdzke alebo medzinrodnej prevdzkovejorganizcii.

    lnok 9PREPOJEN PODNIKY

    1. Aka) sa podnik jednho zmluvnho ttu zastuje priamo alebo nepriamo na riaden, kontrole alebo na majetkupodniku druhho zmluvnho ttu, alebo

    b) sa tie ist osoby priamo alebo nepriamo zastuj na riaden, kontrole alebo na majetku podniku jednhozmluvnho ttu i podniku druhho zmluvnho ttu,

    a ak v tchto prpadoch s oba podniky vo svojich obchodnch alebo finannch vzahoch viazanpodmienkami, ktor sa dohodli alebo im boli uloen a ktor sa lia od podmienok, ktor by si dohodli nezvisl podniky, mu by akkovek zisky, ktor by jeden z nich dosiahol, ale vzhadom na tieto podmienky ichnedosiahol, zahrnut do ziskov tohto podniku a nsledne zdanen.

    2. Ak jeden zmluvn tt zahrnie do ziskov podniku tohto ttu a nsledne zdan zisky, z ktorch bol podnik druhho

    zmluvnho ttu zdanen v tomto druhom tte, a zisky takto zahrnut s zisky, ktor by bol dosiahol podnik skruvedenho ttu, ak by podmienky dohodnut medzi tmito dvoma podnikmi boli tak, ak by sa dohodli medzinezvislmi podnikmi, potom tento druh tt vhodne uprav sumu dane uloenej z tchto ziskov v tomto tte.Pri stanoven tejto pravy sa bude postupova s nleitm ohadom na in ustanovenia tejto dohody a prslun

    rady zmluvnch ttov mu v prpade potreby vzjomne konzultova.

    3. Ustanovenia odseku 2 sa nepouij v prpade myselnho znenia daovho zkladu.

    lnok 10DIVIDENDY

    1. Dividendy vyplcan spolonosou, ktor je rezidentom jednho zmluvnho ttu, rezidentovi druhho zmluvnhottu, sa mu zdani v tomto druhom tte.

    2. Tieto dividendy sa vak mu zdani aj v tom zmluvnom tte, ktorho spolonos vyplcajca dividendy jerezidentom, a to poda prvnych predpisov tohto ttu, ak je vak skuton vlastnk dividend rezidentom

    druhho zmluvnho ttu, da takto stanoven nepresiahne:a) 10 percent hrubej sumy dividend, ak skutonm vlastnkom je spolonos, in ako osobn obchodnspolonos (partnership), ktor priamo vlastn najmenej 25 percent majetku spolonosti vyplcajcejdividendy;

    b) 15 percent hrubej sumy dividend vo vetkch ostatnch prpadoch.

    3. Vraz "dividendy" pouit v tomto lnku oznauje prjmy zo vetkch druhov akci alebo z inch prv podieasa na ziskoch, s vnimkou pohadvok, ako aj prjmy z inch prv, ktor s zdaovan rovnakm spsobom akoprjmy z akci poda prvnych predpisov toho ttu, ktorho je spolonos rozdeujca zisk rezidentom.

    4. Ustanovenia odsekov 1 a 2 sa nepouij, ak skuton vlastnk dividend, ktor je rezidentom jednho zmluvnho ttu, vykonva v druhom zmluvnom tte, ktorho rezidentom je spolonos vyplcajca dividendy, podnikatesk innos prostrednctvom stlej prevdzkarne, ktor sa tam nachdza, alebo vykonva v tomto

    druhom tte nezvisl osobn sluby zo stlej zkladne, ktor sa tam nachdza a as, pre ktor sa dividendyvyplcaj, sa skutone viae na tto stlu prevdzkare alebo na tto stlu zkladu. V takom prpade sa podaokolnost pouij ustanovenia lnku 7 alebo lnku 14.

