Subject: 2014 Engineering Department Capital & Operations/Maintenance Budgets
The Engineering Department has prepared our proposed 2014 Capital and Maintenance & Operations budgets for the Transportation and Public Works Committee for their consideration and recommendations. The budget is presented as an attachment to this report and includes the 5 Year Maintenance Budgets as well as proposed 2014 Capital Projects. Capital Projects are presented with the following information:
1. Carry over from 2013;
2. Items that resulted from Council Resolutions in 2013 or earlier;
3. Items not funded from General Reserve Funds;
4. Items funded from General Reserve ;
5. Items that would move forward if a successful grant application is undertaken.
There are no capital projects scheduled for Sanitary Sewers as this work is undertaken by Corix. Appendix “A” presents the 5 Year Capital Plan and contains a list of capital projects, showing the individual and cumulative funding requirements and funding requirements allowing for carry forwards of 2013 budgeted funds, as needed. It should be noted that where staff are hopeful of obtaining grant funding for capital projects those projects show in the capital budget spreadsheets. When the City applies for grant funding we must show the intent to have thought out and planned for a grant project and therefore are required to show the project in our annual budgets. Where a project is identified as being constructed based on grant funding that project would only proceed if a grant is obtained. Where applicable, items that are considered by the Engineering Department as having a high priority in an effort to maintain and operate existing and projected City inventories have been identified.

Capital Projects Budget Summary There is only one new capital project proposed that is funded by General Revenue. The following key capital projects are proposed for 2014 most of which are funded either by grants, City Reserves or Development Cost Charge (DCC) funds or a combination of those funding sources: Green City Strategies (Bike & Multi Purpose Lanes) – Gas Tax funded; CIPP grant application

Operating Budget Summary No new items are proposed in the 2014 Operating Budget that were not already in place in the 2013 Operating Budget. The proposed 2014 Operating Budget is 4.0% more than the 2013 Operating Budget and reflects an increase based on increased inventory of City owned assets such as more roads, sidewalks, stormwater ponds etc.

BACKGROUND
The Subdivision and Servicing Bylaw 1000 was adopted by Council on February 15, 2013, and repealed Bylaw 500. COMMENTARY
Amendment No. 7 to Bylaw 1000 is being brought forward to deal with bylaw housekeeping issues and other minor adjustments to improve the usability of the bylaw. Changes are as follows:
i. general housekeeping items ensuring all mention of Construction Acceptance and Final Acceptance are consistent and all reference of Substantial Completion is removed
ii. revising “Final Acceptance” definition
iii. revising “Professional Engineer” or “Consulting Engineer” definition
iv. revised fee table
v. consistent use of Construction Acceptance
vi. clarifying the as-constructed information sheet submission
vii. certification requirement for Acceptance

BYLAW NO. 1494
A BYLAW TO AMEND THE SUBDIVISION AND DEVELOPMENT SERVICING BYLAW
The Council of the City of Langford, in open meeting assembled, enacts as follows: 1. City of Langford Subdivision and Development Servicing Bylaw No. 1000 is amended as follows:
i. Delete the definitions of “Acceptance” and “Substantial Completion”and add the
following defintions in appropriate alphabetical order: “cal” or “caliper” means the diameter of the tree trunk measured 15cm from the ground level or from the top of the root ball in the case of a tree grown in a nursery. “Construction Acceptance” means the City’s acceptance of the construction of Works and Services provided by a Developer pursuant to this Bylaw, subject to the obligation of the Developer to remedy defects and deficiencies becoming apparent during the Warranty Period. “Parks Manager” means the person appointed to that position from time to time by the Council and includes any person authorized by the Parks Manager to perform duties under this Bylaw. “Warranty Period” means a period of one year starting from the date of Construction Acceptance, unless a greater period is specified in this Bylaw in relation to particular Works or Services, during which the Developer must remedy any defects in materials or workmanship and other deficiencies that become apparent in the Works and Services.
ii. Replace the definition of “Final Acceptance” with “means the City’s acceptance of Works and Services provided pursuant to this Bylaw at the end of the warranty period with all defects and deficiences remedied to the satisfaction of the City Engineer.
iii. Replace the definition of “Professional Engineer” or “Consulting Engineer” with “means a
person who is registered or licensed and in good standing in the Province of British Columbia as such under the provisions of the Engineers and Geoscientists Act.
iv. Replace Table 1-1 with Table 1-1 attached to and forming part of this Bylaw.
v. Replace Section 1.10.1 with the following: 1.10.1 The City will not issue Contruction Acceptance of Works and Services
that are to be owned and maintained by the City until the Works and Services have been approved and installed, and the following documents have been submitted to, reviewed by and approved by the City Engineer.
vi. Replace 1.10.1.3 with the following:
As-constructed inventory sheet, supplied by the City, to be completed and submitted to the City as a signed and sealed document by a Professional Engineer.
vii. Replace Section 1.10.1.4 with the following: 11

