NAY PYI TAW, 15 Aug — Acting Prime Minis-ter of the Union of Myanmar and Secretary-1 of theState Peace and Development Council Lt-Gen TheinSein and wife Daw Khin Khin Win bade farewell toPrime Minister Mr Nguyen Tan Dung of the SocialistRepublic of Vietnam and Madame Tran Thanh Kiemat Nay Pyi Taw Airport at 8.30 am today before theirdeparture for Yangon.

On arrival at Nay Pyi Taw Airport from NayPyi Taw Hotel Zone, the Vietnamese delegation led bythe visiting Prime Minister and Madame were wel-comed by Acting Prime Minister and Secretary-1 Lt-Gen Thein Sein, wife Daw Khin Khin Win and party.

At the lounge of the airport, Acting PrimeMinister and Secretary-1 Lt-Gen Thein Sein presentedthe photo album on goodwill visit to the VietnamesePrime Minister.

Strengthen friendly relationsbetween Myanmar and Vietnam,enhance regional andbilateral cooperation

The Union of Myanmar and the So-cialist Republic of Vietnam have similarhistorical backgrounds. Heads of bothcountries exchanged visits and the twocountries have maintained good and cor-dial relations.

Head of State Senior General ThanShwe paid visits to the Socialist Republicof Vietnam in 1995, 1998 and 2003. Simi-larly, the Prime Minister and the Presidentof Vietnam paid visits to Myanmar in 1994,2000 and 2002.

At the invitation of Acting Prime Min-ister of the Union of Myanmar and Secre-tary-1 of the State Peace and DevelopmentCouncil Lt-Gen Thein Sein, a goodwill del-egation led by Vietnamese Prime MinisterMr Nguyen Tan Dung and Madame TranThanh Kiem arrived on a friendly visit toMyanmar on 14 August.

NAY PYI TAW, 15 Aug — Minister for Agricultureand Irrigation Maj-Gen Htay Oo met with departmentalofficials and members of the Union Solidarity andDevelopment Association and other social organizationsin Laymyethna, Ayeyawady Division, on 7 August.

At the meeting, Maj-Gen Htay Oo called forconcerted efforts for regional developments.

He then donated 25 sets of textbooks to the basiceducation high school in the town through the town-ship education officer.

After the meeting, the minister and party inspectedthe embankments along Ngawun River in LaymyethnaTownship. He also met with USDA members in YekyiTownship and urged them to cooperate with localpeople in regional development tasks. — MNA

NAY PYI TAW, 15 Aug — The opening ceremonyof Office of the the Grade-I and the Grade-II CourseNo 83 for government employees was held at thetraining school of Office of the Auditor-General, here,this afternoon, with an address by Deputy Auditor-General Daw Thinn Thinn.

It was also attended by the director-general, thedeputy directors-general, officials, instructors and train-ees. Altogether 141 service personnel of 21 depart-ments and 22 enterprises under 30 ministries are nowattending the 3-month course.

YANGON, 15 Aug — U Aung Naing, U HlaWai and Daw San San Maw of Labutta TownshipNational League for Democracy in AyeyawadyDivision and U Tin Win of Salin Township NLDin Magway Division resigned from the party oftheir own accord on 2 August sending their resig-nation letters to the NLD Headquarters and localauthorities concerned.

In the letters sent to Labutta and SalinTownship Multi-party Democracy General Elec-tion Subcommissions, they said that they lostinterest in the acts of the party and they no longerwished to remain as NLD members. That waswhy, they quit the party of their own volition,they said. — MNA

The term “discipline-flourishing genuine multipartydemocracy” should be used in drafting the Constitution

YANGON, 15 Aug—The following is the suggestionsof Six Independent Representatives-elect on mattersconcerning the amendments, the additions, the repealsand the transfer out of the fundamental principles anddetailed basic principles that have been adopted byNational Convention.

I wish health and happiness for all the esteemedChairman and members of the Panel of Chairmen, theesteemed Chairman and members of the NationalConvention Convening Commission, the esteemedChairman and members of the National ConventionConvening Work Committee, the esteemed Chairmanand members of the National Convention ConveningManagement Committee, and delegates.

I am independent representatives-elect U HlaSoe of Minbu Township Constituency 2. Together withme U Thein Kyi will read the paper compiled byindependent representatives-elect U Tin Win of KyaiklatTownship Constituency 2, U Thein Kyi of TaungdwingyiTownship Constituency 1, U Hla Soe of Minbu TownshipConstituency 2, U Mya Hlaing of Twantay TownshipConstituency 2, U Kyi Win of Mingaladon TownshipConstituency 1 and U Tin Tun Maung of MingaladonTownship Constituency 2.Mr Chairman,

At present, the people are looking forward to thetime the Constitution will emerge. The on-going NationalConvention has already adopted fundamental principlesand detailed principles that meet the public desire andwishes for a new democratic nation. To be able to laydown and adopt the said principles the delegates withintheir own groups and between one group and anotherhave been working with mutual understanding, respect,cooperation and coordination like true friends andbrethren.Mr Chairman,

Now the National Convention will makeamendments, repeals, transfers and additions to theadopted fundamental principles and detailed basicprinciples after assessing them for the said principles tobe in accord with the time and situation, to have a propercontextual order and to have a clearer definition. There isa saying, which goes “Well begun is half done”. Webelieve that by doing so the Constitution that will servethe long-term interest of the people will emerge.Mr Chairman,

Now, we will discuss the matter concerning theamendment, repeal, transfer and addition of the adoptedfundamental principles and detailed principles asnecessary.Mr Chairman,

The State will carry out the legislative andexecutive functions in accord with the fundamentalprinciples. In doing so, the State will implement the

functions in accord with the nation’s prevailing situationand time. The running of the legislative and administrativemachinery may face disturbances and obstacles if alawsuit is filed against the State while taking advantageof its failure to implement the task in accord with saidprinciples as time and situation is not ripe yet. In our view,it is necessary to adopt a detailed basic principle that willprotect the State. An addition should be made to thecompilation 3 of the Work Committee Chairman, whichsays “The State fundamental principles are theguidelines to be followed by the legislative Hluttaws inenacting laws and interpreting provisions of the StateConstitution and of other laws.”

In our view, the expression “The application ofthese principles in legislation and administration shall bethe care of the State but shall not be enforceable in anycourt or law” should be added to the said detailed basicprinciple.