    5. Ak spolonos, ktor je rezidentom jednho zmluvnho ttu, dosahuje zisky alebo prjmy z druhho zmluvnhottu, neme tento druh tt zdani dividendy vyplcan spolonosou, s vnimkou prpadov, ak s tietodividendy vyplcan rezidentovi tohto druhho ttu alebo ak sa podie l, v svislosti s ktorm sa dividendyvyplcaj skutone viae na stlu prevdzkare alebo na stlu zkladu nachdzajcu sa v tomto druhom tte, aani neme zdani nerozdelen zisky spolonosti daou z nerozdelench ziskov, aj ke vyplcan dividendyalebo nerozdelen zisky pozostvaj plne alebo iastone zo ziskov alebo z prjmov dosiahnutch v tomtodruhom tte.

    lnok 11ROKY

    1. roky majce zdroj v jednom zmluvnom tte a vyplcan rezidentovi druhho zmluvnho ttu, sa mu zdaniv tomto druhom tte.

    2. Tieto roky sa vak mu zdani aj v tom zmluvnom tte, v ktorom maj zdroj, a to poda prvnych predpisov

    tohto ttu, ak je vak skuton vlastnk rokov rezidentom druhho zmluvnho ttu, da takto stanovennepresiahne 10 percent hrubej sumy rokov. Prslun rady zmluvnch ttov upravia spsob aplikcie tohtoobmedzenia vzjomnou dohodou.

    3. Bez ohadu na ustanovenia odseku 2, roky majce zdroj v jednom zmluvnom tte, poberan a skutonevlastnen vldou druhho zmluvnho ttu alebo Centrlnou (Nrodnou) bankou tohto ttu, s vyat zozdanenia v skr uvedenom tte.

    4. Vraz "roky" pouit v tomto lnku oznauje prjmy z pohadvok akhokovek druhu, zabezpeench alebonezabezpeench zlonm prvom na nehnutenos, bez ohadu na to i maj prvo asti na ziskoch dlnka anajm prjmy z vldnych cennch papierov a prjmy z obligci alebo z dlhopisov vrtane prmi a vhierspojench s tmito cennmi papiermi, obligciami alebo s dlhopismi. Penle za oneskoren platbu sa nepovaujeza roky na ely tohto lnku.

    5. Ustanovenia odsekov 1 a 2 sa nepouij, ak skuton vlastnk rokov, ktor je rezidentom jednho zmluvnhottu, vykonva v druhom zmluvnom tte, v ktorom maj roky zdroj, podnikatesk innos prostrednctvomstlej prevdzkarne, ktor sa tam nachdza, alebo v tomto druhom tte vykonva nezvisl osobn sluby zo

    stlej zkladne, ktor sa tam nachdza a ak pohadvka, z ktorej sa roky platia, sa skutone viae na tto stluprevdzkare alebo na tto stlu zkladu. V takom prpade sa poda okolnost pouij ustanovenia lnku 7alebo lnku 14.

    6. Predpoklad sa, e roky maj zdroj v zmluvnom tte, ak platiteom je tento tt sm, jeho ni sprvny tvar,miestny orgn alebo rezident tohto ttu. Ak vak osoba platiaca roky, bez ohadu na to i je rezidentomniektorho zmluvnho ttu, m v zmluvnom tte stlu prevdzkare alebo stlu zkladu, v svislosti s ktorouvznikol dlh, z ktorho s platen roky, a tieto roky id na archu tejto stlej prevdzkarne alebo stlej zkladne, potom sa predpoklad, e roky maj zdroj v tom tte, v ktorom sa stla prevdzkare alebo stla zkladanachdza .

    7. Ak v dsledku osobitnch vzahov existujcich medzi platiteom a skutonm vlastnkom ro kov, alebo medzinimi a treou osobou, suma rokov vzahujca sa na pohadvku, z ktorej sa platia, presahuje sumu, ktor by boldohodol platite so skutonm vlastnkom, keby takto vzahy neexistovali, pouij sa ustanovenia tohto lnkulen na tto naposledy uveden sumu. as platieb presahujca tto sumu sa v tomto prpade zdan podaprvnych predpisov kadho zmluvnho ttu s prihliadnutm na ostatn ustanovenia tejto dohody.

    lnok 12LICENN POPLATKY

    1. Licenn poplatky majce zdroj v jednomzmluvnom tte a vyplcan rezidentovi druhho zmluvnho ttu, sa

    mu zdani v tomto druhom tte.

