American Family Radio FCC Environmental Compliance Checklist Report

Tower Type: Guyed Lattice Proposed Tower Height: 450’ Date: October 29, 2008 Site Name: Georgetown Landfill Location: Hanover, Hanover Co., Virginia KCI Project Investigator(s): Hylton Hobday and Kim Sebestyen National Environmental Policy Act (NEPA) Review Based on our review, a “YES” response was indicated to one of the questions on the Federal Communications Commission (FCC) Environmental Compliance Checklist with respect to the National Environmental Policy Act (NEPA). In accordance with the FCC regulations implementing NEPA (47 CFR 1), an Environmental Assessment was necessary for the potentially impacted resource. KCI has included the additional Environmental Assessment information in the Historic Places section of this report. A filing with the FCC will be required for their review of the Environmental Assessment of the potentially-impacted resource. Construction may not start on this site prior to the receipt of a finding of no significant impact with the FCC. This NEPA review has been prepared to address the potential adverse environmental impacts associated with the proposed action. Environmental Data Resources, Inc. (EDR) was contracted to provide the necessary background and database searches to complete the FCC Environmental Compliance Checklist. This information was provided in the EDR NEPACheck® Report located in Appendix A. The following summarizes the results of our NEPA review: 1. Designated Wilderness Areas: According to our limited literature and database research no known wilderness areas exist within the proposed project area. KCI reviewed the current listing of National Parks as provided on the National Park Service web page at www.nps.gov as well as the United States Fish and Wildlife service webpage at http://refuges.fws.gov. KCI reviewed appropriate area maps, such as U.S. Geological Survey Topographic quadrangle maps for the area (Figure 1), to locate state and federally designated lands. This information is also provided in the EDR NEPACheck® Report (Appendix A), as well as information on wild and scenic rivers. 2. Designated Wildlife Preserves: According to our limited literature and database research no known Federal wildlife preserves exist within the proposed project area. KCI reviewed the current listing of National Parks as provided on the National Park Service web page at www.nps.gov as well as the United States Fish and Wildlife service webpage at http://refuges.fws.gov. KCI reviewed appropriate area maps, such as U.S. Geological Survey Topographic quadrangle maps for the area (Figure 1), to locate state and federally designated lands. This information is also provided in the EDR NEPACheck® Report (Appendix A), along with information on officially designated wildlife preserves, sanctuaries, and refuges.

3. Listed / Proposed Threatened or Endangered Species or

Designated Critical Habitat: According to our limited literature and database research Listed Threatened or Endangered Species or Designated Critical Habitat does exist within Hanover County but was not listed within the 1-mile search radius. The EDR NEPACheck® report (which searches the EPA Endangered Species Protection Program Database, as well as the Virginia Endangered Species List provided by the VA Department of Game and Inland Fisheries) Natural Areas Map indicates the potential presence of two endangered species within Hanover County. Listed Endangered Species for Hanover County, Virginia are: bald eagle (bird) and dwarf wedge mussel (clam). KCI contacted the Commonwealth of Virginia Department of Conservation and Recreation (DCR) and the U.S. Fish and Wildlife Service, Virginia Field Office (USFWS) in writing to request comment on the proposed undertaking and its effect on listed/proposed threatened or endangered species and their critical habitat. A copy of the DCR response letter is included as Appendix B. In the DCR letter dated May 8, 2008, it is stated that the “Biotics (data system) historically documents the presence of natural heritage resources in the project vicinity. However, due to the scope of the activity and the distance to the resources, we do not anticipate that this project will adversely impact these natural heritage resources.” It is further stated that “the current activity will not affect any documented state-listed plants or insects.” The DCR files do not indicate the presence of any State Natural Area Preserves under DCR’s jurisdiction in the project vicinity. The response letter from the USFWS dated July 16, 2008, stated that “based on the project description and location, the Service believes this project is not likely to adversely affect any federally listed or proposed species or their designated critical habitat” (Appendix B). In addition to the letters received from the agencies, site conditions and the fieldview did not indicate habitat for the species listed in the EDR report. 4. Historic Places: KCI Technologies, Inc., (KCI) on behalf of Hanover County Department of Emergency Communications and American Family Radio, carried out the cultural resources compliance portion of this project in March 2008. The proposed tower site is located in a wooded area on two lots at the former landfill on Georgetown Road, south of the town of Hanover. The project proposes the construction of a 450-foot guyed lattice tower and accompanying equipment compound to be located within a new 100-foot by 100-foot lease area. Access to the site will be made from a proposed drive off of the former landfill driveway. This tower is part of a multi-tower project creating an integrated system that will provide coverage for the 911 emergency system in Hanover County. The Georgetown facility will house emergency 911 telecommunications relay equipment. Locations for the placement of the system’s towers and equipment were studied by Hanover County. Physical locations for proposed towers were chosen by Hanover County and the system design vendor (Motorola) to meet the County’s overall system coverage requirements.