We agree to add the given expression to thedetailed basic principles as follows:

“The State fundamental principles are theguidelines to be followed by the legislative Hluttaws inenacting laws and interpreting provisions of the StateConstitution and of other laws. The application ofthese principles in legislation and administration shallbe the care of the State but shall not be enforceable inany court or law.”Mr Chairman,

The National Convention adopted the detailedbasic principles including the para (50) which states “Inthis Chapter “The State” means a body that exerciseslegislative and executive powers according to thisConstitution.” for the Chapter “Citizenship,Fundamental Rights and Duties of Citizens”. Accordingto the statement, it is as if that the term “State” containedin the detailed basic principle concerns only with theChapter “Citizenship, Fundamental Rights and Dutiesof Citizens”.

The term “State” can be found in the Chapter I“State Fundamental Principles” for many times. In ourassumption, an addition should be made to the para 50 forthe detailed basic principle to cover the interpretation anddefinition of the term “State” of the given chapter.

The para refers only to the term “body”. Theremay be occasions in which the legislative power andexecutive power are exercised by an organization or by aperson. In this situation there may be a constitutionalproblem. They may be no reason for the occurrence ofany disputes if the stipulations contained in the detailedbasic principle are fully comprehensive.

In our view, the detailed basic principle shouldbe amended as follows:

“In this Chapter and the Chapter on StateFundamental Principles, “The State” means a bodyor a person that exercises legislative and executivepowers according to this Constitution.”Mr Chairman,

In connection with the qualifications of theChief Justice of the Union and Judges of the SupremeCourt of the Union, the para (3) (c) (iii) states “havebeen an advocate of a High Court of at least 20 years’standings”.

In connection with the qualifications of the ChiefJustice of the High Court of Region or State Chief Justiceand judges of the High Court of the Region or State, thepara 11 (c) (ii) states “a person who has served asadvocate for 15 years”. The stipulation does not state theword “at least”. It should be stated “at least 15 years” toensure a harmonious context and to prevent againstoccurrence of disputes in the future.

Hence, the expression “a person who has served

as advocate for 15 years” of the detailed basic principle11 (c) (ii) should be amended as “a person who hasserved as advocate for at least 15 years”.Mr Chairman,

The Chapter “State Fundamental Principles”that was adopted at the plenary session of the NationalConvention, includes the subpara (d) of the para 2 whichstates “flourishing of genuine multiparty democracysystem”; the para 3 which states, “the State practisesgenuine multiparty democracy system” and para 28which states “the State shall enact necessary law forsystematic formation of political parties for flourishingof genuine multiparty democracy system”.

But subpara (a) of para 2 of the adopted detailedbasic principles for the chapter “Political Parties” states“A political party shall: (a) accept and practise discipline-flourishing genuine multiparty democracy.” To be able toensure a contextual uniformity, the term “discipline-flourishing genuine multiparty democracy” should beused in drafting the Constitution.

Thus, we agree to use “discipline-flourishinggenuine multiparty democracy” instead of “genuinemultiparty democracy” in para 2 subpara (d), para 3 andpara 28 of the Chapter “State Fundamental Principles”.

Now, U Thein Kyi of Taungdwingyi TownshipConstituency 1 will read the paper.Mr Chairman,

The plenary session of the National Conventionheld on 16 September 1993 adopted the following StateFundamental Principles in connection with judiciary:

(a) the judicial power of the State is distributedamong Pyidaungsu Taya Hluttaw (SupremeCourt), Region Taya Hluttaw (Region HighCourt), State Taya Hluttaw (State High Court)and law courts of different levels including lawcourts of self-administered areas;

(b) in the Pyidaungsu is constituted one PyidaungsuTaya Hluttaw. Pyidaungsu Taya Hluttaw is thesupreme law court of State;

(c) Pyidaungsu Taya Hluttaw has powers to issuewritsBut from paras1 to 9 of the Formation of Judiciary

and paras 1, 2 and 8 of Sharing of the Judicial Power, usethe term “Supreme Court of the Union” to clearly expressthe difference between the term “Supreme Court of theUnion” and the term “High Court” of the Region or State.In our view, to have a uniformed context and to preventoccurrence of disputes in the future, the term “SupremeCourt of the Union” should be used.

We agree that the term Pyidaungsu Taya Hluttawin the subparas (a), (b) and (c) of para 9 of the Chapter“State Fundamental Principles” should be substitutedwith the term “Supreme Court of the Union”.

Subpara (g) of para 34, subpara (e) and (h) ofpara 22 which have connections between one anotherwere included in adopting detailed basic principles forthe formation of executive. The subpara (h) of para 22states “The President of the State may exercise relaxationof stipulation on age limit in the State Constitution”. Asthe para states “The President of the State may exerciserelaxation of stipulation on age limit”, he may or maynot exercise relaxation on age limit. To be able to clearlyexpress the essence and aim of the given detailed basicprinciple and to prevent constitutional disputes in thefuture, it should be used “shall exercise relaxation ofstipulation on age limit”.

We would like to suggest that the expression“may exercise relaxation of stipulation on age limit”of the subpara (h) para 22 should be substituted with theexpression “shall exercise relaxation of stipulation onage limit”.Mr Chairman,

The plenary session of the National Conventionheld on 29 March 1996, adopted detailed basic principlesfor the formation of executive. In the detailed basicprinciples, para 22 states as follows: “(i) The Region or State Chief Minister shall be

responsible to the President of the State(ii) The Region or State Minister shall be

responsible to the Region or State ChiefMinister concerned and through the ChiefMinister, to the President of the State.”The subpara (f) of para (28) states, “The

Advocate-General of the Region or State is responsibleto the President of the State through the Chief Ministerof the Region or State concerned, to the PyidaungsuAttorney-General and to the Chief Minister of theRegion or State concerned.

The subpara (e) of para 31 states, “The Auditor-General of the Region or State is responsible to thePresident through the Chief Minister of the Region orState concerned, to the Pyidaungsu Auditor-Generaland to the Chief Minister of the Region or Stateconcerned.”

In the abovementioned detailed basic principles,the terms and usages in connection with Region or Stateare clear and easy to understand. They should be used indrafting the Constitution to ensure a contextual uniformityand to have a clear definition.

