Introduction

Alarmed by the thousands of citations New Jersey towns were issuing each month for failure to observe traffic signals, and what appeared to be overly aggressive enforcement, StopRoboCops decided to investigate the validity of reports of reduced numbers of crashes at photo enforced intersections.

For our study, StopRoboCops reviewed the New Jersey Department of Transportation’s First, Second, and Third Annual Reports on Red-Light Traffic Control Signal Monitoring Systems. We obtained data from Raw Crash Records on the NJDOT website and verified many of the crash records using the original police investigation reports (Form NJTR-1). We reviewed hundreds documents and police crash investigation reports obtained by OPRA request from several municipalities.

StopRoboCops included all crash types in our counts that occurred on the public street within a fixed distance of the intersection center. The distance used was generally 50 feet for 25 MPH streets and up to 300 feet for others. Crashes in nearby parking lots and on ramps where excluded. Our study includes only crashes reportable to the DOT, which are those with injuries or those having more than $500 property damage.

Newark City – The First Two Intersections

At the Newark intersections where New Jersey red light cameras were born, at Broad & Market and Broad & Raymond, pedestrian accidents were up 1,100% in 2013 over the pre-camera year 2009. At these two locations, the number of pedestrians injured in accidents increased each year from just 1 in the pre-camera year to 12 in 2013. Total crashes more than doubled from 16 to 34. The majority of pedestrian injuries occurred at the intersection of Broad & Market where no right turns are permitted. See

The NJDOT concluded in their third annual Report on Red-Light Traffic Control Signal Monitoring Systems (Pg. 1, Para. 5) that crashes had decreased 86% for right angle types and 58% for rear-end crashes for these locations. Although the NJDOT crash records database contains just 2 right-angle crash records in 2009, the DOT report listed 7 right-angle crashes for the pre-camera base year. Since the pre-camera counts are inflated, the improvement percentages are bogus. Further, the DOT study omitted the numerous pedestrian accidents, which nearly always result in injuries.

Red light camera company Reflex repeats the DOT numbers in their New Jersey “safety” camera advertisements. The company’s clear implication is that the “improvement” applied statewide for all monitored intersections. In a professionally produced video, Newark City makes similar claims based on the DOT numbers: an 86% reduction in right-angle and a 42% reduction in rear-end crashes.

StopRoboCops determined that total crashes were actually up 113% in year 4 of camera operation at the two intersections. See Appendix A for a Crash Type chart and appendix B for the associated crash records table.

Newark City – Fourteen Intersections

After uncovering the discrepancies discussed above, StopRoboCops continued to compile crash data for 12 additional Newark intersections from the raw crash records database. These are exactly the same Newark intersections included in the NJDOT Third Annual Report on Red-Light Traffic Control Signal

Monitoring Systems. As with the DOT study, the one year pre-camera period and the two year with-camera period was determined separately for each location. Crash counts for each period, occurring within 50 feet of each intersection, were combined with data from the first two intersections we studied earlier.

StopRoboCops found major differences between the number of crash records contained in the NJDOT raw crash report database for these locations and the number of crashes reported in the NJDOT Report on Red-Light Traffic Control Signal Monitoring Systems. In Newark City, for example:

Analysis of the DOT raw crash data revealed that total yearly crashes increased 34% from 108 crashes in the pre-camera year to 143 and 145 crashes during each of the two years following camera installation. Same direction crashes were up 36%, from 66 crashes pre-camera to 82 and 90 in the camera monitored years. Pedestrian and pedacycle accidents were up 186%, increasing each year from 6 accidents pre-camera to 13 and 17 during the two years following camera installation. Right-angle crashes changed little from 16 in the pre-camera year, to 19 and 15 during the with-camera year. Cherry Hill

Total crashes at the intersection of Route 70 and Springdale Road in Cherry Hill increased from 32 during the pre-camera year to 40 and 38 crashes during the first and second years after camera installation. Right-angle crash numbers were basically unchanged after camera installation and StopRoboCops’ tally for this crash type was very close to the DOT report counts. The DOT report, however, contained significant over counts for same-direction crashes for the pre-camera year and under counts for the first year with the camera:

StopRoboCops verified most Cherry Hill DOT database records counted with the associated police crash investigation reports of crashes. Crashes occurring before January 2011 could be confirmed because Cherry Hill has discarded investigation reports for prior dates.

