Objective of resettlement action plan and glossary This Resettlement Action Plan (RAP) is prepared according to the relevant
laws and regulations of the People’s Republic of China and the World Bank policy
OP 4.12 "Involuntary Resettlement" and World Bank procedure BP 4.12
"Involuntary Resettlement". It is “an action plan for resettlement and recovery for
the population affected by the project to ensure that they can benefit from the
project, the life standard can be improved or at least the life standard can be
recovered after the project is finished.”
In th project development, the requisition of land and other properties will
affect the life of the population loboring or depending on the land unfavorably.
“The population affected by the project” means the persons affected in their
production or life due to land requisition or relocation. Including:
T⑴ he persons wholse land (homestead, land for public facility, agriculture,
forestry, husbandry, fishery and bywork, etc.), construction (private house or
appurtenance, enterprise house or public construction, etc.), equity or other
properties are requisited partially or totally, temporily or permanently.
⑵The persons who use the aforesaid land, consturction or other properties;
or the persons whose working or residence place or life habit is affected
unfavorably.
⑶The persons whose life standard is affected unfavorably due to land
requisition and relocation.
Definition of “Population affected by Project”
The “Population affected by Project” means the persons whose life standard
has been affected or will be affected unfavorably; or their ownership of house,
equity or interest, land (including homestead, farmland, pasture, etc.) or other
moveable or estate has been requisted temporarily or permanently; or their
business, career, job or residence and havit is affected unfavorably.
They can be individuals, or legal persons such as enterprise or public
institution. The definitioin neither defines the legal registratin, life or business nor
restricts the compensation of their properties within the affecte area; therefore
they include:
⑴The persons affected without taking into consideration their legal rights or
whether they are present when their propertie are requisited.

⑵The persons without residential permit in the special area.
In a word, all those population affected, without taking into consideration
their properties, lands or locations, will be regarded as the persons affected and
will be registered.
If there are more than one person or household using the requisited land or
property, the compensation and recorvery will be conducted based on the loss
and the equity and life standard affected. The aforsaid definitiion has the direct
relation with the unfavorable influence of the project without considering the legal
equity.
All the population affected shall be compensated to improve or at least
recover their life standard. The compensation for the property lost shall be
compensated according to the replacment price rather than the depreciation or
other reasons. The population affected shall enjoy the equity from the influence.
In addition to compensation, they shall be entitled to subsidy to help them to be
recovered. Those affected in their business, reclaim of land or construction due to
the loss of property, equity or legal residential permit shall be deemed same as
those with officlal legal property, equity or permit and shall be entitled to
recovering their life and compensation of their properties.
Definitiion of “resettlement”
The resettlement means the arrangment of production or life for those
affected by the project to ensure their rights in the project. Primarily including:
⑴Relocatingo land requisition;fected unfavorably infrastructre affected;e
affected by the project to ensure their rights in the proj living site;
⑵Looking for new job for those affeced in work;
⑶Recovering the land, working place, wood and infrastructre affected;
⑷Recovering the persons whose life standard is affected unfavorably (for
example, by noxious gas) due to land requisition;
⑸Recovering or compensating the individuals or public enterprises affected;
⑹Recovering the cultural or public properties affected unfavorably.
Definition of “Recovery”
“Reovery” means to recover the ability of production of the persons affected
by the project or raise or at least maintain the current life standard.
This plan is to provide a resettlement plan for the population affected by the
project to ensure their loss is compensated and their life standard is improved or

at leasted maintained at the current level. To achieve this objective, the plan
provides recovery measures to recover the income of the persons affected to
maintain their life. Meanwhile the resources of business and production (including
shops or enterprises), public properties, infrastructure or cultural properties
affected will be improved or at leasted maintained at the current level.

1 Introduction to the project
1.1 Project backgroundNingbo is in the middle section of the coast of China, in the east end of Ning-
Shao Plain of Zhejiang Province, east to Zhoushan Isle as its natural shield, north to
Hangzhou Bay, west to Shengxian, Xinchang and Shangyu of Shaoxing City, south to
Sanmen Bay, adjacent to Sanmen and Tiantai of Taizhou. The whole city covers land
area 9365km2, in which downtown area 1033km2. Ningbo achieved regional total
output value RMB 396.41 billion Yuan in 2008, growing by 10.1% over the previous
year, and the total output value per capita was RMB 69997 Yuan (equal to US$
10079 as per the annual average exchange rate, first time passing US$ 10000 Yuan).
While the central government is promoting harmonious development of national
economy, as a national historical and cultural city, an outstanding tourism city and a
model environment city, Ningbo is still facing the issues such as large total emission
volume of pollutants, great polluted agricultural resource, significant structure-type
pollution, etc. The environment condition is severe. The water environment is
unoptimistic as the rivers in the downtown or even in the plain are polluted and the
total P and the total N of the drinking water resource are far beyond the standard.
On the other hand, according to the Certain Comments on Promoting
Construciton of New Socialism Village ZF [2006] No.1, Zhejiang Provincial
Government has decided to promote the construction of new socialism village to
construct agriculture as a high-effective sustainable ecologic agriculture with market
competitive ability, construct the villages as new village communities for the farmers
to enjoy modern and civilized life and train the farmers as the new farmers with
culture and technology who can meet the requirement of the industrial development
and know how run business to form the integrated development patter for the cities
and the villages.
According to the relevant requirements on promoting the construction of new
socialism village of the central government and the provincial government, Ningbo
Municipal Committee and Government have carried out the project of new village
construction for the renovation of the village environment based on the project of
“one hundred model villages and one thousand renovated villages” already initialized
in 2003 and are looking forward to cooperating with the World Bank to raise the
general level of the construction of new socialism villages in Ningbo backed by the

capital of the World Bank, advanced techniques and management ideas.
1.2 Project detail
1.2.1 Composition
The sub-project includes three sections: express passage to Chunhu Town,
Fenghua City; coastal water supply of Fenghua City and Chunhu Wastewater
Treatment Plant and supporting network, Fenghua.
1.2.2 Project detail
(1) Express passage to Chunhu Town, Fenghua City
The passage will connect Chunhu to Fenghua downtown, Yong-Tai-Wen
Railroad, Yong-Tai-Wen Expressway, etc. It is from the terminal of the West Ring
Highway of Chunhu Town in plan, through Qianzhangyan Tunnel, along the east
side of Hengkeng Reservoir and Shangheng Village, passing Yong-Tai-Wen
Railroad, to the road towards Fenghua Railroad Station which is under
construction, and then connected to Fenghua downtown and the entrance and
exit of Yong-Tai-Wen Expressway.
The passage is 6.20 km long. There will be two bridges of total 96 m long,
one tunnel of 3260 m long, 4 flyovers, and 12 culverts along the road. The
constructions will account for 54.36% of the whole passage. There will be 682900
m3 earth to be excavated and 149900 m3 roadbed to be filled out; 1400 m3 of
drainage project, 7200 m3 of thick base material. The passage project needs to
requisit land 208.3 Mu and relocate house 3027m2.
(2) Coastal water supply of Fenghua City
The constructor of the water supply project is Fenghua Tap-water Company.
Backed by the current water plant in the downtown of Fenghua City, the project
will supply water to Chunhu downtown. The project will include the construction of
new trunk water pipe and booster pump station and the reconstruction of the
original water supply network of Chunhu Town. According to the plan, there will
be one booster pump station at Shanxiadi Village, Xiwu Subdistrict, which will
cover 6.8 mu land; the trunk pipe from the water plant to Hongsheng Bank,
Chunhu Town is 25.7 km long; 5.88 km long network of Chunhu Town will be
reconstructed; 2500 households in the supply scope will have one household one
meter.
(3) Chunhu Wastewater Treatment Plant and supporting wastewater network

The project of Chunhu Wastewater Treatment Plant and supporting
wastewater network including a wastewater treatment plant of capacity 10000 t/d
and the corresponding wastewater network. The plant will be the foot of Mantou
Mountain, southeast Chunhu. It covers land area 49.96 mu in plan. The project
will also construct network 10.36 km long along the roads and will occupy 42.98
mu land temporarily. The project needs to relocate hosue 452 m2.
In addition, the project will use the energy saving capital for increased
projects of the World Bank for the construction of energy saving project of the
collective housing of Dongxie Village, Chunhu Town, Fenghua. The project will
integrate the solar energy heating systems of the individual households into the
construction design and construction, It is expected the energy saving project will
be included in the 2nd phase of construction for 2010-2011.
The collective housing project is in the southeast Dongxie, backed with the
mountains and along the river, north to Chunhu East Ring Road, and south to
Jiangzhu Stream. The whole agricultural residential zone covers land area 65 mu
and construction area 39000 m2 for total 262 households. The land requisition for
the first phase of construction has beeen finished successfully and the
construction will be launched this year. The villagers affected by the requisition
are quite satisfied with the compensative resettlement. The 2nd phase of
construction will be launched in 2010. Dongxie Village has promised to conduct
the land requisition and resettlement well to prepare for the project according to
the relevant requirements.
1.3 Project designExpress passage to Chunhu Town, Fenghua City, is designed by Zhejiang
Highway and Waterway Engineering Consultation Company. The feasibility
research report was compiled in December 2008. The designer is amending the
report according to the requirements of the World Bank and the project owner.
Chunhu Wastewater Treatment Plant and supporting wastewater network is
designed by Beijing Jiangong Jinyuna Environment-protection Development Co.,
Ltd. The feasibility research report was compiled in January 2009. The designer
is amending the report according to the requirements of the World Bank and the
project owner. Coastal water supply of Fenghua City is designed by Central-south
Research Institute of China Municipal Engineering Coorporation. The suggestion

report was compiled in December 2008. The feasibility research report is being
compiled.
During the preparation of this report, the work will be conducted within the
land scope determined by the project owner and the designer.
1.4 Project influence and service scopeThe project concerns 6 administrative villages of Xiwu Subdistrict and Chunhu
Town, Fenghua City. It will inevitably exert negative influence from the land
requisition. According to the feasibility reports, the project will affect 95 households of
total 287 persons, land 265.06 mu and houses 3479m2. Meanwhile, the project will
exert certain influence over the local environment. The project owner and the
designer will prepare satisifying resettlement plan and environment protection plan to
reduce the negative influence of the project according to the relevant state and local
laws and regulations.
The project will definitely bring about positive influence over the local economic
development and environment. The express passage can improve the local traffic
condition; the water supply project can guarantee the water quality and supply of the
local residents; the wastewater treatment plant can reduce the pollution of the
wastewater to the local environment. Through on site survey, the population affected
by the project basically supports the construction of the project.
The project concers wastewater treatment, tap water and traffic of Chunhu Town,
Fenghua City and will surely raise the urbanization of Chunhu Town.
1.5 Measures on reducing resettlement
1.5.1 Planning and design phase
The construction of the project will cause land requisition, relocation and
migration and affect the life and production of the original residents. During the
planning and design phase, we will pay much attention to the influence over the
local society and economy which will be a criterion for the comparision and
optimization of the plan. The designer and the project owner has taken up certain
effective measures to reduce the land requisition and migration and taking into
consideration the local planning and the comment from the local government.
⑴ It is necessary to reduce the relocation and influence over the villagers’
life when selecting the sites for the passage, pipes and wastewater treatment
facility. For example, the passage project has two schemes. One of them is

basically to widen Chunbai Road at its two sides and reconstructs or optimizes
certain section of the road; the another scheme is to connect Chunhu West Righ
Road and way to Fenghua Train Station via tunnel. Compared with scheme two,
scheme one needs more relocation which means much influence over the
residents along the road; though scheme is cheaper, we selected sheme two
finally.
⑵ It is necessary to keep away from the water resource, school, hospital,
cultural relic site, scenic spot, etc. Those sites shall not generate pollution or
generate pollution within the scope according to the relevant laws and regulations
and the current standard. It is also necessary to consider the wind direction for
the residents.
⑶ The project considers the inconvenience brought about to the life of the
local residents because of the construction. The temporary passage shall be set
up in the crowded area. The damage of the infrastructure such as trench shall be
recovered later.
⑷ The project design shall be optimized and the project period shall be
shortened. The earth excavation and fill shall be reduced. It is necessary to
arrange construction period well to reduce the influence of the construction over
the local environment. For example, the relocation and reconstruction shall be
arranged in the offseasons for the farmers; the land requisition shall be arranged
after the harvest; the construction of the bridge or tunnel shall be arranged before
the spring ploughing for the irrigation and flood prevention.
1.5.2 Construction phase
⑴ Participation mechanism
。 Before the project is launched, the project launching time and progress
and the compensation policy for land requisition, relocation and resettlement shall
be announced in bulletin in the area affected for the supervison of the population
affected. During the construction period, the local materials will be adopted firstly.
If possible technically, the local transportation and labor service shall be used
preferentially to benefit those affected.
⑵ Management of dust and waste
The constructor will plan the transportation route of the earth and stone and
take up measures to keep away the fall of earth and stone from the

transportaiton. As the project period is quite long and there are many workers,
the working site will generate much waste every day. The constructor will clean
the environment as per the requirement of the local environment protection
department to prevent the disease.
⑶ Construction management and protection of ecologic environment
The transportation of construction materials and the move of the workers will
crowd the original roads so that it is necessary to enhance the traffice
arrangement. The pitch and RC mixture site, piling site and RC structure field
shall be away from the residential zones. The wastewater from the construction
shall not be drained without control. The temporary consturction site shall be
recovered after the use.
⑷ Environment protection. It is necessary to have measures for the
monitoring of environment indices to avoid the influence of the construction over
the local residents. Meanwhile, the construction shall always consider using the
nearby earth and avoid the damage over the mountains and shall recover the
environment if damaged.
1.5.3 Resettlement action plan and implementation phase
⑴ It is necessary to collect the basic information for the analysis and
research of the local economic condition. The resettlement action plan shall be
based on the practical local condition. The life standard of those affected by the
project shall be guaranteed.
⑵ It is necessary to enhance the internal monitoring and external
independent monitoring, establish effective feedback channel, and shorten the
feedback cycle to guarantee the settlement of the issues in the construction.
1.5.4 After the construction
To reduce the unfavorable influence over life of the local residents during
and after the construction, the project will also take the following measures:
⑴After the project is finished, the waste and equipments casted off shall be
cleared off.
⑵During the construction, the major pollution is dust and odor. The dust can
be controlled through earth covering and water spray; the garbage on the roads
fallen from the transporation shall be cleaned in time; it is necessary to plant
certain grass and trees to beautify the environment and purify the air.

