Other Directions and Conditions for the Winders:

01- The tender shall be valid for one year and can be extended for further six

months without consent of tenderer.

02- The quantity of burnt motors shall be informed telephonically or through

messenger and should be lifted for winding within 24 hours. Winded motors

shall be returned within 7 days of information to the winder.

03- The extra items needed for winding like connection plates, bearings, bushes etc.

shall be provided by the plant.

04- Testing & Verification of rewinded motor is essential at CFP test panel in

presence of appropriate authority for payment. Only motors showing lower than

desired level shall be accepted as winded.

05- Motors showing/taking higher than desire level current will have to be rewinded.

06- The payment of winding shall be released within 15 days of receipt of valid bill. If

the winder wants, can check the motor in the presence of plant representative.

07- In case of insured motors the winder will have to co-operate in inspection of

goods at his workshop by the surveyor.

08- The copper scrap shall be retained by winder.

09- Transport facility for lifting of burnt motors and winded motors shall be provided

by the tenderer.

10- Failure to lift and supply back rewinded motors shall result in cancellation of

tender with forfeiture of EMD.

11- GST whatever is applicable and charged by tenderer shall be included in rates

but if GST or any tax is increased during tender period rates will be revised

accordingly.

General Term / Conditions of Contract

(A) These conditions should be read very carefully by the tenderer while filling in their

quotations.

01- The approved suppliers shall be deemed to have carefully examined to the conditions,

specifications, size and drawing etc. of the goods to be supplied. If the tenders have any

doubt as to the meaning or of any portion of these conditions of the specifications /

drawing etc. He shall before assigning the contract refer it to the Manager and get

clarification in time before tender date.

02- The contractor shall not assign or sublet his contract or any substantial part thereof to any

other agency.

03- All the stores supplied shall be of the best quality to the specification laid down by them

and instruct accordance with the approved standard or approved suppliers. The supplies

shall be of the very best quality.

04- In case goods other then the approved quality or size supplied the same shall be

rejected and will have to be replaced within a reasonable time the supplier without

extra cost.

05- The rejected articles must be removed by the tenderer from destination within 30 days

from dispatch of letter or rejection. The officers concerned will take reasonable care of

such materials but in no case shall be responsible for any losses, shortage or damage that

may occur to it while it is on plant premises.

06- The tenderer shall be responsible for the proper packing do as to damage under normal

conditions of transport by Road and delivery of the material in good condition to the

consignee at destination. In the event or any loss, damage, breakage or leakage or any

shortage the tenderer shall be liable to make goods such loss and shortage found at the

time of checking/inspection of material by the materials by the consignee. No extra cost

on such account shall be admissible.

07- All rates quoted must be FOR destination and should include all taxes. In cash of local

supplier also the rates should include all taxes and no cartage or charges for

transportation will be given by Plant / Federation and the delivery of the goods shall be

given at the premises of CFP, Jodhpur.

08- The tenderer whose tender is accepted shall arrange supplies within a period of minimum

07-10 days from the date of placing the order. Quantities shown in the tenders are

approximate. The supplies will have to be arranged as per requirement of Plant.

09- The contract of supply can be repudiated at any time if the supplies are not made to the

satisfaction of the Plant/Federation.

10- The tenderer should sign the tender at each page and at the end in token of them

acceptance of all the term/conditions of the tender and the agreement.

11- Tender must be accompanied by earnest money required without which tenders will not

be considered. The amount should deposit in Bank by DD/ NEFT in favors of Cattle Feed

Plant , Jodhpur. The earnest money will be refunded to unsuccessful tenderer within one

month of the final acceptance of the tender where as in case of successful tenderer it will

be treated as a part of security.

12- Successful tenderer will have to execute an agreement on prescribed form and deposit

security amount equal to earnest money of goods for the due performance of the contract.

The security money will be return after one months from the date of complete of the

agreed contract. The expenses of completion and stamping the agreement shall be paid by

the supplier and the purchasing officer shall be furnished free of charge with the executed

stamped counter-part on the agreement.

13- Remittance charges/Bank charges on payment made to the firm will be borne by the

Contractors.