Of note is that "Hit and Run" crashes tripled. For two years prior to the installation of the Cherry Hill Township Red Light Cameras, the State DOT database lists 3 reportable "Hit and Run" crashes. In the following two years with cameras installed, hit and run crashes tripled to 9.

Deptford Township

Crashes at the Deptford intersection of Route 41 and Deptford Center Road fell from 35 during the pre-camera year to 26 crashes the second year after camera installation. This would tend to indicate safety improvement, but two years prior to the camera, just 25 crashes occurred.

Obtaining crash data for Deptford proved particularly challenging. The crash count documents we received from Deptford did not reconcile with the DOT annual reports. Also, an entire year of data is missing from the DOT raw crash records database for Deptford, so year 3 crashes could not be charted.

The problems with reporting are evident in a Deptford Police Department email to camera vendor ATS discussing problems with an entire year of data:

“The person who did the stats submitted the wrong year. I am having Diane DiMenna redo the entire year's numbers. … Sorry but too many other people got involved in this without the proper knowledge to complete this report.”

Edison Township

At the intersection of Route 1 and Plainfield Avenue in Edison, crashes in the pre-camera year totaled 89. During the first and second years after camera installation crashes totaled 104 and 81, reflecting no significant change in the frequency of crashes after camera enforcement began. Same direction crash totaled 72 in the pre-camera year increasing to 102 and 75 after camera installation. The right angle tally was 9 pre-camera then 6 and 6 in each of the next two years.

Conclusion

The StopRoboCops investigation uncovered numerous flaws in the methodology used by the New Jersey Department of Transportation to collect crash data for the camera monitored intersections. The DOT followed the state law regulating the pilot program in requesting each municipality to self-report their crash count data. The DOT, however, accepted the counts absent any supporting documentation and apparently provided limited instruction as which nearby crashes to include. The supporting documentation should have included, at minimum, the case number of each Crash Investigation Report counted. This would have permitted an audit. This counting issue is further detailed in Appendix G.

Transparency is a major issue. Under state law, only law enforcement, the courts, and the driver being cited are permitted to review videos from the red light cameras. A review of the videos may permit an understanding of the reasons for the high number of tickets written and could lead to a reduction in violations.

Another factor preventing thorough review of intersection crashes is that municipalities are permitted to discard crash reports after only 3 years, which prevents review of the pre-camera crash documents. Note that the DOT has 10 years of crash reports scanned into their document management system but by law these are not available to the public.

It is quite obvious that the frequency of crashes increased at most camera enforced intersections. Even if some safety improvement can be found, it cannot possibly justify the estimated 1.4 million citations assessing $134 million in fines at just the first 47 intersections.

StopRoboCops deems red light cameras ineffective for improving safety at intersections and finds they frequently cause intersections to become less safe. Short and Ford ask, “What other highway ‘safety’ device routinely causes more accidents?”

The Selection of Intersection Crashes and the NJDOT Annual Reports

StopRoboCops found choosing the crashes to include in our study particularly challenging. The NJDOT counted only a subset of crash types occurring “at” the intersection. Since “at” is roughly defined as the box between crosswalks, “at” would exclude the numerous nearby rear-end crashes. Given the numbers found in the NJDOT reports, it’s obvious that most towns did not limit their counts to just those crashes occurring within the box. StopRoboCops chose to chart all crash types occurring within 50 feet of the intersection center for 25 mile per hour speed limits, going up to 300 feet for higher speed approaches depending on the number of nearby crashes found.

