DRUG/ALCOHOL EDUCATION & TESTING POLICY

JULY 1, 2018

1. Introduction

The following policy has been adopted and shall be administered by the University of Charleston

Department of Athletics. The University of Charleston (UC) reserves the right to make changes to

this policy as needed, and this policy should not be construed to create a contract between a student-

athlete and the University of Charleston. Further, the provisions of this policy do not alter, amend,

or supersede the Student Rights and Responsibilities set out in the Student Handbook or its

associated judicial process. Please note, this policy represents the University of Charleston

substance abuse/testing policy, which is separate and distinct from the NCAA drug- testing program

(including all sanction phases). Information regarding the NCAA drug-testing program is available

at www.ncaa.org.

The University of Charleston is concerned with the health, safety, and welfare of the student-athletes

who participate in its programs and represent the college in competitive athletics. Substance abuse

is one of the most important issues facing athletics and society today. The use of illegal drugs,

misuse of legal drugs and dietary supplements, use of performance-enhancing substances, use of

alcohol and inappropriate use of tobacco is inconsistent with the standards expected of student-

athletes at the University of Charleston. Substance use and abuse in sport can pose risks to a student-

athlete’s health/safety and negatively affect his/her academic and athletic performance. Substance

use and abuse in sport may also compromise the integrity of athletic competition and the ideals of

the University of Charleston.

For the purposes of this policy, “student-athlete” shall mean any student at the University of

Charleston who participates in any UC Department of Athletics sponsored sporting event and/or

practice and/or is a member of any UC Department of Athletics sponsored team.

2. Purpose

The UC Department of Athletics believes that random drug testing and testing based on reasonable

suspicion are appropriate to ensure the health, safety and welfare of our student-athletes, to promote

fair competition in intercollegiate athletics, to affirm compliance with applicable rules and

regulations on drug and alcohol abuse, to identify student-athletes who are improperly using drugs

or alcohol and to assist them before they harm themselves or others. Furthermore, the Department

of Athletics recognizes its responsibility to provide educational programming to student-athletes

that will support a positive decision-making process.

The intent of these policies is to prevent substance use and abuse by student-athletes through

education, testing, and professional guidance.

a) Education – providing student-athletes and athletic staff with accurate information about the

problems associated with substance use in sport and promoting health and safety in sport;

b) Testing – analyzing biological specimens to detect prohibited substances student-athletes may

introduce to their bodies and associated sanctions resulting from use detailed in this policy; and

c) Professional Referral – facilitating appropriate treatment and rehabilitation of student-athletes.

3. Alcohol, Tobacco and Other Drug Education

Participants who are educated about substance use in sport are more likely to make informed and

intelligent decisions about usage. The University of Charleston will conduct a drug and alcohol

education program for student-athletes at least twice a year. These educational programs will be

designed to review athletic department, institutional, conference and national governing body

policies related to alcohol, tobacco, and other drugs. Appropriate educational materials will be made

available to participants including this policy and a list of NCAA banned substances. All student-

athletes and athletics staff members are required to attend. Make-up sessions are available for

participants who must miss a scheduled educational session for an approved reason. In addition to

educating student-athletes and athletics staff about the various policies, a review of the institutional

drug-testing program will be conducted. Dietary supplements and their inherent risks will be

discussed. Time will be allowed for questions from participants. Also, special educational programs

may be arranged to provide participants the opportunity to learn more about the dangers of specific

substances.

4. Consent to Participate

As a condition of participation in intercollegiate athletics at the University of Charleston, each

student-athlete will be required to sign a consent form agreeing to undergo drug and alcohol testing

and authorizing the release of test results in accordance with this policy (See Appendix A). Failure

to consent to or to comply with the requirements of this policy may result in suspension from

participation or termination of eligibility to participate in intercollegiate athletics at the University

of Charleston. Each student-athlete annually will be given a copy of the institutional

policy and will be required to participate in an informative session describing alcohol, tobacco and

other drug education and testing policies. Additionally, student-athletes will be given an opportunity

to ask any questions regarding the information contained in the policy, the testing program, or other

related issues before signing the drug-testing consent form.