In our view, subpara (f) para 28 and subpara (e)para 31 should be amended as follows:

Subpara (f) of para (28) “The Advocate-Generalof the Region or State is

“(i) responsible to the President of the Statethrough the Chief Minister of the Region orState concerned

(ii) responsible to the Pyidaungsu Attorney-General and to the Chief Minister of theRegion or State concerned”The subpara (e) of para (31) The Auditor-General

of the Region or State is(i) responsible to the President through the Chief

Minister of the Region or State concerned(ii) responsible to the Pyidaungsu Auditor-

General and to the Chief Minister of theRegion or State concerned”

Mr Chairman,The plenary session of the National Convention

held on 2 September 1994 adopted the detailed basicprinciple concerning the formation of Pyithu Hluttaw asfollows:

“Pyithu Hluttaw shall be formed with amaximum of 440 Hluttaw representatives as follows:

(a) Not more than 330 Hluttaw representativeselected on the basis of population

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services.”When the National Convention adopted the

detailed basic principles for legislation, it adopted thefollowing detailed basic principle in connection with thenames of the two Hluttaws: “(a) the Hluttaw “formed with Hluttaw

representatives elected on the basis ofpopulation and Tatmadaw member Hluttawrepresentatives nominated by theCommander-in-Chief of the Defence Servicesshall be known as Pyithu Hluttaw;

(b) the Hluttaw formed with Hluttawrepresentatives elected in equal numbers fromregions and states and Tatmadaw memberHluttaw representatives nominated by theCommander-in-Chief of the Defence Servicesshall be known as Amyotha Hluttaw.”If the election of the Pyithu Hluttaw

representatives is based on population, Regions will beable to elect 31 more representatives; and the States willbe able to elect 31 less representatives.

If the election of the Pyithu Hluttawrepresentatives is based on population and township, theStates will be able to elect 31 more representatives.

In the detailed basic principle also it should bestated that the election of Pyithu Hluttaw representativesshould be based on township as well as population.

The Tatmadaw government has been makingendeavours for all-round development. Hence, all thepeople have witnessed the changes in the administrative,economic and social sectors resulting from their rapiddevelopment. More townships will have to be formed asnecessary to be in conformity with the task ofimplementing projects such as security, management,education, health projects when the nation is achievingmore agriculture and industrial development than now.

When the number of townships goes over 330, anewly formed township should be joined with one of thetownships adjacent to it to designate a Pyithu Hluttawconstituency.

We are in support of making the followingaddition to ensure an enduring detailed basic principleconcerning the formation of the Pyithu Hluttaw:


(a) Not more than 330 Hluttaw representativeselected on the basis of township as well as onthe basis of population from constituenciesdesignated in accord with the law aftercombining a newly formed township with oneof the suitable townships adjacent to it if thetotal number of townships exceeds 330

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services.”

Mr Chairman,Concerning the Amyotha Hluttaw the following

detailed basis has been adopted:“Amyotha Hluttaw shall be formed with a

maximum of 224 Hluttaw representatives, as follows:(a) 168 Amyotha Hluttaw representatives elected

in equal numbers of 12 from each region orstate inclusive of Union territories, andincluding one representative from each self-administered division or self-administered zone

(b) 56 Tatmadaw member Amyotha Hluttawrepresentatives nominated by theCommander-in-Chief of Defence Services inaccord with law at the rate of fourrepresentatives from each region or stateinclusive of Union territories.”The subpara (a) states ‘equal numbers of 12

from each region or state inclusive of Union territories,and including one representative from each self-

administered division or self-administered zone’ andthe subpara (b) states “at the rate of fourrepresentatives from each region or state inclusive ofUnion territories”. The expression “inclusive of Unionterritories” means areas that were included in the presentstates and divisions but have been designated as Unionterritories and the areas proclaimed by the PyidaungsuHluttaw as Union territories because of their significantcharacteristics after the promulgation of this Constitution.The word “the respective” should be added to the word“Union territories” for the usage to be more precise.

In our view, the abovementioned detailed basicprinciple should be amended as follows:

“Amyotha Hluttaw shall be formed with amaximum of 224 Hluttaw representatives, as follows:

(a) 168 Amyotha Hluttaw representatives electedin equal numbers of 12 from each region orstate inclusive of the respective Unionterritories, and including one representativefrom each self-administered division or self-administered zone

(b) 56 Tatmadaw member Amyotha Hluttawrepresentatives nominated by theCommander-in-Chief of Defence Services inaccord with law at the rate of fourrepresentatives from each region or stateinclusive of the respective Union territories.

(c) In forming the Amyotha Hluttaw in accordwith the subparas (a) and (b), the words “therespective Union territories” mean Unionterritories designated by this Constitutionand Union territories proclaimed byPyidaungsu Hluttaw after enacting lawsconcerning the matter to elect AmyothaHluttaw representatives are inclusive in thestate or division or the region or state they areincluded in.”

Mr Chairman,Now, the government of the Union of Myanmar

and the offices of the central governments are based inNay Pyi Taw. So, the capital of the State is Nay Pyi Taw.Therefore, need arises to amend the words “Yangon City,that is the Capital of the Union”. Yangon is not the capitalof the nation any longer, but it remains a commercialcity.

The designation of Yangon as a Union territoryunder the direct administration of the president should berevoked. And the municipal area of Nay Pyi Taw, whichhas become the Capital of the State, should be designatedas a Union territory placed under the direct administrationof the president.

Yangon is no longer the Capital of the State, sothe term “Capital Yangon” will be replaced with the term“Yangon”. Moreover, the detailed basic principle“Cocogyun Township which has a special situation isdesignated as Union territory and placed under directadministration of the President of the Union” shouldbe revoked. The designation of Yangon and CocogyunTownship as Union territories is revoked, so, they willremain in Yangon Region.Mr Chairman,

As I have presented that by revoking the designationof Cocogyun Township as a Union territory, the detailedbasic principle of the sub-para (b) no longer needs to beprescribed. However, sub-para (c) should still exist. So, sub-para (c) should be sub-para (b). We are in support ofadopting the following the detailed basic principle: “(a) Nay Pyi Taw, that is the Capital of the Union,

is designated as Union territory placed underdirect administration of the President of theUnion.

(b) if need arises to designate areas that havespecial situation in connection with nationaldefence, security, administration andeconomy etc. as Union territories they may beso designated as Union territories afterenacting laws.”

The term “Capital Yangon” prescribed in thedetailed basic principles on administration of CapitalYangon, a Union territory, prescribed in para 35 and thedetailed basic principles on designation of the status ofthe Chairman and members of Yangon Council prescribedin para 36 of the detailed basic principles adopted at theplenary session held from 28 to 30 March 1996, shouldbe replaced with the term “Nay Pyi Taw”, and the term“Chairman of Yangon Council” prescribed in sub-para(c) 6 of para 16 of detailed basic principle for Formationof Financial Commission with the term “Chairman ofNay Pyi Taw Council”.

Mr Chairman,The plenary session of the National Convention

held on 12 December 2005 laid down detailed basicprinciples for the sharing of judicial power. In thisregard, sub-para 4 (a) of para 6 says, “With regard tothe judicial matter, Yangon Region High Court isthe high court of the courts situated in Yangon Cityand Cocogyun Township”.

We would like to suggest that sub-para 4 (a) ofpara 6 “With regard to the judicial matter, YangonRegion High Court is the high court of the courtssituated in Yangon City and Cocogyun Township”should be amended as “With regard to the judicialmatter, Mandalay Region High Court is the highcourt of the courts situated in Nay Pyi Taw”.