14- If the approved suppliers fail either to supply goods of the prescribed specifications or to

deliver the goods within the specified period the purchasing officer shall be liberty to

arrange supply either through re-tender or otherwise if necessary at risk and cost of

tenderer.

15- No advance payment will be made, payment shall be due and payable by the Federation

only when the whole quantity has been delivered and inspected and accepted by the

concerned authority.

16- Direct or indirect conversing on the part of tenderer or their representative will disqualify

their tenders.

17- The Manager reserve the rights accept or reject any tender without assigning any reasons

thereof.

18- All legal proceeding if necessity arises to institute by any of parties

Federation/Plant or contractor shall have to be lodged in the court situated in

Jodhpur and not elsewhere.

19- In case of any dispute matter shall be refers to Arbitrator Managing Director, R.C.D.F. or

his authorized person shall be as sole arbitrator. His decision shall be final and binding to

both the parties.

20- No other conditions except those mentioned above will entertained in the tender.

21- As the goods shall be supplied on FOR basis no freight payment shall be made from

Cattle Feed Plant, Jodhpur.

22- Successful tenderer must deposit security money Rs. 45000/- The amount should be

deposited in form of demand draft FDR/Bank Guarantee in favour of Cattle Feed Plant,

Jodhpur.

23- If supply is not made in prescribed period late penalty will be imposed at the rate of 1%

for 1st Week and 2% on 2

nd Week and 3% on 3

rd Week.

24- In case of increase in GST/Tax rates by either the Central Govt. or State Govt. same will

be changed accordingly.

25- The contract period/ tender period shall be of one year which can be extended minimum

six months and for this extension consent of tenderer will not required.

01- An agreement made this ___________________ day of __________________between M/s. _____________hereinafter called "approved contractor" which expression shall where the context so admits, be deemed to include his heirs, successors, executors and administrators of the one part and the Cattle Feed Plant, Jodhpur (hereinafter called "the CFP" which expression shall, where the context so admits, be deemed to include his successors in office and assigns) of the other part.

02- Whereas the approved contractor has agreed with the CFP for works of & all those things set forth in the order / tender issued vide No. _______________ and in the manner set forth in the aforesaid order / tender.

03- (a) And whereas the approved contractor has deposited a sum of Rs. ________ in form of as security for the due performance of the agreement. (b) And whereas the approved tenderer / contractor has agreed: (i) To keep the security deposit with the CFP for an initial period of 12 months or such extended period so as to cover the period of performance of

contract as per order. (ii) That no interest shall be paid by the CFP on the security deposit. (iii) That in case of breach of any terms & conditions of the aforesaid contract order /tender of this agreement by

the contractor the amount of security deposit shall be liable to forfeiture in full or part by the CFP

NOW THESE PRESENT WITNESS

01- In consideration of the payment to be made by the CFP at the rates setforth in the aforesaid work order, the approved

contractor will duly work in the aforesaid order and in the manner setforth and within the period stipulated in the conditions of the tender and order.

02- The conditions of the tender as given in the tender document for the work, conditions of the aforesaid order and also any subsequent amendment as may be issued by the CFP will be deemed to be taken as part of this agreement and are binding on the parties executing this agreement.

03- (a) The CFP do hereby agree that if the approved contractor shall duly execute the work in the time and manner, observe and keep the said terms & conditions, the CFP shall pay or cause to be paid to the approved contractor, at the time and in manner set forth in the said conditions, the amount payable for work executed on contractor's raising bills. (b) The mode of payment will be as specified in the order.

04- Work shall be completed in the manner and time specified in the tender / order. 05- In case the approved contractor fails to execute the work within in time specified in the aforesaid work order, the

conditions of as stipulated in the aforesaid tender / order / contract shall be enforced. 06- In case of any doubt or question arising on the interpretation pertaining to the order / tender the terms of the contract

shall be binding, override and final over the order/tender. 07- If any dispute or difference shall at any time arise between the two parties in respect of or concerning any of this herein

contained or arising out of this order/tender/agreement as to the rights, liabilities or duties of the said parties hereunder or as to the recovery of any amount, the same shall be referred to the sole arbitrator M.D., RCDF who in turn may refer the dispute to any officer of RCDF for adjudication. The arbitration shall be in accordance to the law of Arbitration and Conciliation Act, 1996. The decision of the Sole Arbitrator shall be final and binding on both the parties.