5. Dietary Supplements

University of Charleston Department of Athletics personnel will not distribute or encourage the use

of any dietary supplements or ergogenic aids. Many dietary supplements or ergogenic aids contain

banned substances. Often the labeling of dietary supplements is not accurate and is misleading. Terms

such as “healthy” or “all natural” do not necessarily mean that dietary supplements do not contain

a banned substance or are safe to take. Using dietary supplements may cause positive drug tests.

Student-athletes who are currently taking dietary supplements or intend to take any are required to

review the product with the Head Athletic Trainer and/or Assistant Athletic Trainer assigned to

their sport. Student-athletes are solely responsible for any substance that they ingest. All student-

athletes are encouraged to use the Drug-Free Sport Resource Exchange Center (REC) to obtain

current and accurate information on dietary supplements or ergogenic aids. All inquiries to the REC

are confidential. The Resource Exchange Center may be accessed at www.drugfreesport.com/REC/.

By signing the University of Charleston Drug/Alcohol Education & Testing Policy Consent Form

(Appendix A), the student-athlete:

a) Acknowledges that he/she understands that they are to disclose all dietary supplements and/or

prescriptions used to the Head Athletic Trainer and/or Assistant Athletic trainer assigned to

their sport;

b) Acknowledges the aforementioned policies and statements, and fully accepts the detrimental

and possibly permanent defects caused by the use of dietary supplements;

c) Fully accepts that they have been made aware of the University of Charleston and the National

Collegiate Athletic Association (NCAA) policies with regard to the use of dietary supplements;

d) Accepts any and all consequences if they have in the past used, continue to use, and/or use at

any time in the future, dietary supplements in any form; and releases the University of

Charleston, its agents, and all personnel of any and all responsibility and liability related to such

use.

e) Authorizes the University of Charleston to contact the parents and /or legal guardian of the

student-athlete in the event the student-athlete violates this policy.

6. Prohibited Drugs/Substances

The drug and/or alcohol screening process may include analysis of, but is not limited to, the NCAA

list of banned-drug classes. For an ongoing updated listing of the banned-drug list view the NCAA’s

website at www.ncaa.org. Prohibited substances that the University of Charleston may screen for

include, without limitation, alcohol (in any sport), marijuana, PCP, opiates, MDMA (Ecstasy),

amphetamines/methamphetamines, cocaine, and anabolic steroids. University

of Charleston reserves the right to test for substances not contained on the NCAA banned-drug

list and may test at cut off levels that differ from the NCAA program.

7. Specimen Analysis

The drug and/or alcohol screening process may include, but is not limited to, the following

biological specimen collection methods:

a) Urine Testing. The collection process and protocol will be administered by Reliant Drug

Testing Solutions, or such other third-party provider as the University may designate from time

to time.

8. Selected Types of Drug Testing

a) Unannounced Random Testing: All student-athletes who have signed the institutional drug-

testing consent form and are listed on the institutional squad list are subject to unannounced

random testing any time during the academic year. The selection of the students for these

random tests will be completed in the same way as NCAA testing. The dates of the testing will

be determined by the Director of Athletics and communicated only to the testing personnel. The

testing personnel will select the athletes using a computerized random number program from a

list submitted to them by the Administrative Assistant for the Dept. of Athletics. The

Administrative Assistant for Athletics will then notify the student-athletes to be tested with the

dates and the times of testing.

b) Pre-season Screening: Student-athletes are subject to pre-season drug testing as a team and may

be notified of such by the Director of Athletics or her designee at any time prior to their first

competition of the season.

c) Reasonable Suspicion Screening:

1) A student-athlete may be subject to testing at any time when the Director of Athletics or

his/her designee determines there is individualized reasonable suspicion to believe the

participant is using a prohibited drug (Appendix B). Such reasonable suspicion should be

based on objective information as determined by the Director of Athletics or by an

Associate/Assistant Athletic Director, Head Coach, Assistant Coach, Head Athletic

Trainer, Assistant Athletic Trainer, the Team Physician, or the Vice President for Student

Development and deemed reliable by the Director of Athletics or her designee. Anyone

outside of the Department of Athletics who has reasonable suspicions should contact the

Dean of Students or the Director of Athletics.

