hand in glove with local Panchayat officials in misusingMGNREGA funds. He finds that each Panchayat secretary alongwith elected members have used machines to complete manyworks under the scheme and siphoned off funds using fake jobcards. He also finds out that all this was done at the behest of hisfatherinlaw, the local MLA. Now, the state government hastaken cognizance of the issue after a media report and hasordered inquiry into the scam.
Jayanth has to probe the matter and file a report to higherauthorities. His fatherinlaw is pressurizing him to file a falsereport as he himself is under pressure from his followers, who iffound guilty will be slapped with a criminal case. Somecontractors have contacted and requested him to not to mentiontheir names in the report in return for a hefty bribe. SomePanchayat secretaries have requested him to spare them asaccording to them Panchayat members had coerced them intobecoming partners in crime. Jayanth is recently married and it ishis first government job.

Jayant has the responsibility to expose the corrupt practices that arenot only siphoning off funds illegally but also devoiding poorbeneficiaries .He should inform the higher authorities of the conflict of interestsince his father in law is in question .If asked to continue he shouldstand up to his fatherinlaw and hold him accountable for theirregularities in his constituency .Professionalism dictates him tokeep his family matters aside from his work and conduct his dutiesas per the law and should report his fatherinlaw’s illegal actions.Relationships are built on trust, sense of belongingness and notmoral coercions hence his marriage should not ben an impedimentin his line of duty.He should strictly reprimand the panchayat members and secretariesas they failed to do their constitutionally delegated work withoutfavour and fear. Coercion should have been reported and strictlyacted upon instead of colluding with the malpractioners . Jayant should be honest in his reporting and every contractor big orsmall need to be suitably punished for their actions at this stage.Anylet off will only further make them confident in getting away onbigger scale later and erode public belief in justice system and furthermake them suspicious of politicalofficer nexus .

Jayanth should not succumb to any kind of pressure (from fatherinlaw, bribe, etc) and must maintain the highest level of honestyand integrity in his work. He should submit the detailed report on hisfindings impartially to the higher authorities. Since there is a conflictof interest situation has risen here, Jayanth must also keep thehigher authorities informed about the relationship between him andthe local MLA. He can also think of informing the higher authoritiesin a confidential manner regarding the pressures he had to handlefrom his fatherinlaw, his followers, contractors and panchayatsecretaries. Personally, Jayanth can try to persuade his fatherinlaw byexplaining his situation and he does not want to compromise hisprofessional duties for his personal relations. To the panchayatsecretaries, He needs to be very strict and show that he will neverallow any space for conscious misbehavior in their profession.

Jayanth is facing a clear case of conflict of interests between publicduty and personal relations. Professionalism preaches separation ofpersonal relations and duty. Firstly, his relationship with the localMLA and his daughter should not act as an influence in the matter.As an honest public servant, he should probe the issue in anunbiased manner and present a detailed report.
Here, the interest of poor people is under attack. They have beendeprived of their rightful entitlement. Jayanth should side with thepublic and not surrender to any kind of pressures from his fatherinlaw or wife. He should inform the higher authorities about hisrelationship with the MLA and recommend an independent probeinto the matter.
He shouldn't pay heed to the request of the contractors howeverpowerful they are. They should be booked by the law of the land andas a civil servant, it is Jayanth's duty to ensure that rule of lawprevails. The elected panchayat officials should not be spared forbreaching trust of public at large. Jayanth should stand up againsthis fatherinlaw and his followers firmly. The claim of Panachayatsecretaries to have been coerced by the elected members should beinvestigated.
Since this is Jayanth's first government job, taking the right course ofaction would determine his at most dedication to public service. He