    2. Tieto licenn poplatky sa vak mu zdani aj v tom zmluvnom tte, v ktorom maj zdroj, a to poda prvnychpredpisov tohto ttu, ak je vak skuton vlastnk licennch poplatkov rezidentom druhho zmluvnho ttu,da takto stanoven nepresiahne:a) 5 percent hrubej sumy licennch poplatkov v prpade platieb uvedench v odseku 3 psmeno a);b) 10 percent hrubej sumy licennch poplatkov v prpade platieb uvedench v odseku 3 psmeno b);c) 10 percent hrubej sumy licennch poplatkov v prpade platieb uvedench v odseku 3 psmeno c).

    kinematografickch filmov alebo filmov alebo psok a ostatnch prostriedkov obrazovej alebo zvukovejreprodukcie;

    b) akhokovek patentu, ochrannej znmky, nvrhu, nkresu alebo modelu, plnu, tajnho vzorca alebovrobnho postupu alebo za informcie, ktor sa vzahuj na priemyseln, obchodn alebo vedecksksenosti alebo za pouitie alebo prvo na pouitie, priemyselnho, obchodnho alebo vedeckho zariadenia;

    4. V tomto prpade sapoda okolnost pouij ustanovenia lnku 7 alebo lnku 14.

    5. Predpoklad sa, e licenn poplatky maj zdroj v zmluvnom tte, ak platiteom je tento tt sm, jeho nisprvny tvar, miestny orgn alebo rezident tohto ttu. Ak vak osoba platiaca licenn poplatky, bez ohaduna to i je rezidentom niektorho zmluvnho ttu, m v zmluvnom tte stlu prevdzkare alebo stlu zkladu,v svislosti s ktorou vznikla povinnos plati licenn poplatky, ktor id na archu stlej prevdzkarne alebostlej zkladne, potom sa predpoklad , e tieto licenn poplatky maj zdroj v tom tte, v ktorom sa stlaprevdzkare alebo stla zklada nachdza.

    6. Ak v dsledku osobitnch vzahov existujcich medzi platiteom a skutonm vlastnkom licennch poplatkovalebo medzi nimi a treou osobou, suma licennch poplatkov vzahujca sa na pouitie, prvo alebo informciu,za ktor sa platia, presahuje sumu, ktor by bol dohodol platite so skutonm vlastnkom, keby takto vzahyneexistovali, pouij sa ustanovenia tohto lnku len na tto naposledy uveden sumu. as platieb presahujcatto sumu sa v tomto prpade zdan poda prvnych predpisov kadho zmluvnho ttu s prihliadnutm naostatn ustanovenia tejto dohody.

    lnok 13ZISKY ZO SCUDZENIA MAJETKU

    1. Zisky, ktor plyn rezidentovi jednho zmluvnho ttu zo scudzenia nehnutenho majetku uvedenho v lnku 6a umiestnenho v druhom zmluvnom tte, sa mu zdani v tomto druhom tte.

    2. Zisky zo scudzenia hnutenho majetku, ktor je asou prevdzkovho majetku stlej prevdzkarne, ktor mpodnik jednho zmluvnho ttu v druhom zmluvnom tte, alebo hnutenho majetku, ktor patr stlej zkladni,ktor m rezident jednho zmluvnho ttu v druhom zmluvnom tte na vkon nezvislch osbnch sluieb,vrtane ziskov dosiahnutch zo scudzenia tejto stlej prevdzkarne (samej alebo spolu s celm podnikom) alebotejto stlej zkladne, sa mu zdani vtomto druhom tte.

    3. Zisky, ktor plyn rezidentovi jednho zmluvnho ttu zo scudzenia lod, lnov, lietadiel, elezninch alebocestnch vozidiel prevdzkovanch v medzinrodnej doprave alebo hnutenho majetku, ktor sli prevdzketchto lod, lnov, lietadiel, elezninch alebo cestnch vozidiel, podliehaj zdaneniu len v tomto tte.