1.6 ProgressThe preparation work of the project will be finished in 2009 and then the
project will be launched. The project will be finished and put into operation no
later than 2013. The total project period is 30 months. To guarantee the project
construction successfully, the resettlement will be initialized in the second half of
2009 and be finished before the end of 2009. Please refer to the following Table
1.6-1 for the detail progress:

1.7 Introduction to resettlement planThe land requisition will not affect many people as the land in requisition is
scattered and is of small area. The people will be resettled within the same
village afterwards; as for the production resettlement, some villages can use the
extra land or the land of other farmers for the compensation of the those affected;

2 Analysis of natural, social and economic influence within
the project zone
2.1 Natural feature2.1.1 Ningbo’s natural feature
Ningbo is in the middle section of the coast of China, in the east end of Ning-
Shao Plain of Zhejiang Province, east to Zhoushan Isle as its natural shield, north to
Hangzhou Bay, west to Shengxian, Xinchang and Shangyu of Shaoxing City, south to
Sanmen Bay, adjacent to Sanmen and Tiantai of Taizhou. Its topography is higher in
the southeast and lower in the northeast. Siming Mountains of southwest-northeast
direction in the hill region in southwest Zhejiang is originated from Tiantai and
scattered in Yuyao, Fenghua, and Yinxian. The ramification of Tiantai Mountain
enters into the territory through southwest Ninghai; through Xiangshan Port, it
extends into the hills in the south. The northeast and the central parts are the Yong
River Drainage Area, part of the Ning-Shao Alluvial Plain. So the topography is very
gentle. There are numerous rivers such as Yuyao River, Fenghua River, Yong River,
etc. so that there is plentiful of water resource.
Ningbo is in semi-tropical monsoon weather with mild humidity. There are four
different seasons. The average temperature is 16.2℃ around the year. The highest
average temperature is 28.8℃ in July and the lowest -4.2℃ in January. There are
230 days to 240 days in the year without frost. The growth period of the plants is 300
days. So it is ideal for the growth of food, cotton and oil plants. The average annual
rainfall is 1300 to 1400 mm. The rainfall in May to September accounts for 60% of the
total around the year.
2.1.2 Fenghua’s natural feature
Fenghua City is along the coast in east Zhejiang Province, south to Ningbo, east
to Xiangshan Port, opposite to Xiangshan County across the port, south to Ninghai,
west to Xinchang County, Sheng County and Yuyao City, north to Yin County. It is
70.5 km from east to west and 42 km from south to north. The land area covers 1268
km2 and the sea area 96 km2. The coastal line is 61 km long. There are 24 islands.
There are more mountains in the southwest section and much water in the northwest
section. Its west section is the joint section of Tiantai Mountain and Siming Mountain.
The altitude of Huangnijiang Peak is 976 M, the highest peak in the territory. The
northeast section is of gentle topography with numerous rivers and fertile soil, the

Ning-Feng Plain. There is a narrow lower land belt along Xiangshan Port. The rivers
are stream-type rivers. Shan River, Xian River and Dong River all from the southwest
mountains and flow into the northeast section until Fenghua River in Fangqiao Town.
There are over ten streams in the east section flowing into Xiangshan Port. The
topography is “60% mountain 10 % water and 30% farm field”.
Fenghua is in semi-tropical monsoon weather with four different seasons and
mild humidity. The average temperature is 16.3℃ around the year. The highest
average temperature is 28.0℃ in July and the lowest 4.6℃ in January. There are
232 days in the year without frost. There are 1850 sunlight hours around the year.
There are averagely 150 rainfall days. The average annual rainfall is 1350 to 1600
mm. Since the topography is higher in the southwest and lower in the northeast,
there is significant mountain land effect. The rainfall is increased from northeast to
the southwest. The major natural disasters are typhoon, drought, flood and cold
wave.
2.2 Introduction to society and economy2.2.1 Ningbo’s society and economy
Ningbo governs six districts (Haishu, Jiangdong, Jiangbei, Zhenhai, Beilun and
Yinzhou), two counties (Ninghai and Xiangshan) and three county-level cities (Cixi,
Yuyao and Fenghua). In the end of 2008, the population of the city was 5.681 million,
growing by 6.3% compared to the previous year, in which downtown population 2.201
million. The birth rate was 8.15‰ while the death rate was 5.97‰. The natural
population growth rate was 2.18‰. The regional GDP was 396.41 billion Yuan,
growing by 10.1% over the previous year, in which primary industry by 4.1%,
secondary industry by 10% and tertiary industry by 11%. The GDP per capita was
RMB 69997 Yuan (equal to US$ 10079 as per the annual average exchange rate,
first time passing US$ 10000 Yuan). The general fiscale budget income was RMB
81.09 billion Yuan, growing by 12% over the previous year, in which the local fiscal
income RMB 39.04 billion Yuan, growing by 18.6% over the previous year. The
agricultural economy was developing steadily. The value of the gross output of
agriculture, forestry, husbandry and fishery was RMB 26.3 billion Yuan, growing by
4% over the previous year. The “two-creation” multiplying plan in the industrial
section had been implemented totally. The value of gross industrial output reached
RMB 1093.7 billion Yuan, growing by 13.9% over the previous year, in which the

value of gross industrial output of the enterprise with certain scale reached RMB
889.18 billion Yuan, growing by 12.7% over the previous year. The investment via
fixed asset of the whole society reached RMB 172.82 billion Yuan, growing by 8.2%
over the previous year. The investment structure was optimized further. The
investments in the tertiary industry, the industry of agriculture, forestry, husbandry
and fishery and the social cause grew by 12.1%, 48.9% and 23.5% over the previous
year respectively.
The growth of the income of the urban and rural recidents is growing quite fast.
The disposable income per capita in the city was RMB 25304 Yuan, growing by
13.4% over the previous year; the net income per capita in the villages was RMB
11450 Yuan, growing by 13.9% over the previous year, in which the salary incomes
per capita of the urban and rural residerts were RMB 19270 Yuan and RMB 6816
Yuan respectively, growing by 16.6% and 16.0% respectively. The income difference
between the urban residents and the rural residents was decreased from 1.219:1 in
2007 to 2.210:1 in 2008. The consumptive expense per capita of the urban residents
was RMB 16379 Yuan, growing by 17.7% of the previous year and the Engel's
Coefficient was 37.3%; the consumptive expense per capita of the rural residents
was RMB 9174 Yuan, growing by 13.8% of the previous year and the Engel's
Coefficient was 40.9%, decreased by 0.8% over the previous year.
2.2.2 Fenghua’s society and economy
Fenghua was upgraded from a county to a city in 1988. It governs five districts,
five subdistricts, six towns, seven townships, 29 communes, 354
villagers’committees. The population fo the city in the end of 2007 was 480324 in
180298 households, growing by 976 persons over the end of the previous year, in
which agricultural population 103705, accounting for 21.6% of the total population;
there were 3588 persons born and 3172 persons died in this year. The net increased
population is 461 and the natural population growth rate is 0.96‰.
In the end of 2007, the plowland gained covered 321425 Mu (in which paddy
field 289511 Mu and dry field 31914 Mu. The gross product of the food was 63000 T.
The plowland per capita of the agricultural population was 0.84 Mu. The average mu
product was 346 kg and food owned per capita was 131 kg. In 2007, the city finished
GDP 16.889 billion Yuan, growing by 12.7% over the previous year, in which the
added value of the primary industry RMB 1.511 billion Yuan, growing by 2.3% over
the previous year; of the secondary industry RMB 8.633 billion Yuan, growing by

12.3% over the previous year; of tertiary industry RMB 6.745 billion Yuan, growing by
15.8% over the previous year. The proportion among the three industries was
adjusted from 9.7:51.4:38.9 in the previous year to 9.0:51.1:39.9 in 2007. The
GDP per capita was RMB 35200 Yuan. The disposable income per capita of the
urban residents in the city in 2007 was RMB 21698 Yuan, growing by 8.6% over the
previous year and the disposable income per capita of the urban residents in the city
in 2007 was RMB 9505 Yuan, growing by 9.1% over the previous year.
2.2.3 Status in quo of social and economic development of those townships (towns)
affected
The project mainly affects Xiwu Subdistrict and Chunhu Town, Fenghua City.
To analyze the project influence and prepare the practial resettlement plan, under
the arrangement of Ningbo Municipal Project Administrative Office, the various
people’s governments, the administrative office for using World Bank loan and
other relevant departments, and ECIDI organized a project survey workgroup in
February and March 2009 for the survey of the social and economic conditions by
the end of 2007 of those townships (towns) affected.
A. Xiwu Subdistrict
Xiwu Subdistrict is in the east outskirt of Fenghua City, 8 km from the downtown
of Fenghua and 20 km from the downtown of Ningbo, 15 km from Lishe Airport, and
50 km from Beilun Port. The administrative area is 111.7 km2. It governs 23
administative villages, 614 villagers’ groups and 2 communities. The population in the
end of 2007 was 46340 in 17539 households, in which agricultural population 39805.
The plowland covers 53220 mu, in which paddy field 49739 mu, dry land 3481 mu,
and forestry area 67000. Its traffic condition is very good. Tong-San Expressway
passes through the Subdistrict and its only exit in Fenghua is at Xiwu. Yong-Tai-Wen
Railroad passes through Xiwu and a passenger and commodity train station will be
constructed at Shangqiao. Feng-Bai Highway within the district connects the west to
the east while Xi-Ning Highway connects the south to the north.
The plowland per capita of the agricultural population in 2007 was 1.34 mu, the
total output of food 16893t, the food owned per capita 424kg. The total income from
the agricultural economy in the end of 2007 was RMB 3.979 billion Yuan, in which
agricultural income accounted only for 5.6% while the non-agricultural income 94.4%.
The total fiscale income reached RMB 0.109 billion Yuan, passed the RMB 0.1

million Yuan pass for the first time. The net income per capita of the agricultural
population in the end of 2007 was RMB 6779 Yuan.
B. Chunhu Town
Chunhu Town is on the north bank of Xiangshan Port, Zhejiang Province, east to
Qiucun Town, west to Shangtian Town, north to Xiwu Subdistrict. Chunhu Town has
been the political, economic, cultural and trading center in east Fenghua for a long
history. It is the center for the development of oceanic economy in east Fenghua and
is one of the two wings in the development plan “one body and two wings”. Chunhu
Town has convenient traffic and complete facilities. Yong-Lin Line of No.34 Provincial
Highway, Tong-San Expressway and Tong-Tai-Wen Railroad which is under
construction pass through the territory. It is 20 km from Fenghua downtown, 36 km
from Ningbo Lishe Airport, 69 km from Beilun Port, 50 km from Ningbo Train Station
and 40 km from Xikou, a national scenic spot.
Chunhu Town covers land area 127.7 Km2 and its coastal line is 31 km long. It
governs 51 administrative villages and 3 communities. In the end of 2007, the
population was 62644 in 23123 households, in which agricultural population 56363.
The plowland covers 40393 mu (paddy field 35633 and dry field 4760), the shoal
over 30000 mu, the fir forest over 100000 mu. There were 31000 network cases,
13000 mu of oyster breeding base, 8000 mu of greengage base, over 350 steel ships
and over 450 inner harbour small ships.
The total output of food in 2007 was 7598t. The plowland per capita of the
agricultural population was 0.72 mu; the food owned per capita was 135 kg. The total
income from the agricultural economy in the end of 2007 was RMB 4247.59 million
Yuan, in which agricultural income accounted only for 21.7% while the non-
agricultural income 78.3%. The net income per capita of the agricultural population in
the end of 2007 was RMB 7171Yuan.

2.3 Analysis of project influenceThe analysis is to learn the influence of the project over the local residents
and their attitude and response. Especially through the analysis of employment
mode and income structure of the households affected, the influence from the
land requisition is investigated so that the countermeasures can be discussed to
reduce the unfavorable influence to learn the economic influence from the land
requisition and make better resettlement plan.
So the project investigation group surveyed three villages and visited 35
households, accounting for 36.84% of the total number of those affected, with
questionaire. The group carried out detail investigation about the basic condition
of their production and life. The investigation basically covers the whole region
affected and is representative and typical so that it can be the reference for the
influence analysis. The investigation sample covergage is Table 2.3-1.

2.3.1 Analysis of basic condition of those villages affected
The project influences Jindi Village and Qitou Village of Chunhu Town and
Shanxiadi Village of Xiwu Subdistrict. The three villages have different economic
structures. Shanxiadi Village focuses on agriculture, economic planting and labor
service; Jindi Village focuses on industry; and Qitou Village focuses on sand
dredging and breeding.
① Shanxiadi Village
Shanxia Village in in southeast Xiwu Subdistrict and in hills on plain. In the
end of 2007, there had been 37 villagers’ groups, 1025 households for 2641
persons, 3117 mu plowland, in which dry filed 437 mu and paddy field 2650 mu.
There had been 1586 laborers, in which 465 persons worked fro the township
enterprises, accounting for 29.3%; 692 person were engaged in the traditional
agriculture, accounting for 43.6%. In 2007, the total income from the agricultural

economy was RMB 25.09 million Yuan, in which the industrial income was RMB
9.06 million Yuan, accounting for 36.1%; the farming, forestry, animal husbandry,
side-line production and fishery income was RMB 10.63 million Yuan, accounting
for 42.4%. The income of the farmers is mainly from the agriculture. The net
income per capita of the farmers is RMB 8155 Yuan, ranking at the middle level
among all the villages of the town.