We find the Work Committee Chairman’sclarification “I would like to seek the approval of theNC to make necessary amendments to the terms,dictation and word orders without having any adverseeffects to the aims and essence of the basic principlesand detailed basic principles adopted according to theminutes of the NC in drafting the State Constitution”appropriate.

Mr Chairman,Soon, the National Convention will be concluded

successfully. The Constitution will truly come into forcein accord with the seven-point Road Map. The Tatmadawgovernment will transfer the State power to a civiliangovernment in accord with the Constitution. TheTatmadaw government has been training the delegatesproper ways and means to hold sessions, to makepresentations and to hold discussions at the NationalConvention, while it is carrying out the immense nationaltask.

At the National Convention, eight groups ofdelegates discussed, laid down and adopted thefundamental principles and detailed basic principles.The matter concerning the amendment, addition andrepeal of the said principles was presented to the eightgroups of delegates. The task has been accomplishedsmoothly.

I wish public representatives of the respectiveHluttaws that will emerge in the future accept theoccasional changes and systematically make amendments,additions and repeals as necessary in view of the nationalinterest and national cause.—MNA

At the plenary session of the National Conventionheld on 6 August 2007, the Chairman of the NationalConvention Convening Work Committee explained thematter concerning the amendment, addition and repeal ofthe adopted fundamental principles and detailed basicprinciples as necessary.

Based on our experiences and knowledge, we ofthe Delegate Group of National Races held discussionson the Work Committee Chairman’s clarificationcandidly.

As it is the final session, we after holding seriousdiscussions based on Union Spirit will support the WorkCommittee Chairman’s clarifications. We will also presentseparate suggestions.Esteemed Mr Chairman and members and delegates,

Now, the National Convention has successfullyadopted the chapter-wise fundamental principles anddetailed basic principles that are to be included informulating the Constitution. The National Conventiondelegates have unanimously adopted the said fundamentalprinciples and detailed basic principles taking time inholding discussions on them from various angles. Hence,they are the principles that should be actually based in

writing the Constitution. We need to make amendment,the repeal, the transfer and the addition and omission ofthe fundamental principles and detailed basic principlesas necessary after assessing them to be in accord with thetime and situation, for the adopted fundamental principlesand detailed basic principles to be in proper contextualorder, to define the adopted objectives and detailed basicprinciples more clearly and to draft the Constitution moreprecisely and clearly.Mr Chairman,

The State will carry out the legislative andexecutive functions in accord with the fundamentalprinciples. In doing so, the State will implement thefunctions in accord with the nationís prevailing situationand time. The running of the legislative and administrativemachinery may face disturbances and obstacles if alawsuit is filed against the State while taking advantageof its failure to implement the task in accord with saidprinciples as time and situation is not ripe yet. In our view,it is necessary to adopt a detailed basic principle that willprotect the State.

In our view, the expression “The application ofthese principles in legislation and administration shallbe the care of the State but shall not be enforceable inany court or law” should be added to the detailedbasic principle “The State fundamental principles arethe guidelines to be followed by the legislative Hluttawsin enacting laws and interpreting provisions of theState Constitution and of other laws.”Mr Chairman,

There may be occasions in which the legislativepower and executive power are exercised by anorganization or by a person. There may be no reason forthe occurrence of any disputes if the stipulations containedin the detailed basic principle are fully comprehensive.

The para (50) of the Chapter “Citizenship,Fundamental Rights and Duties of Citizens”—”Inthis Chapter “The State” means a body that exerciseslegislative and executive powers according to thisConstitution.”—should be amended as follows:

“In this Chapter and the Chapter on StateFundamental Principles, “The State” means a bodyor a person that exercises legislative and executivepowers according to this Constitution.”Mr Chairman,

In connection with the qualifications of the ChiefJustice of the Union and Judges of the Supreme Court ofthe Union, the para (3) (c) (iii) states “have been anadvocate of a High Court of at least 20 years’standings”. The statement was to indicate the leastrequired period for the said matter.

In connection with the qualifications of the ChiefJustice of the High Court of Region or State Chief Justiceand judges of the High Court of the Region or State, thepara 11 (c) (ii) states “a person who has served asadvocate for 15 years”. The stipulation does not state theword “at least”. In drafting the Constitution, it should bestated “at least 15 years” to ensure a harmonious contextand to prevent against occurrence of disputes in the future.

Hence, the detailed basic principle 11 (c) (ii) “aperson who has served as advocate for 15 years” shouldbe amended as “a person who has served as advocate forat least 15 years”.Mr Chairman,

The Chapter “State Fundamental Principlesinclude the subpara (d) of the para 2 which states“flourishing of genuine multiparty democracysystem”; the para 3 which states, “the State practisesgenuine multiparty democracy system” and para 28 whichstates “the State shall enact necessary law for systematicformation of political parties for flourishing of genuinemultiparty democracy system”.

But subpara (a) of para 2 of the adopted detailedbasic principles for the chapter “Political Parties” states“A political party shall: (a) accept and practise discipline-flourishing genuine multiparty democracy.” When westudy the said detailed basic principle we will find the

The usage emphasizes in all seriousnessthat the democracy Myanmar will practise in the future isa discipline-flourishing genuine multiparty democracysystem. To be able to ensure a contextual uniformity, theterm “discipline-flourishing genuine multipartydemocracy” should be used.

Thus, we agree to use “discipline-flourishinggenuine multiparty democracy” instead of genuinemultiparty democracy in para 2 subpara (d), para 3 andpara 28 of the Chapter “State Fundamental Principles”.Mr Chairman,

Paras1 to 9 of the Formation of Judiciary andparas 1, 2 and 8 of Sharing of the Judicial Power, use theterm “Supreme Court of the Union”.

In this regard, the term Pyidaungsu TayaHluttaw in the subparas (a), (b) and (c) of para 9 of theChapter “State Fundamental Principles” should besubstituted with the term “Supreme Court of the Union”Mr Chairman,

As the subpara (h) para 22 states “The Presidentof the State may exercise relaxation of stipulation onage limit”, he may or may not exercise relaxation on agelimit. To be able to clearly express the essence and aim ofthe given detailed basic principle and to preventconstitutional disputes in the future, it should be used“shall exercise relaxation of stipulation on age limit”.

We support that the expression “may exerciserelaxation of stipulation on age limit” of the subpara(h) para 22 should be substituted with the expression“shall exercise relaxation of stipulation on age limit”.Mr Chairman,

The plenary session of the National Conventionheld adopted detailed basic principles for the formationof executive. In the detailed basic principles,

“The subpara (f) of para (28) states, “TheAdvocate-General of the Region or State is responsibleto the President of the State through the Chief Ministerof the Region or State concerned, to the PyidaungsuAttorney-General and to the Chief Minister of theRegion or State concerned.