In order to assess the effects of the proposed telecommunications tower construction project on properties listed in or determined eligible for listing in the National Register of Historic Places (NRHP), KCI determined an Area of Potential Effect (APE) for visual effects following the guidelines detailed in the Nationwide Programmatic Agreement (PA) on tower construction dated March 7, 2005. Based on the PA’s guidelines, KCI observed an APE for Visual Effects with a radius of 1 ½ -miles centered on the proposed tower location to assess the effects of the proposed tower construction on architectural resources. KCI assessed the effects of the proposed tower on architectural and archaeological resources in the FCC Form 620 New Tower Packet (see Appendix C) and determined that the proposed tower would have an adverse effect on the National Register Eligible Hanover Courthouse Battlefield. KCI determined that there were no effects to archaeological resources at this tower site. Information pertaining to the proposed tower was forwarded to the National Park Service (NPS) and to the Hanover County Historical Society (HCHS) for their consideration. A response was received from the NPS noting that the proposed tower would have an adverse effect to the Hanover Courthouse Battlefield. No response was received from the HCHS. In addition, information was publicized on the Hanover County government website as well as at public meetings, which were held on January 15 and 16. Comment forms, which included questions regarding impacts to historic resources, were provided at the meetings. No comments regarding historic resources were received for the proposed Georgetown tower. FCC Form 620 was submitted to the Virginia Department of Historic Resources (VA DHR) on May 12, 2008 detailing the results of the investigation for the proposed telecommunications facility. A letter was received by KCI, dated June 6, 2008 concurring with the determination of Adverse Effect to the Hanover Courthouse Battlefield. A joint Memorandum of Agreement (MOA) for the Georgetown tower and the Ellerson tower (Cold Harbor Road) was developed among the FCC, the VA DHR, and the Hanover County Department of Emergency Communications. The Advisory Council on Historic Preservation replied on August 7, 2008 that it did not wish to be involved in the consultation for this MOA. The MOA was signed by all signatories by October 8, 2008 and by one concurring party on October 9, 2008. A copy of this information is provided in Appendix C. 5. Indian Religious Sites: Initial tribal notification was submitted through the FCC’s Tower Construction Notification System (TCNS) on March 17, 2008. The TCNS (#37133) identified five potentially interested tribes: the Tuscarora Nation, the Shawnee Nation, the Cherokee Nation, the Eastern Shawnee Tribe of Oklahoma, and the Catawba Indian Nation. In accordance with stated procedures, information packets were forwarded to interested tribes. The Tuscarora Nation noted in the TCNS Notice of Organizations that if the applicant did not receive a response within 30 days that they were not interested in consulting on the site. The Tuscarora has not responded as of September 25, 2008. The Shawnee Tribe replied on April 11, 2008 that they feel that no known historic properties will be negatively impacted by the construction of this tower. The Cherokee Nation responded on April 30, 2008 that they do not know of any cultural sites within the area. The Eastern Shawnee Tribe of Oklahoma replied on April 18, 2008 that they have no objections to the proposed tower. The Catawba Indian Nation responded on April 28,