Site: Zhongheng Villagers’ Gropu, Shanxiadi Village, Xiwu Subdistrict
His family has four persons: husband and wife and two children. The daughter
has graduated from school and is working now. The son is still in his senior high
school. The family contracts over 3 mu land for the planting of vegetable. There are
two main laborers in the family. He usually works in the factory run by the Subdistrict.
His income is over RMB 1000 Yuan. They will also sell some vegetables. The income
from the vegetable is around a couple of thousands RMB Yuan. Their income level is
at the middle level in the village.
He has learned of the highway construction long ago since the newspaper
has covered it before. He thinks most people would support the construction. He
hopes the highway should be as closer as possible to the west of the village
which will not influence the houses in the village. He also hopes there will be two
accesses to the highway.
② Jindi Village
Jindi Village is around 4 km from Chunhu Town. Chunhu Industrial Park is in
this village. There are more than ten enterprises in this village. As there is

insufficient plowland and there are many enterprises, the villagers are not
focusing on agriculture now. Over 70% of the villagers are engaged in individual
industrial or business or work for the enterprises in the village.
In the end of 2007, there had been 8 villagers’ groups, 289 households for
835 persons, 624 mu plowland and 525 laborers, in which 222 persons worked in
the village-owned enterprises, accounting for 42.3%, 115 persons were engaged
in the traditional agriculture, accounting for 21.9%. In 2007, the total income from
the agricultural economy was RMB 52.3 million Yuan, in which the industrial
income was RMB 46.55 million Yuan, accounting for 89%; the farming, forestry,
animal husbandry, side-line production and fishery income was RMB 2.89 million
Yuan, accounting for 5.5%. The income of the farmers is mainly from the
industry. The net income per capita of the farmers is RMB 8430 Yuan.

Site: Jindi Village, Chunhu Town
The family has three persons: husband, wife and son. Their land has been
requisited for constructing factory. They constructed a building of construction area
over 200 m2 at a price over RMB 300000 Yuan a couple of years ago.
The income mainly is from their own factory. As the business is quite good, their
income is decent. They are the rich persons in the village. The income of the villagers
is mainly from the planting of fruit trees, gardening plants and labor service. There is
little traditional agriculture. The income per capita was RMB 8000 Yuan last year,
ranking at the middle level in the twon. I support the national construction. As the
road is constructed, the business will be much convenient. After the tap water is

connected to the village, I hope the water price can a bit cheaper than that in the
downtown.
③ Qitou Village
Qitou Village is 4 km northwest from Chunhu Town and close to Xiangshan Port.
Since it is close to the sea, there is little plowland in the village. The main income of
the villagers is from sand dredging and mariculture. There are a few engaged in
planting. More than 60% villagers are engaged in sand dredging and mariculture.
In the end of 2007, there had been 4 villagers’ groups, 116 households for
292 persons, 252 mu plowland and 185 laborers, in which 85 persons worked for
sand dredging and in the village-owned enterprises, accounting for 45.9%, 42
persons were engaged in the mariculture and fishery, accounting for 22.7%. In
2007, the total income from the agricultural economy was RMB 25.51 million
Yuan, in which the industrial income was RMB 13.41 million Yuan, accounting for
52.6%; the fishery income was RMB 0.37 million Yuan, accounting for 14.5%.
The income of the farmers is mainly from the industry. The net income per capita
of the farmers is RMB 8130 Yuan.

Site: Qitou Village, Chunhu Town
The family has five persons: husband, wife, son, daughter-in-law, and grandson.
The family has contracted 2.5 mu plowland for vegetable and food, sufficient for the
family. The main income of the family is from the mariculture. The annual income is
around a couple of ten thousands RMB Yuan, ranking normal in the village.
I heard of the construction of wastewater plant early this year. I support the
construction. But I still have certain concern whether the plant will influence the
environment of the village. If the influence exists, we have reservation over the
project. Moreover, the compensation for the land requisition should be a bit higher
based on the practical condition of the village.
2.3.2 Analysis of basic condition of those households attected
Population⑴
Basic information: The project will influence 95 households for 287 persons,
in which female population 139, accounting for 48.4%, and male population 148,
accounting for 51.6%, all of Han nationality.

Age distribution: Among the 287 persons, 61 persons under 18 years old,
accounting for 21.3%; 194 persons between 18~60 years old, accounting for
67.6%; 32 persons above 61 years old, accounting for 11.1%.
Family scale: smallest: 1 person; largest: 6 persons; agerage: 3.02 persons.
Educational level distribution: 20 persons before schooling, accounting for
7.0%; 6 persons in kindergarten, accounting for 2.1%; 49 persons educated in
elementary school, accounting for 17.1%; 121 persons educated in junior high
school, accounting for 42.2%; 65 persons in educated senior high school,
accounting for 22.6%; 24 persons educated in secondary technical school,
training school or vocational senior high school, accounting for 8.4%.
Employment type: total 164 laborers, in which 70% for non-agricultural business,
most of them in the village enterprises.
Land resource⑵
The area affected is in the coastal area in east Zhejiang Province. The local
economy and industry are very developed while the plowland per capita is little.
According to the investigation, the main income is transforming from agricultural
income to non-agricultural income.
According to the investigation statistics, the 35 sample households total
contract 91.88 mu plowland with plowland per capita 0.95 mu. In 2007, the total
output of food was 35420 kg and the food owned per capita 365 kg. Among the
sample households, 11 households contract forestry and planting land,
accounting for 31.4%.
Residential condition and durable consumptive goods⑶
According to the statistics, the housing condition is quite good for the sample
households. All the houses are of brick and RC structure. The total housing area of
the 35 sample households is 5600 m2 and the housing area per capita is 57.73 m2.
With the development of the local society and econmy, the life level of those farmers
affected has been raised significantly. All of them take liquified natural gas as the fuel,
are supplied with electricity and equipped with cable TV.

⑷ Production and operation type
Through analysis, it is found that the production type of the sample
households is mainly of mixture production. For example, a family will have
members engaged in labor service, planting, processing or commerce. According
to the statistics, among all the 35 sample households, 72% with members still
engaged in agriculture, 28% with all members or certain members engaged in
processing or commerce; 62% with members engaged in labor service.
⑸ Household income
According to the investigation statistics, in 2007, the total annual income of
the sample households was RMB 13138 Yuan, in which the agricultural income
per capita RMB 1793 Yuan, accounting for 13.7%; the labor service income per
capita RMB 5855 Yuan, accounting for 44.6%; the income from the secondary
and tertiary industries RMB 5313 Yuan, accounting for 40.4%; the income from
other sources RMB 175 Yuan, accounting for 1.3%. So the income source has
been transformed from the trational agriculture to the secondary and tertiary
industries.
⑹ Household expense
The questionairy mainly inquired about the expenses in production, food,
clothing, fuel, electricity, household goods, service, health, traffic,
communication, education, recreation, and others.
According to the investigation statistics of the 29 sample households, it is
found that the total expense per capita around the year was 7723.9 Yuan, in
which for operation RMB 2201.2 Yuan, accounting for 28.5%; for consumption
RMB 5522.7 Yuan, accounting for 71.5%. Among the operation expense, for
agriculture RMB 756.9 Yuan per capita, accounting for 34.4%; among the

consumption expense, for food RMB 2485 Yuan per capita, accounting for 45%,
for health and education RMB 480 Yuan per capita, accounting for 9.2% and for
recreation RMB 317.5 Yuan, accounting for 6.1%.
⑺ Influence over income due to land requisition
According to the investigation statistics, it is learned that the land requisition
will influence 95 households. According to the analysis of the income structure of
the 35 sample households, the planting income is RMB 2651 Yuan, mainly from
plowland. The plowland affected accounts for 14% of the total plowland. Based
on the basic calculation, the land requisited will reduce the agricultural income by
RMB 191000 Yuan each household, accounting for 5.5% of the total income of
each household. So the influence from the land requisition is quite limited.
2.3.3 Status of women in areas affected
The areas affected are in Ningbo City, Zhejiang Province, of quite good social
and economic condition. With the fast development of society and economy in the
recent years, the status of the women in those areas affected has been raised
gradually. More and more women have jobs in the government departments and run
their own businesses. In the agricultural households in thos areas affected, the
women enjoy equal right as the men do. The husband and the wife usually will
consult each other for the family issues.
During the investigation, the investigation group interviewed the women in those
areas affected. It is learned that the women in those area support the state
construction and hold that the project will improve the local environment; however
they hold that the land requisition will influence the family much and hop that the
state can arrange the resettlement and compensation appropriately.
2.3.4 Analysis and conclusion of influence over production and life
The main conclusion is:
T⑴ he project construction will attract the foreign capital, improve the town
status and traffic condition, raise the life standard, advance the economic
development, and bring about quite good environment and social benefit.
⑵The project construction will generate income for the local residents,
increase the job opportunity, and drive forward the development of the secondary
and tertiary industries.

⑶The project has been supported by most people. The project will bring
about benefit and social development opportunity for most people as well as
improve their production condition and life standard in those area affected.
⑷The villagers serveyed concern the house relocation and compensation for
land requisition much and hope that the compensation procedure can be open to
the public.
⑸The villagers affected demand that the policy maker should pay much
attention to the environment protection and the pollution from the project
construction.

3 Physical indices affected
3.1 Determining the areas affected3.1.1 Permanent land requisition for the project
The land requisited permanently is for Chunhu Town Wastewater Treatment
Plant, Tap Water Booster Station, Express Passage, etc. The land requisition will
influence the land requisited and the areas which cannot be recovered due to the
project construction. The project confirms the land requisition scope on site
according to the report of feasibility research and the preliminary design report
finished by Zhejiang Highway and Waterway Engineering Consultation Company,
Beijing Jiangong Jinyuna Environment-protection Development Co., Ltd. and
Central-south Research Institute of China Municipal Engineering Coorporation in
January 2009.
3.1.2 Temporary project land
The temporary project land is for the pipe network for the wastewater
treatment plant and for the coastal water supply project.
3.2 Investigation method for influence of physical indices due to land
requisitionTo investigate the loss from the land requisition and provide reference for the
resettlement plan or the calculation of compensation, according to the practical
condition of this project, the investigation objects are determined as investigation
of land requisition, investigation of influence over population from land
requisition, investigation of hosue and attached facilities relocation, investigation
of individual industrial and commercial units, investigation of odd woods,
investigation of special facilties, etc.
From early February to middle March of 2009, total over 30 days, the project
owner carried out detail investigation with the local governments of various
levels, the administrative villages, the cadres of the villagers’group and the
design institutes over the population, houses and attached facilities, land and
special faciltieis affected based on the land requisition scope determined
temporarily. Here is the detail:
A Population investigation: according to the land requisitioin influence, the
households affected are classified into three categories: land requisition without

relocation, relocation without land requisition and land requisition with relocation;
then the investigation is carried out in each household as per the household type
(agricultural and non-agricultural), nationality, age, educational level,
employment, etc.
B Land investigation: based on the land investigation of the land
administration, with the relief map 1:2000 and the boundary post set up on site as
the reference, the land areas are counted as per the status in quo, ownership,
land type, etc.
C Investigation of house and attached facilities: the investigation is carried
out based on measuring on site based on the cateory and structure indices and
the attached facilitie are registered.
D Investigation of individual industrial and commercial unit: The individual
industrial and commercial unit is registered one by one and its business period,
annual business volume and profit are investigated.
E Investigation of enterprise or instution: the investigation is carried out as
per the investigation outline.
F Investigation of odd woods: the trees are counted and registered as per
the category within the areas affected.
G Investigation of special facilities: the investigation of electricity,
communication and other special facilities are verified on site based on the
documents available from the various administrative departments.
3.3 Influence over physical indicesThe project will influence 2 towns (subdistricts), 6 villages, 95 households for
287 persons, in which the land requisition will influence 14 households for 39
persons while will not influence 81 households for 248 persons. The project
needs to relocate various houses 3479 m2, occupy temorarily various lands
419.60 mu, in which permanent 265.06 mu, temporary 154.54 mu, relocate 1787
trees and 8.31 km electricity and communication cables. Please refer to Table
3.3-1 for the detail influence over the various physical indices:

The project needs to relocate 3479 m2 of various houses, in which 3329 m2 of
brick and RC houses and 88 m2of brick and wood houses. Meanwhile the relocation
covers the duck breeding shelter, fence and other attached failities. Please refere to

54.61 mu, garden land 46.84 mu, nursery 56.68 mu, forest field 5.14 mu, pool

The temporary land is for the network layout. It covers 154.54 mu, maily road
construction land, occupied for three months.

3.3.5 Odd trees and tombs
The odd trees affected are those need to be felled or explanted around the
houses, on the fields and land to be requisited. There are 1787 trees to be felled,
in which 600 peach trees, 465 orange trees, 234 plum trees and 488 other trees.
There are 9 tombs will be influenced due to the express passage project.
3.3.6 Special facilties
The express passage project will influence 10 kV power line 0.33 post km,
380 V 1.51 post km, one 100 kV transformer, communication optical cable 2.29
post km, communication cable 4.18 post km. The other projects do not influence
the special facilties.

3.3.7 Disadvantaged group
The project also investigates the nationality, age structure, educational level,
employment condition household after household. Based on the household

structure and the information of the local civil affairs departments and the poverty
alleviation offices, the disadvantaged groups are confirmed. At the present stage,
there is no disadvantaged group requiring special spport. If there is any found in
the future, the project will extend corresponding support and care. In addition,
Fenghua Municipal government will include those affected in the land requisition
into the pension insurance system as per the relevant policies.
3.4 Analysis of influence from land requisition3.4.1 Analysis of influence from permanent land requisition
The permanent land requisition influences 9 villagers’ groups in 4
administrative villages in 2 towns (subdistricts). To analyze the influence of land
requisition over the villagers, the project office organzied the relevant personnel
to carry out investigation of the land resource of those affected and detail
analysis of the influence degree as per the physical indices affected. Please refer
to Table 3.4-1 for detail.

Through the construction of traffic, water supply and wastewater treatment,
the project will improve the general construction level of Chunhu Town. According
the aforesaid analysis, among the 9 villagers’ groups affected by the project, 7
groups have influence percentage less than 10% so that the influence from the
land requisition is limited for those villagers’ group. The largest influence
percentage is 16.93% of No.2 Group of Qitou Village.
3.4.2 Analysis of influence of temporary land requisition
The installation of network needs to occupy 154.54 mu land temporarily, all
road construction land. According to the information provided by the project
owners and the on site investigation, the project period is about 30 – 60 days and
the project will be constructed along the road. There is a space over 3 m between
the network and the roads so that the business of the roadside shops will not be
affected much. Meanwhile to reduce the influence form the earth excavation and
piling over the environment and the residents, the project design have careful
consideration over the site and operational type of the temporary land requisition.
For example, the pipe network is laid down along the roads or roads in plan
rather than occupying the farm field. The project site will have fence to prevent
the dust. The project office will sign the contract with the contractor to clarify the
use type and recovery requirement of the temporary land requisition.