First Thing Jayant should do that he should tell his higher officialsthat since this case involves his fatherinlaw as one of the potentialaccused, the matter should get investigated by some other competentofficer. In case his higher ups shows faith in him & ask him toconduct inquiry after knowing that he may be party of interest,Jayant should proceed with inquiry in impartial way. He shouldpresent the report as per his true findings. However this might createproblems in his personal relations & people he might be complainingabout might create problems for him in future.
He should talk to his father in law & tell him that such kind ofmisusing of MNREGA should be stopped immediately. He shouldalso make it very clear to him that personal relation & professionalwork are separate things for him. He would not like to haveinterference in his professional work.
As far as contractors requesting his not to mention their name, Theyshould also be given stern message & should be warned that offeringdirectly or indirectly any kind of bribe might lead to another problemfor them.
As far as Panchayat Secretaries request are concerned, They shouldbe assured that he would conduct the inquiry impartially. If he findsthat they were forced to perform certain tasks, it will be mentioned inreport. But in case they were found guilty, they will not be spared.

Jayanth as a have moral responsibility to inform this inconsistency tohigher authority. He should not be influenced by his relation with theMLA, as personal relations set back when its a matter of nationalinterest. Firstly Jayant should immediately inform his superior in writingabout his relationship with local MLA as his enquiry report may berejected on the ground of conflict of interest and he may bereprimanded for non disclosure of his relationship at later point oftime.Even after this, if he is trusted with the task of conducting enquirythen he must take up this and start probing the scam from all angles.On being pressurized by his FIL, he must make his stand clear to himthat he is duty bound to conduct fair enquiry and will not entertainany request at his behest. He must inform the police about those whoare pressurizing him and offering bribes. Also he must convinceeveryone that those who are not involved in the scam should notworry.

the false report will be injustice to the villagers and against the moralcode of conduct also. so far as the matter of the Some Panchayatsecretaries who have requested me to spare them "as according tothem Panchayat members had coerced them into becoming partnersin crime" , a inquiry committee will be formed so that injustice don'thappen with them and get punishment or relief as per the law. This is a clear case of a conflict between public duty and personallife.He must look into the facts of the case objectively and impartiallywithout fear or favor, conducting an honest inquiry.
Claim of Panchayat secretaries that they had been coerced intocorrupt practices is unacceptable. They could have come out aswhistle blowers and raised the alarm to prevent such corruptpractices in initial stages itself.Private contractors have not only misused the public fund but theyare offering bribe to cover up the case. Bribe giving is also a crimeunder the corruption acts of the country. Letting them gounpunished will only encourage them to indulge in more corruptionpractices.

Finally, Jayanth report may consist of findings that can jeopardizehis relationship with his father in law & family members. But being apublic servant, it is his duty to prefer public interest over his personalinterest.So, he should give the true report to higher authorities. In theprocess, he should also maintain confidentiality of the report. Noteven family members should know content of his report until it’sofficially disclosed by the government itself.
Failing to report all these misdeeds, he will not only violate the codeof conduct as public servant but will also be an accomplice incorruption. Case has already been reported by media & stategovernment. Higher authorities may put his inquiry report to furtherscrutiny after knowing the conflict of interest. Act of misrepresentingthe facts to his superiors can further put his job at risk.

The situation shown here is very much like to that shown in the hindifilmIndian. Jayanth ,here is the sunny deol. But he is facing the realcircumstances, thus his responses to them are likely to be differentfrom the picture. There are two responses that he may do :1) He may write to higher authorities ,tell them that the names of hiskiths and kins are involved in the matter. Thus ,the enquiry done byhim is likely to be questioned in future. It is, therefore be better toappoint another enquiry officer.2) He may face many problems here from culprits even to thewarning of his death. He should first of all take his wife intoconfidence, make her known all the facts and then be ready to standwith the truth. In this way his personal life is less likely to be suffer.

