2. April 12, 2018 Notice of Civil Action was filed for U.S. District Ct. Case No. 3:18-cv-02174 to
REVERSE the TTAB decision made August, 07, 2017.
3. On December 18, 2019 and January 3, 2020, each party signed a mutual Settlement Agreement
with true intentions of reversing the TTAB decision made August, 07, 2017. Thereby allowing
Hidden Wineries Inc, to maintain original Registration No. 3,771,513, Serial No. 77,839,136
for the MARK in this proceeding; and U.S. Case No. 3:18-cv-02174 was thereby dismissed.
4. February 25, 2020, Registration No. 3,771,513 was canceled by TTAB
5. The Settlement Agreement signed by both parties is attached herein, in addition to declarations,
Petitioner’s withdrawal of cancelation for Proceeding 92058885, as well as the Petitioner’s
express abandonment of all related marks promptly following the February 25, 2020 TTAB
decision, all support this REQUEST FOR RELIEF FROM JUDGEMENT.

NOTICE OF CIVIL ACTION was opened for the Northern District of California.
“Hidden Wineries, Inc., Plaintiff, v. Modern House Wines LLC, Defendant”
case number 3:18-cv-02174 “COMPLAINT FOR DECLARITORY RELIEF.”.
4 July 30, 2018
Answer to Complaint was filed by Counsel Letourneau, Owen and Townsend for Petitioner
Modern House Wines LLC.
5 December 18, 2019 and January 3, 2020 respectively,

Recitals of the Settlement Agreement for U.S. District Ct. Case No. 3:18-cv-02174, signed by
both parties states: WHEREAS, the Action was in the nature of an appeal to the district court
from a decision in the Trademark Trial and Appeal Board, dated August 7, 2017, arising out of
Cancellation Proceeding No. 92058885 wherein the Board ordered cancellation of Plaintiff’s
registration for THANK YOU, Registration No. 3771513 for wines, issued on April 6, 2010.
Plaintiff having timely appealed, the decision is not final, and the Cancellation Proceeding
remains pending; WHEREAS, to avoid the expense of further litigation, the Parties have now
agreed to resolve the Action and all claims therein as provided in this Agreement.

ARGUMENT
1 Due to surprise, inadvertence, and/or mistakes of Proceeding 92,058,885 along with the
delays, difficulties, and tragedies associated with COVID-19, Defense hereby requests the
Board “TTAB” to grant RELIEF FROM JUDGEMENT on the Decision made February 25,
2020, and thereby allow Registration No. 3,771,513, Serial No. 77,839,136 to be revived for
the original owner Hidden Wineries Inc. according to Fed. R. Civ. P. 60(b).
2 A plethora of evidence has been provided in the background of this Request, that the true
INTENTION of U.S. District Ct. Case No. 3:18-cv-02174 was to reverse TTAB decision on
August 7, 2017. Thereby allowing Hidden Wineries Inc. to retain Registration No. 3,771,513,
and Serial No. 77,839,136 for the MARK in this proceeding.
3 A plethora of evidence has been attached herein to demonstrate a Settlement Agreement
between the parties supports the reversal of the TTAB decision made on August 7, 2017.
Thereby allowing Hidden Wineries Inc. to retain Registration No. 3,771,513, and Serial No.
77,839,136 for the MARK in this proceeding.
4 Declarations attached herein demonstrate the true intention of U.S. District Ct. Case No. 3:18-
cv-02174 was to reverse TTAB decision on August 7, 2017. Thereby allowing Hidden
Wineries Inc. to retain Registration No. 3,771,513, and Serial No. 77,839,136 for the MARK.
5 Petitioner’s Express Abandonment of all related marks promptly following the TTAB decision
of February 25, 2020, attached herein, demonstrate the true intention of U.S. District Ct. Case
No. 3:18-cv-02174 was to reverse TTAB decision on August 7, 2017. Thereby allowing
Hidden Wineries Inc. to retain Registration No. 3,771,513, and Serial No. 77,839,136 for the
MARK in this proceeding.
6 Retaining this mark is vital to the Hidden Wineries business. Severe hardship to the company
will occur if the mark is not retained. Years of time, work, and money are invested in this mark.