4 Outline of resettlement policiesThe preparation and implementation of the resettlement action plan will be
conducted as per the relevant laws and regulations of the People ’s Republic of
China and Zhejiang Province and the relevant requirements of the World Bank
policccy OP4.12. the resettlement compensation standard shall be clarified in the
action plan. If there is any change in the implementation, the project constructor
shall apply to the World Bank for approval.

4.2 Relevant laws and regulations4.2.1 Land Administrative Law of the People’s Republic of China
Article 47 In requisitioning land, compensation should be made according to
the original purposes of the land requisitioned.
Compensation fees for land requisitioned include land compensation fees,
resettlement fees and compensation for attachments to or green crops on the
land. The land compensation fees shall be 6-10 times the average output value of
the three years preceding the requisition of the cultivated land. The resettlement
fee shall be calculated according to the number of agricultural population to be
resettled. The number of agricultural population to be resettled shall be
calculated by dividing the amount of cultivated land requisitioned by the per
capital land occupied of the unit whose land is requisitioned. The resettlement

fees for each agricultural person to be resettled shall be 4-6 times the average
annual output value of the three years preceding the requisition of the cultivated
land. But the maximum resettlement fee per hectare of land requisitioned shall
not exceed 15 times of the average annual output value of the three years prior to
the requisition.
The standards for land compensation and resettlement fees for land
requisitioned shall be determined by various provinces, autonomous regions and
municipalities in reference to the land compensation fees and resettlement fees
for cultivated land requisitioned.
The standards for compensating for ground attachments and green crops on
the land requisitioned shall be determined by various provinces, autonomous
regions and municipalities.
Article 49 Rural collective economic organizations shall make public to its
members the receipts and expenditures of the land compensation fees for land
requisitioned and accept their supervision.
Article 57 In the case of temporary using State-owned land or land owned by
peasant collectives by construction projects or geological survey teams, approval
should be obtained from the land administrative departments of local people's
governments at and above the county level.
The term for the temporary use of land shall not usually exceed two years.
4.2.2 Measures on Implementing Land Administrative Law of the People’s Republic
of China of Zhejiang Province
Article 12 The compensation system shall be implemented for the plowland
requisition. The plowland reclaimation expense paid by the constructor shall be
regarded as the construction cost and listed into the total investment or production
cost of the project.
Article 23 The land compensation for the land requisition shall be paid as per the
following standard:
(1) 8-10 times of average annual output of three years before the plowland land
requisition;
(2) 4-7 times of average annual output of three years before the non-plowland land
requisition;
(3) 50% of the local plowland compensation for the virgin land requisition.
(4) As per the local plowland compensation for the construction land requisition.

Article 24 The resettlement allowance for the plowland requisition shall be
calculated as per the agricultural population to be resettled. The agricultural
population is the plowland quantity divided by plowland per capita before the land
requisition. The allowance shall be 4-6 times of the average annual output of the
previous three years; however this allowance shall not be more than 15 times of the
average annual output of the previous three years.
The resettlement allowance for the non-plowland requisition shall be processed as
per the previous clause.
Article 26 The compensation for the green crops on the land requisited shall be
calculated as per the crop of that very season; the compensation for the trees,
construction, farm field, water conservancy facility, etc. shall be calculated as per the
actual value; after the land requisition plan is announced, the trees and crops planted
or the facilities constructed shall have no compensation.
4.2.3 Administrative Measures of Forest Land of Zhejiang Province
Article 38 The unit or individual for forest land requisition or occupation shall
pay the recovery fee for forest vegetation and pay the compensation for the forest
land, trees and other facilities and the resettlement allowance to the unit or individual
with forest land requisited or occupied.
The unit or individual for forest land requisition or occupation temporarily shall
pay the recovery fee for forest vegetation and pay the compensation for the trees and
other facilities to the unit or individual with forest land requisited or occupied.
Article 39 The compensation for the forest land shall be 4-7 times of the
average output of the local plowland of the previous three years for the land
requisited or occupied. The average annual output shall be paid as per Article 27 of
Measures on Implementing Land Administrative Law of the People’s Republic of
China of Zhejiang Province.
Article 41 The resettlement allowance shall be paid as per Article 24 of
Measures on Implementing Land Administrative Law of the People’s Republic of
China of Zhejiang Province.
Article 43 The the recovery fee for forest vegetation shall be paid as per the
Provinsional Administrative Measures for Collection and Use of the Recovery Fee for
Forest Vegetation.

4.2.4 Provinsional Rules on Compensation Standard and Labor Arrangement for
Land Requisition of Ningbo City
Article 1 The compensation for the land requisited shall be paid as per the
original purpose of that land.
Article 2 The compensation for the outskirt plowland requisition shall be 8-10
times of the annual output of that land; the compensation for the other plowland
requisition shall be 6-8 times of the annual output of that land; the compensation for
the non-plowland requisition shall be no more than one half o that of the plowland.
Article 4 The resettlement allowance for the each agricultural person due to
outskirt plowland requisition shall be 5-6 times of the annual output of that land.
The resettlement allowance for the each agricultural person due to other
plowland requisition shall be 5-6 times of the annual output of that land.
The resettlement allowance for each hectare shall not more than 15 times of the
annual output before the land requisition.
The resettlement allowance for the non-plowland requisition shall not be more
than one half of that of the plowland.
Article 5 If the aforesaid land compensation and resettlement allowance paid
still cannot keep the original life standard of the farmer, after approved by the
Provincial People’s Government, the resettlement allowance can be increased;
however the total land compensation and resettlement allowance shall not be more
than 30 times of the annual output of the land requisited.
Article 7 The compensation for the green crops of the land requisited shall be
paid as per the output of the crops of that very season and no compensation shall be
paid if there is no green crop. After the requisition, if the land is not used while the
crops are planted meanwhile, the green crops shall not be compensated.
Article 8 For the land requisition, the government will usually not arrange
worker recruitment. The laborers shall be arranged diversifiedly. If they are arranged
by the collective rural economic organization, the resettlement allowance shall be
paid to such organization; if finding job by themselves, the resettlement allowance
shall be paid to the individuals by the collective rural economic organization for their
insurance; if the collective rural economic organization arranges the laborers into
other units, the resettlement allowance shall be paid to those unit.
4.2.5 Rules on Collective Land Requsition and House Relocation of Ningbo City
Article 3 The relocation of houses on the collective-owned land shall be in

conformity with the principle of legal administration, adequate compensation, and
careful resettlement, meet the general planning, urban planning, village and town
planning and be good for the integrated and economic use of land.
Article 26 The compensation resettlement for the relocation can be
implemented via property exchange or currency resettlement. The move resettlement
can be implemented for the unit relocated if conforming to the regulations of the
municipal, county or district governments. The unit relocated has the right to choose
the compensation resettlement.
Article 28 If the unit relocated chooses property exchange or currency
resettlement, the resettlement area shall be determined as per the regulations in
Article 23 hereof; however the construction area of each household shall not be
larger than 250 m2. For the villager eligible for the application for homestead but no
homestead gained yet or whose housing area is less than the construction area to be
applied for, the resettlement area shall be determined as per the construction area
per capita no less than 30 m2.
Article 33 The attached facilities of the house relocated shall not be regarded
as the reference for resettlement while the relocator shall pay corresponding
compensation.
The relocator shall pay for the decoration of the house relocated.
4.2.6 Measures on Compensation for Land Requisition of Fenghua City
Article 6 The compensation of the land requisited includes the land
compensation, resettlement allowance and the comprehensive for the green crops
and aboveground attached facilities. The land compensation shall belong to the
collective economic organization; the resettlement allowance shall be used for the
resettlement of the agricultural population only; the compensation for the green crops
and aboveground attached facilities shall belong to their owner.
The land within the scope of this city are classified into five categories. The detail
class scope and corresponding comprehensive standard are as follows: (Omitted)
Article 10 The compensation for the green crops shall be calculated as per the
output of crops of that very season. The compensation for the aboveground attached
facilities shall be calculated as per the actual cost. The detail compensation standard
shall be determined by the town people’s government and Subdistrict office as per
the actural condition of that area.
No compensation will be paid for the illegal construction, the trees planted and

the construction constructed after the land requisition scheme is announced.
Article 11 The minimum compensation standard for the garden land, other
agricultural land and construction land shall be implemented as per the
compensation standard for the plowland. The compensation for the forest land and
virgin land shall not be less than 50% of that of the plowland.
4.2.7 Implementation Measures on Collective Land Requsition and House
Relocation of Fenghua City
Article 29 The compensation and resettlement for the house can be
implemented via property exchange or currency resettlement. According to the urban
planning, the relocation resettlement can be implemented outside the urban planning
when there is any resettlement land. The unit relocated has the right to choose the
compensation and resettlement method.
4.3 Compensation standard4.3.1 Compensation standard for the land requisited or occupied
4.3.1.1 For the collective land
According the relevant regulation on the standard of class price of Fenghua City
in the Measures on Compensation for Land Requisition of Fenghua City, the project
is on Class IV land. So according to the relevant regulations on the comprehensive
class land price and the actual influence, the land compensation and resettlement
allowance for the plowland is determined as RMB 37000 Yuan / mu. The
compensation standard for the garden land, other agricultural land, construction shall
be implemented as per the standard of the plowland while the compensation
standard for the forest land and virgin land shall be 60% of the standard of the
plowland.
According to the relevant regulations of Fenghua City, the compensation for the

4.3.1.2 Compensation standard for temporary land requisition
The temporary land requisited is road construction land. According to the
comment of the project office and the road owners, the temporary land requisition is
free of charge while the constructor shall recover the road after the construction.
4.3.2 Compensation for house relocation and attached facilities
According to Implementation Measures on Collective Land Requsition and
House Relocation of Fenghua City, Regulations on Compensation and Resettlment
Price and Relevant Fee Standards for House Relocation of Fenghua City and the
practical condition of the area affected, it is determined that the compensation
standard for the brick and RC house is RMB 800 Yuan / m2, for the brick and wood
house RMB 580 Yuan / m2. The compensation for the attached faclities shall be paid
as per the relevant regulations of the local government and the relevant standard of
the local project under construction.

4.3.3 Compensation standard for infrastructure
A Field leveling
Since the villagers affected construct their houses scatteredly, the leveling of the

homestead can be carried out by the villagers themselves at a price RMB 3000 Yuan
for each household.
B Water and electricity supply
According to the preliminary plan of the resettlement, the villagers affected will be
resettled within the village. The resettlement can use the original water supply
system. Besides, the coastal water supply project has covered the relocation area.
So the villagers affected can take the advantage of the coastal water supply project.
The compensation for the water supply facilities is RMB 600 Yuan each household.
Right now, the agricultural power grid has been constructed. So the only issue is the
access to the main power line. The compensation for the power facilities is RMB 800
Yuan each household.
C Traffic
In the planning and design phase, the selection of resettlement site took into
consideration the principle of convenient traffic. The villagers affected are all resettled
along the road so that there will be no traffic compensation.
Allowance for move and temporary residence
The villagers affected will be resettled within the same village, according to the
Regulations on Compensation and Resettlment Price and Relevant Fee Standards
for House Relocation of Fenghua City and the practical condition of the area affected,
the allowance for temporary residence is RMB 5 Yuan /m2 each household for three
months, or the allowance for the temporary residence is RMB 15 Yuan/m2.
The allowance for move covers the property loss, traffic expense, medical expense,
allowance for loss of working period. According to the Regulations on Compensation
and Resettlment Price and Relevant Fee Standards for House Relocation of
Fenghua City and the practical condition of the area affected, the allowance for move
is RMB 600 Yuan each household.
The project will affect a small scale brick factory in Wujiabu Village. According to the
consultation comment between Chunhu Town and the owner, the compensation for
the move of the factory is RMB 20000 Yuan.
4.3.4 Compensation for odd fruit trees and tombs
The compensation standard for the odd fruit trees shall be determined as per the
tree category, age and size. According to the relevant regulations of Fenghua City,
the compensation for the peach tree is RMB 160 Yuan / tree; for the orange tree
RMB 150 Yuan / tree; for the odd trees RMB 10 Yuan / tree. According to the local

custom and the relevant regulations of Fenghua City, the compensation for the tomb
is RMB 3000 Yuan / tomb.
4.3.5 Compensation standard for special items
According to the condition of influence and the reconstruction price determined
by the various administrative department, the compensation standard for the
reconstruction of the special items is determined. Please refer to Table 4.3-3 for
detail.

