IN MAJOR METROPOLITAN AREAS ACROSS CANADA, IT IS VERY TEMPTING TO HOP ON THE SHORT-TERM RENTAL BANDWAGON. Some renters may try to rent out a spare room – or rent out the whole place when demand in the city is high.It seems like a great way to earn a few easy dollars. There can be many bonuses as well as headaches that go along with short-term rentals.With the Pan Am Games that just went down, many Torontonians cashed in on renting out rooms in their homes. As you can imagine, short-term rentals are a major pain to the hospitality industry, and because of that, in many cities the government is cracking down. In places like New York and the province of Quebec, it is illegal to rent your place for less than 30 days. However, there are no laws prohibiting short-term rentals in Ontario, or the rest of the country – yet.

There are many things to think about and many ways you can get yourself in hot water – with your neighbours, your landlord and your insurance company. Yes, you need to worry about is insurance (and perhaps the idea of a stranger sleeping in your bed and rifling through your things!). Many insurance companies don’t want the headache of covering short-term rentals, which means you’ll need to find a speciality insurance company (like those used to insure strip clubs).

If your short term renters end up being wild party people that disturb the peace and the neighbours you may have to worry about the apologies you’ll have to dole out to the people you have to live with and spend time with on an elevator on a regular basis.

Technically, short-term rental isn’t illegal anywhere in Canada, other than Quebec. That being said, you still need to get your landlord’s approval. As per the Ontario Tenant’s Act, a landlord has every right to evict you if you sublet without consent (act s.100).

Another important thing to remember, as per act s.134(3), you can’t charge a subletter more than your monthly rent. So if you’re thinking about renting out your living room, make sure the total amount charged doesn’t exceed your monthly rent.

As in all things, it’s better to ask questions first. Talk to your landlord, your roommate, your condo board, and your insurance broker before jumping into any new business venture!

FOR MOST OF US, HOME IS EVERYTHING. When we’re in our homes, we feel comfort, a sense of familiarity and belonging. It’s our haven, our refuge from the hectic day-to-day lives most of us lead today. For those who rent rather than own, that need is not diminished. Walking into an apartment should be a relaxing, pleasant experience – which is why selecting a building that is clean, well kept and professionally run is important. With this in mind, a few years ago the Federation of Rental-housing Providers of Ontario (FRPO) created the Certified Rental Building Program (CRBP) to help apartment shoppers zero in on excellent residences more easily.

In a nutshell, the CRBP promotes best practices in operating apartment buildings in Ontario. The idea is to offer consumers an easy, recognizable way to find top-quality residences in their search for an apartment home, and from the feedback we’ve had, it’s working. When shoppers see the CRBP certification logo displayed, they know that they are looking at a building where the living conditions are safe and efficient, and where customer service is considered a priority. The logo tells you that the property manager and staff practice more than 38 established building management and customer service standards.

To be certified, applicants must complete and pass the training and education component of the program, which covers everything from safety procedures and building code compliance to knowing the Human Rights Code and what is expected for information and privacy law compliance. Participants cover the requirements of meeting CRBP’s Standards of Practice and learn how and why upholding them improves operations and customer service.

Annual random-audit site inspections ensure that the professionalism of the program is being upheld. To provide even more peace-of-mind to renters who select a CRBP building, FRPO enlisted J.D. Power and Associates to conduct all the building audits for participating companies. This well-respected third-party independent performance measurement firm conducts unbiased surveys of customer satisfaction, product quality and buyer behaviour.

Judging from recent results, we’re on the right track with CRBP.

In 2011, the J.D. Power Canadian Resident Survey results indicated that: 74 per cent

RENTING OUT A ROOM IN A PRIVATE HOUSE OR CONDO AND SHARING THE HOME WITH THE OWNER is a lot like having a roommate – except for the legal implications. Living with someone can be a great way to save on expenses, make your housing budget go further and enjoy a type of home you wouldn’t normally rent on your own. But unlike a typical roommate, where both of you rent from the owner, living with the landlord doesn’t offer you the same legal protection through the Residential Tenancies Act (RTA) It’s important to know the regulations and limitations that this type of tenancy has.

You may be surprised to find that, in most provinces, if a tenant shares the kitchen or bathroom with the landlord or the landlord’s immediate family (parent, child or spouse), then the Residential Tenancies Act (RTA) or Landlord and Tenant Act do not apply.

Since it doesn’t apply, it means the landlord isn’t obligated to give notice and can ask the tenant to leave immediately if they don’t pay rent, or for any other reason. The landlord can raise the rent, change the locks or do a number of other things a landlord would be prohibited from doing under the RTA.

It works both ways - a tenant can also jump ship without notice and the landlord does not have the same protection covered by the RTA. It is implied that treatment should be fair, but there are no legal regulations or support for either the landlord or the tenant in a home shared with the owner.

In order for both landlord and tenant to protect themselves and have clear expectations, there should be a written roommate/rental agreement. This kind of agreement is a contract and can be enforced through contract law. You may want some legal guidance on creating a proper contract. That agreement should include, but is not limited to:

• Rent amount, how it will be split among residents and paid to the landlord.

• How other costs like utilities, Internet, cable, etc will be split and paid for.

• How the property will be shared. For example: who gets what cupboard in the kitchen or space in the linen closet, and if any areas will be exclusive to one person.

• How the chores will be split.

• How notice of termination and length of notice should be given to the landlord and other roommates.

• If there will be a damage or last month’s rent deposit, and how that will reimbursed upon terminating the tenancy leaves.