    4. Zisky zo scudzenia inho majetku, ne je uveden v odsekoch 1, 2 a 3, podliehaj zdaneniu len v tom zmluvnomtte, ktorho je scudzite rezidentom.

    lnok 14NEZVISL OSOBN SLUBY

    1. Prjmy, ktor pober rezident jednho zmluvnho ttu z nezvislch odbornch sluieb alebo z inch innost

    nezvislho charakteru, podliehaj zdaneniu len v tomto tte, ak rezident nem obvykle k dispozcii v druhomzmluvnom tte stlu zkladu na vkon svojich innost. Ak m k dispozcii takto stlu zkladu, mu byprjmy zdanen v tomto druhom tte, ale iba v rozsahu, v akom ich mono pripota tejto stlej zkladni.

    2. Vraz "odborn sluby" zaha najm nezvisl vedeck, literrne, umeleck, vchovn alebo vzdelvacieinnosti, ako aj nezvisl innosti lekrov, prvnikov, ininierov, architektov, zubnch lekrov a tovnchznalcov.

    3. Na ely tejto dohody vraz "stla zklada" oznauje stle miesto, ako je kancelria alebo miestnos,prostrednctvom ktorho fyzick osoba vykonva, plne alebo iastone, nezvisl osobn sluby.

    lnok 15ZVISL INNOS

    1. Platy, mzdy a in podobn odmeny, ktor rezident jednho zmluvnho ttu pober z dvodu zamestnan ia podliehaj zdaneniu, s vnimkou ustanoven lnkov 16, 18 a 19, len v tomto tte, ak sa zamestnanie

    nevykonva v druhom zmluvnom tte. Ak sa tam zamestnanie vykonva, mu sa odmeny za prijat zdani vtomto druhom tte.

    2. Odmeny, ktor rezident jednho zmluvnho ttu pober z dvodu zamestnania vykonvanho v druhomzmluvnom tte, podliehaj zdaneniu, bez ohadu na ustanovenia odseku 1, len v skr uvedenom tte, ak:

    a) sa prjemca zdriava v druhom tte poas jednho obdobia alebo viacerch obdob, ktor nepresiahnu v hrne183 dn v akomkovek dvansmesanom obdob, ktor sa zana alebo kon v prslunom kalendrnomroku, a

    b) s odmeny vyplcan zamestnvateom alebo v mene zamestnvatea, ktor nie je rezidentom druhho ttu, a

    c) odmeny nejd na archu stlej prevdzkarne alebo stlej zkladne, ktor m zamestnvate v druhom tte.

    3. Bez ohadu na predchdzajce ustanovenia tohto lnku, sa odmeny poberan z dvodu zamestnania

    vykonvanho na palube lode, lna, lietadla, elezninho alebo cestnho vozidla prevdzkovanho vmedzinrodnej doprave podnikom zmluvnho ttu mu zdani v tomto tte.

    lnok 16TANTIMY

    Tantimy a in podobn odmeny, ktor rezident jednho zmluvnho ttu pober ako len tatutrneho orgnuspolonosti, ktor je rezidentom druhho zmluvnho ttu, sa mu zdani v tomto druhom tte.

    lnok 17UMELCI A PORTOVCI

    1. Prjmy, ktor pober rezident jednho zmluvnho ttu ako umelec vystupujci na verejnosti, ako divadeln,filmov, rozhlasov alebo televzny umelec alebo ako hudobnk, alebo ako portovec z takchto osobnevykonvanch innost v druhom zmluvnom tte, sa mu bez ohadu na ustanovenia lnkov 14 a 15 zdani vtomto druhom tte.

    2. Ak prjmy z innost osobne vykonvanch umelcom alebo portovcom neplyn tomuto umelcovi aleboportovcovi priamo jemu sammu, ale inej osobe, sa mu zdani bez ohadu na ustanovenia lnkov 7, 14 a 15 vtom zmluvnom tte, v ktorom umelec alebo portovec vykonva svoju innos.