5 Resettlement and Recovery PlanThe World Bank Project Office of Ningbo City, the various people’s
governments affected, and East China Investigation and Design Institute carried
out the resettlement planning for th project based on the resettlement plan
presented by the towns and villages affected according to the current policies,
laws and regulations and the requirement of the World Bank on resettlement.
5.1 Year of planning levelAccording to the project progress, the pre-phase work of the project should
be finished in the first half of 2009; the project should be launched in the second
half of 2009 and be finished and put into operation in 2012. The working period of
each sub-project is one year – two years and six months. The resettlement
should be started and finished in 2009. The base year is 2009. the reference year
of the resettlement planning is 2009.
5.2 Objective and task5.2.1 Objective
The general objective of the resettlement is the villagers affected have way-
out, the laborers have adequate arrangement, the production and life standard is
improved to a certain extent or at least cannot be lower than the current level.
According to the practical life standard in 2008 and the 11th five-year plan of
national economy and social development and the 2015 objective of Fenghua
City, the resettlement objective is determined as follows:
⑴Through adjustment of agricultural structure, find the land potential and
raise the land output;
⑵Take active measures to ensure that the annual net income per capita of
the household affected can recover the original level;
⑶The public infrastructure, school, hospital, social welfare, natural
environment and traffic can be improved after the resettlement.
5.2.2 Task
According to the investigation statistics, there are 95 households for 285
persons to be resettled in this project.
5.3 Policy and principle of resettlement plan5.3.1 Policy
The resettlement policy is: respect and take care of the local production, life and

custom and consider the willing of the villagers affected. While the original life and
production are not changed, based on the land resource and the natural resource
developable in the town or village, the resettlement ensures land resettlement and
encourages planting production. The resettlement shall guarantee the basic physical
survival condition as well as long-term development potential. The resettlement shall
be developing resettlement based on the local regional advantage to guarantee the
sustainable development.
5.3.2 Principle
(1) The resettlement plan shall be based on the physical indices of land
requisition and the relevant state laws and regulations and compensation
policies.
(2) The resettlement shall be integrated into the regional construction,
resource development, economic development, and environment protection. The
measures for recovering and developing the life and production of the villagers
affected shall be prepared. It is also necessary to create the conditions for the
villagers affected for self-development.
(3) The planning and layout shall consider the principle of “favoring for
production and production”.
(4) The construction scale and standard shall regard recovering the original
scale, standard or founction as the principle. Based on the regional development,
the investment for expanding scale, raising standard and future planning shall be
secured by the local governments and relevant departments.
(5) It is necessary to handle the relation among the state, the collective and
the individuals properly.
(6) It is necessary to take the full advantage of the local natural resource:
water conservancy, reclaim of virgin land, increment of plowland, improvement of
irrigation to guarantee that the villagers affected can keep their original life
standard.
5.4 General resettlement planThe project will influence some land but will not influence the original
production and life much. We convened symposia in the villages and towns
affected to discuss about the resettlement plan. According to the comments of
the villagers affected and the practical condition of the areas affected, the project

will adopt the method of resettlement within the same village through plowland
adjustment and cash compensation to guarantee the original production and life
style. In addition, Fenghua Municipal government will include those affected in
the land requisition into the pension insurance system as per the relevant
policies.
For the special facilities for communication and power, the layout of the
cables will be altered in certain areas. The reconstruction shall guarantee the
original standard, scale and function.
5.5 Analysis of capacity of resettlement environment
5.5.1 Natural condition and land resource
The project is in south Ningbo City, Zhejiang Province, one of the developed
region in Zhejiang Province. Fenghua is of typical hill land. Fenghua is in semi-
tropical monsoon weather with four different seasons and mild humidity. It enjoys
the natural condition for various crops. The abundant land resource, diversified
terrains, reliefs and soils will never limit the capacity of resettlement environment.
The plowland requisited only accounts for below 10% of that of each village
so that the land requisition is of little influence. After the land requisition, Wujiabu
Village, Chunhu Town, has the small plowland per capita, 0.61 mu. Due to town
construction, most of its plowland has been requisited and most of its villagers
have been engaged in business or labor service. Relatively speaking, they do not
depend on land much. Through investigation, those villagers affected have
limited depence over the land. For example, the agricultural income of Jindi
Village only accounts for 5.5% of its total agricultural economic income. Its main
income is from the industry. In addition, the project only occupies 3.65 mu
plowland of this village. The main income of Qitou Village is from sand dredge
and mariculture while its traditional planting income only accounts for 5.5% of its
total agricultural economic income. The land requisition is of little influence over
the economic income of this village. The agricultural income of Shanxiadi Village
accounts for 42% of its total agricultural economic income. The plowland per
capita of this village is 1.18 mu. The land requisition influences 0.92% of its
plowland. So the influence is also limited.

5.5.2 Character of villagers affected and humn-land relation
The project requisites limited land and the income of the villagers affected is
mainly from the secondary and tertiary industries. On the other hand, the
construction of the project will improved the local infrastructure and environment
quality significantly so that the town image can be polished to attract more
investments. The economic development can drive forward the optimization and
upgrading of the industrial structure. The promotion of the development of the
local economic belf can create better condition for the development of the
secondary and tertiary industries. So the resettlement plan will be based on the
land and focus on developing resettlement. The environment quality in the areas
affected will also be protected.
5.5.3 Condition of infrastructure of production and life
(1) Traffic
The construciton of the express passage can improve the local traffic
condition significantly and speed up the urbanization. After the project is
constructed, the residential environment and infrastructure of the villagers
affected can be improved. So the traffic will restrict the environment capacity.
(2) Water supply
The water supply of the villagers affected is quite convenient however the
water quality and capacity cannot be guaranteed. The construction of the project
will cover the local residents into the tap water supply system of Fenghua City
which will improve the water supply condition tremendously.
(3) Electricity supply
The project construction will not influence the local power transmission and
transformation.
(4) Medical, cultural and educational condition
The project will not influence the medical, cultural and educational facilities
directly. The original facilities can be operated continuously.
(5) Fuel supply
The villagers affected usually use liquefied gas. The project will have little
influence over the various towns (townships) and villages in this regard.

5.5.4 Economic development and potential
The agricultural economy is mainly in the secondary and tertiary industries.
The economic condition is quite good. There are sufficient laborers. The
development potention is huge. It is necessary to take the full advantage of local
economy and traffic to raise the production and life level of the local residents
and promote the all-round development in agriculture, forestry, animal husbandry,
subsidiary business, industry, commerce, and tourism. Based on the land
resource and developing production, the life standard of the villagers affected can
be raised and the environment capacity will be expanded with the development of
the economy in the areas affected.
5.6 Plan of resettlement and recovery of production and lifeIn the investigation and planning process, the resettlement planning group
convened symposia in the towns and villages affected to discuss about the
resettlement plan. The cadres from Fenghua City, towns (townships) and villages
and the villagers affected attended the symposia. All the resettlement plans have
been confirmed by the local governments and the villagers affected. Through the
analysis of environment capacity after the requisition, it is decided that the
villagers affected will be resettled within the same community to ensure that they
will keep their original production and life style and the original social relation will
not be changed.
Plan for life recovery: According to the comments of the villagers affected
and the practical condition of the areas affected, it is necessary to reduce the
influence from the land requisition over the local residents. The villagers affected
will be resettled within the same communities. The house construction will be
considered within the village and town plan.
Plan of production recovery: Through the analysis of the geographic location,
land resource, resident’s income, etc. after consulting the villagers affected and
the villager representatives, the resettlement group and the local governments
prepared the practical plan for production recovery, mainly through cash
compensation or other production recovery measures. Since the resettlement
plan is based on the comment of the most villagers affected, the project office will
help to resolve the issues of some individual villagers affected. For the villages
with cash resettlement, if some villagers affected want to be engaged in the

agricultural production, the project office wll arrange the collective land or the
land abandoned by certain villagers to them; on the other hand, if the villagers
affected want to have cash resettlement, if they have certain business ability,
they can win certain cash compensation. In addition, Fenghua Municipal
government will include those affected in the land requisition into the pension
insurance system as per the relevant policies.
5.6.1 Plan for production and life resettlement
Since the land requisition has little influence over the villagers affected,
through investigation and consultation with the relevant villages, according to the
actual land requisited and the quantity of house relocation and the comment of
the villagers affected and the local government, the reconstruction planning
adopts adjustment of plowland within the group or cash compensation. The land
compensation will be paid to the villagers’ group. The resettlement plan of each
village is as follows:
1) Chunhu Town
A. Jindi Village
Chunhu Town is on the north bank of Xiangshan Port of Zhejiang Province and
is the political, economic, cultural and trading center of east Fenghua. Jindi Village is
4 km south to Chunhu Town and adjacent to Chunhu Market. It covers land area 2
km2. The village governs 8 villagers’ groups. In the end of 2007, there had been 289
households for 835 persons, 624 mu plowland (0.78 mu per capita), and 5252
laborers, accounting for 62.9% of the population. Most of them are engaged in the
secondary and tertiary industries and are providing labor service in the village. The
net income per capita in the end of 2007 was RMB 8430 Yuan.
The land requisition influences 4 households for 11 persons. According to the on
site investigation and the will of the villagers affected, the villagers affected will be
resettled within the same village.
The land requisition if 3.65 mu plowland, influencing 4 villagers’ group: No.2, 4, 5
and 8. The plowland requisition influences 6 households for 16 persons. Please refer
to Table 5.6-1 for the information about plowland requisition.

allowance for resettlement and green crops will be paid to the individual villagers
directly. No uniform adjustment of plowland will be conducted. If the villagers
affected really need plowland, the village can adjust the plowland within the
group. In addition, Fenghua Municipal government will include those affected in
the land requisition into the pension insurance system as per the relevant
policies.
B. Qitou Village
Qitou Village is 4 km northwest to Chunhu Town and adjacent to Hongsheng
sea bank. In the end of 2007, there had been 116 households for 292 persons
and 252 plowland, in which 198 mu paddy field and 54 mu dry field with plowland
per capita 0.86 mu. There are 185 laborers, accounting for 63.4% of the total
population of the village. Most of them are engaged in mariculture and sand
dredge. According to the investigation, 85 persons are engaged in sand dredge
or labor service in the enterprise, accounting for 45.9% of the total laborer
number; 42 persons are engaged in maricultureor fishery, accounting for 22.7%
of the total laborer number. The net income per capita in the end of 2007 was
RMB 8130 Yuan.
The Chunhu Town Wastewater Treatment Plant and the supporting network
will requisit plowland 20.77 mu permanently, which will influence No.2 and No.3

villagers’ groups (12 households for 45 persons). Please refer to Table 5.6-2 for
detail on the plowland.

Xiangshan Port, the main economic income before the land requisition is from the
mariculture and sand dredge while the planting income only accounts for a small
portion of their economic income(how much?). Meanwhile as this village is close
to Chunhu Town, the villagers have more opportunities to be engaged in the
secondary and tertiary industries. After consulting the comment of the villagers
affected, as decided by the two committees of the villages, it is decided to adopt
cash compensation. The allowance for resettlement and green crops will be paid
to the individual villagers directly. No uniform adjustment of plowland will be
conducted. If the villagers affected really need plowland, the village can adjust
the plowland within the group. In addition, Fenghua Municipal government will
include those affected in the land requisition into the pension insurance system
as per the relevant policies.
C. Wujiabu Village
Wujiabu Village is in Chunhu Market Town and governs 28 villagers ’ groups.
In the end of 2007, there had been 1206 households for 3768 persons, 2300 mu
plowland with plowland per capita 0.61 mu, and 2200 laborers, accounting for
58.4% of the total population. The main economic income is from business and
enterprise while the traditional agriculture only accounts for a small portion of the
total economic income. The net income per capita in the end of 2007 was RMB
9424Yuan, ranking at the middle level in the twon.

The project will affect a small scale brick factory in Wujiabu Village.
According to the consultation comment between Chunhu Town and the owner
and the on site investigation, the factory will be moved within the village. (how
about the compensation of business interuption)
Chunhu Town Wastewater Treatment Plant and network will permanently
requisit 1.5 mu plowland of this village, which will influence No.17 villagers ’
group. There are 38 households for 180 persons in this group. The plowland area
is 102 mu eillgroup. lage, which will influence No.17 viqThe plowland requisited
permanently only accounts for 1.47% of the total plowland of this group. So the
land requisition is of small influence over the production and life of the villagers
affected.
The land requisition influences 3 households for 12 persons and the
plowland requisited does not account for over 20% of the plowland of each
household. So the influence is limited. After consulting the comment of the
villagers affected, as decided by the two committees of the villages, it is decided
to adopt cash compensation. The allowance will be paid to the individual villagers
directly. No uniform adjustment of plowland will be conducted. In addition,
Fenghua Municipal government will include those affected in the land requisition
into the pension insurance system as per the relevant policies.
(2) Xiwu Subdistrict
A Shanxiadi Village
Shanxidi is in southeast Xiwu Subdistrict and adjacent to the outskirt. In the
end of 2007, there had been 1025 households for 2641 persons, 3117 plowland,
in which 2680 mu paddy field and 437 mu dry field with plowland per capita 1.18
mu, and 1664 laborers, accounting for 63.0% of the total population. Most of
them are engaged in the traditional planting and the tertiary industry. According
to the investigation, 465 persons are engaged in the labor service in the
enterprises in the subdistrict, accounting for 27.9% of the total laborers; there are
418 person engaged in catering, transportation or other non-agricultural trades,
accounting for 25.1% of the total laborers; only less than one third of laborers are
engagved in planting. The net income per capita in the end of 2007 was RMB
8155 Yuan.

The project influences 9 households for 25 persons. According to the on site
investigation and the will of the villagers affected, the resettlement will be house
reconstruction within the village.
The Chunhu express passage and the coastal water supply will requisit
plowland 28.69 mu permanently, which will influence Shangheng and Zhongheng
villagers’ groups (21 households for 57 persons). Please refer to Table 5.6-3 for
detail on the plowland.

According to the investigation, it is learned that the plowland requisited
permanently only accounts for less than 2% of the total plowland of the village.
After the land requisitiion, the plowland per capita is 1.17 mu so that the influence
from the land requisition is small.
The villagers affected have plenty plowland. The land after the requisition
can still meet the demand of food. After consulting the comment of the villagers
affected, as decided by the two committees of the villages, it is decided to adopt
cash compensation. The allowance will be paid to the individual villagers directly.
No uniform adjustment of plowland will be conducted. For those affected
significantly, their plowland will be adjusted from the households which have
plenty plowland or are basically depending on the secondary or tertiary
industries.
5.6.2 Plan of recovery of temporary land requisited
The temporary land requisited is the land temporarily used by the project. In
this project, it is mainly for the network construction. The land requisited
temporarily is road land and will be recovreed as per the relevant requirement by
the contractor after the project is finished.

To reduce the influence over the environment and residents from the project,
the designer has considered the site selection, construction method and recovery
after the project.
5.6.3 Measures to guarantee the resettlement and recovery
To speed up the recovery and development of the villagers affected in
production and life, the following measures will also be taken:
⑴During the construction period, the villagers affected will be arranged for
the labor service preferentially. The local construction materials and life materials
will be used preferentially. After the project is finished, the villagers affected will
be arranged for employment preferentially under the same condition.
⑵The villagers affected will be arranged for labor service within the city
preferentially.
⑶The resettlement will be conducted within the same group. The adjustment
of field and new construction of field can guarantee the plowland and other land
of the villagers affected not less than the resettlement standard.
⑷The agricultural technical training will be enhanced. The relevant
personnel from the municipal agricultural technical station will be invited to the
resettlement region for lectures on planting and breeding technologies. The
quantity and quality of the agricultural produce of the villagers affected will be
raised to increase the income of the villagers affected.
5.6.4 Use of compensation and guaranty measures
A Administration and use of compensation
Except the compensation for the attached facilities and green crops and the
resettlement allowance for the employment paid to the individuals directly, the
varoius compensations and resettlement allowances shall be paid to the
collective for the production development, the employment of the extra laborers
and the life of those who cannot be engaged in work.
Normally, the land requisition compensation shall be kept by the villagers ’
committee or the village economic cooperative which reprsents the rural
collective economic organization. How to use the compensation shall be
determined by the villagers’ conference. At least half of the villagers not younger
than 18 years old or over two thirds households shall attend the conference and
the resolution shall be passed by over half the participants.