The first thing that readily comes to my mind is as a public servantupholding public interest is my highest duty. Family relation can't bean excuse or compulsion to allow such loss of public money underhis nose. As has been mentioned, it's Jayanth's first encounter of anysuch situation, any compromise will embolden the corrupts.Thisfavor or silence or candidly saying collusion in wrongdoing could beused as precedent in future decision making.Hence Jayanth must submit an impartial and independent report tohigher authority without succumbing to any sort of pressure. Hemust infrom, perhaps in writing, to his higher authority regardingthe conflict of interest involved here. Confidentially or privately hemust make his superior aware of the mounting pressure localpoliticians and other associates who had greased their hands incorruption.And the officers who are pleading before him not to mention theirnames as they were coerced by others and did not have much ofoptions but to cooperate,, for them omission of names is not going tohelp. Instead he must prepare the report explaining their case. Thenit's for the higher authority to decide the course of action on them.

I think this option wouldn't be appropriate. As he is newly appointedand frequently asking to avoid the responsibility. It would hamperhis future, as it indicates negative character.

First of all, Jayanta should talk to his fatherinlaw personally andthereafter a meeting should be called upon by Jayanta regarding allthese fake jobs and what were the circumstances that promptedthem to take those steps. Then He should warn them theconsequences they might face if he files a report. Truly but notsurprisingly, this might provoke them. But Jayanta should take stepswith proper thinking. Thereafter, He should talk personally tofatherinlaw and explain him all the reasons and why he can't file afalse report. Thereafter, Jayanta should convince his fatherinlaw tofollow the due course of law, and if there were anyone behind suchheinous corruption, his fatherinlaw should name him. Thus finally,he should file a report underlying all facts truly and all themisgovernance and corruption that has taken place, on the otherside he should take steps so that punishment, if at all necessary toteh culprits minimised. So, Jayanta will not compromise his honesty and integrity, and byfollowing his course of action, he will prove himself as resultoriented.

his professional duty.However, it is part and parcel of a publicservice and a honest public servant should not succumb to anythreats/bribes/personal relations and do injustice to his mandatedduties and cause a breach of trust in the eyes of public. Keeping thisin view, I suggest the following course of action.1. First of all, inform higher authorities regarding the conflict ofinterest between public duties and personal relationships involved.2. If the higher authority gives a go ahead signal, then he shouldprepare the report impartially without succumbing to any offers.3. Private contractors have misused the public funds causing greatinjustice to poor people and threatened the economy of the nation atlarge. Also ,bribing a public servant is a criminal offence underPCA,1988. So these aspects should find place in the report.4. His FIL should be made aware that he is just carrying out hispublic duties and there is nothing in person against him. Also, since,he himself is a public functionary he would be aware of a civilservant duties. Also, he cannot threaten him with dire consequencesbecause his daughter would also suffer by his acts.5. Panchayat Secretaries are collusive with officials in corruption andhave violated code of conduct. If they are really honest they could veblown the whistle and informed about this to higher authorites. Sono lenience should be shown and their names also should find placein the report.6. If there are life threatening calls/msgs , Jayanth should informabout this to suitable authorites and ask them to provide security ifneeded.7. Sticking to the above principles would also help in his careerprospects.

As a civil servant jayanth should do his work with honesty andintegrity.he should be impersonal while doing his job so even if hisfather in law is involved in the crime ,he should aptly scrutinise allthe details and must work impartially while making the report .Tothe other side if we see he is recently married and being honest in thejob would ruin his new relations in which he just entered,he shouldreport to higher authorities about his relation with the personinvolved and request the higher authorities to appoint anotherperson in this case.And even the panchayat members should bemade aware of the fact that offering a bribe is itself a crime so theyshall not involve themselves in other crime too.Moreover thepanchayat members shall also be told that no further frauds will beaccepted too.

Panchayat member shd be warned rather than just makingthem aware.2 Jayanth cannot insist seniors to absolve him from thisduties. It is the sole preorogative of seniors. There are certain principles which are basic tenets of civil services.Honesty, Integrity and being true to the work are quintessentialqualities expected from a public servant and no matter what thepressure is, as there will always be some kind of it given the nature ofwork, Jayanth should not succumb to it.