7 A motion under Rule 60(b) is made within a reasonable time.
8 According to Fed. R. Civ. P. 60(b) Grounds for Relief from a Final Judgment, Order, or
Proceeding, on motion and just terms, the court may relieve a party or its legal representative
from a final judgment, order, or proceeding for the following reasons: (1) mistake,
inadvertence, surprise, or excusable neglect; (2) newly discovered evidence that, with
reasonable diligence, could not have been discovered in time to move for a new trial under
Rule 59(b); (3) fraud (whether previously called intrinsic or extrinsic), misrepresentation,
or misconduct by an opposing party; (4) the judgment is void; (5) the judgment has been
satisfied, released, or discharged; it is based on an earlier judgment that has been
reversed or vacated; or applying it prospectively is no longer equitable; or (6) any other
reason that justifies relief. And made applicable by 37 CFR § 2.116(a),
9 A Petition to the Director has been filed concurrently with a Fed. R. Civ. P. 60(b) motion to the
Board for relief from judgment, and the petition and motion seek the same relief and require
review of the same set of facts.
10 The Petition to the Director requests, that if the Board grants a RELIEF OF JUDGEMENT in
TTAB Proceeding 92,058,885, that the Director allows the Registrant, Hidden Wineries Inc. to
file a Section 8 and 9 in a manner that will be considered timely.
11 According to Fed. R. Civ. P. 60(b) [Note 8.] See TBMP § 312.03. If, in a cancellation
proceeding, a Petition to the Director is filed concurrently with a Fed. R. Civ. P. 60(b)
motion to the Board for relief from judgment, and the petition and motion seek the same
relief and require review of the same set of facts, the Board will rule first upon the motion
for relief from judgment.
12 According to Fed. R. Civ. P. 60(b) [Note 9.] If the Board grants the motion, the Director, as a
ministerial act, will reinstate the subject registration.

13 A motion to “re-open” the period for filing Section 8 and 9 filing for Registration No.
3,771,513 is hereby submitted simultaneously. According to TBMP 509.01 “Pursuant to Fed.
R. Civ. P. 6(b), made applicable to Board proceedings by 37 C.F.R. § 2.116(a), a party may file
a motion for an extension of the time…If however, the motion is not filed until after the
expiration of the period as originally set or previously extended, the motion is one to extend a
period that has closed (often referred to as a motion to "reopen"), and the moving party
must show that its failure to act during the time allowed therefor was the result of excusable
neglect…..”
14 Due to the TTAB February 25, 2020 Judgement, Registration No. 3,771,513 was unavailable
for filing Section 8 and 9 filing despite the calls, emails, and working of Defense to learn how
to file for Relief of Judgement, compounded by the delays, difficulties, and tragedies due to
COVID-19. The time for Section 8 and 9 filing for Registration No. 3,771,513 has since
expired.
CONCLUSION
I pray that TTAB will grant Relief from Judgement of February 25, 2020, in Proceeding No.
92,058,885 and reinstate Registration No. 3,771,513 (Serial No. 77,839,136) to Hidden Wineries Inc.
It was the intention of both parties that the Settlement Agreement for U.S. District Ct. Case No. 3:18-
cv-02174 signed by MaDonna White President/CEO of Hidden Wineries Inc. “Plaintiff” and Alexis
Swanson Traina, Principal of Modern House Wines LLC “Defense” respectively: December 18, 2019
and January 3, 2020 was to reverse and REVERSE the decision of August, 07, 2017 for TTAB
Proceeding No. 92058885.