2008 that they have no immediate concerns with any Native American sites within the project area. A copy of this information is included in Appendix C. Should cultural materials be uncovered during the course of construction, construction will be ceased, and the Virginia Department of Historic Resources will be notified immediately. 6. Floodplains: The search conducted by EDR, which included a review of the Federal Emergency Management Agency (FEMA) database, indicated that the facility is located in an area where electronic FEMA flood data was not available. A copy of the EDR NEPACheck® report is located in Appendix A. A review conducted by KCI of the FEMA FIRM maps at http://map1.msc.fema.gov indicated that the site is in Zone C, which are areas of minimal flooding and are outside the 100-year and 500-year flood zones. 7. Surface Features: Our limited literature and records search and on-site observations, indicate that the construction of the proposed communications compound at this site will not involve a significant change (wetland fill, deforestation, or water diversion) in surface features. According to National Wetland Inventory (NWI) mapping, the closest wetland areas are approximately ⅓-mile to the northeast and ½-mile to the southeast of the proposed subject site. The boundaries of these wetlands have been identified and the design of the proposed facility will avoid wetland impacts. The EDR NEPACheck® contains NWI mapping for the project area (Appendix A). An unnamed intermittent stream was identified approximately 800 feet to the west/southwest of the proposed tower site. This stream drains to a tributary of Crump Creek. Based on our site visit, construction of the site will not require surface water diversion. 8. Zoning / High Intensity White Lights: According to the site plans, no high intensity lighting will be installed at this site. 9. Radiation Exposure: Based on information provided by American Family Radio, this site will not exceed the FCC’s RF emissions exposure limits for building mounted antennas. Summary KCI obtained, reviewed, and evaluated information currently available form the client and local, state and federal databases searched by EDR and presented in the EDR NEPACheck® report. KCI’s conclusion, opinions, and recommendations are based, in part, on this information. KCI’s services did not include verification of the accuracy or authenticity of this information. KCI determined that one of the nine questions on the FCC Environmental Compliance Checklist had a “YES” answer. Therefore, and Environmental Assessment of the potentially-impacted resource was necessary. KCI has included the additional Environmental Assessment information in the Historic Places section of this report. Based on the results of the FCC Environmental Compliance Checklist, a filing with the FCC will be required for their review of the Environmental Assessment of the potentially-impacted resource. Construction may not start on this site prior to the receipt of a finding of no significant impact with the FCC.

National Wetland Inventory Maps are produced by the U.S. Fish and Wildlife Service, a sub-department

of the U.S. Department of the Interior. In 1974, the U.S. Fish and Wildlife Service developed a criteria for

wetland classification with four long range objectives:

· to describe ecological units that have certain homogeneous natural attributes,

· to arrange these units in a system that will aid decisions about resource management,

· to furnish units for inventory and mapping, and

· to provide uniformity in concepts and terminology throughout the U.S.

High altitude infrared photographs, soil maps, topographic maps and site visits are the methods

used to gather data for the productions of these maps. In the infrared photos, wetlands appear as

different colors and these wetlands are then classified by type. Using a hierarchical classification,

the maps identify wetland and deepwater habitats according to:

· system

· subsystem

· class

· subclass

· modifiers

(as defined by Cowardin, et al. U.S. Fish and Wildlife Service FWS/OBS 79/31. 1979.)

The classification system consists of five systems:

1. marine

2. estuarine

3. riverine

4. lacustrine

5. palustrine

The marine system consists of deep water tidal habitats and adjacent tidal wetlands. The riverine

system consists of all wetlands contained within a channel. The lacustrine systems includes allnontidal wetlands related to swamps, bogs & marshes. The estuarine system consists ofdeepwater tidal habitats and where ocean water is diluted by fresh water. The palustrine system

includes nontidal wetlands dominated by trees and shrubs and where salinity is below .5% in tidal

areas. All of these systems are divided in subsystems and then further divided into class.

National Wetland Inventory Maps are produced by transferring gathered data on a standard 7.5

minute U.S.G.S. topographic map. Approximately 52 square miles are covered on a National

Wetland Inventory map at a scale of 1:24,000. Electronic data is compiled by digitizing these

National Wetland Inventory Maps.

