PAYBACK Loyalty Program T&Cs -

These Terms and Conditions ("Terms") apply to the PAYBACK Loyalty Program offered by eBay India, and are in addition to and

not in derogation of the terms and conditions mentioned in the User Agreement, Privacy Policy and other Policies of

www.ebay.in ("eBay website") (further referred to as "eBay UA & Policies"). To the extent of any inconsistency between these

Terms and eBay UA & Policies, the eBay UA & Policies shall prevail.

In these Terms and Conditions the following words and phrasesshall have the meaning set below, unless the context indicatesotherwise, and may be modified from time to time.

Definitions

1. "Program" shall mean the PAYBACK Loyalty Program offered by eBay India in collaboration with PAYBACK (definedbelow).

2. "Reward Points" or "PAYPACK Points" shall mean the points awarded by PAYBACK under the Program.

3. "PAYBACK" shall mean Loyalty Solutions & Research Pvt. Limited, a company incorporated under the IndianCompanies Act, 1956 and having its registered office at 4th & 5th Floors, Kabra Excelsior, #6A, 7th Main, 1st Block,Koramangala Industrial Layout, Bangalore - 560 034 and such expression shall, unless it be repugnant to the subject orcontext thereof, include its successors, assigns, representatives and transferees.

4. "PAYBACK member" means the customer/s or user/s who is/are also enrolled as a member of PAYBACK with aPAYBACK Account.

5. "PAYBACK Card" means and includes the card issued by PAYBACK to its member/s for redeeming/ earning the RewardPoints that is accumulated in their respective PAYBACK Account as per the terms and conditions specified byPAYBACK.

6. "PAYBACK Account" shall mean the account opened with PAYBACK in the name of the customer/s or user/s for thepurpose of accumulating the Reward Points earned by them under PAYBACK Loyalty Program.

7. "Effective Date" shall mean the date from which the Program commences on eBay website.

8. The user can neither earn nor redeem PAYBACK points on COD (Cash on Delivery) transaction through eBay website.

9. "Redeem PAYBACK Points" shall mean a user will select the PAYBACK points out of the accumulated points available inits PAYBACK Account to be redeemed and click on "Redeem Now" to redeem such PAYBACK points during thetransaction. Once user redeems its PAYBACK points, such points will be instantly deducted from its PAYBACK Account.

10. "Earn PAYBACK Point" shall mean a user will be awarded the PAYBACK points that will reflect in the user's PAYBACK



account in 4 (four) days from the user's transaction on eBay website. The Payback points thereby earned will be in ablocked state and will only be unblocked post 45 days from the date of transactions for the user to redeem the same.

11. "Drop-offs" shall mean an event(s) when a user selects its PAYABCK points and clicks on 'Redeem Now' for theirredemption, but does not proceed further and/or is unable to complete the transaction, for any reason whatsoever, i.e.fails to make the payment for the goods/products.

12. "Refund" shall mean a transaction wherein user's claim has been allowed and approved for refund by eBay.

13. "Eligible Transactions" shall include the successful transactions made by users on www.ebay.in and m.ebay.in

14. Promotional/ discounted item(s)" shall mean the items/products listed by sellers on www.ebay.in andpromoted/discounted/subsidized/incentivized including but limited to as individually or as a part of various Promotionalcampaigns, activities or in the form of gifts or coupons in any manner whatsoever.

General Terms & Conditions:

1. This program (redemption ONLY) is live from January 09, 2014. The PAYBACK EARN process will be live onwww.ebay.in with effective from June 20, 2014. With PAYBACK Loyalty Program the user can now Redeem and/or EarnPAYBACK Reward points on their transactions made on eBay website.

2. For the sake of these Terms, "Customer/s" or "User/s" shall only include resident Indian eBay registered user/s.

3. Requirement for Participation: The user should hold an active eBay India account and a valid PAYBACK account. Usermust link their PAYBACK Account to its eBay India account to participate in the Program. A user shall be allowed to linkonly one of its PAYBACK accounts at a time. However, the user may choose to de-link the existing linked PAYBACKaccount from the eBay India Account, and may link a new PAYBACK account, if any.

4. The PAYBACK points shown in the transaction flow is as per the records of PAYBACK Account of user maintained atthe end of PAYBACK.

5. A user can earn or redeem or both the PAYBACK points in a single transaction. However, the user will not earn anyPAYBACK points on its transaction for the purchase of Promotional/ discounted item in the form of coupon or subsidy(s)on eBay website.

6. A user can redeem its PAYBACK Points during its transaction on Promotional/discounted item(s).

7. The user will be allowed to apply coupon only before redemption of PAYBACK points in the transaction flow. In otherwords, a user who is willing to use an eBay coupon in a transaction can apply the coupon only before redemption of itsPAYBACK points.

8. The PAYBACK Points redeemed by the user under this Program will be forthwith deducted from its PAYBACK Account.

9. In case of Drop-offs, the PAYBACK points deducted from the user's PAYBACK Account will be credited/refunded backto the user's PAYBACK account within 4 (four) working days of the transaction.

