He was the consensuschoice following more than 24 hours ofcrisis talks and intense horse trading be-tween Zardari and members of his frac-tious ruling coalition. He was brieflyfinance minister during the 1993-1996premiership of Benazir Bhutto. He wrote that section 248(2) of the pakistaniconstitution stated: “No criminal proceedingswhatsoever shall be instituted or continued against thepresident or governor in any court during his term ofoffice.” the language of the above provision is clear, andit is a settled principle of interpretation that when thelanguage of a provision is clear the court should not twistor amend its language in the garb of interpretation, butread it as it is, he said. “i therefore fail to understand how proceedings oncorruption charges (which are clearly of a criminalnature) can be instituted or continued against thepakistani president”, Katju said. Moreover, “how can the court remove a prime minister?this is unheard of in a democracy. the prime ministerholds office as long he has the confidence of parliament,not the confidence of the supreme Court”. Katju said the constitution established a delicate balanceof power, and each of the three organs of the state – thelegislature, the executive and the judiciary – mustrespect each other and not encroach into each other’sdomain, otherwise the system could not function. “it seems to me that the pakistani supreme Court haslost its balance and gone berserk. if it does not nowcome to its senses i am afraid the day is not far off whenthe constitution will collapse, and the blame willsquarely lie with the court, and particularly its chiefjustice,” the former indian sC judge added.

Murder, torture and extortion allegationswould bar most people around the world fromseeking public office. Not in country’s commer-cial capital, Karachi, where men like Balochthrive amid gang wars and ethnic, sectarian andpolitical violence. He’s confident of winning alegislative seat in a general election due earlynext year. in some ways, instability in the city of18 million poses a graver security threat to Usally pakistan than the headline-grabbing talibaninsurgency in the north.

Karachi is home to pakistan’s main stockmarket. it handles all of the cash-strapped coun-try’s shipping. the city also generates most ofpakistan’s tax revenue - and some of the coun-try’s most wanted men.

Muhammad Rafique, who represents Lyariin the provincial assembly on behalf of the ppp,has appeared with Baloch at several rallies. Heis careful not to criticise his former supporterbut insists Baloch had no formal position in theparty. “if criminals have taken over politics, howcan gentlemen survive?,” he said. His own familyhome lies behind a heavily guarded roadblock.

it is the admission season in DelhiUniversity. And according to news-paper reports, the elite st stephen’sCollege, the alma mater of GeneralZia-ul-Haq, has received a record

22,000 applications for 420 seats.i hang around in the college to find out

just what the fuss is all about. (it’s surely notthe Zia factor!)

stephen’s is a sort of local Oxbridgewhere everything and everyone is differentfrom Delhi’s other colleges, at least inname. Here, the canteen is the café, thehostel is the residence, and the teachers andstudents are called senior members andjunior members, respectively. the annualfarewell ceremony for outgoing students istermed Dismissal service.

But today the college’s elite image is alsobeing questioned.

“st stephen’s’ elite status is a myth,” thecollege’s associate professor of philosophy Kp shankaran told me, “ that is perpetuatedby talking derogatively about other colleges.”

Last year, former indian ambassador topakistan Mani shankar Aiyar, an ex-stephanian, displayed what some see assnobbery typical of his alma mater. Respond-ing to an allegation in a letter written bysports minister Ajay Maken to the pM blam-ing Aiyar for delaying Commonwealth

Games projects, Aiyarsaid: “Firstly, we have toestablish the authenticityof this letter. it containswords like ‘dichotomous’,which i cannot believethat a BA pass from HansRaj College would know.”

in response, 40stephanians marched toHans Raj to “express sol-idarity”. “We had to con-vey that today’sstephanians do not sub-scribe to the views of oldboys like Aiyar,” saidUdit Bhatia, general sec-retary of the college’sstudents’ Union society.“Now more stephaniansattend festivals and de-bates in other colleges,where we see the bril-liance of their students.We are no longer in a po-sition to say that we aresuperior.”

Running an institu-tion that fancies carryingthe burden of nation-building on its shoul-ders, the reverendValson thampu, the col-lege’s controversial 12th

principal, says, “the business of st stephen’sis to produce leaders for tomorrow’s india.”

in that, the college’s record is impres-sive. Look around and you will find the illus-trious old boys. Montek singh Ahluwalia isdeputy chairman of the planning Commis-sion; Kaushik Basu is chief economic adviserto the finance ministry; and Kapil sibal andsalman Khurshid are Union cabinet minis-ters. the college seems to have, at least par-tially, colonised other aspects of india too.in fashion, Rohit Bal; in cinema, shekharKapur; in tV, Barkha Dutt; and in literature,almost every renowned novelist, includingAmitav Ghosh and Khushwant singh.