2) Reasonable suspicion may include, without limitation, 1) observed possession or use of

substances appearing to be prohibited drugs, 2) arrest or conviction for a criminal offense

related to the possession or transfer of prohibited drugs or substances, or 3) observed

abnormal appearance, conduct or behavior reasonably interpretable as being caused by the

use of prohibited drugs or substances. Among the indicators which may be used in

evaluating a student-athlete’s abnormal appearance, conduct or performance are: class

attendance, significant GPA changes, athletic practice attendance, increased injury rate or

illness, physical appearance changes, academic/athletic motivational level, emotional

condition, and/or mood changes.

3) If suspected, the Director of Athletics or her designee will notify the student-athlete and

the student-athlete must stay with a member of their coaching staff, the athletics

administration staff, or the sports medicine staff until an adequate specimen is produced.

Note: The possession and/or use of illegal substances may be determined by means other

than urinalysis. When an individual is found to be in possession and/or using such

substances, he/she will be subject to the same procedures that would be followed in the

case of a positive urinalysis.

d) Postseason/Championship Screening: Any participant or team likely to advance to postseason

championship competition may be subject to additional testing. Testing may be required of all

team members or individual student-athletes at any time within thirty (30) days prior to the

post-season competition. If a student-athlete tests positive, he or she will not be allowed to

compete at the post-season event and will be subject to the sanctions herein.

e) Re-entry Testing: A student-athlete, who has had his or her eligibility to participate in

intercollegiate sports suspended as a result of a drug or alcohol violation, may be required to

undergo re-entry drug and/or alcohol testing prior to regaining eligibility. The Director of

Athletics or her designee shall arrange for re-entry testing after the Team Physician involved in

the student-athletes case indicates that re-entry into the intercollegiate sports program is

appropriate.

f) Follow-up Testing: A student-athlete who has returned to participation in intercollegiate sports

following a positive drug test under this policy may be subject to follow-up testing. Testing will

be unannounced and will be required at a frequency determined by the Director of Athletics or

her designee in consultation with the counselor or specialist involved in the student- athlete’s

case.

9. Notification and Reporting forCollections

The student-athlete will be notified of and scheduled for testing by the institution. Notifications of

testing shall consist of an electronic mail notification and/or phone call by the Administrative

Assistant for Athletics or his/her designee. In addition, the Administrative Assistant for Athletics

will notify the student-athlete of the date and time to report to the testing station and will have the

student-athlete read and sign the Student-Athlete Notification Form (See Appendix C).

The Director of Athletics or her designee will be in the testing station to certify the identity of the

student-athletes selected. Student-athletes shall provide picture identification when entering the

drug-testing station. The Director of Athletics or her designee must remain in the collection station

until all student-athletes complete the collection process.

ALL COLLECTIONS AND/OR TESTING UNDER THIS POLICY SHALL BE OBSERVED

COLLECTIONS.

10. Laboratory Analysis/Reporting Results

Urine samples will be collected and sent to an independent SAMHSA and/or World Anti-Doping

Agency-approved laboratory for analysis. Any laboratory engaged for the testing of performance

enhancing drugs/agents will be required to abide by the World Anti-Doping Agency code of ethics

as it relates to the testing of samples. University personnel are strictly prohibited from sending any

sample to any laboratory for the sole purpose of monitoring an athlete in order to circumvent a

positive drug test under this policy.

Each sample will be divided into two specimens, the first to be tested in accordance with this policy,

and the second to be retained in case further testing is requested.

If the laboratory reports a specimen as substituted, manipulated or adulterated, the student-athlete

will be deemed to have refused to submit to testing and treated as if the test were positive for a

banned substance.

a) Notification of a Positive Test: The student-athlete will be notified of a positive result by the

Medical Review Officer (MRO) and University personnel.

b) Notification of a Dilute Sample: The laboratory retained by the University will notify the

designated University personnel of a diluted sample result by any student. The student-athlete

will be notified that diluted sample is considered a positive result and will face the same

sanctions that are administered for a positive result.

c) Request for additional testing: Student-athletes who test positive for a banned substance by the

laboratory retained by the University may, in writing and within 48 hours following receipt of

notice of the laboratory finding, contest the finding. Upon the student-athlete’s request for

additional testing of the original sample, the Director of Athletics will formally request the

laboratory retained by the University to perform testing on specimen B of the original sample.