10. The PAYBACK points earned by the user on its successful transaction on eBay website will be credited in the user'slinked PAYBACK account within 5 (five) days from payment confirmation and would remain in a blocked state for aperiod of 45 (forty five) days from the date of credit of the PAYBACK Points in its PAYBACK Account. The user can usesuch earned PAYBACK Points after aforesaid period of 45 (forty five) days.

11. The PAYBACK points earned by the customer will be valid for a period of 3 years from the date the points get creditedinto the customers PAYBACK account.

12. The Reward Points earned by user(s)/customer(s) can be redeemed by the user(s)/customer/s in the form and mannerprescribed by PAYBACK in this regard.

13. In the event the transaction wherein user's claim has been allowed and approved for refund by eBay, the points earnedby the user and are reflecting in a blocked state will be reversed/ removed from the user's PAYBACK Accounts on thecompletion of the reversal/ refund process.

14. User in order to participate in the Program shall agree the Terms and Conditions mentioned herein, and shall also be



governed by the terms and conditions of PAYBACK hosted on its website www.payback.in. In case of any contradictionbetween these Terms and Conditions and the terms and conditions hosted on the PAYBACK website, the former shallprevail.

15. User shall raise its grievances in relation to PAYBACK Points under this Program directly with PAYBACK without anyreference or recourse to eBay. eBay or eBay website, and/or its employees/ representatives shall not be liable, in anymanner whatsoever, for any disputes, claims, damage, cost, expenses which may arise out of or in connection with thisPAYBACK Loyalty Program between the user(s) and PAYBACK for any reason whatsoever.

16. The Loyalty Program is complimentary and it is hereby understood that all transaction charges on Eligible Transactionson the basis of which the Reward Points are assigned to the customer, are voluntarily incurred by a customer in thenormal course of their making transactions on eBay website. Further, nothing contained herein shall prejudice or affectthe terms and conditions governing the operation of eBay or its website.

17. eBay and its website expressly reserves the right, at any time and without prior notice to the Customer/s, to add and/oralter, modify, change or vary all or in part, this Program or to withdraw the Program altogether.

18. On redemption, the Reward Points so redeemed shall automatically stand reduced from the accumulated Reward Pointsin the PAYBACK Account. Computation of the Reward Points shall be final, conclusive and binding on the customer/sand will not be liable to any dispute or questioning.

19. Any tax(es) or charges payable to the Government or any other authority or body which may arise or accrue to thecustomer/s by redemption as aforesaid or otherwise as a result of this Reward Program, shall be borne by thecustomer/s or user/s.

20. The existence of a dispute, if any, under this Program shall not constitute a claim against eBay or eBay website.

21. In all matters relating to the conduct of this Program the decision of eBay or eBay website shall be final and binding inall respects.

22. The customer/s or user/s cannot transfer, assign or bequeath Reward Points accumulated under this Program to anyanother person under any circumstances.

23. eBay or eBay website makes no warranties or representations either expressed or implied, with regard to the type,quality or fitness of the goods/benefits received through PAYBACK.

24. Whether an Eligible Transaction is considered to be valid for the purpose of redeeming Reward Points shall be the solediscretion of eBay or eBay website. If the customer/s reverses an Eligible Transaction/s on which Reward Points wereredeemed, Reward Points redeemed for such reversed transactions will also be reversed. That means in case ofrefunds, the redeemed points will also be refunded to the user within 4 (four) working days from the time the refundprocess is initiated by eBay.

25. Nothing contained in this Reward Program shall be construed as a binding obligation upon eBay or eBay Website tocontinue the Reward Program or in the event of the termination of the Program or otherwise.

26. Disputes, if any, arising out of or in connection with, or as a result of this Reward Program or otherwise shall be subjectto the laws of India and the exclusive jurisdiction of the competent courts in Mumbai only.

I am not registered with PAYBACK; can I still get a PAYBACK PIN?

What is the Maximum number of PAYBACK points I can redeem?

The number of PAYBACK points you can redeem during a transaction depends on the number of points in your PAYBACK account.

The available points will be displayed when you link your PAYBACK account to your eBay ID. Note that the redemption can only be

a fraction of the transaction value and not more than total value of your order.

What is the point to rupee conversion for purchase with PAYBACKpoints?

For every point redeemed on eBay India, the buyer will avail a discount of 0.25 rupees, i.e., if a buyer redeems 4 points on eBay

website, then he/she gets a discount of one (1) Rupee.

What if I don't have enough points to cover the entire amount of thepurchase?

If you do not have enough PAYBACK points to cover the entire amount of your purchase, you can pay the balance amount by

using your Debit/Credit card, Net banking and other payment methods accepted on eBay India.

For example: The item is worth Rs.100 and you only have PAYBACK points worth Rs. 25 in your account, then you can pay Rs. 25

with redemption of your PAYBACK points and pay the balance Rs. 75 using any of the afore mentioned payment methods .

Can I use eBay coupons as well as redeem my PAYBACK points in onetransaction for my purchase on eBay India?