1.10.1.4 Certification by the Professional Engineer that to the best of their
knowledge there are no outstanding deficiencies or defects.
viii. Delete Section 1.10.1.4.1.
ix. Replace Section 1.11.2.1 with the following: 1.11.2.1 Final Approval of the subdivision will not be granted to the applicant by the
Approving Officer unless the City has issued Construction Acceptance, or the applicant has entered into a Works and Services Agreement with the City. Subdivision plans submitted for final subdivision approval must be accompanied by:
x. Add to Section 1.12.3 the following sentence: “The security shall be returned to the
owner upon Construction Acceptance by the City, less any amount retained as security for the owner’s obligations during the Warranty Period.”
xi. Replace Section 1.13.1 with the following: 1.13.1 Upon completion of the landscaping works to the satisfaction of the City Parks
Manager, the City shall issue Construction Acceptance for the landscaping works. The Developer shall maintain all landscaping works to the standard specified by the City for a period of one year from the date of issuance of Construction Acceptance. At the end of the one year period, the City shall inspect the landscaping works and note any deficiencies. Once the developer has remedied all defects and deficiencies, the City will issue Final Acceptance of the landscaping works.
xii. Replace the heading of Section 1.14 with “Warranty Period and Security”.
xiii. Replace Section 1.14.1 with the following:
1.14.1 Upon Construction Acceptance, the Developer shall warrant the Works and Services for the Warranty Period, shall remedy all defects and deficiencies becoming apparent in the Works and Services during that period, and shall provide in a form acceptable to the City Engineer, security in the amount of 10% of the actual cost of the Works and Services to ensure performance of the Developer’s obligations, which shall be returned to the Developer upon Final Acceptance.
xiv. Replace Section 1.14.2 with the following:
1.14.2 The actual cost of the Works and Services for the purposes of Section 1.14.1 shall be certified by a Professional Engineer and approved by the City.
xv. Replace Section 4.18.14 with the following: 4.18.14 Construction Acceptance for all street lighting will require:
xvi. Replace Section 5.8.1 with the following:
5.8.1 All inspection chamber (IC) lids and collars shall be installed in accordance with drawing SS S9. The lid cams shall be securely tightened to ensure that they are not subject to vandalism or misuse.