    3. Prjmy, ktor pober rezident jednho zmluvnho ttu z jeho osobne vykonvanch innost umelca aleboportovca, podliehaj zdaneniu bez ohadu na ustanovenia odsekov 1 a 2 len v tomto tte, ak sa takto innos

    vykonva v druhom zmluvnom tte v rmci programu kultrnej a po rtovej vmeny schvlenho obidvomazmluvnmi ttmi a takto innosti s plne alebo z podstatnej asti financovan z verejnch fondov jednhoalebo druhho ttu.

    lnok 18DCHODKY

    1. Dchodky a in podobn odmeny vyplcan z dvodu predchdzajceho zamestnania rezidentovi niektorhozmluvnho ttu podliehaj zdaneniu, s vhradou ustanoven lnku 19 odsek 2, len v tomto tte.

    2. Dchodky a in platby uskutonen na zklade systmu socilneho zabezpeenia niektorho zmluvnho ttupodliehaj zdaneniu, bez ohadu na ustanovenia odseku 1, v tomto tte.

    lnok 19TTNA SLUBA

    1. a) Platy, mzdy a in podobn odmeny, in ako dchodok, vyplcan jednm zmluvnm ttom

    alebo jeho nim sprvnym tvarom alebo miestnym orgnom tohto ttu fyzickej osobe zasluby poskytovan tomuto ttu alebo niiemu sprvnemu tvaru alebo miestnemuorgnu, podliehajaj zdaneniu len v tomto tte.

    b) Takto platy, mzdy a in podobn odmeny vak podliehaj zdaneniu len v druhomzmluvnom tte, ak s sluby poskytovan v tomto tte a fyzick osoba, ktor jerezidentom tohto ttu:(i) je ttnym prslunkom tohto ttu; alebo(ii) sa nestala rezidentom tohto ttu len z dvodu poskytovania tchto sluieb.

    2. a) Akkovek dchodok vyplcan priamo alebo z fondov, ktor vytvoril jeden zmluvn tt alebo jeho ni sprvny tvar alebo miestny orgn, fyzickej osobe za sluby poskytovan

    tomuto ttu alebo niiemu sprvnemu tvaru alebo miestnemu orgnu, podliehazdaneniu len v tomto tte.

    b) Takto dchodok vak podlieha zdaneniu len v druhom zmluvnom tte, ak fyzick osoba jerezidentom a ttnym prslunkom tohto ttu.

    3. Ustanovenia lnkov 15, 16, 17 a 18 sa pouij na platy, mzdy a in podobn odmeny a na dchodky za slubyposkytovan v svislosti s podnikateskou innosou vykonvanou niektorm zmluvnm ttom alebo nimsprvnym tvarom alebo miestnym orgnom tohto ttu.

    lnok 20TUDENTI

    Platby, ktor tudent alebo iak uilia, ktor je alebo bol bezprostredne pred svojm prcho dom do jednhozmluvnho ttu rezidentom druhho zmluvnho ttu a ktor sa zdriava v skr uvedenom tte iba za elomtdia alebo vcviku, dostva na hradu nkladov za pobyt, tdium alebo vcvik, sa nezdania v tomto tte zapredpokladu, e takto platby maj zdroj mimo tohto ttu.

    lnok 21IN PRJMY

    1. Prjmy rezidenta jednho zmluvnho ttu, bez ohadu na ich zdroj, ktor sa neuvdzaj v predchdzajcich

    lnkoch tejto dohody, podliehaj zdaneniu iba v tomto tte.

    2. Ustanovenia odseku 1 sa nepouij na prjmy in ako prjmy z nehnutenho majetku, ktor je definovan vlnku 6 odsek 2, ak prjemca takchto prjmov, ktor je rezidentom jednho zmluvnho ttu, vykonvapodnikatesk innos v druhom zmluvnom tte prostrednctvom stlej prevdzkarne, ktor sa tam nachdza,alebo vykonva v tomto druhom tte nezvisl osobn sluby zo stlej zkladne, ktor sa tam nachdza, a ak prvo alebo majetok, za ktor sa prjmy platia, sa skutone spja s touto stlou prevdzkarou alebo stlouzkladou. V takomto prpade sa poda okolnost pouij ustanovenia lnku 7 alebo lnku 14 .

    lnok 22MAJETOK

    1. Nehnuten majetok uveden v lnku 6, ktor vlastn rezident jednho zmluvnho ttu a ktor je umiestnen vdruhom zmluvnom tte, sa me zdani v tomto druhom tte.