Yes, you can use both. You can apply an eBay coupon and can also redeem your PAYBACK points in the same transaction to avail

greater discounts. However, you will have to apply your eBay coupon first and then you can redeem your PAYBACK points in your

transaction.

Can I redeem PAYBACK points on COD (Cash on Delivery) transaction?

No you cannot redeem PAYBACK points on a COD transaction.

Can I redeem my PAYBACK points on items featured on Deal of theWeek, Deal of the Day and other eBay promotional properties?

Yes, you can redeem your PAYBACK points on all items listed on eBay website.



I did not complete my transaction. Why were my points deducted?

If you select the number of PAYBACK points to be redeemed and proceed with 'Redeem Now', the respective PAYBACK points will

be instantly deducted from your linked PAYBACK account. However, if your transaction is incomplete or cancelled, your redeemed

PAYBACK Points will be added back to your PAYBACK account within4 (four) working days

I got a refund for my claim under eBay Guarantee Program. Will myPAYBACK points also be refunded?

Yes, your claim under eBay Guarantee Program has been approved for a refund, your PAYBACK points redeemed during the

transaction will be refunded back to your respective PAYBACK account within4 (four) working days from the time the refund is

approved.

How do I earn my PAYBACK points?

To earn PAYBACK points, once you have decided what you wish to purchase, click on 'Get started' on the 'Review your order'

page. Link your Payback account if not already linked. The 'Review your order' page will display the number of Payback points you

will earn on that transaction. Once the transaction is complete, the points will be credited into your account.

Check the number of Payback points you will earn on the VIP page of the item you wish to purchase. If

Payback is not eligible on the listing, the VIP page will not display the highlighted message below.

View Item Page (VIP):

After clicking on 'Buy it Now', you will arrive at the Review Order page where you will be prompted to link

your Payback account using your mobile number.

:Once you've linked your accounts, you will see the number of Payback



points that can be earned on the transaction. Refer to the screenshotbelow.

After you've completed the payment, you will get a confirmation of the Payback points earned on the

Order Confirmation page.

How many points do I earn per transaction?

You will earn 1 PAYBACK point for every Rs. 25 spent on eBay.in i.e. each point is worth Rs. 0.25. Points will be rounded in case

the order total is not a multiple of Rs. 25

: Order total = Rs. 80

In this case the points will be calculated as

EG 1

Rs. 80 / 25 = 3.2 points

In this case, you will earn 3 Payback points

: Order total = Rs. 90

Rs. 90 / 25 = 3.6 points

In this case, you will earn 4 Payback points

What will be the validity of PAYBACK points earned on eBay.in?



The PAYBACK points earned by the customer will be valid for a period of 3 years from the date points get credited into the

customer's respective PAYBACK account.

When do I Earn Payback points?

You will earn Payback points:

When you purchase an item on eBay India that isn't pre-discounted or promoted.on- This includes coupons, deals, subsidizeditems, gift promotions, flash sales, etc.On a transaction where you have only redeemed Payback points, you can also EARN Payback points on the payable orderamount.For instance, if you purchase item worth Rs.100 and you redeem PAYBACK points worth Rs.50/-, then on the balance Payable

Order amount (Rs.50/-), you can earn PAYBACK points.

Please note: You will only earn Payback points in this scenario if you haven't applied any coupon to the transaction or bought any

promoted/deal item.

When do I not Earn Payback Points?

You will not be allowed to Earn Payback points in the following scenario.

If you do not have a valid Payback account/ have not linked your Payback account.You will not be allowed to earn Payback points on items that are already discounted/ promoted merchandise in the form ofcoupons, deals/subsidy, gift promotions, flash sales etc.You will not earn any Payback points on a transaction where you have redeemed the entire order amount using your Paybackpoints,For instance, if you purchase an item worth Rs. 100 and you use up 4000 Payback points to redeem the entire amount (Rs. 100),you will not earn any Payback points on that transaction.

Can I use eBay coupons as well as earn my PAYBACK points in onetransaction for my purchase on eBay India?

No. You will not be allowed to earn any Payback points on transactions where a coupon was applied.

An appropriate error message will be thrown in such cases.



What happens when I club a promoted and non-promoted item into a cart and make a single transaction? Do I earn Payback points

on the same?

You will earn Payback points on the non-promoted/ non-discounted item and will not earn any Payback points on the

promoted/discounted item. But in case you do apply a coupon to this cart, the coupon will be applied to the non-promoted item

thereby not allowing you to earn any Payback points on the transaction.

On viewing your cart, you will see message disclaimer indicate against items on which you can or cannot earn Payback points.

Can I redeem/earn PAYBACK points on COD (Cash on Delivery)transaction?



No, you cannot redeem/earn PAYBACK points on a COD transaction.

When will the PAYBACK points be credited into my PAYBACK account?

The eligible Payback back points earned by you will be credited into the linked PAYBACK account within 5 days of your transaction.

These PAYBACK points credited will be in a state of block and will only be released within 45 days from the date of transaction for

you to use/ redeem them.
