I, Keir Holeman, being first duly cautioned and sworn, do hereby swear as follows:

1. I am the duly appointed Director of the Warren County, Ohio Board of Elections

(hereinafter referred to as Respondents), and I have personal knowledge of the facts

contained herein and access to all records of Respondents.

2. Respondents held regularly scheduled meetings on June 7, 2011, and July 5, 2011, and no

meetings were held between those two dates.

3. Ordinary mail addressed to each individual board member, including a letter purportedly

from Relators dated June 9, 2011, was presented to, opened, and reviewed by each

member on July 5, 2011.

4. In response to an inquiry from Relators, I drafted and sent to Relators a letter dated July

19, 2011, explaining to Relators that no action was taken regarding their June 9, 2011,

letter and why.

5. I have reviewed records of Respondents and as of July 5, 2011, there had been no

candidate petitions filed with Respondents by or on behalf of Mike Gilb for any office.

6. At the meeting held July 5, 2011, Respondents took no action in regard to the letter

purportedly from Relators dated June 9, 2011, because there were no petitions filed by

Mike Gilb. Minutes of the meeting held July 5, 2011, are attached hereto as Exhibit 1.

7. According to records of Respondents, which I have personally reviewed, on August 23,

2011, Mike Gilb filed petitions for candidate for member of the Mason City Council.

8. According to the 2011 Ohio election calendar received from the Ohio Secretary of State,

and specifically referenced therein, R.C. Section 3513.263, protests against candidates in

non-partisan races, such as the Mason City Council, must have been filed by August 26,

2011. A copy of the election calendar with referenced code sections is attached hereto as

Exhibit 2.

9. As of the date of execution of this affidavit, no protest has been filed against the

candidacy of Mike Gilb, no hearing has been held by Respondents, and Respondents

have not taken any quasi-judicial action regarding the candidate petitions filed by Mike

Gilb.