    2. Hnuten majetok, ktor je asou prevdzkovho majetku stlej prevdzkarne, ktor m podnik jednhozmluvnho ttu v druhom zmluvnom tte, alebo hnuten majetok, ktor patr k stlej zkladni, ktor mrezident jednho zmluvnho ttu v druhom zmluvnom tte za elom vkonu nezvislch osobnch sluieb, same zdani v tomto druhom tte.

    3. Lode, lny, lietadl, eleznin alebo cestn vozidl, ktor vlastn rezident zmluvnho ttu a prevdzkovan vmedzinrodnej do prave, alebo hnuten majetok sliaci na prevdzkovanie tchto lod, lnov, lietadiel,elezninch alebo cestnch vozidiel podlieha zdaneniu len v tomto tte.

    4. Vetky ostatn asti majetku rezidenta zmluvnho ttu podliehaj zdaneniu iba v tomto t te.

    lnok 23VYLENIE DVOJITHO ZDANENIA

    1. V prpade Slovenska sa dvojit zdanenie vyli takto:

    Slovensko me pri zdaovan svojich rezidentov zahrn do zkladu dane, z ktorho sa takto dane ukladaj,asti prjmov alebo majetku, ktor sa mu poda ustanoven tejto dohody rovnako zdani v Bielorusku, povolvak zni sumu dane vypotan z takhoto zkladu o sumu rovnajcu sa dani zaplatenej v Bielorusku. Suma, oktor sa da zni, vak nepresiahne t as slovenskej dane vypotanej pred jej znenm, ktor pomernepripad na prjmy alebo majetok, ktor sa mu zdani poda ustanoven tejto dohody v Bielorusku.

    2. V prpade Bieloruska sa dvojit zdanenie vyli takto:Ak rezident Bieloruska pober prjmy alebo vlastn majetok, ktor sa poda ustanoven tejto dohody me zdanina Slovensku, Bielorusko povol:a) zni da z prjmov tohto rezidenta o sumu rovnajcu sa dani z prjmu zaplatenej na Slovensku; b) zni da z majetku tohto rezidenta o sumu rovnajcu sa dani z majetku zaplatenej na Slovensku.Takto znenie vak v iadnom prpade nepresiahne t as dane z prjmov alebo dane z majetku vypotanejpred jej znenm, ktor pomerne pripad, poda okolnost, na prjmy alebo majetok, ktor sa mu zdani naSlovensku.

    3. Ak v slade s ktormkovek ustanovenm tejto dohody prjmy, ktor pober rezident jednho zmluvnho ttu, svyat zo zdanenia v tomto tte, tento tt napriek tomu me pri vypotan sumy dane na zvyn prjmy tohtorezidenta zohadni tieto vyat prjmy.

    lnok 24ZSADA ROVNAKHO ZAOBCHDZANIA

    1. ttni prslunci jednho zmluvnho ttu nepodliehaj v druhom zmluvnom tte iadnemu zdaneniu alebopovinnostiam s nm spojenm, ktor s in alebo aivejie ako zdanenie a s nm spojen povinnosti, ktorm podliehaj alebo mu podlieha ttni prslunci tohto druhho ttu, ktor s v rovnakej situcii najm vsvislosti s trvalm pobytom. Toto ustanovenie sa bez ohadu na ustanovenia lnku 1 uplatn rovnako naosoby, ktor nie s rezidentmi jednho alebo oboch zmluvnch ttov.