6.1.2.1 Notwithstanding Section 6.1.2, In areas not served by the municipal sewer,
but contained within the West Shore Environmental Services contract area for sewer service [defined in the agreement dated September 20th, 2004 (Westshore Utility; Bylaw No. 876)], the following forms of development may occur without connection to the municipal sanitary sewer system: i. the alteration or repair of a residential building; or
ii. the construction, alteration or repair of a building that is accessory to a residential building;
provided that: a) the construction, alteration or repair is pursuant to a building
permit or is exempt from the requirement of a building permit; and
b) the construction or alteration does not require a plumbing permit for additional fixtures; and
c) the construction, alteration or repair is not for the purpose of creating an additional dwelling unit or units,; and
d) the construction or alteration does not create more than 70 m2 (750 ft2) of new gross floor area, or a cumulative total of more than 70m2 (750 ft2) of new gross floor area when considered together with all alterations.
xviii. Replace Section 6.5.1 with the following: 6.5.1 All inspection chamber (IC) lids and collars shall be installed in accordance
with drawing SS S9. The lid cams shall be securely tightened to ensure that they are not subject to vandalism or misuse.
xix. Replace Section 6.7.1 with the following:
6.7.1 All sewer systems must be tested to MMCD standards prior to Construction Acceptance. The Contractor must provide the City Engineer with 24 hours notice of the test.
xx. Re-number Table 6-4 to 6-5
xxi. Add Section 7.7.24 with the following:
7.7.24 Warranty Any product warranties in excess of one year shall be assigned to the City.
xxii. Replace Section 7.8.3.2 with the following: 7.8.3.2 The Warranty Period shall, despite any other provision of this Bylaw, be two
years from the date of Construction Acceptance.
xxiii. Replace Section 8.18.2 with the following: 8.18.2 Service connection separation shall meet the CRDWS separation
requirements.
xxiv. Replace Section 9.4 with the following: 9.4 All utility services, junction boxes, transformers and service facilities shall be
located within the road right of way or as approved by the Utility owner if not in the road right of way. 13

xxv. Replace the table in Schedule 11 with the table attached to and forming part of this Bylaw.
xxvi. Replace Standard Detail Drawings MMCD SS G4, MMCD SS S9, MMCD SS S11 and
MMCD SS SD7 in Schedule 11 with the drawings to and forming part of this Bylaw.
xxvii. Add Standard Detail Drawings L3, L4, L5, MMCD SS G5 and MMCD SS S10 (attached) to and forming part of this Bylaw to Schedule 11 in appropriate alphanumeric order.
xxviii. Add Schedule 14 (attached) to and forming part of this Bylaw, to follow Schedule

1.6 Measurement for Payment
Add Clause 1.6.6 which reads: “Payment for trench rock will be by cubic metre. For measurement purposes, the volume of trench rock is defined as that amount below subgrade in areas of mass rock removal or below natural rock surface, extending down to 200 mm below the lowest designed pipe or service invert in the trench and having a width of 450 mm plus the overall external diameter or dimension of the service or services being installed. For two services in common trench this means the width of the two outside diameters, plus the separation between the pipes plus 450 mm. Payment for the excavation of structures shall extend 500 mm from the outside faces of the structure and shall extend to 200 mm below the lowest elevation of the structure.

3.10 Service Connection Installation
Delete the first 2 words of “Where specified,” from Paragraph 3.10.3 to read “Install inspection chambers at, etc.”
3.11 Cleaning and Flushing
Revise Paragraph 3.11.6 to read: “Remove foreign material from pipe and related appurtenances by power flushing with water.” Delete the remainder of the Paragraph.
3.12 Inspection and Testing