08- All the disputes pertaining to the said contact shall vest to the jurisdiction of Courts at ………………….…………………

SPECIAL CONDITIONS 01- The tender forms along with the terms and conditions appended there to duly filled in should be

submitted in a closed sealed envelope. 02- It will be presumed that the tenderer have gone through the terms and conditions of the tender.

No changes shall be made in these conditions by the tenderer 03- The tenderer should fill in his name along with telephone number and Email address 04- Tender should be filled in ink legibly. There should be no cutting or over writing. If any cutting

or overwriting it is necessary then every cutting over writing shall be duly signed. 05- The rates should be quoted per quintal in Eproc Site only. 06- An earnest money @ 2% of Contract value shall be deposited with the tender. No cheque will be

accepted. The earnest money should be deposited in form of DD/Banker cheque in the office of the undersigned or tenderer is required to state the number and date of such receipt in tender

form, if the earnest money is not deposited the tenderer are liable to be rejected. 07- The security money apart from EMD @ 3% of Contract value will be deposited as FDR duly

pledged with CFP Jodhpur OR Bank Guarantee of same value shall be given at the time of agreement.

08- Parties quoting the rates are required to give in eproc site. 09- All the papers of the Vehicle should be valid and complete in all respect and the contractor shall

be responsible for any dispute or any penalty made by any authority for any reason. 10- When federation found it necessary it will have right to sent representative with vehicles. 11- Truck shall have to be sent to our plant for lifting the goods even in small quantities.

(Minimum 10 M.T.). 12- The contractor shall have to lift the material as and when requisition is made by our

representative telephonically or through letter/messenger or By email. If he fails to do so with in 24 hours alternative arrangement would be made at his cost and risk without any written notice and excess charges made will be deducted from the amount of security deposit/ freight/ any

other amount lying with Cattle Feed Plant. 13- The delivery of the goods to the destination shall have to be made without any delay except the

time taken in transit. 14- Generally freight shall be paid by Milk Unions and some Govt. Organizations. While freight for

Pvt. Dealers, Units and Other agencies shall be paid by dealers and other agencies receptively. 15- No payment of Octroi charges will be made by CFP, Jodhpur / Milk Unions. Toll taxes / any

other tax will be paid to party only if the Toll Tax / any other tax is levied after issue of work order during contract period. Transporter should submit copy of such notification. The contractor has to produce the valid receipts of such taxes / copy of Govt. orders if any.

16- No other tax, bilty charges etc. will be considered separately these may be included while quoting the rates.

17- Quantity of goods, Nos. of bags accepted by the contractor at our factory will be considered the final weighment of goods.

18- The capacity of the vehicle shall be 10 Ton or more as desired. 19- The contractor will be responsible for any damage or loss caused due to the non supply of the

things in time or not supplying the things in original and in good condition to Unions / Units / Parties. For any such lapse no payment will be made and the CFP, Jodhpur shall have the power to penalize & recover the cost of any damages and losses from bills of contractor due to him from the normal transport bill or the amount of security deposit.

20- Loading/ unloading will be made free of cost at plant and Union / Units concerned /Union. 21- The truck shall be empty when sent for lifting the material. 22- The delivery of Material taken by the Union / Units can be made in part at the different

places (maximum 3 destinations).

23- The participant Contractor should not have been declared black listed by R.C. D.F. Ltd., Jaipur

/ CFP, Jodhpur or by any other unit of R.C.D.F. 24- The employees of the Federation, Unions ,CFP’s and their relatives will not be allowed to

participate in tender. 25- In case of To-pay freight, GST of such consignments shall be deposited by Unions/Units by

deducting desired amount from contractor’s bill. 26- The concealment of any fact in the part of contractor having a bearing on the contract will

empower the management to terminate the contract as and when it comes to light. 27- The Manger shall have the right to reject any tender without assigning any reason. 28- The contractor shall not assign or sublet this contract or any part thereof to any other agency or

persons. 29- The successful tenderer shall have to execute an agreement in the prescribed form on non-

judicial stamp paper as applicable and deposit security as applicable in form of Bank Guarantee

OR FDR for the due performance of the contract. The security money will be returned minimum after three months from the date of completion of the contract on completion of necessary formalities. The expenses of completing and stamping of the agreement shall be borne by the contractor. In case of failure to execute the contract successfully the EMD amount will be forfeited. This amount can also be used for recoveries due from contractor.