    2. Zdanenie stlej prevdzkarne, ktor m podnik jednho zmluvnho ttu v druhom zmluvnom tte, sa nestanov vtomto druhom tte nepriaznivejie ako zdanenie podnikov tohto druhho ttu vykonvajcich rovnakinnosti. Toto ustanovenie neznamen zvzok jednho zmluvnho ttu, aby priznal rezidentom druhhozmluvnho ttu osobn avy, zavy a znenia dan z dvodu osobnho postavenia alebo rodinnch zvzkov,ktor priznva svojim vlastnm rezidentom.

    3. Ak sa neuplatnia ustanovenia lnku 9 odsek 1, lnku 11 odsek 7 alebo lnku 12 odsek 6, roky, licennpoplatky a in vdavky platen podnikom jednho zmluvnho ttu rezidentovi druhho zmluvnho ttu, naely stanovenia zdanitench ziskov tohto podniku s odpotaten za rovnakch podmienok, ako keby boliplaten rezidentovi skr uvedenho ttu. Podobne, akkovek pohadvky podniku jednho zmluvnho ttuvoi rezidentovi druhho zmluvnho ttu s za elom stanovenia zdanitenho majetku takhoto podnikuodpotaten za rovnakch podmienok, ako keby boli dohodnut s rezidentom skr uvedenho ttu.

    4. Podniky jednho zmluvnho ttu, ktorch majetok plne alebo iastone, priamo alebo nepriamo vlastn aleboovlda rezident alebo rezidenti druhho zmluvnho ttu, nepodliehaj v skr uvedenom tte iadnemuzdaneniu ani povinnostiam s nm spojenm, ktor s odlin alebo aivejie ako zdanenie a s nm spojenpovinnosti, ktorm podliehaj alebo mu podlieha in podobn podniky skr uvedenho ttu.

    5. Ustanovenia tohto lnku sa bez ohadu na ustanovenia lnku 2 vzahuj na dane akhokovek druhu acharakteru.

    lnok 25RIEENIE PRPADOV DOHODOU

    1. Ak sa osoba domnieva, e opatrenia jednho alebo oboch zmluvnch ttov ved alebo bud vies v jej p rpade kzdaneniu, ktor nie je v slade s ustanoveniami tejto dohody, me nezvisle od opravnch prostriedkov, ktorposkytuj vntrottne prvne predpisy tchto ttov, predloi svoj prpad prslunmu radu zmluvnho ttu,ktorho je rezidentom, alebo ak sa na prpad vzahuje lnok 24 odsek 1, prslunmu radu zmluvnho ttu,ktorho je ttnym prslunkom. Prpad mus by predloen do troch rokov od prvho oznmenia o konesmerujcom k zdaneniu, ktor nie je v slade s ustanoveniami tejto dohody.

    2. Ak prslun rad povauje nmietku za oprvnen a ak nie je sm schopn njs uspokojiv rieenie, bude sausilova, aby prpad vyrieil vzjomnou dohodou s prslunm radom druhho zmluvnho ttu tak, aby sa

    vylilo zdanenie, ktor nie je v slade s touto dohodou. Dosiahnut dohoda sa uplatn v lehotch podavntrottnych prvnych predpisov zmluvnch ttov.

    3. Prslun rady zmluvnch ttov sa vynasnaia vyriei vzjomnou dohodou akkovek akosti alebopochybnosti, ktor mu vzniknpri vklade alebo uplatovan tejto dohody. Mu sa aj vzjomne poradi, abysa vylilo dvojit zdanenie v prpadoch, ktor nie s v tejto dohode upraven.