The resettlement compensation shall be used in the following ways: a. if the
rural collective economic organization needs to resettle the villagers affected, the
land requsitor shall pay the resettlement allowance to the rural collective
economic organization and the latter carries out the resettlement. b. if the
resettlement is carried out by other units, the resettlement allowance shall be
paid to other units by the land requisitor and those units shall conduct the uniform
disposal and arrangement. c. if the villagers affected does not demand uniform
resettlement, the resettlement compensation shall be paid to the villagers
affected directly or purchase the insurance for the villagers affected.
The compensation for the aboveground attached facilities and green crops
shall be paid to the owners directly. Normally the land requisition compensation
shall be paid to the rural collective economic organization and then it will pay the
compensation to the villagers affected as per the confirmed procedure.
⑴The compensation for the house and attached facilities shall be paid to the
household affected directly as per the relevant policies.
⑵The land compensation and the allowance for the laborer resettlement
shall be managed by the town, village or villagers’ group. In addition to
production recovery, as approved by the villagers’ group, the compensation will
be used in the following ways:
① The compensation will be invested into the infrastructure construction
such as basic construction for farm field, improvement of irrigation facility,
construction of village road, improvement of traffice condition.
② The compensation will be used for the public welfare of the village.
③ The compensation will be invested in the secondary and tertiary industrial
projects run by the village to increase the employment opportunities of the
laborers.
⑶If necessary, the compensation can be used for setting up risk fund to
provide basic life guarantee for the unemployed villagers affected for three years.
⑷The compensation can be loaned to the small enterprises or shops run by
the villagers affected as approved by the villagers’ conference.
B Guaranty measure for compensation
⑴If the compensation is to be invested in the secondary or tertiary industry,
the two committees of the village shall first carry out detail and careful
investigation and alaysis, then confirm the maturity of the market condition and

then report to the township (town) government for approval. It shall also be
approved by the villagers’ conference in the villagers’ group affected for the
implementation.
⑵To guarantee that the income standard of the villagers affected will not be
influenced after the resettlement, it is necessary to enhance the management of
the business of the newly established enterprises such as inspection and auditing
to resolve the practical issues of those enterprises such as technical instruction
or sales channel. It is necessary to prepare certain systems to guarantee the
development of the enterprises.
⑶If the surrounding investment environment is changed so that the
investment plan cannot guarantee the stable income of the villagers affected, the
land compensation and laborer allowance shall be deposited into the banks. The
interest shall be distributed to the villagers affected every year to guarantee their
life standard not less than before. Meanwhile the investment project shall be
assessed again based on the current market condition to determine whether the
investment shall be done or whether shall adjust the investment direction.
5.7 Plan of reconstruction of special faciltiesOnly the express passage will influence 10 kV 0.33 post km, 380 V 1.51 post
km, optical cable 2.29 post km and communication cable 4.18 post km. Right
now, Fenghua Power Company and Fenghua Telecom Company have presented
the reconstruction plans respectively. The power line and the communication line
will be moved out of the red line of the roads. The reconstruction length of 10 kV
power line is 0.17 post km, of 380 V power line 1.10 post km, of optical cable
1.16 post km and of communication cable 4.43 post km. The reconstruction will
be taken care of by the relevant departments.
5.8 Administration of resettlement implementation organizationThe implementation of the resettlement plan will be under the leadership of
the resettlement leadership group. Fenghua City will appoint certain personnel to
set up resettlement office to prepare the resettlement policy and take charge of
promotion, mobilization and organization of move and resettlement. Meanwhile,
the office is the channel to reporting about the resettlement issues. The office
shall collect and sort out the comments and issues in time and report to the

relevant competent departments as well as feed back the disposing comments to
the villagers affected.

6.2 Principle of compensationThe standard of compensation is determined as per the relevant laws and
regulations and the practical condition of the project.
⑴The land compensation and the resettlement allowance and the
compensation for green crops shall be determined as per Measures on
Implementing Land Administrative Law of the People’s Republic of China of
Zhejiang Province, the relevant documents released by Fenghua City and the
local standard;
⑵The compensation for the special facilties shall be calculated as per the
expense for recovering the original scale, standard and function.
6.3 CompensationThe rough calculation for the resettlement compensation covers the
resettlement compensation, compensation for special facilties, other expenses,
basic preparation expense and relevant taxes. The resettlement compensation
includes the land requisition compensation, house compensation, etc. According
to the resettlement policy and other relevant regulations, the aforesaid expenses
and fees are calculated as follows:
6.3.1 Resettlement compensation
The resettlement compensation is RMB 11.8391 million Yuan, in which land
requisition compensation RMB 8.6003 million Yuan, accounting for 72.64%;
compensation for house and attached facilities relocation RMB 2.8733 million
Yuan, accounting for 24.27%; other compensations RMB 0.1304 million Yuan,
accounting for 1.10%; compensation for fruit trees and tombs RMB 0.2351 million
Yuan, accounting for 1.99%.
6.3.1.1 Land requisition compensation
⑴Compensation for permanent land requisition
The compensation for permanent land requisition includes the land
compensation, resettlement allowance, and compensation for green crops or treets.
The project requisites land 265.03 mu permanently. The compensation for the

compensation standards for the various land requisitions in Chapter Five. Please

⑵ Compensation for temporary land requisition
The temporary land requisition is road construction land. The project can use
those lands free of charge but shall recover them after the project is finished.
6.3.1.2 Compensation for house and attached facilities
Only the express passage concerns the relocation of house and attached
facilities. The total relocation area is 3479 m2, in which brick and RC house 3329 m2
and brick and wood house 150 m2. According to the compensation standard
determined in Chapter Four, the compensation for the relocation of house and
attached facilities is RMB 2.8733 million Yuan. Please refer to Table 6.3-2 for detail.

The project needs to fell down 1787 trees, in which 1299 fruit trees and 488

⑵ Compensation for tomb relocation
9 tombs will be affected. According to the compensation standard in Chapter
Four, the compensation for tomb relocation is RMB 27000 Yuan.

The project needs to reconstruct 10 kV power line 0.17 km, 380 V power line

6.3.3 Other expenses
The other expenses include the administrative fee of constructor,
administrative fee of implementation, technical training fee, supervision fee,
monitoring and assessment fee, planning and design fee and document review
fee.
Administrative ⑴ fee of constructor
It is mainly for the various expenses of the constructor in the resettlement.
The expense percentage is 0.5% of 7.3.1~7.3.2 so that the total amount is RMB
63300 Yuan.
⑵ Administrative fee of implementation
The administrative fee of implementation is mainly for the various expenses
of the resettlement implementation institution in land requisition, relocation and
resettlement. The expense percentage is 3% of 7.3.1~7.3.2 so that the total
amount is RMB 379600 Yuan.
⑶ Technical training fee

The technical training fee is mainly for the expense for the production and
technical training of the villagers affected. The expense percentage is 0.5% of
7.3.1 so that the total amount is RMB 59200 Yuan.
Supervision ⑷ fee
The supervision fee is mainly for the expenses of the supervising unit in
control of progress, quality and capital of resettlement. The expense percentage
is 1.0% of 7.3.1~7.3.2 so that the total amount is RMB 126200 Yuan.
Monitoring ⑸ and assessment fee
The monitoring and assessment fee is mainly for the expenses of the
retained monitoring and assessment unit in monitoring and assessment in
resettlement. The expense percentage is 1.5% of 7.3.1~7.3.2 so that the total
amount is RMB 189800 Yuan.
⑹ Planning and design fee
The planning and design fee is mainly for the expenses of the pre-phase
design department, investigation institution and local government in relocation
design, investigation and preparation of resettlement plan. The expense
percentage is 2.5% of 7.3.1~7.3.2 so that the total amount is RMB 316300 Yuan.
⑺ Design document review fee
It is mainly for the expenses of the consultation unit or competent
administrative department in consultation or review of the resettlement plan. The
expense percentage is 0.3% of 7.3.1~7.3.2 so that the total amount is RMB
38000 Yuan.
⑻Administrative fee for land requisition
It is RMB 248000 Yuan, or 2.8% of the compensation for land requisition, for
the expenses of land requisition department in the land requisition.
⑼Supporting fee for disadvantaged group
The supporting fee for disadvantaged group is mainly for the expenses for
providing various assistance or life support for the disadvantaged group.
According to the on site investigation, there is no disadvantaged group right now.
However taking into consideration the natural disaster or other force majeure in
the resettlement, RMB 118400 Yuan, or 1% of 7.3.2, will be withheld temporarily.
6.3.4 Basic preparation fee
The basic preparation fee is 10% of 7.3.1~7.3.3 for the unexpected
accidents.

6.3.5 Relevant taxes and fees
⑴ Tax of plowland occupation
According to Provisional Rules of Tax of Plowland Occupying of the People ’s
Republic of China and Implementation Measures on Tax of Plowland Occupying
of Zhejiang Province, the plowland occupation tax shall be RMB 35 Yuan / m2 so
that the total amount is RMB 4.6134 million Yuan.
⑵ Plowland reclaiming fee
According to Measures on Implementing Land Administrative Law of the
People’s Republic of China of Zhejiang Province and the Notice on Administrative
Measures for Collection of Plowland Reclaiming Fee, the unit price is RMB 10
Yuan / m2 for the plowland and garden land so that the total amount is RMB
676400 Yuan.
⑶ Recovery fee for forest vegetation
According to the Provisional Measures for Administration of Collection and
Use of Recovery Fee for Forest Vegetation, the unit price is RMB 4000 Yuan /mu
and the total amount is RMB 20600 Yuan.
⑷ Fee for Using Newly Increased Construction Land
According to the Notice on Adjusting Policy on Fee for Using Newly
Increased Construction Land CZ [2006] No.48 released by the Ministry of
Finance, the Minitry of Land and Resource and the People ’s Bank of China, it is
necessary to pay the use fee for the agricultural land or virgin land transformed
as construction land. The fee grade and standard of the newly increased
construction land is Grade 12, or RMB 20 Yuan / m2. Through calculation, the
total amount is RMB 3.4124 million Yuan.
6.4Detail of compensation for land requisition and resettlementThe total investment for compensation for land requisition and resettlement
is RMB 24.3271 million Yuan (including taxes and fees RMB 8.7227 million
Yuan), which will be listed into the rough calculation of the whole project and
borne by the constructor. Please refer to Table 6.4-1 for detail.

6.5 Capital payment
6.5.1 Principle of payment
⑴All the expenses related to the land requisition and relocation is included
into the total project price. The compensation for land requisition and relocation
and other expenses will be paid to the releant units and individuals through the
project office.
⑵The compensation for the land and other facilities will be paid one month
before the land requisition.
⑶To guarantee the successful resettlement, the resettlement departments at
different levels shall set up financial and supervision organizations to guarantee
the payment.
6.5.2 Organizatio responsible for the finance of the villagers affected
. ⑴ The responsible organizations are the Project Office, Coordinating and
Leading Group of Fenghua Chunhu Small Town Subproject of Ningbo Socialism
New Village Construction Project, the various subproject owners, the land
administratioins, and the town and village committees.
⑵The resettlement capital is allocated from the upper institutions to the
lower institutions. Each organization will implement strict financial settlement and
auditing system, inspect and report the capital allocation and use regularily, and
present suggestion and remedy to guarantee the successful capital allocation and
use.
6.5.3 Capital flow
⑴According to the compensation policy and standard confirmed in the
resettlement plan, the project owners shall enter the general agreements on land
requisition and relocation with the corresponding county state land department
and the municipal state land department shall enter the agreement on
compensation for land requisition and relocation with the municipal resettlement
office.
⑵ The resettlement office of Fenghua City shall enter the agreement on
compensation for land requisition with the corresponding villagers’ committee.
⑶ The project owner shall transfer the compensation to Fenghua Municipal
State Land Bureau through banks as per the agreement on compensation for
land requisition and relocation. The Land Bureau then shall transfer the capital to

the resettlement office. The resettlement office then shall transfer the capital to
the villagers affected and the compensation for land to the villagers’ committee.

7.Resettlement Implementation Plan
7.1 Implementation ProceduresA. Land Acquisition and Compensation
Land Acquisition and Compensation shall be completed by through
cooperation of related organs with procedures as follows:
a. The project design unit shall provide detailed land-acquisition range
drawing ,Fenghua Municipal Project Office and each sub-project the owner shall
together with each-level government, land & resource departments and impacted
units (individuals) make joint investigation and verification to ascertain the range
and quantity of land-acquisition and removal
b.Each sub-project ownershall apply for land-acquisition to related land &
resource departments
c. Reply to land-acquisition application
d. Each sub-project the owner and land & resource departments discuss the
land-acquisition compensation, sign land-acquisition compensationagreement
and go through land-use formalities.
e. Municipal Land & Resource Bureau shall with related townships (towns)
and villages on site ascertain the land-acquisition range and quantity.
f. Municipal Land & Resource Bureau shall with related townships (towns)
and villages sign “Land-acquisition agreement”.

B. Production recovery
Production, resettlement and recovery shall be made by village committee
with the procedures as follows:
a. The village habitant groups with resettlement tasks shall orgnize to hold
village habitant representative meeting to discuss and work out the overall
scheme ofland-adjustment, distribution of compensation fee and production
recovery.
b. Announcing the overall scheme of production recovery to hear from
habitans of this village habitant group and re-settlers

C. Removal of house and resettlement of habitants
The procedures of removal of house and resettlement as follows:
⑴ The engineering design unit shall provide the range of impacted houses to be
removed
⑵ The resettlement office, design unit and related townships (towns) and
villages shall survey and assess the quantity and quality of houses.
⑶ The resettlement office and related townships (towns) and villages shall
discuss with removal resettling-households to decide the compensation
standards for houses and accessories and work out houses removal
compensation agreement.
⑷ The town resettlement office entrusts each village to announce the quantity,
compensation standards and removal time of houses of houses of removal-
households to hear from their opinions
⑸ Fenghua City or town resettlement office shall sign houses removal
compensation agreement with removal resettling-households.
⑹ The townships (towns) and villages shall cooperate with removal-
households to decide the resettling site and hear from their opinions.
⑺ Municipal and town resettlement office shall cooperate with re-settlers in
going through new residence ground land-acquisition formalities.
⑻ Municipal and town resettlement office shall sign houses removal-
construction agreement with removal resettling-households.
⑼ The re-settlers obtain compensation fee.
⑽ The re-settlers build houses.
⑾ The re-settlers remove to new residence.
⑿ Removal of old house

7.2 Schedule The schedule of land-acquisition, removal and resettlement shall be
dependent on the schedule of project construction and in the implementation
process the followings shall be obeyed:
⑴ The land-acquisition shall be completed before start of each bid section.
⑵ The removal shall be in 3 months’ advance informed of the re-settlers and
render them at least 4 months of building house from the notice day to the final
removal day and the impacted personnel may stay in the old house before
completion of new house
⑶ The house-building date shall be fully discussed with the re-settlers, and if
necessary, it may be properly extended.
⑷ The land-adjustment and distribution shall be made in the crop reason-
change gapas far as possible.
⑸ The labors shall be arranged before completion of land-acquisition.
⑹Recovery and re-construction Each special facility shall be completed
before commissioning of each work.
As per the overall schedule of this project,the schedule for land-acquisition
and removal is shown in Table 7.2-1.