thampu said, “st stephen’s College isnow less snooty.” it’s rare for a college headto directly confess how snobbish his collegeis, or used to be.

in no other DU college is the algebra ofinfinite merit as complex as it is in stephen’s.You have to be top-notch academically, haveblue-chip public school pedigree or have par-ents belonging to the old boy network, bepart of a religious quota or other reservedcategories such as sports and physicallyhandicapped, to get into the college.

the exclusivity that marked stephen’sis now being challenged. the changes thatare transforming india are being reflectedin the college. According to the principal,20% of the indian Administrative serviceand indian Foreign service officials in the1970s and 1980s were from stephen’s. inthe past five years, that percentage is notmore than 10. the number of students fromextremely poor backgrounds has gone upthreefold in the last five years.

thampu said that the interview roundin the college’s admission process favouredenglish-speaking candidates, who had bet-ter communication skills than studentsfrom a vernacular background. “those morecomfortable in indian languages felt intim-idated by the ambience of the interview, afeeling aggravated by the awe the college in-

spires,” he told me. “since 2007, dependingon the candidate, our interviews also takeplace in Hindi, and that’s why you find morepeople coming from the towns and villagesof Uttar pradesh and Haryana.”

professor shankaran, who has beenteaching in the college since 1985, says: “ststephen’s was socially elite, but never intel-lectually. Well-read people are an excep-tion. We are like any college, except thatthere are fewer rowdy elements and it iseasy to manage the college due to a long tra-dition of political passivity.”

the one time stephen’s became politi-cally engaged was when quite a few stu-dents went underground to join the Naxalmovement in the 1960s.

to Ayesha Adlakha, a first-year student,the college is like a “camp” where you canmeet adventurers of various kinds. “Cominghere is the most liberating thing that hap-pened to me,” says Adlakha, whose hair isdyed red. “people are so non-judgemental.You say and do whatever you want. every-thing we need in this world is right here.”

the world immediately outside, how-ever, is moving on, and the college may finditself left behind one day. it’s a fact acknowl-edged by st stephen’s’ living legend. DavidBaker, a retired history professor who livesin an apartment in a boys’ block, is busywriting a history of the college. “My bookdeals with how Delhi’s history overlappedwith that of st stephen’s,” he says. “Aftercrushing the 1857 uprising, the British re-shaped Delhi into a commercial, industrial,railway city, and the college began in thisnew world. it acquired more importancewhen the city was made india’s capital…each chapter of my book explores what ef-fects these two made on each other duringsignificant periods. today Delhi has becomea megalopolis of 16.7 million people. the col-lege’s hold on the city has begun to taper.that could be the final chapter, but, in gen-eral, my proposition holds true.”

the situation is rife with dangers for the system.the ruling alliance is at loggerheads with theopposition which is gradually moving towards theone point agenda of fresh elections. What is more,the government is simultaneously confronting thesC. Certain sections of the establishment might behappy over the way the sC has removed the pM, butthey are perturbed over the way the sC is trying torein in the security agencies. Meanwhile, the lawyerscommunity has been divided into hostile groups, andthe entry of some of the outstanding leaders of theircommunity into bar rooms has been banned. thegovernment has to realise the gravity of thesituation. it must not take confrontation with the sCand the opposition to a stage where a small pushfrom outside sends the system hurtling down theabyss.

ate for peace in the south Asian regionand have expressed concern for the sta-bility of Afghanistan, most of them in-volved in the process have startedpreparing for a seemingly imminent coldwar between the Us and China. the Usis currently the only superpower in aunipolar world but the emergence ofChina as a new power centre has put itinto confrontation with the country inmultifarious ways.

During his trip to Australia, on No-vember 17, 2011, president BarrackObama, while sending an unmistakablemessage to Beijing said, “the Unitedstates is a pacific power, and we are hereto stay.” Us Defence secretary Leonpanetta also made statements relevantin this context during his Asia visit. Herevealed during his visit to singaporethat the Us will shift a majority of itswarships to the Asia-pacific region by2020 as part of a new Us military strat-

egy in Asia. panetta’s Asia visit came ata time of renewed tension betweenChina and philippines, the latter being amajor Us ally.

With regards to strengthening its po-sition in the pacific, America has alsocultivated security relations with NewZealand. it is also working with severalGulf countries to solidify its entrench-ment in the region. American strategicthinkers take China’s military moderni-sation as a great threat to its militarybases in the continent.

Russia and China had opposed theUs-led NAtO attack on Libya, whilethey have asked the Us to resolve thequestion of iran’s nuclear programmepeacefully. But America and israel arestill acting upon a war-like diplomacyagainst tehran. the Us and China alsohave disagreement about many interna-tional issues. A notable one which hasled them to being at loggerheads is thetaiwan issue.