Student-athletes may be present at the opening of Specimen B at their own expense. If specimen

B results are negative, the drug test will be considered negative. A positive test would confirm

the Specimen A results. Specimen B findings will be final.

d) Confidentiality: All student-athlete information and records associated with the University of

Charleston drug testing program will be confidential and will be released only to those

individuals with a legitimate need to know.

11. Sanctions

Refusal to sign a consent form prohibits a student-athlete from participating in any intercollegiate

sport at the University of Charleston. Any student-athlete who tests positive for a banned substance

is determined to have altered or adulterated a specimen sample, or who refuses to submit to a

required drug test, and/or who violates the terms of the safe harbor program as described in this

policy shall be subject to the sanctions below. Notwithstanding anything herein to the contrary, a

team physician, in his/her sole discretion, reserves the right to withhold a student-athlete from

practice and/or competition if such practice and/or competition would pose a threat to the health

and safety of the student-athlete or his/her competitors. However, any decision to restrict a student-

athlete from practice and/or competition for health concerns must be based on credible evidence.

Only the team physician may release a student-athlete to resume competition and/or practice. All

violations of this policy are cumulative.

a) First Offense

When the testing agency notifies the University that a student-athlete has tested positive under this

policy, the Director of Athletics or her designee will schedule a confidential meeting with the

student-athlete and the appropriate head coach to review the positive drug test results, and will

notify the Dean of Student Life in writing that the student has tested positive. The team physician

may also be present if deemed necessary by the Director of Athletics or her designee. The student-

athlete will be immediately suspended from competition in any intercollegiate sport at the

University of Charleston for 20% of the competitive season (Championship Season). The

suspension may last longer than 20% of the competitive season based on the amount of time that it

takes for the student-athlete to complete all of the components of his/her sanction. Competition

suspension will carry over to the subsequent season if necessary. See attached chart (Appendix D).

The student-athlete will be required to attend all practices and competitions unless excused by the

appropriate head coach.

The Director of Athletics or her designee will notify the student-athlete’s parent(s) or legal

guardian(s) by telephone and/or in writing. At the student-athletes sole expense, the student-

athlete will be required to attend drug counseling assessment session(s) as determined by the

Director of Athletics or her designee. The university’s Director of Counseling will ask the student-

athlete to discuss the nature and extent of his/her involvement with prohibited drugs and/or alcohol.

The counselor shall determine the appropriate form(s) of intervention and rehabilitation needed by

the student-athlete, based on the circumstances of the case. Failing to comply with the counselor’s

directions for treatment will be classified as a second offense. The student-athlete will be subject to

follow-up testing. Testing will be unannounced and will be required at a frequency determined by

the Director of Athletics or her designee. All costs associated with any counseling session shall be

the sole responsibility of the student-athlete. The Director of Athletics will send all documentation

of the decision to the Dean of Students to be placed in the Student ConductFile.

b) Second Offense

When the testing agency notifies the University that a student-athlete has tested positive under this

policy, the Director of Athletics will schedule a confidential meeting with the student-athlete, and

the appropriate head coach to review the positive drug test results, and will notify the Dean of

Student Life in writing that the student has tested positive a second time. The team physician may

also be present if deemed necessary by the Director of Athletics or her designee. The Director of

Athletics or her designee will notify the student-athlete’s parent(s) or legal guardian(s) by telephone

and/or in writing. The student-athlete will be immediately suspended from competition in any

intercollegiate sport at the University of Charleston for 50% of the competitive season. The

suspension may last longer than 50% of the competitive season based on the amount of time that it

takes for the student-athlete to complete all of the components of his/her sanction.

Competition suspension will carry over to the subsequent season if necessary. See attached chart

(Appendix D).

The student-athlete will be required to obtain a minimum of 10 hours of Community Service at a

site that is approved by the Director of Athletics or her designee (e.g., Covenant House,

Rehabilitation Center) The student-athlete will be required to attend all practices and competitions

unless excused by the appropriate head coach. At the student-athletes sole expense, the student-

athlete will be required to attend drug counseling assessment session(s) as determined by the

Director of Athletics or her designee. The counselor will ask the student-athlete to discuss the nature

and extent of his/her involvement with prohibited drugs and/or alcohol. The counselor shall

determine the appropriate form(s) of intervention and rehabilitation needed by the student-athlete,

based on the circumstances of the case. Failing to comply with the counselor’s directions for

treatment will be counted as a third offense. The student-athlete will be subject to follow-up testing.