I concurrently pray, according to Fed. R. Civ. P. 60(b) [Note 8.] and [Note 9.] that if TTAB
Judgement Relief is granted to the February 25, 2020 decision, that the Director is allowed to accept
Hidden Wineries Inc. filing for Section 8 and 9 in a manner that is acceptable and timely for Hidden
Wineries Inc, to renew and maintain Registration No. 3,771,513, Serial No. 77,839,136 for the MARK
in this proceeding.
Retaining this mark is vital to the Hidden Wineries continuous business. Severe hardship to the
company will occur if the mark is not retained. Numerous years, months, and hours of time, work, and
money are invested in this mark.

SETTLEMENT AGREEMENT AND RELEASE
This Settlement Agreement and Release (“Agreement”) is entered into by and between Plaintiff Hidden Wineries, Inc., a California corporation (“Plaintiff”), on the one hand, and
Defendant Modern House Wines, LLC, a California limited liability company (“Defendant”), on the other. Plaintiff and Defendant are collectively referred to as the “Parties.”
RECITALS
WHEREAS, on or about April 11, 2018, Plaintiff initiated a lawsuit (hereinafter the
“Action”) entitled Hidden Wineries, Inc. v. Modern House Wines, LLC, Case No. 3:18-cv-02174-
SK (the “Action”) in the United States District Court for the Northern District of California;
WHEREAS, the Action was in the nature of an appeal to the district court from a decision
in the Trademark Trial and Appeal Board, dated August 7, 2017, arising out of Cancellation
Proceeding No. 92058885 wherein the Board ordered cancellation of Plaintiff’s registration for THANK YOU, Registration No. 3771513 for wines, issued on April 6, 2010. Plaintiff having
timely appealed, the decision is not final, and the Cancellation Proceeding remains pending;
WHEREAS, to avoid the expense of further litigation, the Parties have now agreed to
resolve the Action and all claims therein as provided in this Agreement.
NOW THEREFORE, in consideration of the representations, warranties, mutual
covenants, promises, and agreements as set forth below, and for other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as
follows:
1. TERMS OF SETTLEMENT
The Parties agree to file a stipulated withdrawal with prejudice of the Cancellation Proceeding in
the form attached hereto as Exhibit A. The Parties further agree to file a stipulated dismissal with
prejudice of the Action in the form attached hereto as Exhibit B. The parties further agree to
execute any other documents reasonably necessary to effectuate the foregoing. To the extent
Defendant’s application to register the mark THANK YOU (and design), Serial No. 87564405 for
wines, is not deemed finally refused upon the filing of Exhibits A and B, Defendant agrees that it
will take no further action in prosecution of the application, and it will allow the application to
become abandoned.
2. MUTUAL RELEASE OF ALL CLAIMS
2.1. Plaintiff and its successors and assigns fully release and discharge Defendant, its
directors, members, volunteers, employees, agents, attorneys, insurers, assigns and successors,
from any and all claims, causes of action, actions, obligations, demands, liabilities, damages, costs,
and expenses (including, without limitation, attorney’s fees) of any kind (contingent, accrued,

inchoate or otherwise), which they may now have, or believe that they may have, individually,
collectively or otherwise relating to or arising out of the Action.
2.2 Defendant and its successors and assigns fully release and discharge Plaintiff, its
directors, members, volunteers, employees, agents, attorneys, insurers, assigns and successors,
from any and all claims, causes of action, actions, obligations, demands, liabilities, damages, costs,
and expenses (including, without limitation, attorney’s fees) of any kind (contingent, accrued, inchoate or otherwise), which they may now have, or believe that they may have, individually,
collectively or otherwise relating to or arising out of the Action.
2.3 The Parties represent, warrant and agree that they have been fully advised by their
respective attorneys regarding the content of Section 1542 of the California Civil Code, and hereby
waive any and all rights thereunder. Section 1542 reads as follows:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS
WHICH THE CREDITOR OR RELEASING PARTY DOES NOT
KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE
TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY
HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR
HER SETTLEMENT WITH THE DEBTOR OR RELEASED
PARTY.
The Parties hereby expressly waive any known or later discovered claims against the
adverse party or parties hereunder existing as of the date of execution of this Agreement.
3. REPRESENTATIONS AND WARRANTIES
3.1 Each Party to this Agreement has made such investigation of the facts pertaining to
this settlement and this Agreement, and all other matters pertaining thereto, as it deems necessary.
Each Party or responsible officer, director or authorized representative has read this Agreement
and understands the contents hereof. Each person signing this Agreement hereby warrants that he
or she has the power and authority to bind any Party on whose behalf this Agreement is signed.
3.2 Each Party expressly warrants and represents that it owns the claims released and/or
compromised hereunder and has not transferred or assigned or attempted to transfer or assign any
of the claims released hereunder.
3.3 Each Party has cooperated in the drafting and preparation of this Agreement. In
any interpretation of this Agreement, or of any of its terms and provisions, the same shall not be
construed against any Party.
4. NO ADMISSION OF LIABILITY