The New Jersey statute authorizing the "traffic control signal monitoring systems" for a 5 year pilot period required the municipalities implementing such systems to prepare annual reports detailing violations and accidents at the monitored intersections. The Commissioner of Transportation must submit an annual report that includes the municipal data to the governor and others. For reasons detailed below, we believe the portions of the DOT reports based on crash counts are so seriously flawed as to be near worthless. This is primarily due to the method used for data collection:

1. The NJDOT studies rely on crash count data submitted by each participating town - Despite numerous OPRA requests for documents the towns submitted to DOT we unable to obtain a list of crash report case numbers for the crashes the towns were counting. Such lists apparently do not exist as formal documents. It’s impossible to audit a municipal crash count without knowing which crashes were counted.

2. NJDOT crash counts are not useful because the towns were not given clearly defined crash selection criteria - Each town, or more than one person in each town, determined which crashes to count for the annual reports. The decision to include a crash in the count is often subjective. Examples:

a. Should crash counts include only those occurring "AT" the intersection? The phrase "at the intersection" appears in the state law that requires the annual reports. Note though, on a crash investigation report, an investigator should check the box “At intersection with” only when a crash occurred near the center of the intersection, typically anywhere between the crosswalks. Counting only "AT" crashes would exclude the numerous rear-end and side-swipe crashes that are known to increase after camera installation.

b. If nearby crashes are to be counted, at what maximum distance from intersection? We found towns using various distances from "AT", 50, or up to 200 feet. This distance may have varied from year to year depending on the person tallying the numbers, which precludes year to year comparisons.

c. If nearby crashes are to be counted, should the count include only those occurring in the intersection approaches? Numerous crashes occur soon after vehicles pass through intersections.

d. What types of crashes should the town count? The annual report form from DOT provided for counting only a subset of the crash types listed on NJTR-1 crash investigation reports. Examples from NJTR-1: Same direction (Rear-end and side-swipe), right-angle, opposite direction (head-on and side-swipe), parked, vehicle, left turn and U-turn, pedestrian, etc.

e. The NJDOT crash count form provided to towns lists crash types not found on NJTR-1 Crash Investigation Reports. "Front", for example, is not a defined crash type.

f. If crashes near the intersection are to be counted, should those counted include only certain type crashes? Only rear-end crashes for example.

g. Should crashes during left and right turns onto or from nearby ramps and driveways be counted? High-traffic businesses frequently occupy corner locations and that traffic contributes to higher intersection crash numbers. What about a left-turning driver crashing while approaching a service station entrance within feet of the intersection?

3. In the DOT report, pedestrian accidents are buried in an "Other" category - Although pedestrians and bicyclists commonly experience injuries when involved in motor vehicle crashes, the report calculates crash severity costs by intersection without factoring in the costs for these types of crashes.

4. Crash investigators sometimes incorrectly identify the type of crash - Because the correct crash-type assignment can almost always be ascertained by examining the investigator’s crash diagram and reading his description of the event, DOT often corrects crash types when entered in their database. It's unlikely these would be corrected in the municipal counts.

5. Towns may have counted "Non-reportable crashes" for their annual reports. The NJDOT annual report assigns each PDO (property-damage-only) crash a crash severity cost of $7,400. Non-reportable crashes, however, are defined as those with no injuries and with less than $500 property damage. Note that police departments are required to routinely send investigation reports for "reportable" crashes only, which a DOT contractor then scans to a document management system. The DOT database contains no information on non-reportable crashes.

6. Why didn't the DOT use their database to perform the crash count study, or at least compare to the data submitted by the towns? We have used the raw Crash Records that DOT has posted on-line to determine crash numbers at a few of the monitored intersections. Note that in no instance did our crash counts match those published in the DOT annual red light camera reports.

7. Crash locations are often difficult to identify from crash investigation reports. This may result a town overlooking relevant crashes for annual crash counting or to include crashes that should not have been counted.

8. Crash locations are inconsistently identified on crash reports alternately using route numbers or street names. Abbreviations are often used or a location may be identified by postal address number. The street name or route number may change at the cross street. On crash reports, a single street could be known or identified by multiple names: i.e. Brunswick Pike, Brunswick Ave, US Rte. 1, Route 1. Cross streets can be particularly challenging because the crash report form contains no box to enter the route number.

9. Crash investigators often fail to enter the milepost number using NJDOT Straight Line Diagrams.