Testing will be unannounced and will be required at a frequency determined by the Athletic Director

or her designee. All costs associated with any counseling session shall be the sole responsibility of

the student-athlete. The Director of Athletics will send all documentation of the decision to the Dean

of Students to be placed in the Student Conduct File.

c) Third Offense

When the testing agency notifies the University that a student-athlete has tested positive under this

policy, the Director of Athletics will schedule a confidential meeting with the student-athlete,

Faculty Athletic Representative, Dean of Students and the appropriate head coach to review the

positive drug test results. The student-athlete will be permanently suspended from participating in

any sport at the University of Charleston. Consistent with all University and NCAA regulations, the

student-athlete will have all athletic financial aid canceled for the subsequent semester and non-

renewal of the athletic financial aid for the ensuing academic year(s). The Director of Athletics or

her designee will notify the student-athlete’s parent(s) or legal guardian(s) by telephone and/or in

writing of such decision.

A recommendation will be made that the student-athlete enrolls in an appropriate treatment

program. The Department of Athletics will be willing to assist the student-athlete with enrolling in

such a treatment program but will not assume any financial responsibility for the student-athletes

treatment program.

12. Missing A Counseling Session

It is the responsibility of the student-athlete who makes an appointment with a counselor to keep

that appointment. If the student-athlete is not able to keep the appointment he or she is expected to

cancel the appointment by telephone, preferably 24 hours in advance but at least by 8:30 a.m. on the

day of the appointment. Prior to the initial appointment, the student-athlete will read and sign an

informed consent for evaluation and treatment, which includes an agreement to follow the

appointment policies.

Cancellation or failure to keep an appointment as stated above may result in suspension from

practice and/or competition as determined by the Director of Athletics or her designee.

13. Voluntary Disclosure/Safe Harbor

a) A student-athlete who has engaged in prohibited drug or alcohol use is encouraged to seek

assistance from the Department of Athletics by voluntarily disclosing his or her use prior to an

announced drug test.

1) If the student-athlete seeks assistance prior to being notified that he or she must undergo

screening, and prior to being identified as having violated this policy, the impermissible

use will not be deemed an offense for purposes of determining sanctions under this policy;

however, the student-athlete will be ineligible to participate in intercollegiate sports

pending an evaluation. The student-athlete entering the safe harbor program will be

required to take a drug test immediately to establish a baseline for follow-up testing. A

student-athlete will not be permitted to enter the Safe Harbor Program within the thirty

(30) days prior to NCAA or Conference postseason competition.

2) The Athletic Director will notify the Dean of Students that the student has voluntarily

disclosed a violation of this policy and requested treatment. The student-athlete will be

required to undergo an evaluation by a University of Charleston counselor. The University

of Charleston designated counselor shall determine the appropriate form(s) of intervention

and rehabilitation needed by the student-athlete, based on the circumstances of the case.

The counselor will provide a summary of his or her findings and recommendations to the

Dean of Students and the Director of Athletics.

3) A student-athlete will be permitted to remain in the Safe Harbor Program for a reasonable

period of time, not to exceed thirty (30) days, as determined by the treatment plan.

However, the student-athlete will not be permitted to return to participation in

intercollegiate sports until the counselor has interviewed the student-athlete following the

conclusion of the recommended treatment (or stage of treatment, as applicable) and has

determined that reentry into intercollegiate sports is appropriate. If the counselor deems it

necessary, the student-athlete will be required to undergo drug and/or alcohol testing as

part of the reentry evaluation.

4) Failing to complete the treatment recommended by the counselor, or having a positive test

for any banned substance that indicates continued and/or new use after entering the Safe

Harbor Program will be considered an offense under this policy.

5) If the student-athlete regains his or her eligibility to participate in intercollegiate sports, he

or she may be required to undergo unannounced follow-up tests at the discretion of the

Director of Athletics in consultation with the counselor.

14. Appeal Process to the Appeals Committee

a) Request for Appeal: Student-athletes who test positive under the terms of the University of

appeal process. Requests for such an appeal must be made within forty-eight (48) hours of

notification of the repeated positive test result. If the forty-eight hours would end on a weekend,

the request must be made by noon on the next business day. Requests must be in writing and

received by the Director of Athletics within the required time period.