The subpara (e) of para 31 states, “The Auditor-General of the Region or State is responsible to thePresident through the Chief Minister of the Region orState concerned, to the Pyidaungsu Auditor-Generaland to the Chief Minister of the Region or Stateconcerned.”

To have a clearer meaning and usage, the subpara(f) para 28 and subpara (e) para 31 should be amended asfollows:

Subpara (f) of para (28) “The Advocate-General of the Region or State is

(i) responsible to the President of the Statethrough the Chief Minister of the Region orState concerned

(ii) responsible to the Pyidaungsu Attorney-General and to the Chief Minister of theRegion or State concernedThe subpara (e) of para (31) The Auditor-

General of the Region or State is(i) responsible to the President through the Chief

Minister of the Region or State concerned(ii) responsible to the Pyidaungsu Auditor-

General and to the Chief Minister of theRegion or State concerned

Mr Chairman,As regards the formation of Pyithu Hluttaw, to

be able to allow a large number of national racesrepresentative to take part in the Pyithu Hluttaw, thedesignation of Pyithu Hluttaw constituencies should bebased on township as well as population.

More townships will have to be formed asnecessary to be in conformity with the task ofimplementing projects such as security, management,education, health projects when the nation is achievingmore agriculture and industrial development than now.

When the number of townships goes over 330, anewly formed township should be joined with one of thetownships adjacent to it to designate a Pyithu Hluttawconstituency.

We are in support of making the followingaddition to ensure an enduring detailed basic principleconcerning the formation of the Pyithu Hluttaw:


(a) Not more than 330 Hluttaw representativeselected on the basis of township as well as onthe basis of population from constituenciesdesignated in accord with the law aftercombining a newly formed township with oneof the suitable townships adjacent to it if thetotal number of townships exceeds 330

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services.”

Mr Chairman,As regards the formation of Amyotha Hluttaw of

the legislation, the subpara (a) states ‘equal numbers of12 from each region or state inclusive of Union territories,and including one representative from each self-administered division or self-administered zone’. Theword “the respective” should be added to the word“Union territories” for the usage to be more precise.

We agree that detailed basic principle concernedshould be amended as follows:




(c) In forming the Amyotha Hluttaw in accordwith the subparas (a) and (b), the words “therespective Union territories” mean Unionterritories designated by this Constitutionand Union territories proclaimed byPyidaungsu Hluttaw after enacting lawsconcerning the matter to elect AmyothaHluttaw representatives are inclusive in thestate or division or the region or state they areincluded in.”

Mr Chairman,Now, the government of the Union of Myanmar

and the offices of the central governments are based inNay Pyi Taw. So, the capital of the State is Nay Pyi Taw.The designation of Yangon as a Union territory under thedirect administration of the president should be revoked.And the municipal area of Nay Pyi Taw, which hasbecome the Capital of the State, should be designated asa Union territory placed under the direct administrationof the president.

Moreover, the detailed basic principle“Cocogyun Township which has a special situation isdesignated as Union territory and placed under directadministration of the President of the Union” should berevoked as it is no longer required.

In our opinion, the following detailed basicprinciple should be adopted:

“(a) Nay Pyi Taw, that is the Capital of the Union,is designated as Union territory placed underdirect administration of the President of theUnion.

(b) if need arises to designate areas that havespecial situation in connection with nationaldefence, security, administration andeconomy etc. as Union territories they may beso designated as Union territories afterenacting laws.”

Mr Chairman,As Yangon is no longer the Capital, the term

“Capital Yangon” prescribed in the detailed basic principleson administration of Capital Yangon, a Union territory,prescribed in para 35 and the detailed basic principles ondesignation of the status of the Chairman and members ofYangon Council prescribed in para 36 of the detailed basicprinciples adopted at the plenary session held from 28 to 30March 1996, should be replaced with the term “Nay PyiTaw”, and the term “Chairman of Yangon Council”prescribed in sub-para (c) 6 of para 16 of detailed basicprinciple for Formation of Financial Commission with theterm “Chairman of Nay Pyi Taw Council”.Mr Chairman,

The National Convention laid down detailedbasic principles for the sharing of judicial power. In thisregard, sub-para 4 (a) of para 6 says, “With regard to thejudicial matter, Yangon Region High Court is the highcourt of the courts situated in Yangon City andCocogyun Township”.

After designating Capital Nay Pyi Taw as aUnion territory and revoking the designation of Yangonand Cocogyun Township as Union territories, it will needto amend the detailed basic principle, as appropriate.

We support that sub-para 4 (a) of para 6 “Withregard to the judicial matter, Yangon Region HighCourt is the high court of the courts situated inYangon City and Cocogyun Township” should beamended as “With regard to the judicial matter,Mandalay Region High Court is the high court of thecourts situated in Nay Pyi Taw”.Mr Chairman,

When basic principles were laid down for thechapter “State Fundamental Principles” of the 15 Chaptersto be included in the State Constitution, an exception wasprescribed under the 104 basic principles as follows:

“After laying down the principles to serve asbase for formulating state fundamental principles, it willbe carried on as follows:— of those basic principles, relevant ones are to be

taken as basic in discussing basic principles inrespective chapters,

— of those basic principles,— those that should be mentioned in the preamble

of the State Constitution should be mentionedalso in that preamble,

— principles concerning the State are to be mentionedseparately in the chapter heading “The State”,

— likewise, principles concerning respective chaptersare to be transferred to respective chapters, whendiscussions are held for those respective chapters,

— principles concerning the chapter “Statefundamental principle” are to be retained in thechapter on State fundamental principles.”

When detailed basic principles were laid downaccording to the chapter headings, the principles relevantto respective chapters were transferred as detailed basicprinciples. It is assumed that of the detailed basic principlestransferred to respective chapters, some principles shouldcontinue to be prescribed in the Chapter ‘StateFundamental Principlesí and some not.

I would also like to present the basic principlesthat are no longer prescribed because they do not need tobe prescribed as detailed basic principles. They are:

The principles transferred to the Chapter“The Head of State”—1. The Head of State is the President of the Union.

