Senate Candidate and Supreme Court Have a History In nearly every speech Ted Cruz delivers in his United States Senate campaign, he repeatedly mentions the United States Supreme Court. Whether Mr. Cruz, the former Texas solicitor general, is recalling the time he argued that a state should not have to follow an order from an international body or the brief he wrote in defense of a Ten Commandments monument on public property, Mr. Cruz’s work before the nation’s highest court during five-plus years as solicitor general has served as the cornerstone of a somewhat unorthodox campaign. Mr. Cruz worked on so many high-profile cases because he and his former boss, Attorney General Greg Abbott, set out to engage in politically charged issues. “We ended up year after year arguing some of the biggest cases in the country,” Mr. Cruz said. “There was a degree of serendipity in that, but there was also a concerted effort to seek out and lead conservative fights.” Mr. Cruz, who has never held elective office, has argued before the Supreme Court nine times, more than any practicing lawyer in Texas or any current member of Congress. Increasingly, arguing before the Supreme Court has become a specialized skill; those with previous experience before the justices are more likely to be called upon to argue before them again, said H. W. Perry, a University of Texas School of Law professor who has studied the court. “Most lawyers will go their entire life without getting close to the Supreme Court,” he said. “It really is kind of a special art.” Lt. Gov. David Dewhurst, Mr. Cruz’s opponent in the July 31 Republican Senate runoff, has dismissed Mr. Cruz’s background as inadequate training for the job of senator. “There’s a difference between being a debater and a fighter,” Mr. Dewhurst said Tuesday at a debate in Dallas. Yet Mr. Cruz has energized Tea Party groups in large part through his repeated review of Supreme Court cases in which he pushed back against the federal government or defended religious expression in the public square. Mr. Cruz, a Harvard Law School graduate, was introduced to the court in 1996 as a clerk for Chief Justice William Rehnquist. Through a stint as a private lawyer and work in President George W. Bush’s administration, he gained a reputation as a first-rate appellate lawyer. In 2002, Mr. Cruz got a call “out of the blue” from a friend about the Texas solicitor general position. In nearly every speech Ted Cruz delivers in his UnitedStates Senate campaign, he repeatedly mentions theUnited States Supreme Court. Robert Ardovino grew up within four miles of El Paso’s smokestacks — remnants of the copper smelter run byAsarco. “I experienced everything that was wrong with that company,” Mr. Ardovino said of Asarco, which in 2009settled one of the largest environmental bankruptcies in United States history, after being accused for years ofpolluting and contaminating El Paso’s air and soil. Despite that, Mr. Ardovino wants to prevent the demolition ofthe stacks. Mr. Ardovino and Gary Sapp, another El Paso resident, run the Save the Stacks movement, and they saythe smokestacks are a historic landmark. The planned demolition of the stacks is part of a state-run remediation toclean up the land Asarco occupied. The company acquired the plant in 1899, and the refinery’s smokestacks wereadded later. The taller one, built in 1967, is more than 800 feet. The other, built in 1951, is close to 600 feet. Asarco,citing economic challenges, closed the refinery in 1999. In 2002, it considered reopening the plant, but critics citedconcerns over the contamination. Analyses found high levels of lead and arsenic had leaked from the plant, and laterreports suggested the company had illegally burned toxic waste. Health and environmental concerns led to a six-yearlegal battle between Asarco and local environmental groups over whether the refinery would follow environmentalstandards. Asarco filed for bankruptcy in 2005, and reached a bankruptcy settlement of $1.79 billion in 2009. Thecompany abandoned plans to reopen the El Paso refinery. Estimates suggest it would cost $14 million to maintainthe stacks for 50 years, though that figure is based solely on the blueprint of the stacks, said Roberto Puga, thetrustee managing the remediation. Mr. Puga said that money from the remediation budget could not be diverted topreserve the stacks. As part of Asarco’s bankruptcy settlement, the state-run trust received $52 million to clean upthe site. Mr. Ardovino said Save the Stacks would conduct a cost analysis. It has until November to make its caseand raise money. If the stacks were to remain standing, they would be privately maintained, Mr. Sapp said.

“It kind of pays for itself,” he said. He suggested that if the stacks were made structurally sound, they could hostan observation deck or be the basis of a new town cultural center. Veronica Carbajal, a lawyer representing the groupEx-Asarco Workers, said the stacks may stand on a foundation of slag, a smelting byproduct harmful to theenvironment. If that is so, keeping the stacks could present a “catastrophic” environmental threat, Ms. Carbajal said.

But Mr. Sapp said destroying the stacks could produce dust that must be controlled. Because demolishing the stackswould have mitigated concerns about the foundation, the trust never conducted an environmental analysis of the site,Mr. Puga said. Save the Stacks must prove that preserving them would pose no threat, he said.

Mr. Puga stressed a need for community dialogue. “There’s people,” he said, “who are very passionate on both sidesof the debate.”