Introduction

The NT Submission Packet is to be completed by or on behalf of Applicants to construct new antenna support structures by or for the use of licensees of the Federal Communications Commission (“FCC”). The Packet (including Form 620 and attachments) is to be submitted to the State Historic Preservation Office (“SHPO”) or to the Tribal Historic Preservation Office (“THPO”), as appropriate, before any construction or other installation activities on the site begin. Failure to provide the Submission Packet and complete the review process under Section 106 of the National Historic Preservation Act (“NHPA”)1 prior to beginning construction may violate Section 110(k) of the NHPA and the Commission’s rules.

The instructions below should be read in conjunction with, and not as a substitute for, the “Nationwide Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings Approved by the Federal Communications Commission,” dated ______, 2004, (“Nationwide Agreement”) and the relevant rules of the FCC (47 C.F.R. §§ 1.1301-1.1319) and the Advisory Council on Historic Preservation (“ACHP”) (36 C.F.R. Part 800).2

Exclusions and Scope of UseThe NT Submission Packet should not be submitted for undertakings that are excluded from Section 106 Review. The categories of new tower construction that

are excluded from historic preservation review under Section 106 of the NHPA are described in Section III of the Nationwide Agreement.

Attachment 2. Additional Site Information

Hanover County Planning Department proposes to construct an emergency services communications tower facility on Georgetown Road, Hanover County, Virginia (Attachment 12: Figures 1 and 2). KCI Technologies, Inc., (KCI) on behalf of Hanover County, carried out the cultural resources compliance portion of this project in March 2008. This facility will house emergency 911 telecommunications relay equipment and will provide coverage for the 911 emergency system in Hanover County.

The proposed tower site is located in a wooded area on two lots at the former landfill on Georgetown Road, south of the town of Hanover (Attachment 11: Plates 1-4). The project proposes the construction of a 450-foot guyed lattice tower and accompanying equipment compound to be located within a new 100-foot by 100-foot lease area (Attachment 12: Figure 2). Access to the site will be made from a proposed drive off of the former landfill driveway.

Attachment 3. Tribal Involvement

Tribal notification was initiated by the inclusion of the proposed site information on the Antenna Structure Registration page of the FCC website, utilizing the Tower Construction Notification System (TCNS). Notification of the proposed tower was forwarded to potentially concerned Native American tribes that were identified through the TCNS. Tribes that were notified of this proposed tower site were the Tuscarora Nation, the Cherokee Nation, the Eastern Shawnee Tribe of Oklahoma, the Catawba Indian Nation, and the Shawnee Tribe. Replies were received from these tribes noting that there are no tribal concerns at this tower. Please see Appendix A.

Attachment 4. Local Government

a. The tower will serve the Hanover County government through its emergency 911 services. Hanover County has been involved in the development process of this tower and has provided comments concerning historic resources. Please see Appendix B.

b. No additional local government consultation has been sought.

Attachment 5. Public Involvement

Public meetings were held on January 15 and January 16, 2008. Advertisements for the meetings were placed in the Hanover Herald-Progress on January 3 and 10 and in the Mechanicsville Local on January 2 and 9. A notice for the meeting was also posted on the Hanover County government website (www.co.hanover.va.us). The public was asked, among other subjects, to note any concerns involving historic resources at the proposed tower sites. No comments were received for this tower site. Please see Appendix C.

Attachment 7. Areas of Potential Effects `

a. KCI investigated the proposed construction footprint, defined as the APE for Direct Effects, for historic properties.

b. In order to assess the effects of the proposed telecommunications tower construction project on properties listed in or determined eligible for listing in the National Register of Historic Places (NRHP), KCI determined an Area of Potential Effect (APE) for visual effects following the guidelines detailed in the Nationwide Programmatic Agreement (PA) on tower construction dated March 7, 2005. Based on the PA’s guidelines, KCI observed an APE for Visual Effects with a radius of 1 ½ -miles centered on the proposed tower location to assess the effects of the proposed tower construction on architectural resources.

a. A search of the Virginia SHPO, Virginia Department of Historic Resources, files found a total of eighteen previously identified resources in the visual APE (Table 1). The visual APE consists of the rural area near the town of Hanover. The Chickahominy River runs through the south portion of the visual APE. Structures in the area consist of nineteenth and twentieth century residential as well as some areas of modern housing developments. The tower is located within the boundaries of the Hanover Courthouse Battlefield and the visual APE extends into the northern portion of the Totopotomoy Battlefield. The tower is located on a former landfill utilized during the 1960s and 1970s.

b. At the time of writing, no historic properties had been identified through comments of Indian tribes, local governments, or members of the public.

