PRESS NOTE

subject: Biennial elections to the state Legislative councils of Karnataka andMaharashtra from Graduates, and Teachers, Constituencies.

The terms of office of 9 members of the State Legislative Councils of Karnataka andMaharashtra from Graduates'and reachers' constituencies is going to expire on 30s June,and 19th luly, 2074 respectively due to the retirement of the sitting members. A statementshowing the details ofthe abovementioned seats is given in Appendix.A .

2. Therefore, for the purpose of filling up the aforementioned seats, the ElectionCommission has decided to hold biennial elections to the State Legislative Councils ofKarnataka and Maharashtra from Graduates'and Teachers, constituencies, in accordancewith the following programme :-

3. The Model code of conduct as applicable to Elections to Graduates, & Teachers,Constituencies will come into force with immediate effect in the district(s) within which the aboveConstituencies are comprised. In addition, the provisions of Model Code of Conduct and ECI instructionsapplicable to Legislative Assembly Elections, with regard to defacement of public & private properties,shall also be applicable Detailed combined instructions with regard to applicable provisions ofModel codeofConduct for these elections have been separately issued.

we have received ECr letter under reference on appticabltity of Modet code ofconduct. lt is mentloned in the said tetter that no offlcial of any rank of the districts

dealing with etection related work where the BienniaVbye- elections are being hetd shatt

be calted to attend any meeting by any Min'rster at any place, if such meetings catted by

Ministers are retated to lssues of the EducationaI lnstitutions which are constituents ofGraduates' and Teachers' constituencies. lt is atso mentioned in the [etter that no poticy

announcement or programme woutd be initiated [n the Government Departments related

to constltuents of the election under reference, ln the letter it is atso mentioned that theprovislons of Modet code of conduct and ECI instructions appticabte to Assembty

elections with regard to defacement of pubtic and private properties, shall atso be

apptlcable The District Cottectors and other Officiats have sought cLarificati.ons on certainpolnts in this regard. ln this context ptease ctarlfy on following points.

a. Distrlct Ptanning Committees (DpCs) are constituted for preparation and

lmptementatlon of the District plan and are chalred by the Guardian

Minister of the District and the District Cotlector is the Secretary of thecommittees. Whether meetings of such committees can be continued

during the said potl period if the subjects related to constituents of theetection under reference are not dlscussed?

Different other meetlngs tike, Kharif crop ptanning etc. which are chaired byPotitical functionaries are conducted and the decisions taken may influencethe constituents of the etection. lf in such cases speciftc decisions regardingGraduates,I'eachers, not taken, can conduct of such meetings .s

possibte?c. Different recruttment drives are being conducted [n which certainconstituents may be apptying for the recrultment. Looking into the ModetCode of Conduct for the said election, whether such recruitment process becontinued?

d. Different departments are effecting transfers in the month of May as per theState Act. ln the said tetter, nothing is mentioned on the transfers. So pteaseclarify on the guidetines for transfers, especiatty for electlon related officialsand constituents of the said etections.

e. The guicletines for processtng beneficiary oriented schemes for theconstituents of said etection are not given.

So please issue guldetines on above issues.
