Green Deal Finance Closureo Green Deal is not deado It is the government support to the funding of Green

Deal plans that has stopped. o This will have a significant effect on the Providers and

the Finance Company itself o Only 10,000 of the 576,000 Green Deal assessments

resulted in Green Deal Planso The drivers for the remaining 98% still exist

Private Rental Sector - New Legislation

o There is a legal obligation for as many fuel poor homes as reasonably practicable to be raised to a Band C energy efficiency rating by 2030.

o Currently only 5% of England’s 2.3 million fuel poor homes reach the Band C standard. Raising standards will cut bills significantly.

Private Rental Sector - New Legislationo The Energy Efficiency (Domestic Private Rented

Property) Order 2015 No. 799o The regulations which have been approved by

Parliament and been made into lawo They fulfil a duty in the Energy Act 2011o They will improve the energy efficiency of privately

rented properties and will mean:

Private Rental Sector - New LegislationFrom April 2016, residential private landlords will not be able to unreasonably refuse consent to a tenant’s request for energy efficiency improvements where subsidies are available to pay for them

Private Rental Sector - New Legislationo From April 2018, private domestic and non-domestic

landlords will need to ensure that their properties reach at least an ‘E’ EPC rating

o Or must have installed those improvements that could be funded using subsidies available to pay for them, before granting a tenancy to new or existing tenants

Private Rental Sector - New Legislationo Any energy efficiency improvements must be

financeable without any compulsory upfront cost to the landlord.

o These requirements will apply to all private rented properties – including occupied properties

o April 2020 - domestic sector o April 2023 - non-domestic

Deregulation Act - New Legislationo Legislation to protect tenants will increase demand

for EPCs in the private rented sector.o From 2016 landlords prevented renting properties and

that have an EPC rating of F or G. o Further piece of legislation has now been introduced

designed to prevent Landlords taking retaliatory action against tenants who request

Deregulation Act 2015

o Introduced in the House of Commons on 23 January 2014, and received Royal Assent, becoming law, on 26 March 2015.

o The Deregulation Act 2015, provides for the “removal of burdens on business, civil society, individuals, public sector bodies and the taxpayer”.

o Section 33 makes significant changes to Section 21 of the Housing Act with the intent of preventing ‘retaliatory eviction’.

Housing Act 1988 Section 21

o Section 21 of the Housing Act 1988 allows a landlord to terminate an assured shorthold tenancy giving 2 months’ notice without reason.

o The Act also allows, if certain conditions have been adhered to, to accelerate the possession and a Judge has little discretion not to grant possession.

The implications of change

o Section 33 of the Deregulation Act effectively prevent the landlord from serving a section 21 notice until the landlord has complied with the relevant legal obligations such as the;

o condition of dwellings o the health and safety of occupiers of dwellings, o the energy performance of dwellings and that information has been provided to the tenant.

When do the provisions apply?

o Sections 33 of the 2015 Act apply to assured shorthold tenancies in England granted on or after 1st October 2015.

Deregulation Act - In summary

o From October 2015 any landlord entering a short term tenancy will risk losing their right to issue an eviction notice under Section 21 if they themselves have not complied with all their legal obligations, including the provision of a current EPC.

Energy Savings Opportunity Scheme (ESOS)o New energy-saving initiative introduced in response to

the EU’s Energy Efficiency Directive.

o Applicable to “large undertakings” – oMore than 250 employees oTurnover of more than €50m (around £39.5m) and a

balance sheet exceeding €43m at 31 December 2014.