The landlord and tenants can add to the contract, as long as it is agreed upon. Although you won’t be protected by the RTA, having a written contract will give both the landlord and tenants some protection.

YOU DON’T GET TO CHOOSE YOUR NEIGHBOURS. If you did, you wouldn’t be sandwiched in between two crazy families – one that reminds you in all the wrong ways of the cast of Modern Family to one side, and the loudmouth cast of Roseanne to the other. If this isn’t representative of your living situation, maybe one of these famous TV neighbours is. Read on to discover which TV neighbour you are: SEINFELD: ARE YOU A COSMO KRAMER?

Your neighbour’s rental is basically your second home. You don’t wait to receive an invite. Instead, you just show

up uninvited and rarely even bother to knock on the door. Your home grocery bill is very low, because you just

mooch all of your neighbours’ food and anything else that you fancy for that matter. Fortunately, most of the time

you are welcome. Other times, you can be a bit much. If you can’t take a hint and your neighbour has had to

literally tell you “Get out!” - You’re definitely a Kramer.

TWO BROKE GIRLS: ARE YOU A SOPHIE?

The first time you met your neighbours is when they left you a threatening letter, begging you to keep the noise

down. They didn’t know who they were messing with. You don’t let people walk all over you and you have a bit of

an attitude. Luckily, you also have a nice side and your generosity wins neighbours over. If you’re a Sophie, you’re

honest and totally eccentric, but your sweet personality has earned you a spot at your neighbour’s kitchen table.

THE SIMPSONS: ARE YOU A HOMER?

If you’re a Homer, you haven’t got a clue! You think you and your neighbours are on good terms since you always

politely say “Good morning” (when you wake up drunk on your door step). You’re constantly having parties and

being loud at any, and every hour. Of course, you invite them to join the party. They never come. You have a good

heart, but the fact is you couldn’t care less about your neighbours needs.

EVERYONE LOVES RAYMOND: ARE YOU A MARIE & FRANK?

Your son lives right across the street and you’re convinced he couldn’t be luckier. After all, you shower him with

homemade food and surprise visits that you know he really appreciates. Maybe you can be too honest at times

about everything from his parenting skills to his wife’s looks, but everyone needs a little bit of tough love. You

only want what’s best for him.

THE BIG BANG THEORY: ARE YOU A SHELDON?

You have no interest in attending a dinner party at your neighbour’s nor do you have any intentions of inviting

them over to your place. In fact, you purposely try to avoid them at all costs. You don’t ask them for anything

and you’re happy if they don’t either. If you avoid eye contact and any type of conversation with your neighbour,

you’re probably a Sheldon.

Here are some suggestions that will help to make your experience a success.

CAN YOU BE DENIED AN APARTMENT IF YOU HAVE CHILDREN?

You are required to disclose on your rental application

who the occupants of the apartment will be. Technically

a landlord cannot deny you an apartment if you have

children (this would be a Human Rights violation), but

you should be aware that some buildings are much more

child-friendly than others. Keep

this in mind when searching and

if necessary ask the rental agent if

there are young children or other

families with children in the building.

SAFETY SHOULD ALWAYS BE PARAMOUNT

Infants and toddlers should never

be left alone in an apartment – that

includes going downstairs for even

five minutes or less to get the mail,

do the laundry, take out the garbage,

or get something from your car.

Infants – even if sleeping in a crib

– should never be left unattended.

Likewise, keep your eye on your

toddler and ensure that windows

and balcony doors are kept locked.

Children, particularly school-age

children under the age of 11, should

not be left alone in apartments if

parents are working or are out for

other reasons, but many parents have

little choice and do it anyway. Serious injuries – due to falls,

accidents, burns, poisoning, etc., could result from a variety

of accidents that could easily occur in an apartment building.

Your children are your responsibility and should not be free

to run around the halls and ride on the elevators. Although

it is extremely rare, children wandering alone through

the building could easily be lured into the apartment of a

stranger with ulterior motives.

BE SENSITIVE TO THE NEEDS OF CHILDLESS NEIGHBOURS

If you do have children, keep in mind that many of your neighbours don’t. Your child-free and childless neighbours are not used to living with crying and shouting, or coping with large strollers, so be sensitive to the needs and concerns of others. Children do have a right to be there, but they are your responsibility at all times. Strollers should

be folded up and stored inside your apartment or in the storage room and bicycles parked in storage racks provided for that purpose.

CHOOSE AN AREA THAT’S CONVENIENT TO SCHOOLS, PARKS AND PLAYGROUNDS

If you are renting with children, research the neighbourhood first to find out where schools, parks and

playgrounds are located. Some companies are very sensitive to the needs of families and welcome children enthusiastically and happily provide this information. Some buildings even provide on-site daycare and host seasonal events like Hallowe’en parties, picnics and barbecues for year-round family fun.

If your building does not have on-premises daycare, search the Internet for information about municipal daycare in your neighbourhood. Or inquire in the rental office if anyone in the building provides babysitting or childcare services (either in their apartment or in yours). Perhaps after you have settled into your apartment community and have gotten to know some of your neighbours you might be able to exchange babysitting services.

When they are old enough, teach your children essential

streetproofing, safety and other coping skills. While there is no law specifying the minimum age a child must be to stay alone, if you choose to do so, ensure that you give children the knowledge, skills and confidence they need to manage if they have to be alone in the apartment for any length of time. Address with them, if they can invite friends over. How can they use the kitchen safely? What would they do in an emergency? It is important to prepare for the unexpected.
