Recommendations of the Working Group on Amendment ofAmendment of 

Child Labour (P&R) Act, 1986Definition of the ‘child’:Definition of the  child :

• existing definition of ‘child’ who has not completed 14 years of age, maycontinue.

Special Courts: • Special Courts for trying cases relating to the violation of the Child Labour

(Prohibition & Regulation) Act, so as to expedite their trial.

Compounding of first time offences: • Executive Magistrates should be given the powers to adjudicate cases

under the Act and provisions may be made under the Act for allowingcompounding of first time offences.

Action against the Traffickers:Action against the Traffickers: • Add provisions relating to trafficking of children for labour under the  Act 

to take  action against the traffickers, middlemen and agents etc. involved in these    activities.

List of extremely hazardous occupations and Processes: • Such list would dilute the effect of the existing list of hazardous

occupations and processes under the Child Labour (P&R) Act.Powers to Officers: 

• Inclusion of specific provisions under the Child Labour (P&R) Actto equip the officers with the power of search and seizure,particularly to search residential premises to detect cases ofparticularly to search residential premises to detect cases ofchildren engaged as domestic workers.

Children working at  home: 

• Children working at home with their family should not beconsidered as child labour as these children could be workingafter the school hours and under the parental guidanceafter the school hours and under the parental guidance.

Children in Agriculture Sector: • Not to include any of activities under agriculture under the hazardous