Given that the Us is now buttingheads with two big powers – China andRussia - right in our backyard, doesn’tthis shifting scenario necessitate someadjustment in our foreign policy? Al-ready pak-Us relations are in consider-

able flux. tensions already existed whenthe May 2nd operation took place whichonly worsened the situation. thingscame to a head with the November 26salala incident. in response, pakistanblocked the NAtO supplies and closedthe shamsi airbase. Following these in-cidents, since islamabad has decided toreassess its engagement with the Us, itwould do well to take the emergent sce-nario into consideration.

it seems that pakistan is doing thatto some extent. it has rejected Americanduress with regards to the ip gaspipeline project with iran. Moreover,besides China, pakistan has also culti-vated its relationship with the RussianFederation. Moscow and islamabadagreed to enhance bilateral relations indiverse fields.

in 2010, the then Russian primeMinister Vladimir putin publicly en-dorsed pakistan bid to join the shanghaiCooperation Organisation (sCO).

pakistan’s president Asif Ali Zardariparticipated in the 12th summit of theshanghai Cooperation Organization re-cently held in Beijing. While addressingthe summit, hinting at Us overtures inthe region, Chinese president Hu Jintao

said that the international situation hadbecome complex, thus, leading to manyuncertainties in the regional situation.He stressed that only if the sCO memberstates remain united can they effectivelycope with the emerging challenges.

it cannot be denied that the Us haskey interests in this region and many ofits recent liaisons with countries in theregion can be explained in the context ofits new designs. the Us has made manyforeign policy adjustments and theypoint towards the fact that the Us is try-ing to buttress a few of its allies in the re-gion to counteract growing Chinese andRussian influence.

Moreover, the Us also needs to es-tablish these relations to pursue its pres-surisation campaigns against iran andpakistan and put its plans with regardsto them into action. its pacts withAfghanistan and india are a case inpoint. it has repeatedly pressed indianot to cooperate with iran while it haspropped up india as a force and an allyin the region to tick off pakistan’s estab-lishment. Leon panetta’s trip to the re-gion thus makes sense in this context.

During his recent visit to New Delhi,panetta revived the blame game and

upped the ante on pakistan by remark-ing that drone attacks would continue onterrorists’ safe havens within pakistan.While there, panetta also encouragedindia to take a more active role inAfghanistan in training the Afghanforces.

this nexus is clearly aimed at neu-tralising pakistan and offsetting the in-fluence of the emerging power of Chinaand Russia.

Rapidly developing geo-political dif-ferences among global powers in Asiashow that the next cold war is likely tobe waged between the Russia-China al-liance and the Us-led block and many oftheir battles will directly or indirectly in-volve pakistan.

thus, it is imperative that pakistanrethink its role in the region and reeval-uate its relations not just with the super-power but with its neighbours andregional and international powers. itneeds to abandon outdated foreign pol-icy paradigms and wake up to the newground realities.

A great lady she was. May Allah bless her soul andgive courage to the bereaved and the nation to bear thisshock. she fought for democracy, human rights andwomen empowerment. through sheer hard work andsincerity, Mrs Wahab became the face of country’slargest political party (ppp). By virtue of her ownpersonal background and dedication, she became avoice of the middle class, a self-made woman.

through her visible and also indirect role as pppMNA and office bearer, she did a lot for womenempowerment. in countries like pakistan, it is verydifficult for a woman to participate in politics and earnrespect. Fauzia Wahab did it nicely and she set anexample for all. she used to help and solve the problemsof women hailing from middle class. And women alsofelt free to share their problems with Fauzia Wahab. sheplayed a key role in a number of bills related to womenempowerment.

she was a popular parliamentarian and enjoyed

massive support for her work. she embarked on herpolitical career by volunteering for the ppp in theGeneral elections 1988. in 1995, Ms Wahab became theinformation secretary of the ppp sindh Women’s Wing.she also remained a member of the party’s advisorycouncil from 1994 to 1996 and chairperson of theKarachi Metropolitan Corporation’s informationcommittee from 1994 to 1995. Foreign affairs, financeand women’s development issues drew her interest inparticular. Later on in 1998, Benazir Bhutto nominatedFauzia Wahab to become the Central Coordinator of theHuman Rights Cell and was tasked to correspond withhuman rights defending organisations abroad.

in 2003, she attended the National Defence Collegecourse for bringing the politicians and armed forcesclose to each other. she was one of the initiators ofrelationship with the National Democratic institute(NDi) and was invited to attend the “Win with Women– Global initiative” of the institute in December 2003.

in June 2004, she was invited by the NDi to attend the2004 Democratic National Convention in Boston.

she was appointed central information secretary ofparty in 2009. she chose to side with the ppp becauseshe believed that it was the only political party open toliberal democratic values and the only political partythat was not plagued by gender discrimination. Herdedication to ppp was matchless. she always defendedher party in very difficult times. she was the mosthonest person. in my view, after BB shaheed, FauziaWahab was the only leader, who followed her footsteps.Moreover, she upheld liberal face of ppp in highlypolarised, fanatic and charged environment of pakistan.

