objection letter? There will be additional charges payable towards container detention and demurrage (liner &

terminal) due to late clearance and re-delivery of the empty container to liner, attributable to the error on part of EL.

Reasonably we can except PTI responsible for the container detention & demurrage charges until 14th

of December, as

this would entail the normal clearance period. Any additional charges as from 15th

of December that come with the

Dear Ira, Option 1 is not a reasonable solution by paying fines for no fault of us. Option No. 2 doesn’t seems to be feasible either since none knows or guarantee the number of

days/weeks/months required to finalise the objection thus getting the goods released. I have some

quick remarks for the draft letter(s); Though my Indonesian language is not at all good but I don’t see anywhere reason of objection “stating

that there had been 1x Invoice missed out to be entered into the system, was an human error, didn’t do

intentionally, didn’t change total quantity/weights and Packing List + Bill of Lading still covers all the

items which customs alleged dispute as undeclared goods etc......? What I could understand from

google translate that we still insist upon that the mistake is from customs and not from us (actual EL but

in letter should be PTI being importer) knowing the fact that the invoice No. JDN/BEL-MKS/002-P was

never uploaded onto customs system/PIB. Can you please advise if such facts are stated in the letter somewhere and possibly an English translation

of the letter please? I would still prefer that the actual facts are advised to the customs and a condone/waiver of the fines is

requested thus not putting PTI in an awkward situation and also unharmed. Although, all the

technicalities (letter mentions about some legislation, regulation etc..) are well known to you therefore

ensure that letter is appropriately drafted/submitted to customs. Dear Ms Wiwin, Mr Chadi, Confirm your agreement that the letter is in line with the requirement and reasonable. Please review

the letter of protest+letter of undertaking and add your input/suggestion. Considering that the

sent is not surprising me and is exactly the same consisting of Invoice No. JDN/BEL-MKS/002-P

which was supposed to be permanently imported! Not that those items were undeclared. The

terms of import was advised to you by Karthik well in advance on 27th

2. Why are the fines/penalties @ IDR 108,159,000.00 imposed? EL response : According to

Customs, the fines are calculated from the comparison between the attached finding items and

the PIB which been reported. [Sandal Ashok] As explained at point 1 that the items were

declared by us vide our Invoice No. JDN/BEL-MKS/002-P for permanent import so fines shouldn’t

be applicable as those items are or weren’t undeclared. Should I understand that the Import

Declaration for items in Invoice No. JDN/BEL-MKS/002-P had not been entered by EL for

permanent import?

3. Hope the PPh @ IDR 5,381,000.00 wasn’t indicated in the initial Import declaration as this was

processed based only on the Temporary Imports? EL response : since the attached finding items

are not listed on temporary import approval then these items must be processed under duty

paid so import duty+wat+pph have to be paid in full [Sandal Ashok] Of course these items

weren’t part of temporary import and had been requested to be imported on Permanent basis

vide Invoice No. JDN/BEL-MKS/002-P. Attached both the Invoice No. JDN/BEL-MKS/002-P and

JDN/BEL-MKS/002-T including the instructions from Idros to import permanently and

temporarily respectively.

We don’t have issue with the import duty and taxes on permanent import which we had already

requested to do so by why fines at the tune of 100% of these amounts? Please advise if it was something wrong from our side or someone in EL had just forget to enter the