8.1Setting of mechanism
8.1.1Mechanism
In order to ensure smooth progress of Fenghua Chunhu Small-urban
Development Sub-project, Ningbo Municipal People’s Government, Fenghua
Municipal People’s Government and Each sub-project the owner set up
necessary coordination mechanism for planning, coordination and monitor of
resettlement activities. The following mechanisms are repsonsible for land-
acquisition and removal resettlement of Fenghua Chunhu Small-urban

A. Ningbo Municipal Project Leading Group
In order to ensure smooth resettlement of Ningbo Socialist New Rural
Development Project and intensify organization and leading of this project,
Ningbo Municipal People’s Government sets up 了 Ningbo Socialist New Rural
Development Project Coordination Leading Group consisting of competent
leaders of Ningbo Municipal People’s Government, Municipal Development and
Reform Committee, Municipal Finance Bureau,Municipal Land & Resources
Bureau and Municipal Construction Bureau and it is mainly responsible for
organization, leading, overall planning, coordination and solving related problems
of World Bank loaned Ningbo Socialist New Rural Development Project. The
Leading Group has an office which is set up in Municipal Development and
Reform Committee and is responsible for comprehensive management,
organization, coordination, external liaison, monitor and check of the project.
B. Ningbo Municipal Project Leading Group Office

Small-urban Development Sub-project shall be made by the external independent

Ltd. and Project Office and the external independent monitor and assessment
mechanism shall provide technical aids to land-acquisition and removal office, as
per specification make survey of resettlement and survey of life level of the
impacted personnel and conduct all monitors and assessments. Its main
responsibilitiesare as follows:
a. As an independent monitor mechanism, monitoring the resettlement plan
and eachimplemented aspect, and providing resettlement monitor and
assessment progress to the owner and World Bank, which shall be described in
section of external independent monitor and assessment.
b. Providing the owner and related department technical consultation in data
survey and processing of inner monitor

In order to ensure smooth implementation of this project and resettlement,

9 Public participation and complaint
9.1 Public participation At working out resettlement policiesand preparation and implementation of
plan for this project, community participationg and consultation shall be stressed
to hear from social groups, government department,community and re-settlers.
Each party participate in resettlement and reconstruction. At project design of
preparation stage, project the owner and design unit seek suggestions and
opinions on project sitting, resettlement route and mode from local related
departments, mass groups, townships (towns) government and mass
representative. During preparation of resettlement, project office and each sub-
project the owner seek suggestions and opinions on resettlement and
compensationpolicies from each level local government and re-settlers
representativesand under cooperation of each level local governments complete
“Resettlement activity plan (RAP)”. At project implementation of stage, each level
resettlement mechanism shall further encourage people to participate in
resettlement and production recovery and reconstruction.
9.1.1Public participation at project preparation stage
⑴During social and economical survey, survey of land-acquisition and
removal physical indexes and selection of settlement scheme, Ningbo and
Fenghua Municipal Project Leading Group, development and reform
bureau,urban construction bureau and land & resources bureau make complete
consultation and the working out of scheme obtains cooperation and acceptance
of local government.
⑵ The local governments and project working groups successively organize
related cadres and habitants representatives of townships (towns), villages and
groups involved with land-acquisition and removal to hold informal discussion to
advertise the neccesity and resettlement policies of project construction.
9.1.2 Public participation during “Resettlement activity plan” preparation process
At preparation stage and process of “Resettlement activity plan”, local
government and re-settlers participate the following works:
⑴ At survey of project land-acquisition and removal-impacted physical
goods, each level local People’s Government, village committee and village
habitant group, re-settlers representatives participae the said survey.

⑵ Ningbo Municipal Project Office organizes Fenghua Resettlement Leading
Group, each sub-project the owner, and related functional departments to hold
policies propagating meeting, explains prevailing state, provincial and municipal
resettlment policies and policiesof World Bank and raises specific requirements.
Each Fenghua Leading Group organizes policies propagating meeting of each
level local cadres and impacted personnel, widely propagates policies of World
Bank and China on land-acquisition, removal and resettlementand hear from and
consultate with them on decrease of project-impact, arrangement of re-settlers
due to land-acquisition and removal and compensation standards of impacted
objects.
⑶ In Feb., 2009, during resettlement planning 5 meetings were held in
project-impacted Fenghua City and each townships (towns) and villages with
attendants 80 and topics includes planning of project land-acquisition, removal
and resettlement, propagating resettlement policies, seeking for opinions on
construction from local mass and re-settlers, and working out resettlement
primary scheme. The meeting objects include main leaders of Fenghua City and
townships (towns), responsible persons related department, village cadres and
re-settlers representatives.
⑷ In Feb., 2009, the project survey group organized large-sized survey of
social opinions and sought for opinions on project construction and resettlement
from resettling-households, and habitants of related vilalges and village habitant
group.
⑸ In Feb., 2009 during survey of project construction, land-acquisition and
removal survey members of Fenghua Municipal Project Leading Group Office,and
main cadres of villages and habitant group participated in the survey.
⑹In fuiture, related county project coordination office and project
coordination leading group shall through the following measures intensify
propagating of resettlement policies and encourage participtation of mass:

9.1.3 Public participation during “Resettlement Plan” implementation of
process
The re-settlers are encouraged to participat in entire implementation process
of “Resettlement Plan”:
A. Participating in houses reconstruction and settlement
a. Houses compensation standards
The houses compensation standard is directly rel;ated with removal-
households’ interests. Before houses removal, related restttlement mechanism
will consultate with removal-households on houses compensation standard and
sign agreement and the consultation results shall be announced before signing
agreement to accept mass monitor.
b. Houses reconstruction place and mode
During preparation and working-out stage of this “Resettlement activity plan”,
related departments make related survey of re-settlers houses reconstruction
place and mode. The houses shall be built as per village-town overall plan in
mode of combination of centralized settlement with rear-scattered settlement for
easy production. This project involves with not high removal volume and the re-
settlers select the self-removal and self-construction mode.
c. Disposal of old house
All removal-households will obtain houses compensation at re-construction price.
In the specified time the removal-households re-settlers may select removal
before construction or construction before removal and the materials removed
from the previous houses belong to removal-households.
B. Participating in production and settlement

All village habitant, especially re-settlers having special requirements on
land, shall participate in re-adjustment and distribution of land and start of other
agricultural development project.
C. Participating in utilization and management of land compensation fee
The land compensation fee belongs to village (group) collective and any unit
or individual shall not withhold or mispropriate it. The village (group) collective
shall integrally arrange the obtained compensation funds and use of the funds
shall be adopted by village (group) habitant meeting and accept supervision from
village habitant representatives.
D. Participating in project construction
The project construction will somewhat generate local impact. In order to
make project-impacted personnel obtain benefits, mass are encouraged to
participate in this project construction and provided with conveniences in building

9.2 Complain mechanism and channels Duringpreparation and implementation of “Resettlement Plan”, re-settlers’
participtation is always encouraged. But during actual work problems would
somewhat occur. In order to timely and effectively solve the problem, and ensure
smooth project construction and land-acquisition and removal, each level local
governments shall keep the existing letter-visiting complaint channels and also a
transparent and effective complaint channel is established as follows:
Stage 1:
If re-settlers are unsatisfied with the resettlement plan, they may raise oral or
written complaint to village committee and Coordination Leading Group Office
ofproject-located townships (towns). In case of oral complaint, the village shall
make treatment and written record. In case of rational requirements or
suggestions village committee or townships (towns) project Coordination Leading
Group Office shall solve it in 2 weeks from receiving the said complaint.
Stage 2:
If re-settlers are unsatisfied with the treatment in stage 1, they may after
receiving the decisionraise complaint to Fenghua Municipal Project Leading
Group Office. Fenghua Municipal Project Leading Group Office shall make
treatment decision in 2 weeks from receiving the said complaint.

Stage 3:
If re-settlers are still unsatisfied with decision of Fenghua Municipal Project
Leading Group Office, they may after receiving the decision raise complaint to
Ningbo Municipal Project Leading Group Office. Project Leading Group Office
shall make treatment decision in 2 weeks from receiving the said complaint.
Stage 4:
If re-settlers are unsatisfied with the decision of Ningbo Municipal Project
Leading Group Office, after receiving the decision of Project Leading Group
Office they may raise the case to civil court.
The re-settlers may raise lawful suit in any respect of the resettlement,
including compensation standard.
The above complaint routes shall notify re-settlers through meeting and other
modesto make them fully understand the complaint rights. The propagation shall
be intensified through medium and each party shall sort out opinions and
suggestions on resettlement, which shall be timely discussed and treated by
each level resettlement mechanism.
Any mechanism accepting re-settlers’ complaint shall not charge any
expense and the complaint-incurred expenses shall be paid from the unexpected
expense of Project Coordination Leading Group Office.

10 Monitor and assessment mechanismIn order to ensure smooth implementation of resettlement plan and realize
the resettlement targets, the entire implementation process of land-acquisition,
removal and resettlement shall be monitored in 2 portions (resettlement
mechanism’s inner monitor and external independent monitor).
10.1Inner monitor
10.1.1 Targets and tasks
The inner monitor will make each level resettlement mechanism during
implementation of process of “Resettlement activity plan” keep functional, protect
thelegal interests of the project-impacted personnel from infringe and ensure
smooth project construction. Each level audit body shall legally independently
execute audit and monitor right to the related unit in the jurisdictional area. In
order to make all restttlement mechanisms conduct the resettlement under the
principle and as per the schedule specified in “Resettlement activity plan”, each
responsible unit shall monitor the work of its subsidiary mechanism.
10.1.2 Mechanism and personnel
The project resettlement office shall preside over inner monitor of the land-
acquisition and removal resettlement, which shall be executed by Fenghua
Municipal Project Office and each village. In order effectively execute inner
monitor function, each level restttlement mechanism is specially allocated with
personnel and they participate in preparation and implementation of
“Resettlement activity plan” and conduct inner monitor and control as per
“Resettlement activity plan”. The mechanism and personnel responsible forinner
monitor and data processing are shown in Table 10.1-1.

10.1.4 Implementation procedures
⑴ Municipal Resettlement Office conducts inner monitor mechanism to
check resettlement activities. Project Resettlement Office setsbasic data base of
land-acquisition, removal and resettlement and monitors the entire process of
resettlement preparation and implementation.
⑵ During implementation period, each level resettlement mechanism shall
establish corresponding resettlement information base, as per actual
implementation particulars make dynamic upgrade, and progress the current
activities record and implementation progress to higher-level resettlement
mechanism to keep continuous monitoring of resettlement implementation.
⑶ For the above monitor mechanism, the information form of specified
format shall be made to realize continuous information flow from village level to
project land-acquisition and removal office. Ningbo Municipal Project Office,
Fenghua Municipal Project Office, townships (towns) resettlement office, as
important composition of the inner monitor system, shall make regular check and
verification.

10.2 External independent monitor and assessment
10.2.1 Targets and tasks
The external monitor and assessment is mainly external regular monitor and
assessment of the land-acquisition, removal and resettlement activities of
restttlement mechanism to assess realization of the resettlemen ttargets. The
external monitor and assessment will raise opinions and suggestions on the
entire process of resettlement and the recovered production and life level of the
re-settlers, provide pre-warning for engineering management departmen and
supply re-settlers channel for reflecting their opinions.
The external monitor mechanism will become advisor of project construction
leading group and project land-acquisition and removal office, trace, monitor and
assess the implementation activities of resettlement plan and raise consultation
opinions on decision-making.
10.2.2 Mechanism and personnel
Currently, project office has not decided external monitor and assessment
mechanism. The external monitor and assessment mechanism shall provide
technical aids to project office, study life level of impacted people through
resettlement survey, conduct all basic monitor works, and cooperate with project
office in preparation of annual and semi-annual report.
10.2.3 Main indexes of monitor and assessment

10.2.4 Monitor and assessment method
The monitor and assessment activities are on basis of the survey data
provided by settlement implementation mechanism. The assessment shall adopt
method combined with sampling survey and fast assessment on basis of overall
survey and learning, select representative typical samples (resettling
households/village/town), for different impacted objects establish corresponding
assessment index system, invite senior resettlement experts to determine weigh
of each index with “Back-back” method, on basis of latest domestic and abroad
research achivements on life quality makke dimensionless processing of indexes,
analyze and calculate survey achievements, and compare and assess the
calculation achievements.
The external monitor and assessment unit shall make the following works:
(I) Survey of re-settlers life level
In this project, the background shall be overall surveyed and background
data on production and life level of seleced samples (samples randomly taken)
shall be collected. The production and life level shall be surveyed 1-2 times every
year to measure the change of the production and life level of samples. It shall
use methods such as regular survey, free interview and site observation to obtain
necessary related and on this basis make statistics analysis and assessment.
The life level survey form consists of indexes metering the production and
life level and in a same index the dynamic change before and after land-
acquisition, removal and resettlement reflects trhe change of production and life
level. The background survey will verify if the design of indexes surely reflects
change of re-settlers’ production and life level, which may be modified as per
actual conditions to make the obtained information overall and truly reflects
quantity and quality of re-settlers’ production and life level.
Scale of re-settler samples: Rre-settler of land-acquisition and removal: 5%,
land-acquisition impacted village: 20%

(II) Public consultation
The external monitor mechanism shall attend the public consultation meeting
organized by villages and townships (towns) and through this it will assess re-
settlers’ participatation effect and their cooperation in participating in resettlement
plan. During and after resettlement implementation, these activities will continue.
(III) Re-settlers’ opinions
The external monitor mechanism shall frequently visit township (town) ,
village and group resettlement mechanism to know re-settlers’opinions or meet
the complaining re-settlers in a formal or informal way, timely reflect opinions and
requirements of impacted people and collective organization, and propose
improvement measures to much effective implementation of resettlement.
(IV) Other liabilities
During implementation period the external monitor mechanism shall monitor

11. Report-preparation plan
11.1 Resettlement plan progress Ningbo Municipal Project Office and Fenghua Municipal Project Office
submitted the resettlement activity plan (RAP) of this project to World Bank April
2009, which was modified as per World Bank’s opinions and requirements and
finally submitted to World Bank for assessment.
11.2Resettlement progress report A. Cycle
From start of resettlement implementation,each level resettlement
mechanism shall every 3 months submit to higher-level resettlement mechanism
of the jurisdictional area the work progress report, the project land-acquisition
and removal office shall depending on the progress conditions provided by each
level resettlement mechanism submit to World Bank “Fenghua Chunhu Small-
urban Development Sub-project resettlement progress report”. In the first 3 years
from starting the project, the report shall be submitted twice every year (at end of
each semi-year) and from the 4 th year submitted once every year (at end of each
year).
B. Format and contents
The report is divided into 2 parts. The first part is lectural part and it
summaries thecompensation for land-acquisition and removal, and shows the
particulars, problems and difficulties in implementation process and corrective
measures. The second part is tables, and it includes statistics data and
statements per 6 months, compares the completed and planned compensation
fee for regional project-impacted land-acquisition and removal, with the format
shown in Table 11.2-1 and Table 11.2-2.