Attachment 9. Historic Properties Identified in the APE for Direct Effects

a. A search of archeological and architectural site records at the Virginia Department of Historic Resources found one historic property, the Hanover Courthouse Battlefield (042-5019), located in the APE for direct effects.

b. No historic properties were found in the APE for direct effects.

c. The APE for direct effects is located in a wooded area within the former landfill on Georgetown Road (Attachment 11: Plates 1-4; Attachment 12: Figure 2). The property has a varying topography, although the tower compound is located on a relatively flat area. The proposed tower center is not located in close proximity to any perennial stream. Vegetation on the property consists mainly of evergreen trees approximately 30 years old and scrub brush.

Shovel tests were placed within the proposed tower compound and along the proposed access road. Field survey methods followed VDHR guidelines for archaeological investigations at the Phase I-reconnaissance level (VDHR 1999). The direct APE was investigated through pedestrian survey and systematic shovel testing. The soil matrix was screened through ¼” mesh hardware cloth to recover potential cultural material. All shovel tests were excavated at least 10cm into sterile subsoil.

No shovel tests were placed in the area of the tower center and compound due to previous disturbances. The tower center and compound are located in a clearing formerly used as part of the landfill. Subsoil and gravels are visible on the ground surface and numerous push piles are located on the north and south sides of the clearing. Hanover County employee Steve Chidsey indicated that on portions of the property trench filling was used

to dispose of garbage in the 1960s and 1970s (personal communication March 2008). Soil was taken from trenches and pushed into piles, which were later used to fill the garbage trenches. It is likely that the disturbances in this area are related to the trenching activities. The area of proposed new access road also lies within the disturbance and no shovel tests were placed there.

Six shovel tests were placed at the points of contact for the tower’s guy wires. Five of the guy wire points exhibited soils that appeared to be intact; the sixth displayed disturbed soils similar to those in the clearing. The intact shovel tests all exhibited a profile of approximately 20-30 cm of olive brown (2.5Y6/6) sandy loam over a strong brown (7.5YR5/8) sandy clay. Three of the STPs also had 6-9 cm of organic dark yellowish brown (10YR4/4) sandy loam at the surface. No artifacts were recovered from these STPs. STP #5, located at the guy point to the north of the compound, was located within the same disturbance as the tower center.

Based on the negative results of shovel testing and the location of this proposed tower within a former landfill, no further archaeological work is recommended.

Attachment 10. Effects on Identified Properties

A search of the Virginia Department of Historic Resources files found three NRHP-Listed or Eligible historic properties in the visual APE, Hanover Wayside Park (042-0286), Spring Hill (042-0553), and the King House (042-0782), and two potentially eligible properties, Hanover Courthouse Battlefield (042-5019), and the Totopotomoy Battlefield (042-5022). Oak Level (042-0554) is no longer standing.

The proposed tower is located on the Hanover Courthouse Battlefield (042-5019), which is potentially eligible for listing in the NRHP according to DHR files (Plates 9-10). Lands located on this battlefield are mainly privately owned. The Hanover Courthouse Battlefield has been rated a Class C, Priority III.3 battlefield by the Civil War Sites Advisory Commission (CWSAC 1993). The proposed tower site is located within a former landfill (1960s-70s) on Georgetown Road at the southeastern tip of the battlefield, south of Route 301. The VDHR form notes that “Route 301 south of this intersection [Rt.657, US 301, Rt. 651] is not historic and bisects the main field of fighting. The intersection supports a clutter of commercial buildings”. Several commercial buildings are located at the intersection of Routes 301, 657, and 651 (Crosses Corner) including an abandoned mini-market and two motels (Plates 21-24), and modern (21st century) residential and commercial structures are located within the Visual APE along Route 301 (Plates 23-24). Civil War Sites Advisory Commission maps available at DHR show limited troop movements south of Route 301. The area of the proposed tower site and the area south of Route 301 does not convey the setting, feeling or association of a Civil War battlefield and is not designated in any way by monuments or markers.