(from page 6)2. The President of the Union shall be elected bythe presidential electoral college.The principles transferred to the Chapter “Citizenship,Fundamental Rights and Duties of Citizens”—3. All persons who have either one of thefollowing requirements are citizens of the Union ofMyanmar. All persons born of parents both of whomare nationals of the Union of Myanmar. Persons whoare vested with citizenship according to existing lawson the date this Constitution comes into force.Citizenship, naturalization and revocation ofcitizenship shall be prescribed by the law.4. Every citizen is under a duty to uphold Non-disintegration of the Union; Non-disintegration ofnational solidarity; and Perpetuation of sovereignty.5. Every citizen is under a duty to abide by theprovisions of the Constitution.6. Every citizen is under a duty to undergomilitary training in accord with the provisions of thelaw and to serve in the armed forces to defend theState.7. The above right shall not include anyeconomic, financial, political or other secular activitiesthat may be associated with religious practice.8. The freedom so guaranteed shall not prohibitthe State from enacting laws for the purpose of socialwelfare and reform.9. The State recognizes the special position ofBuddhism as the faith professed by the great majorityof the citizens of the State.10. The State also recognizes Christianity, Islam,Hinduism and Animism as religions existing in theUnion on the date of the coming into force of the StateConstitution.11. The State shall render assistance and protectas far as it can the religions it recognizes.12. The abuse of religion for political purposes isforbidden. And any act which is intended or is likelyto promote feelings of hatred, enmity or discordbetween racial or religious communities or sects iscontrary to the State Constitution. A law may beadopted to punish such actions.13. The State shall help national businessmenhave access to technologies, investments, machinery,and raw materials.The principles transferred to the Chapter “GeneralProvisions”—14. Myanmar language is the official language.

15. The State fundamental principles are theguidelines to be followed by the legislative Hluttawsin enacting laws and interpreting provisions of theState Constitution and of other laws.

We consider that these detailed basic principleshave been transferred to respective chapters, and theyno longer need to be mentioned in the Chapter “StateFundamental Principles”. Therefore, they are notprescribed.Mr Chairman,

The plenary session of the National Conventionadopted detailed basic principles for the Chapter“Transitory Provisions”. In this regard, para 5 says,“The existing laws are still in force until they arerevoked or amended by the Pyidaungsu Hluttaw,and unless they are in contrary to the Constitution”.

We agree that the detailed basic principle para15, sub-para 5 in the sharing of legislative power nolonger needs to be prescribed, and it will be revoked.Mr Chairman,

In drafting the State Constitution in accordancewith the basic principles and detailed basic principlesthe National Convention has adopted, necessaryamendments should be made to the terms, dictationand word orders without having any adverse effects tothe aims and essence of the basic principles and detailedbasic principles.

So we agree to the clarification which said, “Iwould like to seek the approval of the NC to makenecessary amendments to the terms, dictation andword orders without having any adverse effects to theaims and essence of the basic principles and detailedbasic principles adopted according to the minutes ofthe NC in drafting the State Constitution.”Mr Chairman,

This is the final session of the NationalConvention. The Delegate Group of National Racesstudied all the fundamental principles and detailedbasic principles in addition to the clarifications madeby the Work Committee Chairman.

Based on our study, we are going to present aseparate suggestion concerning the impeachment orthe act of laying blame.

Subpara (a) para 19 of General Provisionsstates as follows:

(a) A member of the Constitutional Tribunal canbe blamed or impeached under any of thefollowing reasons:“(1) treason;(2) violation of any of the provisions of the

Constitution;(3) misbehaviour;(4) incapability of discharging duties

prescribed in the State Constitution for amember of the Constitutional Tribunal;

(5) being unable to perform the dutiesassigned to him efficiently;

There are similar detailed basic principles toimpeach the Chairman of the Union ElectionCommission or one of the members in accord with theabovementioned five points.

Only the first to fourth detailed principlesare stipulated for the impeachment of the President,or the Vice-President, a Union Minister, theAttorney-General of the Union, the Auditor-Generalof the Union, Region or State Chief Minister or anyof the ministers, the Chief Justice of the Union orany of the judges of the Supreme Court or a ChiefJustice or any of the judges of the Region or StateHigh Court State.

To have a contextual uniformity and to preventoccurrence of disputes in the future, the detailed basicprinciples concerning the impeachment should alwaysbe five points for every matter.

It can be assumed that the expression “beingunable to perform the duties assigned to himefficiently” is so general that there is no specificationof the person concerned or the duty. It will be moreappropriate if the said expression should be substitutedwith the expression “being unable to effectivelyperform the duties assigned to him in accord withthe law”.

In our view, the point 5 “being unable toperform effectively the duties assigned to him inaccord with the law” should be added to the fourdetailed basic principles concerning the impeachment.Concerning the impeachment of a member of theConstitutional Tribunal or Chairman of the UnionElection Commission or one of the members, theexpression of the point 5 “being unable to perform theduties assigned to him efficiently” should be substitutedwith the expression “being unable to effectivelyperform the duties assigned to him in accord withthe law”.Mr Chairman,

As regards the clarifications made by theWork Committee Chairman, the Delegate Group ofNational Races have supported the 14 amendments,two revocations, one decision and transfers andpresented separate suggestions in connection withimpeachment.

In conclusion, we would like to express beliefthat the National Convention will concludesuccessfully, that a new Constitution will come intoforce and that a peaceful, modern and developed nationwill emerge. — MNA

NAY PYI TAW, 15 Aug — The mine explosion ofinsurgents caused damage to two towers No 206 andNo 208 of Leiktho-Yado power grid between Yadoand Thaukyaykhat in Thandaung Township on 14August afternoon and tower No 205 was tilted.

In the mine blast committed at the same place bythe insurgents in 1999, tower No 207 was destroyedand tower No 208 was tilted, and then these towerswere repaired. While tower No 206 was now destroyedin mine blast, tower No 208 fell down due to its pastdamage. Although the towers were destroyed effortswere made for supply of power regularly.

Officials supervise the prompt repair of damagedtowers, and Tatmadaw columns are in hot pursuit ofthe insurgents responsible for the mine blast.

In 1993, it launched the NationalConvention with representatives of people from all walksof life to lay down fundamental principles to draft a StateConstitution necessary for guaranteeing the sharing oflegislative, executive and judicial powers and turning outa discipline-flourishing genuine multiparty democracysystem.

While the National Convention is in session, theNational Convention Convening Commission, the WorkCommittee, the Management Committee and NationalConvention delegates have worked hard together andheld discussions variously taking time to adopt the basicprinciples and detailed basic principles. As a result, theyhave adopted unanimously the 104 fundamental principlesand basic principles for 15 chapters.