1. I. Basic conditions of project
1. Project contents
Fenghua Water Plant has design daily water supply capacity 100000t and is built
in 2 phases. The first phase project was built in 1995 and the second phase project
was built in 2005. Currently, the actual water supply capacity is 100000t/d.
2. Owner
The owner is Fenghua Water Co., Ltd.
3. Time
The first phase project and the second phase project was completed in1994 and
2004respectively.
4. Relationship
In order to coordinate with urban construction, Fenghua City from 1993 built
Fenghua Qiujiashan Water Plant , which was put into operation in 1995and has water
supply capacity 50000t/d. It also builds independent running water supply pipe
network system, which basically meets the demands on running water by Fenghua
urban area. After expansion of the second phase project, Qiujiashan Water Plant
reaches 100000t/d water supply capacity. According to statistics of Fenghua Water
Co., Ltd., in 2006 the maximum daily water consumption in Fenghua urban area
65000t/d and Qiujiashan Water Plant has surplus water supply capacity 35000t/d.
Though Chunhu Town is built with water plant, the water supply capacity is low, the
purifying process is backwards and equipment exceeds the service life, water supply
capacity and water quality fail to conform to new-published health standards for
drinking water. Chunhu Town shall build water supply pipe network connected with
Qiujiashan Water Plant so as to make the surplus capacity of Qiujiashan Water Plant
to meet demands of Chunhu Town. Completion of this project will play an important
role in improving environment of Chunhu Town.
II. Compensation standards for project land-acquisition and impact of removal
Project land-acquisition procedures:

III. Resettlement effects
Fenghua City Qiujiashan Water Plant is sited at Qiujiashan, Jingping Sub-district
(Fenghua suburbs) and project land-acquisition involves with 3 villages (Fengnan,
Zhengming and Hedongguan). The compensation for land-acquisition and ground
accessories was completed in 1994. For the plant area totally 80mu land was
acquisitioned and it is forestry land and all funds were completely and directly paid to
the resettling households and most of them are satisfied with the land-acquisition
compensation. The land acquisitioned for the project construction is forestry land.
The back-visiting of re-settlers by Fenghua City Construction Bureau, Water
Company and Land & Resources Bureau show that project construction basically has
no impact on family production and life.

Resettlement information manual I. Targets
1. This manual will provide the personnel impacted by project land-acquisition
and removal the related information on resettlement plan, mainly the compensation
principle and standards, settlement requirements, and payment mode of
compensation fee, and describe policies and procedures on land-acquisition,
resettlement, compensation payment and complaint. This manual is issued in public
and it is a part of resettlement policies and implementation procedures. The project
implementation mechanism --World Bank Fenghua New Rural Construction
Demonstration Project Leading Group Project Office will before land-acquisition and
removal issue this manual to each township (town) and village committee.
II. Briefing of the project and its impacted range
2 Ningbo Socialist New Rural Construction Project Fenghua Chunhu Small-

small-urban sub-project includes 3 sub-projects: ⑴Fenghua City, Chunhu Town
Express Way Works, ⑵ Fenghua Coastal Water Supply works, ⑶Fenghua, Chunhu
Town Sewage Treatment Plant and Necessary Pipe Network. The fore-phase
preparations of project are scheduled to complete in first half of 2009 and project is
scheduled to start from 2009 and complete and put into operation in 2011 with total
construction period 3years. As per schedule of each sub-project, the resettlement
plan for project-impacted area will be implemented from 2009 and the resettlement
and land-acquisition shall be completed in 2009.
3 Fenghua Chunhu Small-urban Development Sub-project land-acquisition
involves with Fenghua City Chunhu Town and Xiwu Sub-district with total 2 townships
(towns) and 6 villages. It totally covers land 419.60mu, including acquisitioning farm
land 54.61mu, garden land 46.84mu, breeding garden 56.88mu, forestry land
5.14mu, fish pond 34.44mu, construction land 9.14mu, unutilized land 58.21mu, and
temporary used-land154.54mu. The project land-acquisition totally impacts 95
households and 287persons and it will cut off 1787 odd fruit trees. It also impacts
some special facilities such as telecom.
III. Compensation policies and compensation standards

4. In the settlement compensation policies for land-acquisition impacted
personnel in project the Chinese laws and regulation as well as policies and
requirements of World Bank are considered. The resettlement plan mainly aims after
land-acquisition to recover income and life level of the personnel impacted by land-
acquisition and removal and to protect them from interruption of current social and
economical environment as far as possible. It will focus on requirements of poor
group and weak group of the re-settlers and this is a main guidance principle for
working out this plan. The related compensation standards are shown in Table 1-
Table 3.

development sub-project resettlement plan shall be implemented by World Bank,
Fenghua New Rural Construction Demonstration Project Leading Group Project
Office, project involved each level People’s Government and HHEC in accordance
prevailing Chinese laws and regulation as well as policies and requirements of World
Bank on basis of resettlement scheme raised by the project-impacted villages.
6 The land compensation belongs to rural collective and is directly paid to village
(group) for developing production and restoring economical level of impacted
personnel. Each village (group) shall as per actual conditions and re-settlers’
intentions locally adjust land within a given range. In case of no sufficient land for
adjustment, the land-acquisitioned individual or farmer households will be
compensated with cash. During the settlement process, any re-settler who has base
and capacity of trading and will get compensation in form of cash shall be
compensated with cash for his due settlement allowances. The distribution ratio of
compensation fee shall be decided by village habitant meeting and the balances shall
belong to village collective for reforming of infrastructure such as road and farm land
water conservancy.
7. The compensation for crops loss will be directly paid to individuals and Table
4details the compensation qualification and related problems.
V. Participating in consultation
8 At project preparation stage, World Bank Fenghua New Rural Construction
Demonstration Project Leading Group Project Office and local each-level
governments make wide consultation with the land-acquisition impacted personnel
through questionnaire and informal discussion. At project investigation and design
and survey stage of physical indexes, the land-acquisition impacted personnel shall
participate in the followings: (1) sitting for further reducing project impact, (2)
classification and survey of land, (3) survey of quantities of trees and grave, and (4)
survey and confirmation of water- and power-supply, telecom and other
infrastructures.
9. At project implementation stage, the land-acquisition impacted personnel shall
participate in the followings: (1) determining compensation range and compensation

standard, (2) signing compensation agreement, (3) adjusting land, (4) use of each
village’s land compensation fee, (5) deciding treatment of complaint, (6) monitoring
settlement, complaint mechanism and channels
VI. Complaint
10. Duringpreparation and implementation of “Resettlement Plan”, re-
settlers’ participtation is always encouraged. But during actual work problems
would somewhat occur. In order to timely and effectively solve the problem, and
ensure smooth project construction and land-acquisition and removal, each level
local governments shall keep the existing letter-visiting complaint channels and
also a transparent and effective complaint channel is established as follows:
11. Stage 1: If re-settlers are unsatisfied with the resettlement plan, they may
raise oral or written complaint to village committee and Coordination Leading
Group Office ofproject-located townships (towns). In case of oral complaint, the
village shall make treatment and written record. In case of rational requirements
or suggestions village committee or townships (towns) resettlement working
group shall solve it in 2 weeks from receiving the said complaint.
12. Stage 2: If re-settlers are unsatisfied with the treatment in stage 1, they
may after receiving the decisionraise complaint to Fenghua Municipal Project
Leading Group Office. Fenghua Municipal Project Leading Group Office shall
make treatment decision in 2 weeks from receiving the said complaint.
13. Stage 3: If re-settlers are still unsatisfied with decision of Fenghua
Municipal Project Leading Group Office, they may after receiving the decision
raise complaint to Ningbo Municipal Project Leading Group Office. Project
Leading Group Office shall make treatment decision in 2 weeks from receiving
the said complaint.
14. Stage 4: If re-settlers are unsatisfied with the decision of Ningbo
Municipal Project Leading Group Office, after receiving the decision of Project
Leading Group Office they may raise the case to civil court.
15. The re-settlers may raise lawful suit in any respect of the resettlement,
including compensation standard. Any mechanism accepting re-settlers’
complaint shall not charge any expense and the complaint-incurred expenses
shall be paid from the unexpected expense of Project Coordination Leading
Group Office.

1. For the project construction acquisitioned land, the land-acquisitioned village (group) shall obtain land compensation fee and settlement allowances paid by land-acquisitioning unit and the land-acquisitioned farmer households will obtain crop loss compensation and ground accessories compensation fee. If village (group) conducts land-adjustment or land development and utilization to make land-acquisition households re-obtain land or other production means, the land compensation fee and settlement allowances shall be managed and used by village (group) collective. 2. The compensation fee and settlement allowances of project construction-acquisitioned land are mainly used for recovery of re-settlers’ production and life, such as farm land water conservancy facilities, reform of rural infrastructure and adjustment of agricultural structure.

As per comprehensive price of Fenghua acquisitioned land sub-area and actual conditions of project-impacted area, project land-acquisition compensation standards are decided as follows: farm land 38200RMB/mu, garden land and breeding garden 41000RMB/mu, forestry land 23700RMB/mu, fish pond 40000RMB/mu, construction land 37000RMB/mu, and unutilized land 22200RMB/mu.
4. In accordance with “Method of Fenghua acquisition of collective-owned land and removal of houses” and project actual conditions, the compensation price for project-removal houses or brick-concrete house 800RMB/m2and brick-wood house 580RMB/m2.

Appendix VII: Outline of resettlement independent monitor and
assessment 1. Targets of resettlement monitor and assessment
The resettlement of Ningbo Socialist New Rural Construction Project Fenghua
Chunhu Development Sub-project shall be subjected to independent monitor and
assessment as per requirements of World Bank and it will trace and assess the
resettlement work of this project through checking recovery of re-settlers’ life and
income, resettlement progress, funds and management. It will regularly provide
report, information and suggestions to World Bank, Ningbo Municipal Project Office
and related competent department for reference at each department’s decision-
making. The independent monitor and assessment will make World Bank and project
competent units fully know if the project land-acquisition and resettlement timely
reaches the predicted targets at specified quality, and it also points out problems and
raises suggestions on improvement.
2. Contents of resettlement monitor and assessment
(1) Monitor and assessment of construction land-acquisition and temporary
occupied-land
Including: ① Progress of examination, approval and delivery for use of
construction land, ② particulars of temporary occupied-land, ③ land compensation
standard and implementation particulars.
(2) Recovery of re-settlers’ life and income
including: ① Payment of compensation funds, ② Land change, ③ production
arrangement mode, ④ Change of economical income, ⑤ Employment, ⑥ Training, ⑦
Satisfaction degree of re-settlers.
(3) Monitor and assessment of placement and use of funds
Including: ① Allocation of funds, ② Use of funds (planned amount and actual
amount)
(4) Settlement of weak groups
Including: ① Settlement of weak groups, ② Problems occurring during
settlement process and special supporting measures

3. Technical route

For this project Ningbo Municipal Project Office shall engage domestic body
experienced in resettlement monitor and assessment of similar projects to conduct
independent resettlement monitor and assessment.
5 Organization and segregated duties of monitor and assessment of
resettlement
⑴ External independent monitor and assessment mechanism shall be
responsible for specific survey, data collection, calculation and analysis work for the
monitor and assessment and audit the achievements.
⑵ External independent monitor and assessment mechanism shall form “Ningbo
Socialist New Rural Construction Project Fenghua Chunhu Small-urban

Development Sub-project Resettlement Monitor And Assessment Group”. It will under
guidance of World Bank project officials monitor and assess the project resettlement,
prepare outline of monitor and assessment work, set up monitor points, make site
survey and monitor and indoor analysis work and work out resettlement monitor and
assessment report.
⑶During site monitor and survey period of resettlement monitor and assessment
group, Ningbo Municipal Project Office and local governments shall coordinate with
them in personnel and traffics.
6. Resettlement monitor and assessment mode
⑴ The monitor and assessment shall adopt method of site survey, qualitative
and quantitative analysis and experts’ comprehensive assessment.
⑵ The survey shall be made in point-face combined mode, resettlement
implementation progress, funds, mechanism and management shall be overall
surveyed and the resettling households shall be subjected to sampling survey.
⑶ Random sampling in classification shall be used in sampling survey and the
typical sample resettling households shall be subjected to fixed trace survey at
sampling ratio 20% for households impacted by permanent land-acquisition.
⑷ The overall survey shall be made in form of table survey, informal discussion
and reference to documents, files and data.
⑸ In addition to written data, the photo, audio and video records and kinds shall
also be collected.
