ADMINISTRATIVE SETTLEMENT AGREEMENT AND ORDER ON CONSENT FOR REMEDIAL INVESTIGATIONS AND FEASIBILITY STUDIES

FOURTH MODIFICATION OF SETTLEMENT AGREEMENT

This Administrative Settlement Agreement and Order on Consent ("Settlement Agreement") was signed by The Peoples Gas Light and Coke Company ("Respondent") on October 13, 2008 and by the United States Environmental Protection Agency ("U.S. EPA") on October 31 , 2008 and has been modified since then. The Settlement Agreement requires the Respondent to conduct a Remedial Investigation and Feasibility Study at various locations in Chicago, Cook County, Illinois. Two of the locations are the North Shore Avenue Site and the Willow Street/Hawthorne Avenue Station Operable Unit ("OU"), which is part of the No1th Branch Site. The North Shore A venue Site is bounded to the north by recently-constructed single family homes, to the west by the Nmth Shore Channel of the Chicago River system, to the south by residential properties, and to the east by property owned by the Chicago Board of Education. The No1th Shore Avenue Site also includes adjacent areas of the North Shore Channel.

Under this Modification, U.S. EPA is splitting the Willow Street/Hawthorne Avenue Station OU into two portions: the Willow Street OU and the Hawthorne Avenue Station OU. The Hawthorne A venue Station OU is bounded on the n01thwest by Wisconsin Street, on the northeast by Marcey Street, on the southeast by Willow Street and on the southwest by the North Kingsbury Street.

North Shore A venue Site is depicted in Attachment 1 and the Hawthorne A venue Station Operable Unit of the North Branch Site is depicted in Attachment 2. Based on a review of existing data, U.S. EPA has determined that no further remedial or investigatory activities by U.S. EPA are planned or anticipated to be needed on the upland area of the North Shore Avenue Site (depicted in Attachment 1) and on the Hawthorne Avenue Station OU. Therefore, pursuant to this Modification, the upland area of the North Shore A venue Site is removed from the Settlement Agreement and the Hawthorne Avenue Station Operable Unit is removed from the definition of the North Branch Site and so neither will be subject to the terms and conditions of this Settlement Agreement and are not to be considered as covered by the Settlement Agreement. The areas identified above will be addressed, if needed, under the State of Illinois Voluntaiy Program.