If the reported student-athlete requests an appeal, he or she is entitled to receive written

notification of his or her alleged violation and notice of the time, place, and location of the

appeal. The student-athlete may not participate in any type of NCAA Countable Athletically

Related Activity while an appeal is pending. The hearing on the appeal should take place no

more than seventy-two (72) hours after the written request for an appeal is received.

b) Appeals committee: The Appeals Committee will consist of the Faculty Athletic

Representative, a representative of the Office of Student Life, and the Chair of the

Department of Athletic Training. Either the student-athlete or the other parties involved may

request an extension of time from the Director of Athletics, who may grant the extension upon

a showing of good cause. The appeal hearing shall be based on the record of the meeting

conducted by the Director of Athletics. The proceedings shall be confidential. The decision

by the Appeals Committee shall be delivered to the student-athlete in writing and the

sanction imposed shall be final.

c) General provisions regarding the appeal: All appeals shall be closed to all parties not directly

involved. However, the student-athlete has the right to bring witnesses to the appeal hearing.

He or she may also bring along one member of the University community of his or her

choice as a “support person.” The support person may not comment during the hearing

procedure and parents, lawyers, and other advocates are not permitted to attend.

d) Record of Appeal: There shall be a written record maintained in connection with any appeal.

The record shall contain the written results of all drug tests, all written statements received, all

witness lists and other information submitted, the written conclusions and rationale of the

Appeals Committee in making the determination, and any other relevant records submitted in

the appeal hearing. This record will be retained on in the Student Conduct file for the amount

of time required by law. Access to these records shall be governed by the University’s Family

Educational Rights and Privacy Act (FERPA) policy, as set out in the Student Handbook. No

records relating to any hearing will appear in a student’s academic transcript, EXCEPT in

cases of suspension or expulsion from the University.

University of Charleston Department of Athletics Drug/Alcohol Education &

Testing Policy Student-Athlete ConsentForm

I, , hereby acknowledge that I have received a copy of, read and been given the opportunity to ask questions regarding

the Drug/Alcohol Education & Testing Policy implemented for the Department of Athletics at the University of

Charleston. I understand the policies, procedures and my responsibilities as described in such policy.

As a condition of my participation in intercollegiate athletics at the University of Charleston, I consent to participate

in the program set out in the Drug/Alcohol Education & Testing Policy. I understand that my participation in this program

includes the collection and testing of my urine at various times during the academic year and pre-season for drugs,

alcohol, and/or other banned substances.

I further consent to the release of the results of any drug test to the Director of Athletics or her designee, Assistant

Director of Athletics, my Head Coach, the Head Athletic Trainer and/or Assistant Athletic Trainer assigned to my sport,

Dean of Student Life, Team Physician, counselor, Appeals Committee and/or my parent(s) or guardian(s). I

acknowledge and understand that a copy of this consent form may be sent to my parent(s) or guardian(s) along with a

copy of the Drug/Alcohol Education & Testing Policy. To the extent outlined in this document, I waive any privilege

I may have in connection with such information.

I fully understand that the University of Charleston Drug/Alcohol Education and Testing Policy is separate and distinct

from the NCAA drug-testing program and its sanctions; however, I also understand that sanctions may be imposed by

the University of Charleston under its Drug/Alcohol Education and Testing Policy upon a positive result under the

NCAA drug-testing program. I also understand that the Drug/Alcohol Education and Testing Program does not alter

or supersede my obligations as set out in the Student Rights and Responsibilities (Student Handbook).

Notwithstanding anything to the contrary in the policy, I fully understand that I may be suspended from competition

and/or practice by the team physician if credible evidence suggests that such competition and/or practice poses a health

and safety risk to me, my teammates, and/or my competitors.

The University of Charleston, its officers, employees, and agents are hereby released from legal responsibility and/or

liability for the release of any information and/or record as authorized by this consent form. I fully and forever release

and discharge the aforementioned parties from any claims, demands, rights of action, or causes of action, present or

future, whether the same be known or unknown, anticipated or unanticipated, resulting from my participation in

University of Charleston’s Drug/Alcohol Education & Testing Program including those claims, demands, rights of

action, or causes of action arising out of any positive result under such Drug/Alcohol Education

& Testing Program.