The tower will, however, likely be visible from the core area of fighting, which is located between Route 301 and the railroad especially near the intersection of Route 657 and 649 (Plates 11-13). It is KCI’s recommendation that the proposed tower will have an Adverse

Effect on the Hanover Courthouse Battlefield (042-5019) (Plate 25). However, due to the commercial buildings at the intersection of Routes 301, 651, and 657, new housing developments, and a new church complex at the intersection of Routes 301 and 649 (Plates 26-27), the area that will be most affected by the proposed tower lies between Route 657 and the railroad tracks, centered at the intersection with Route 649.

The Totopotomoy Battlefield (042-5022) is located approximately ¾-mile south of the proposed tower site (Plate 14-15). According to DHR files, the battlefield is considered potentially eligible for listing in the NRHP and has been rated a Class B, Priority IV.1 by the Civil War Sites Advisory Commission (CWSAC 1993). The northern tip of the battlefield is located within the Visual APE and intersects with the Hanover Courthouse Battlefield near Kersey Creek. This area is heavily vegetated and is located in a ravine with lower elevation than the proposed tower site (Plate 28-29). It is likely that, due to the topographical changes and the heavy vegetation, even in the winter months the tower will not be visible from the northern tip of the battlefield. It is likely that the tower will be visible from portions of the battlefield located south of the Kersey Creek wooded area; however, this area has numerous modern housing developments both inside and along the borders of the battlefield (Plates 30-31). The Oak Knoll Middle School and Hanover High School are located in the northwest portion of the battlefield (Plates 32-33). Due to these modern intrusions, topographical changes, heavy vegetation, and the minimal intrusion of a guyed tower, it is KCI’s opinion that the proposed tower will have NoAdverse Effect on the Totopotomoy Battlefield.

Oak Level (042-0554) is located approximately ½-mile west of the proposed tower site. DHR files note that Oak Level is considered eligible for listing in the NRHP; however, a site visit revealed that the house and most of the outbuildings have been destroyed (Plate 16). A standing chimney, cemetery, and shed mark the area where the house stood. Therefore, it is KCI’s opinion that the proposed tower will have No Effect on Oak Level.

The King House (042-0782), located approximately ½-mile south of the proposed tower location, is considered Eligible for listing in the NRHP. The property is located at the end of a long driveway inside the woodline, and KCI did not have access to the house (Plate 17); however, a photo-simulation was created by Hanover County showing that the tower is not visible from the house due to vegetation surrounding the property (see Appendix B). It is also likely that topographical differences between the house and the tower will obscure all or most of the tower during times of the year when the vegetation is lighter (Plate 34). It is KCI’s opinion that the proposed tower will have No AdverseEffect on the King House (042-0782).

Hanover Wayside Park (042-0286) is located approximately 1.3 miles southwest of the proposed tower site (Plates 18-19) and is currently owned and maintained by Hanover County Parks and Recreation Department. The park consists of a wetland area and former dam, picnic areas, a veteran’s memorial, and a caretaker’s house and garage. Portions of the park lie behind tree cover and portions of the wetland area lie at a lower elevation with tree cover. The proposed tower will likely not be visible from these areas of the park. A former landing strip is located adjacent to the north of the park so it is

likely that the tower will be visible from northern portions of the park, including the caretaker’s house, through this open space (Plates 35-36). Therefore, it is KCI’s opinion that the proposed tower will have an Adverse Effect on Hanover Wayside Park.

Spring Hill (042-0553) is considered Eligible for listing in the NRHP and is located approximately 1.5 miles northeast of the proposed tower site (Plate 20). Due to distance, topography, and the amount of vegetative cover surrounding the house, it is likely that the proposed tower will not be visible from Spring Hill (Plate 37). Therefore, it is KCI’s opinion that the proposed tower will have No Adverse Effect on Spring Hill.