3.12 Leakage Testing General
The preferred method of leakage testing is the low pressure air test. All other tests will be carried out at the discretion of the Contract Administrator.
3.18 Video Inspection
Revise Paragraph 3.18.1 replace the phrase “under 900mm in diameter following completion of installation with “prior to Acceptance of Works and services and prior to Final Acceptance of works and services.”
Add Clause 3.18.3 which reads: “Inspection records shall illustrate flow through the pipe for all design grades less than 2%.” Add Clause 3.18.4 which reads: “The inspection report shall be in a form acceptable to the City.” Add Clause 3.18.5 which reads: “Inspections shall be submitted to the City in electronic format.” Add Clause 3.18.6 which reads: “Prior to the end of the maintenance period, or when directed by the Contract Administrator, the Contractor is to carry out power flushing and video inspection of all mains. BOULEVARD LANDSCAPE STANDARDS
14.1. Submission Approval Requirements 14.1.1. Landscape plans must be drawn by a Landscape Architect or a Landscape Designer or
other qualified person approved by the Parks Manager for: 14.1.1.1. developments in the Downtown Pedestrian Commercial Development Permit
Area identified in the Official Community Plan or 14.1.1.2. On-site landscape works on internal roadways and boulevards where the
Subdivision creates more than 3 new lots. 14.1.1.3. Boulevard areas on existing roadways for developments and/or Subdivisions
which creat more than 3 new lots. 14.1.2. Landscape plans must be drawn by a Civil Engineer who has been engaged to provide
Landscape details and supervise the works on install for: 14.1.2.1. Subdivisions less than 3 lots or 14.1.2.2. Boulevard areas on existing roadways for subdivisions which create less than 3
new lots. 14.1.3. The developer must provide to the Parks Manager an itemized cost estimate for the
supply and installation of frontage landscape materials and labour prepared by a landscape architect or other qualified person.
14.1.4. Cost estimates should include, but are not limited to:
14.1.4.1. Site Preparation and Grading 14.1.4.2. Topsoil 14.1.4.3. Plants 14.1.4.4. Irrigation 14.1.4.5. Mulch/Topdressing 14.1.4.6. Labour, Materials and Equipment. 14.1.4.7. Hardscape materials, street furniture, lighting, and other improvements
approved by the Engineering Department. 14.1.4.8. As-Built drawings – production and submission
14.1.5. All trees should be planted after development is complete, and when there is no danger
of large vehicles moving on and off the development frontage across root zones and irrigation lines.
14.1.6. Landscape plans or civil drawings submitted to the Parks Manager for approval should
include: 14.1.6.1. the surveyed location and size of all existing trees over 15 cm within the
municipal right-of-way Proposed trees, shrubs, grass locations and irrigation system, including water meter, valves and timers, if required, and the irrigation system must be included on the Civil Engineer’s drawing of water supply services.

14.1.6.2. Tree species botanical and common names, cultivar, caliper, height, B+B or wire basket specification

14.2. Boulevards 14.2.1. Boulevard Trees
14.2.1.1. Should be minimum 7 cm caliper.measured 15 cm from ground level or as approved by the Parks Manager.
14.2.1.2. May be inspected by the Parks Manager prior to planting for health, size, and species appropriateness for the site, preferably at the nursery.
14.2.1.3. Should be provided in the road allowance at a density of one per 15 metres of frontage.
14.2.2. Shall be planted in accordance with drawings L1, L2a, L2b, L2c, L2d, and L2e. For recommended species, refer to Table 14-1.

14.2.3. Existing Trees
14.2.3.1. Existing or significant trees on existing or future boulevards, shall be evaluated prior to site work commencing, and shall be retained at the discretion of the Parks Manager.
14.2.3.2. At the discretion of the Parks Manager, an arborist report or tree survey may be required as part of the landscape plan. Existing trees to be retained must be protected with a tree protection barrier, prior to commencement of any site works. Tree Protection barrier as per drawing L3 or as per directed by a Certified Arborist or the Parks Manager.
14.2.3.3. A tree that has been noted to be and is damaged to the point that replacement is necessary, must be replaced in accordance with Table 14-2

14.2.4. Irrigation
14.2.4.1. The Developer must supply irrigation and a water meter to all City boulevard trees in accordance with Schedule 10 and Drawings P1-P4, or at the discretion of the Parks Manager may supply a sub-meter from private property water source.
14.2.4.2. Trees planted within municipal right-of-way, must be irrigated as specified in Schedule 10 and Drawings P5-P7.
14.2.4.3. Automatic underground irrigation shall be installed with an electric timer and valve box.
14.2.4.4. Where hardscape instead of grass is constructed on the boulevard, irrigation to the boulevard trees is required with an electric timer and valve hook up to an approved water supply.
14.2.5. Median Planting
14.2.5.1. Plantings for medians and at driveways, intersections, and pedestrian crossing locations and other locations specified by the City Engineer where sight lines are critical must neot exceed height of one meter. Density and spacing of plants to be determined by the Parks Manager. Refer to L4.
14.2.6. Grass Seeding/Sodding