The Work Committee took steps for enabling therepresentatives of the delegate groups to study withconvenience the constitutions of many other countries, tocompile collectively proposal papers based on thehistorical background of Myanmar, and to give adviceand make suggestions as to whether the basic principlesand detailed basic principles should be adopted or not.The representatives from various regions compiled theirindependent proposal papers through the experiencesand knowledge they have gained, and the experiences ofother countries. National Convention delegates are pleasedand proud of the achievement that the National Conventionhas adopted some of their separate suggestions as basicprinciples and detailed basic principles to be included inthe State Constitution.Mr Chairman,

Now, I would like to make some suggestions aboutthe adopted basic principles and detailed basic principlesthat should be amended, repealed or added so that theyare constituent with the current changes, there is contextualuniformity in them, the initial objectives and the adopteddetailed basic principles become more clear andcomprehensible, and the State Constitution can be draftedmore precisely and specifically. My presentation is tocontribute towards the drive to help the whole processmeet the systematic programmes of check, re-check andcounter check.Mr Chairman,

The State will have to carry out legislative andexecutive duties in accordance with the adopted 104State fundamental principles. If there is a lawsuit filedagainst the government taking advantage of the fact thatthe government has not completed the procedures becausethe time is not ripe yet, there will be disruption to theoperation of legislative and executive machinery. Inorder to avert such undesirable situation, there must be adetailed basic principle to protect the State. Therefore,regarding a matter to adopt a detailed basic principle toprotect the State from being sued, the expression in para3 of Chapter “General Provisions”:

“The State fundamental principles are theguidelines to be followed by the legislative Hluttaws inenacting laws and interpreting provisions of the StateConstitution and of other laws” should be added withan expression:

“The application of these principles shall be thecare of the State but shall not be enforceable in anycourt of law”.Mr Chairman,

The term “State” is prescribed many times in Chapter(1) “State Fundamental Principles” to be included in theState Constitution. In order to make the term “State”prescribed in this Chapter more meaningful andcomprehensible, there should be an amendment to the50th point of Chapter “Citizenship, Fundamental Rightsand Duties of Citizens”.

In relation to the referring of the term “a body”,legislative and executive powers are exercised in line

with the State Constitution, but sometimes they may bepractised for personal affairs. If so, there may be someproblems on the State Constitution. Therefore, a completedetailed basic principle should be adopted now.

So, the 50th point of Chapter “Citizenship,Fundamental Rights and Duties of Citizens” should beadopted as:

“In this Chapter and Chapter 1 ‘StateFundamental Principles’, the term “State” means abody or a person that exercises legislative and executivepowers according to this Constitution as the contextmay require”.Mr Chairman,

To ensure contextual uniformity in drafting the StateConstitution and to avert possible future constitutionaldisputes, the expression “a person who has served asadvocate for 15 years” in para 11 (c) (ii) in connectionwith the qualifications of judges of the High Court of theRegion or State, should be “a person who has served asadvocate for at least 15 years”.

And to reveal the fact that the type of democracy theUnion of Myanmar will practise in the near future is notonly genuine but also discipline-flourishing, and to ensurecontextual uniformity in drafting the State Constitution,the expression “genuine multiparty democracy system”contained in sub-para 4 of para (b), para (c) and para 28should be “discipline-flourishing genuine multipartydemocracy system”.Mr Chairman,

Of the detailed basic principles laid down at theplenary session held on 16 September 1993, the term“Taya Hluttaw” was prescribed in the sub-paras 1, 2 and3 of para (i) concerning judiciary. However, the term isprescribed as “Pyidaungsu Taya Hluttawgyoke” in parasfrom 1 to 9 of Formation of Judiciary, and in paras 1, 2 and8 of the sharing of judicial power.

In order to avert possible disputes in future and toensure contextual uniformity in drafting the StateConstitution, the expression “Pyidaungsu Taya Hluttaw”prescribed in the sub-paras (a), (b) and (c) of para 9 of theChapter “State Fundamental Principles” should besubstituted with the term “Supreme Court of the Union”.Mr Chairman,

Of the detailed basic principles for the formation ofexecutive, sub-para (h) of para 22 states “The President ofthe State may exercise relaxation of stipulation on age limit.

A person appointed as the okkahta of the self-administered division or self-administered zone, orHluttaw representatives elected to undertake the affairs ofnational races, or a Region or State Minister may possessall qualifications set for a hluttaw member, but he may beunder 35.

Therefore, in order to make the initial aims andessence of the expressions more comprehensible and toavoid possible disputes on the State Constitution in future,sub-para (h) of para 22 should be adopted as:

“The President of the State shall exercise relaxationof stipulation on age limit”.Mr Chairman,

In view of the detailed basic principles adopted at theplenary session of the National Convention held on 29March 1996 for Formation of Executive, the expressionsrelated to Region or State Ministers are clear andcomprehensible. To ensure clear and comprehensibleexpressions in drafting the State Constitution, sub-para(f) of para 28 should be:

“The Advocate-General of the Region or State isresponsible:

(1) to the President of the State through the ChiefMinister of the Region or State concerned,

(2) to the Pyidaungsu Attorney-General and tothe Chief Minister of the Region or Stateconcerned”, and sub-para (e) of para 31:

“The Auditor-General of the Region or State isresponsible:

(1) to the President through the Chief Minister ofthe Region or State concerned,

(2) to the Pyidaungsu Auditor-General and to the

Chief Minister of the Region or Stateconcerned”.

Mr Chairman,Now, the development in the administrative, economic

and social sectors is gaining momentum due to the effortsbeing made for national development in line with the 12objectives the government has laid down. In future, theagricultural and industrial sectors will make more progress.Then, if necessary, new townships will have to be formedto expedite the implementation of the projects on security,management and education. If the number of townshipsgoes over 330, the number of Pyithu Hluttaw members willbe more than 330. When the number of townships is over330 due to urbanization, a newly formed township shouldbe joined with one of the townships adjacent to it todesignate a Pyithu Hluttaw constituency.

Thus, to ensure an enduring principle, regarding theformation of Pyithu Hluttaw, the point:

“Pyithu Hluttaw shall be formed with a maximumof 440 Hluttaw representatives as follows:

“(a)Not more than 330 Hluttaw representativeselected on the basis of township as well as onthe basis of population from constituenciesdesignated in accord with the law aftercombining a newly formed township with oneof the suitable townships adjacent to it if thetotal number of townships exceeds 330,

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services” should be adopted as detailedbasic principles.

Mr Chairman,The word “the respective” should be added to the

word “Union territories” for the usage to be more precise.Hence, the points:




(c) In forming the Amyotha Hluttaw in accordwith the sub-paras (a) and (b) the words “therespective Union territories” mean Unionterritories designated by this Constitutionand Union territories proclaimed byPyidaungsu Hluttaw after enacting lawsconcerning the matter to elect AmyothaHluttaw representatives are inclusive in thestate or division or the region or state they areincluded in.” should be adopted as detailedbasic principles.