    4. Prslun rady zmluvnch ttov mu vzjomne komunikova priamo s cieom dosiahnu dohodu v zmysle predchdzajcich odsekov. Ak sa na dosiahnutie dohody stna vmena nzorov jav elnou, me sa taktovmena nzorov uskutoni prostrednctvom komisie zloenej zo zstupcov prslunch radov zmluvnchttov.

    lnok 26VMENA INFORMCI

    1. Prslun rady zmluvnch ttov si vymieaj informcie potrebn na uplatovanie ustanoven tejto dohodyalebo vntrottnych prvnych predpisov zmluvnch ttov vzahujcich sa na dane, ktor s predmetom tejtodohody, ak zdanenie, ktor upravuj, nie je v rozpore s touto dohodou. Vmena informci nie je obmedzenlnkom 1. Vetky informcie, ktor zmluvn tt prijal, sa uchovvaj v tajnosti rovnakm spsobom akoinformcie zskan poda vntrottnych prvnych predpisov tohto ttu a poskytn sa len osobm alebo radom(vrtane sdov a sprvnych orgnov), ktor sa zaoberaj vymeriavanm alebo vyberanm dan, na ktor savzahuje tto dohoda, vymhanm alebo trestnm sthanm svisiacim s tmito daami alebo rozhodovanm oopravnch prostriedkoch. Tieto osoby alebo rady pouij takto informcie len na uveden ely. Tietoinformcie mu poskytn pri verejnch sdnych konaniach alebo v sdnych rozhodnutiach.

    2. Ustanovenia odseku 1 sa nebud v iadnom prpade vyklada tak, e niektormu zmluvnmu t tu ukladaj

    povinnos:a) vykona sprvne opatrenia, ktor by poruovali prvne predpisy alebo sprvnu prax tohto alebo druhho

    zmluvnho ttu; b) poskytn informcie, ktor by nebolo mon zska na zklade prvnych predpisov alebo v riadnom

    sprvnom konan tohto alebo druhho zmluvnho ttu;c) poskytn informcie, ktor by odhalili akkovek obchodn, hospodrske, priemyseln, komern alebo

    profesijn tajomstvo alebo obchodn postup, alebo informcie, ktorch poskytnutie by bolo v rozpore sverejnm poriadkom.

    lnok 28NADOBUDNUTIE PLATNOSTI

    1. Zmluvn tty si vzjomne oznmia, e boli splnen vntrottne podmienky pre nadobudnutie platnosti tejtodohody.

    2. Tto dohoda nadobudne platnos tridsa dn po dtume neskorieho z oznmen uvedenom v odseku 1, a jejustanovenia sa bud vykonva v oboch zmluvnch ttoch:

    a) v prpade dan vyberanch zrkou pri zdroji zo sumy prjmov poberanch 1. janura aleboneskr v kalendrnom roku nasledujcom po roku, v ktorom dohoda nadobudne platnos;

    b) v prpade ostatnch dan z prjmov a dan z majetku, na dane ukladan za kad daov rokzanajci sa 1. janura alebo neskr v kalendrnnom roku nasledujcom po roku, v ktorom dohodanadobudne platnos.

    3. Dom nadobudnutia platnosti tejto dohody strca vo vzjomnch vzahoch medzi Slovenskou republikou aBieloruskou republikou platnos mnohostrann zmluva o zamedzen dvojakho zdanenia prjmu a majetkufyzickch osb podpsan v Mikovci 27. mja 1977 a mnohostrann zmluva o zamedzen dvojitho zdaneniaprjmu a majetku prvnickch osb podpsan v Ulnbtare 19.mja 1978.

    lnok 29VPOVE

    Tto dohoda zostane v platnosti, pokia ju niektor zmluvn tt nevypovie. Kad zmluvn tt me dohoduvypoveda diplomatickou cestou oznmenm o vpovedi najmenej es mesiacov pred koncom kadhokalendrneho roka nasledujceho po uplynut piatich rokov od dtumu nadobudnutia platnosti tejto dohody. V tomtoprpade sa tto dohoda prestane uplatova:a) v prpade dan vyberanch zrkou pri zdroji zo sumy prjmov poberanch

    1. janura alebo neskr v kalendrnom roku nasledujcom po roku, v ktorom je dan oznmenie ovpovedi;

    b) v prpade ostatnch dan z prjmov a dan z majetku, na dane ukladan za kad daov rok zanajci sa 1.janura alebo neskr v kalendrnnom roku nasledujcom po roku, v ktorom je dan oznmenie o vpovedi.

    NA DKAZ TOHO podpsan, na to riadne splnomocnen, podpsali tto dohodu.