14.2.6.1. New grass areas, whether seeded or sodded shall be inspected by the Parks Manager for acceptance after three mows for seed, and immediately for sod, unless a Warranty Period is applicable. Refer to L5.
14.2.7. Topsoil
14.2.7.1. All areas designated for topsoil and blending of restored areas shall conform to the current BCSLA/BCNLA Landscape Standard and the Canadian System of Soil Classification.
14.2.7.2. The Parks Manager may request that a topsoil analysis be submitted, undertaken by a recognized soil testing agency, prior to the delivery of the topsoil.
14.2.7.3. Minimum topsoil depths shall comply with Table 14-3.

14.2.8. Mulch
14.2.8.1. All planting beds should be top-dressed after planting with 50 mm bark mulch.
14.2.9. Common Fill
14.2.9.1. All common fill shall consist of granular material free of rubble or debris greater than 2mm and shall not be toxic to plant or animal life.
14.3. Construction Acceptance
14.3.1. Construction Acceptance starts the Warranty Period and may be issued by the Parks Manager once all of the following conditons have been met:
14.3.1.1. All landscaping has been installed, inspected and approved by the Parks Manager and has no outstanding deficiencies. 14.3.1.2. As built landscape drawings have been submitted to the Parks Manager in .dwg
and .pdf format and approved. 14.3.1.3. As Constructed Sheet, supplied by City, has been completed and submitted to
the Parks Manager. 14.3.1.4. Supply and installation of all plant materials are complete (trees, shrubs and
grass). 14.3.1.5. all grass seeding is well established and has been mowed to 200 mm height at
least three times. 14.3.1.6. installation and testing of the irrigation system has been completed and the
system is fully operational with full coverage of all planted areas. 14.4. Warranty
14.4.1. Upon Construction Acceptance of the works and services to be owned and maintained by the City, the Developer shall warrant the works and services for a period of one

yearand shall provide in a form acceptable to the Parks Manager, security in the amount of 10% of the cost of the Landscape works and services.
14.4.2. The City may draw upon the security in whole or in part at any time prior to the expiration of the Warranty Period for repairs pertaining to the Landscaping, if the developer fails to perform the repairs within a reasonable time period as stipulated by the Parks Manager.
14.4.3. Should a deficiency be noted at any time during the Warranty Period, the City may notify the Developer giving 30 days to repair the deficiency to City standards. After acceptance of the repair, the City may elect to extend the Warranty Period for the repaired item for up to one year.
14.5. Final Acceptance
14.5.1. Final Acceptance will be issued by the Parks Manager once a Final Inspection has occurred at the end of the applicable Warranty Period and there are no outstanding deficiencies to be rectified or repaired. The Parks Manager may extend the Warranty Period on items that require replacement or repair at the final inspection, and defer Final Acceptance of those items until the end of the Warranty Period as extended.

A BYLAW TO AMEND THE TRAFFIC BYLAW NO. 33, 1995 __________________________________________________________________
The Council of the City of Langford, in open meeting assembled, enacts as follows:
1. Traffic Bylaw No. 33, 1995 is amended by adding section 10.4.10 with the following:
DRIVEWAYS 10.4.10 No more than one driveway will be permitted: (a) For residential lots with a lot area of less than 0.4 hectare (1.0 acre) With the exception of:
i. Where there is more than one dwelling on a lot, each dwelling will be permitted one driveway exclusive of secondary suites
ii. Residential lots with a secondary suite to an accessory building will be permitted a second driveway for the secondary suite in an accessory building if the lot has more than one frontage and each driveway accesses onto a separate frontage
2. This Bylaw may be cited for all purposes as “Traffic Bylaw No. 33, 1995, Amendment No. 17, 2013”.