The Parties agree that this settlement is the compromise of disputed claims, and that the terms of
settlement herein are not to be construed as an admission of liability on the part of the Parties
released and that said Parties deny liability and intend to merely avoid litigation.
5. ENTIRE AGREEMENT
This written Agreement is the entire agreement between the Parties pertaining to the subject matter
hereof and supersedes all prior or contemporaneous agreements. There are no other Agreements
modifying its terms. The terms of this Agreement can only be modified by a writing signed by all
Parties hereto, expressly stating that a modification is intended.
6. ADVICE OF COUNSEL
Each Party, by its execution of this Agreement, represents to each other that each has reviewed
each term of this Agreement with its counsel or has had the opportunity do so and has declined to
review this Agreement with counsel, and that hereafter no such Party shall deny the validity of this
Agreement on the ground that it did not have advice of its counsel.
7. KNOWING, FREE, AND VOLUNTARY EXECUTION
This Agreement has been carefully read and understood by the Parties, its contents are known by
the Parties, and it is freely and voluntarily signed by the Parties.
8. ATTORNEY’S FEES
Each Party shall bear its own attorneys’ or other professional fees and associated costs incurred in, or in any way related to, asserting or defending the claims or defenses asserted by and between the
Parties, and the negotiation, preparation and closing of this Agreement.
9. GOVERNING LAW AND JURISDICTION
This Agreement shall be interpreted, construed, governed and enforced in and pursuant to the laws
of the State of California, without regard to choice of law principles. The Parties to this Agreement
consent to personal jurisdiction of any state or federal court located in the State of California (and
any corresponding appellate court) in any proceeding arising out or relating to this Agreement and
such Parties waive venue or inconvenient forum defenses to any proceeding maintained in such
courts.
10. COUNTERPARTS
This Agreement may be executed in counterpart, each of which shall be deemed an original. A
facsimile or PDF signature shall be deemed an original signature for purposes of this Agreement.

Proceeding 92058885 filed with TTAB to withdraw the petition for cancellation that was
the basis of the TTAB’s Cancelation of Registration No. 3,771,513, with the full
understanding and intention that the Registrant of Registration No. 3,771,513, and Serial
No. 77,839,136 for the MARK in TTAB Proceeding: 92058885 shall be RETAINED for
Hidden Wineries Inc.
5. January 6, 2020
Upon the signed Settlement Agreement, Modern House Wines LLC filed a dismissal of

stipulate to the dismissal of this entire action with prejudice, pursuant to Federal Rule of Civil
Procedure 41(a)(i)(A)(ii). (Dkt. 45.) All parties having consented to the jurisdiction of the
undersigned, the Court HEREBY APPROVES the stipulation. The action is DISMISSED with
prejudice, and all currently set dates are VACATED. The Clerk of Court is directed to close the
file.

Registration No. 3,771,513, the Registration No. 3,771,513 was canceled by TTAB and all
attempts at calls and communications to USPTO prior to the deadline of Apr. 06, 2020 to file
section 8 and 9, including the or grace period were ineffective.

