Dear Mr. Miles,
As discussed via telephone today I am concerned that my complaint regarding unconstitutional disenfranchising ofregistered voters, violations of voters rights and other illegitimate actions by the directors of the Woodlands RoadUtility District #1 and their legal counsel may have been suppressed by officials in my county.
I ask you to delay submitting your letter of referral to the AG and afford me sufficient time to submit my complaintdirectly to you.

The saga with the RUD and alleged voter fraud is, it seems proceeding against me.

Thank you for your e-mail expressing your position that the Woodlands Road UtilityDistrict No. 1 of Montgomery County has not been allowing residents of the districtto vote in district elections. Additionally, from that conversation, I understandyou to be saying that you had provided the Montgomery County District Attorney withmaterial concerning your assertion. As you are aware, both the district attorney andMr. James Stillwell submitted complaints to our office asserting that ineligiblepersons had voted in the Woodlands Road Utility District's May 12, 2010 election. Based on our conversation, I once again reviewed the complaint the district attorneysubmitted and believe at least some of the material you submitted to the districtattorney may have been submitted with the complaint.

However, the district attorney's cover letter does not clearly reflect that thedistrict attorney's complaint included all of your documentation. Rather, thatletter principally reflects that the district attorney conducted an investigationinto the road districts May election. Accordingly, we cannot say we have beenprovided all the material you provided the district attorney. Please again note, as I stated over the phone, the Secretary of States office doesnot itself investigate elections or make conclusive determinations as to theexistence of criminal activity. When the agency receives a complaint, it is assignedto a staff attorney (myself in the case of the road district complaints), who reviewsit to see whether it suggest any potential criminal violation in connection withelections. If referred to the Office of the Attorney General, the CriminalInvestigation Section makes a determination as to whether to proceed with aninvestigation, and, ultimately whether to seek an indictment.
Lastly, you asked about interaction between our agency's general counsel and Mr.James Stillwell, the road districts attorney, who as noted above also submitted acomplaint about allegedly illegal election activity in the road district's Mayelection. Please note that I discussed this with the general counsel and he advisedme that Mr. Stillwell had questioned the general counsel on the process forsubmitting the complaint as well as the status of the complaint. The general counselexplained the process and provided a courtesy informational update on the status ofMr. Stillwell's complaint.

Peggy,
I know my voter fraud case sound a little obscure but at the crux of it is a rogue utility district that I challenged thebest way I could. I took care to see that my actions were lawful by calling the SOS elections division beforehand. After the election I took the offer of free help from a local attorney and everything has gone awry from there. I andnow my wife are now unemployed and unable to afford competent legal counsel. I did find a lawyer who hasprevailled in a similar case but he wanted $10K up front.
I am concerned that the system is going to plow me under and wondered if you or AFP can assist in finding a probono attorney conversant with Texas election law.