No doubt, she was a courageous and brave lady.Outspoken secular voice is no more with us now. Hersad demise is a big blow for pakistan and the vacuumcreated after her death will never be filled.

the second blowDuring the 65-year long history of

our country, the parliament received itssecond big blow by judiciary on 19June.

it is not true that all the decisionsmade by apex court were always right.We had example of Z A Bhutto’s vitalcase in which the verdict was given by 3-4judges. Nonetheless, the deciding judge,Justice Naseem Hassan shah, after manyyears of his verdict in an interview withGeo tV categorically said that had hewanted to save the life of Z A Bhutto, hecould have done so but his advocateYahya Bakhtiar annoyed the judges.

this is not the first example of itskind. in 1954, when late Chaudhry MalikGhulam Mohammad was Governor Gen-eral (GG), the speaker of National As-sembly Maulvi tameezuddin challengedthe dissolution of the Constituent Assem-bly by GG in the apex court but the thenChief Justice of the supreme Court ofpakistan, Justice Mohammad Munir,supported the decision of the GG andthus the judiciary delivered its first blowon the sovereignty of the parliament.

it appears that the history hasrepeated itself in 2012 as the parliamenthas recently received its second blow byjudiciary. throughout the world, theparliament is supreme whereas the job ofjudiciary is only to explain the constitution,not challenge every decision of the govt.

Unfortunately, a group of people inpakistan have always tried to prove judi-ciary as supreme against the parliamentand they have unfortunately succeededin their designs. this will have highly badrepercussions on the sovereignty of theparliament besides on the future of thecountry as it is bound to further weaken it.

the pakistan Cricket Board (pCB) hasapproved a deficit budget of Rs700 mil-lion for the fiscal year 2012-13 in its re-cent Governing Board (GB) and alsoplanning to establish another head of-fice in interior sindh.

the meeting chaired by the board'schairman Zaka Ashraf approved thebudget with the amount having an im-provement on the Rs1.1b deficit budgetthat was announced last year. “theamount is a tremendous improvement,”a GB member was quoted by reports.

A major chunk of the budget hasbeen set aside for infrastructure devel-opment. the board had initially plannedto spend a lot on administration but theGB members were against that moveand asked Ashraf to allot that to devel-opment instead.

“there are several stadiums thatneed renovation. there are academiesand high-performance centres that needmodification so we believed that infra-

structure development should get themajor share of the budget and the chair-man agreed to that.”

the pCB is building two high-per-formance centres in Karachi and Multanalong the same lines as Lahore's Na-tional Cricket Academy. it also intendsto build a new stadium in islamabadand Larkana and the addition of a newhead office in interior sindh was alsodiscussed. the GB members also raisedquestions over the continued existenceof Javed Miandad in the pCB who, de-spite being paid a hefty amount permonth, does not play an active role inthe board. Meanwhile, four regions havealso been added to pakistan cricket –nominated by patron-in-Chief Asif AliZardari – which did not please the GBmembers. “Dera Murad Bugti, Larkana,Fata and Bahawalpur are now active re-gions. Bahawalpur is a good inclusionand Fata has tremendous talent but theother two regions have been included onpolitical grounds. the teams of Quettaand Hyderabad don't even have 11 goodplayers.”

prevented from holding dual na-tionality, the influx of importedprime ministers would continue.

A three-member bench headedby Chief Justice iftikhar Muham-mad Chaudhry heard the proceed-ings of the dual nationality case. Noone appeared before the court on be-half of MNA Farhat Mehmood andMpAs Nadia Gabol and Dr Ashraf.

Anwar Mansoor, the counsel forRehman Malik, told the sC that theycould not present nationality re-nouncement form because theBritish lawyer was on leave in spain.the court said it has been asking fornationality renouncement form ofRehman Malik for the last 11 hear-ings. petitioner Waheed Anjum pre-sented evidences regarding dualnationalities of MpA tariq Alonaand MNA Zahid iqbal by submittingphotocopies of their passports. Hesaid MpA Nadia Gabol and MpAKhadim Nazir also had British na-tionality.