30- Any direct or indirect canvassing on the part of the tenderer or his representatives shall disqualify his tender.

31- If the rates indicated in the tender’s are higher than the prevailing rates or market rates, the parties may be called for negotiations at the discretion of Management.

32- The persons engaged for work by the contractor will have to follow the instructions of the Manager or his staff. If these persons are found to be negligent, the contractor will be liable to pay the damage and will have to taken action as decided by the Federation.

33- After acceptance of the tender of the contractor, the Federation reserves the right to terminate the contract on account of violation of any of the conditions of the contact. In such cases the contractor will be responsible for all damages, which occur from such termination of the contract. During the period of contract if the Federation has to make alternative arrangements for this work and additional cost of any such work will have to be borne by the contractor.

34- In case the services of the contractor are found satisfactory and if no other arrangement is made at the time of the expire of the terms of this contract, the Federation can extend the term of this contract for six months and the contract shall have to accept it on the same terms and conditions.

35- The contractor is bound to start functioning within 48 hours from the date of receipt of work order. In case of failure the security money / earnest money will be forfeited and loss on account of late functioning sustained by the Federation may also be recovered from him.

36- During the contract period in case of increase / decrease in rates of diesel the rate per km will be increased / decreased. It reckons if 4 kms of run i.e. one liter of diesel with 15 MT load. Tender date diesel rates shall be taken as base. Revision shall be carried out only when accumulated ±5% in diesel rates has resulted.

37- In the event of any dispute in the execution of above contract or difference of opinion between the parties on any point in execution arising out of, or in connection with the agreement / accepted order for supply of vehicle as per terms and conditions of the above tender the parties here to shall use their best effort to settle such disputes or difference of opinion amicably by mutual negotiations. In case of any dispute or the failure of any suitable/amicable settlement between the parties by negotiations the Managing Director, R.C. D.F. Ltd., Jaipur or any person nominated by him shall enter reference as the sole arbitrator to adjudicate the dispute between the parties and shall pass the award. The award passed by the sole arbitrator shall be final.

38- Under normal conditions contract period shall be one year. However the contractor will have to

abide by all terms / conditions of the contract. Failure to follow terms / conditions shall result in termination of contract at any time during the year / contract period.

39- Though the validity of tender shall be one year. But if the market drops suddenly due to overloading permitted or due to any other reason the Manager CFP, Jodhpur will have the right to terminate the tender. Under such conditions the EMD / Security Money of the party shall be refunded.

40- In case if any pending claim is lodged by any vehicle driver also who had loaded the vehicle from CFP. The claim will immediately paid to the driver on produce of valid receipt of delivery of goods at destination & the amount paid to driver will be recovered from the contractor.

41- The contractor has to produce the valid receipt of delivery of goods to CFP within 2 months failing which the amount of freight paid will be recovered from the contractor. One photocopy of such receipt shall be retained by contractor during the contract period. Failure to submit any

receipt and non-confirmation of receipt from recipient party for two month shall result in recovery of entire amount of consignment from contractor along with penalty which may be decided by the CFP management.

42- Claim of freight will be made to concerned Milk Unions/Units by contractor on 10 days (01 – 10 /11 – 20 / 21 – 31) basis on original GR’s.

43- During the tender period if any new toll tax is imposed on any route, that shall be paid extra to transporter on actual basis and on submission of actual receipt.

part and Manager of the Cattle Feed Plant, Jodhpur (hereinafter called ‘The Federation which expression shall where the context so admits be deemed to include his successors in office and assign) of the other part.