Mr Chairman,Internationally, the city where the office of the central

government is based is designated as the capital of theState. And in some countries, the capitals are placedunder direct administration of the President or the centralgovernment. Now, the government of the Union ofMyanmar and the offices of the central governments arebased in Nay Pyi Taw. So, the capital of the State is NayPyi Taw. The municipal area of Nay Pyi Taw, which hasbecome the Capital of the State, should be designated asa Union territory placed under the direct administrationof the President. Therefore, regarding the designation ofUnion territories, the points:

Mr Chairman,The Delegate Group of Peasants is in support of

the clarification that Nay Pyi Taw, the Capital of theUnion of Myanmar, should be designated as a Unionterritory placed under the direct administration of thePresident.

So, the term “Yangon” prescribed in paras 35 and 36of the detailed basic principles the National Conventionplenary session adopted should be replaced with the term“Nay Pyi Taw”.

And the term “Chairman of Yangon Council”prescribed in sub-para (c) 6 of para 16 of detailed basicprinciple for Formation of Financial Commission shouldbe replaced with the term “Chairman of Nay Pyi TawCouncil”.Mr Chairman,

If Nay Pyi Taw, the Capital of the Union of Myanmar,is to be designated as a Union territory, Sub-para 4 (a) ofpara 6 “With regard to the judicial matter, YangonRegion High Court is the high court of the courts situatedin Yangon City and Cocogyun Township” should beamended as “With regard to the judicial matter,Mandalay Region High Court is the high court of thecourts situated in Nay Pyi Taw”.

Mr Chairman,There will soon be the State Constitution necessary

for ensuring peace and development of the motherlandand building a discipline-flourishing multipartydemocratic nation. In order to complete the drafting of theState Constitution, the State has spent a lot of funds andtime, while the delegates have worked and exertedgoodwill, sacrificing their economic, health and socialaffairs to an extent. We believe the State Constitution thathas cost such huge investments will be complete withmagnificent characteristics such as essence, durability,harmony with the modern time, and serving publicinterests.Mr Chairman,

Many constitutions are no longer in force because:(a) the provisions that deserved amendments could

not be amended in time,(b) appropriate laws could not be promulgated with

the passage of time,(c) there was failure to take an action correctly and

immediately to remedy the grievances of thepeople.

Therefore, the organ or persons that will exercise thelegislative, executive and judicial powers that will comeinto force under the forthcoming State Constitution shouldkeep in mind these notable points.

In the new State that will emerge under the StateConstitution we have drafted in harmony, the authoritiesat all levels will have to honour the State Constitution.And I assume that we delegates will have to protect it.

Our ultimate goal is to turn out a good government tobe elected by the people through discipline-flourishinggenuine multiparty democracy general elections inaccordance with the State Constitution that will soon becompeted by the National Convention, and that cancreate a prosperous future of the State, and guarantee theinterests of the electorate, and the rights of each citizen.We hope the best in this regard.

I would like to remind again that we have to makesure that each citizen can enjoy all the fundamental rightsof citizens for long existence of the State Constitution tillour posterity.

Indeed, the State Constitution is the basic law of allthe laws. I believe it will also need to amend the laws,rules and regulations, as appropriate in accordance withthe changes.Mr Chairman,

We delegates have worked whatever role we are in tosuccessfully complete the National Convention. TheNational Convention Convening Commission, the WorkCommittee, the Management Committee and respectivesubcommittees have provided all forms of necessaryassistance for our convenience including stay, transport,meals, security and personal affairs. So, on behalf of alldelegates, I would like to express my heartfelt thanks toall the committees and responsible persons.

We delegates are very proud to have an opportunityto help set up a milestone that can bring a brighter futureof the nation and the people. We are willing to carry outsuch public services more than ever.Mr Chairman,

In drafting the State Constitution in accordance withthe basic principles and detailed basic principles theNational Convention has adopted, necessary amendmentsshould be made to the terms, dictation and word orderswithout having any adverse effects to the initial aims andessence of the basic principles and detailed basicprinciples.

In conclusion, I would like to present peasantrepresentatives’ decision to seek the approval of the NCto make necessary amendments to the terms, dictationand word orders without having any adverse effects tothe aims and essence of the basic principles anddetailed basic principles adopted according to theminutes of the NC in drafting the State Constitution.

DAMASCUS, 14 Aug—The Syrian authorities seizedsome 57 kilos of narcotics as two men were attemptingto smuggle the stack into Saudi Arabia, the independentSyria-news website reported on Sunday.

Syrian security officials arrested the two men, whoclaimed that they were going to Saudi Arabia to performpilgrimage, in the northern province of Hama afterreceiving a tip, the report said. Dinosaur mass gravediscovered

ZURICH, (Switzerland)14 Aug—An amateurpaleontologist in Swit-zerland may have un-earthed Europe’s largestdinosaur mass graveafter he dug up the remainsof two Plateosaurus.

The dinosaurs’ bonescame to light duringhouse-building in thevillage of Frick, near theGerman border.

“A hobby paleonto-logist looked at a con-struction site for a houseand happened to discoverthe bones,” said MonicaRuembeli from the Frickdinosaur museum.

The finds show that anarea known for Plateosa-urus finds for decadesmay be much larger thanoriginally thought.

“It could be that the areaextends for 1.5 kilometres

(0.9 miles) and in that case,you could certainly sayit’s the biggest site inEurope” said MartinSander, a dinosaur paleon-tologist at the universityof Bonn in Germany.

The Frick area con-tained the bones of oneanimal per 100 squaremeters, Sander said, sothe entire area mightcontain bones of 100 morePlateosaurus.

ABU DHABI, 14 Aug— Etihad Airways, the nationalairline of the United Arab Emirates (UAE), willincrease its weekly flights by 27 per cent for the winterseason, Emirates News Agency reported on Sunday.

The Abu Dhabi-based carrier will increase itsweekly flights from 564 to 716 for the aviationindustry’s winter season that starts on 28 October, thereport said.

Most of the new flights are scheduled fordestinations in the Gulf region, Europe and the Indiansubcontinent.

The four-year-old carrier announced last week thatits planes were on average 65 per cent full in the firstsix months of 2007, a figure often considered anindustry benchmark for an airline’s break-even point.

FIFA add prize money,extra team to World Club Cup

ZURICH, 15 Aug — FIFA have added a milliondollars prize money and one extra place to this year'sWorld Club Cup in Japan, the world governing soccerbody said on Tuesday. Japan was also awarded the2008 competition with the bidding to host the 2009event scheduled to start in November.

"The organizing committee decided to increase theprize money by one million dollars for the 2007 event,putting a total of 16 million dollars up for grabs inJapan," FIFA said in a statement.

"The champion will take home 5 million, the run-ner-up will net 4 million, and 3rd place 2.5 million.fourth place will get 2 million, the two fifth-placedteams will receive one million and seventh place willearn 500,000 US dolllars."

Seven teams instead of six will take part in thecompetition starting on 7 December.