The February 25, 2020 TTAB cancellation in Proceeding 92,058,885, in addition to COVID-19:
delays, difficulties, and tragedies were primary reasons that the owner of the mark, Hidden
Wineries Inc., could not access the ESTTA system and submit a timely filing of USPTO Section
8 and 9 for Registration No. 3,771,513.

A REQUEST FOR RELIEF FROM JUDGEMENT was filed concurrently with this PETITION
TO THE DIRECTOR to TTAB. If TTAB grants a RELIEF FROM JUDGEMENT to Proceeding
92,058.885 and the cancelation judgement of Registration No. 3,771,513 on February 25, 2020 is
reversed, then Registrant Hidden Wineries Inc. requests to file Section 8 and 9 in a timely
manner for registration renewal of this mark due to Extraordinary Circumstances:

ARGUMENT
The INTENT of the Settlement Agreement for U.S. District Ct. Case No. 3:18-cv-02174
established by Counsel Ficenec and signed by MaDonna White President/CEO of Hidden
Wineries Inc. “Plaintiff” and Alexis Swanson Traina, Principal of Modern House Wines LLC
“Defense” was to reverse and OVERTURN the decision of TTAB Proceeding No. 92,058,885
made August, 07, 2017. Thereby allowing Hidden Wineries Inc. to retain Registration No.
3,771,513, and Serial No. 77,839,136 for the MARK in this proceeding.
Recitals of the Settlement Agreement for U.S. District Ct. Case No. 3:18-cv-02174, signed by
both parties states: WHEREAS, the Action was in the nature of an appeal to the district court
from a decision in the Trademark Trial and Appeal Board, dated August 7, 2017, arising out of
Cancellation Proceeding No. 92058885 wherein the Board ordered cancellation of Plaintiff’s
registration for THANK YOU, Registration No. 3771513 for wines, issued on April 6, 2010.
Plaintiff having timely appealed, the decision is not final, and the Cancellation Proceeding
remains pending; WHEREAS, to avoid the expense of further litigation, the Parties have now
agreed to resolve the Action and all claims therein as provided in this Agreement.

ARGUMENT
1 Due to surprise, inadvertence, and/or mistakes of Proceeding 92,058,885 along with the
delays, difficulties, and tragedies associated with COVID-19, Defense hereby requests
the Board “TTAB” to grant RELIEF FROM JUDGEMENT on the Decision made
February 25, 2020, and thereby allow Registration No. 3,771,513, Serial No. 77,839,136
to be revived for the original owner Hidden Wineries Inc. according to Fed. R. Civ. P.
60(b).
2 A plethora of evidence has been provided in the background of this Request, that the true
INTENTION of U.S. District Ct. Case No. 3:18-cv-02174 was to reverse TTAB decision
on August 7, 2017. Thereby allowing Hidden Wineries Inc. to retain Registration No.
3,771,513, and Serial No. 77,839,136 for the MARK in this proceeding.
3 A plethora of evidence has been attached herein to demonstrate a Settlement Agreement
between the parties supports the reversal of the TTAB decision made on August 7, 2017.
Thereby allowing Hidden Wineries Inc. to retain Registration No. 3,771,513, and Serial
No. 77,839,136 for the MARK in this proceeding.
4 Declarations attached herein demonstrate the true intention of U.S. District Ct. Case No.
3:18-cv-02174 was to reverse TTAB decision on August 7, 2017. Thereby allowing
Hidden Wineries Inc. to retain Registration No. 3,771,513, and Serial No. 77,839,136 for
the MARK.
5 Petitioner’s Express Abandonment of all related marks promptly following the TTAB
decision of February 25, 2020, attached herein, demonstrate the true intention of U.S.

invested in this mark.
7 A motion under Rule 60(b) is made within a reasonable time.
CONCLUSION
February 25, 2020
TTAB canceled Registration No. 3,771,513 (of Serial No. 77,839,136). by surprise,
inadvertency, and/or mistake. Therefore the owner of Registration No. 3,771,513, Hidden
Wineries Inc. was prohibited from accessing ESTTA to file section 8 and 9 in a timely manner.