02 Whereas the contractor has agreed to start the work in the manner set forth in the conditions of the tender and contract

and appended herewith at the rate shown in annexure “A”.

03 And whereas the contractor has deposited in cash sum of Rs. ……………./- (Rupee………………………………………) vide receipt No----------- dt. -------------- as security deposit for the due

performance of the aforesaid agreement. In case of failure to execute the contract successfully this amount will be

forfeited.

04 Now, these present witness:

(i) In consideration of the payment to be made by the Federation at the rate set forth inclusive 2 of this

agreement the contractor will start work in the manner set forth in conditions of the tender and contract.

(ii) The conditions of tender and contract enclosed to the tender Notice …………. dated …………. and also

appended to this agreement will be deemed to be taken as part of this agreement and are binding on the

parties executing this agreement.

(iii) The Federation do hereby agree that if the contractor works regularly in manner aforesaid observes and keep

the said terms and conditions to Federation will pay through accounts payee cheque the amount payable for

ten days/monthly bills of the contractor for work.

05 Whereas the agreement has / will come into force with effect from ------------------ and will remain in force up to ------

--------------- and can be terminated earlier if the Federation is not satisfied with the work of the contractor.

06 In case of no fulfillment of all or any of the condition of the contract by the contractor, penalty at the rates mentioned

in the terms and conditions attached with the tender and also appended with this agreement will be recovered either

out of the dues of the contractor or from the security deposit amount / earnest money amount.

07 All disputes arising out of this agreement shall be decided by the Managing Director of Federation and decision of the

Managing Director shall be final and binding to both parties.

GENERAL TERMS AND CONDITIONS 01 The rate should be quoted per bag. Rates should be quoted only in Eproc Site

(BOQ). No offline rate shall be accepted. 02 (A) The rate should be quoted F.O.R. Cattle Feed Plant, Jodhpur. This

should include GST and all other taxes. If any change in tax rate during contract period, shall be considered and adjusted accordingly.

(B) Supplier should provided breakup of rates such as (cost of basic material, labour, GST) so that change in tax rate during contract period is adjusted accordingly.

03 The party will have to deliver the goods within 30 days of receipt of order. if

supply is not made in prescribed period late penalty will be imposed at the rate of 1% for 1st week. 2% for 2nd week and after 2nd week Risk purchase will be made. Failure to supply the goods may result in risk purchase against the party or forfeiture of earnest/security money.

04 Full payment shall be released on confirmation of quality. 05 No price escalation/reduction shall be applicable during the supply period. 06 Testing of bags shall be carried out at our own lab or from CIPET. 07 In case goods are not as per our specifications the plant will have the right to

consume the same by imposing up to 10% quality deduction. 08 The bags not conforming to our specifications are liable to be rejected such sub

standard bags will have to be lifted by the party within 7 days of intimation replace goods within supply period.

09 Successful tenderer would be required to deposit security money Rs. 45000/- in

addition to EMD Rs. 30000/-. 10 Approximate requirement should be as under:- Laminated PP Woven Sack (Tubular Type) 70000 Nos. Quantities are tentative which can be increase/decreased ± 05%.

The rate should be inclusive of printing. 02 The rate should be quoted F.O.R. Cattle Feed Plant, Jodhpur in

E-Proc site only. No need to submit with technical tender. This

should include all taxes and Octroi if any applicable. 03 The party will have to deliver the goods within 30 days of receipt of

order. if supply is not made in prescribed period late penalty will be imposed at the rate of 1% for 1st week. 2% for 2nd week and after 2nd week up to 4% in 4th week. Failure to supply the goods may

result in risk purchase against the party or forfeiture of earnest/security money.

04 100% payment shall be released after quality confirmation. 05 No price escalation/reduction shall be applicable during the

tender period. 06 Supply period of contract shall be one year from the date of

awarding the contract which can be further extended for next six month on same tender term conditions.

07 The material not conforming to our specifications is liable to be rejected such sub standard material will have to be lifted by the party within 7 days of intimation and replace goods immediately.

PRINTING:-Design, colour combination and printed matter shall be provided

by the Cattle Feed Plant, Jodhpur. We plan to seek Bicolour/ Tricolour

printing.
